Extract of Inscriptions
The Portuguese Civil Code, 1867The extract relating to property inscription besides a serial number and date with year, month and day, both of the title document, as well as of its presentation for registration shall contain. § 1. The name, status, profession and residence: 1. Of the owner in the case of mortgages encumbrances on immovable property rights and possession; 2. Of the transferor in the documents of transfer; 3. Of the defendant in suits and judgments; 4. § 2. The name, status, profession and residence: 1. Of the person’s in whose favour the mortgages or encumbrances on rights to immovable property are effected, or the names of the dominant heritage in the case of easements. 2. Of the person’s in whose favour the transfer is made in the case of transfers of immovable assets. 3. Of the plaintiff in suits and judgments. 4. Of the execution creditor in attachments. § 3. The amount secured by mortgage by which the transfer was made or for the payment of which the attachment was made. § 4. The conditions attached to the mortgage, the transfer or encumbrance on immovable rights. § 5. The number of the lot of documents of the respective year in which the title or declaration on the bases of which the inscription is made, has been kept or the description of the office or public archive where the document lies.
