Own Assets
The Portuguese Civil Code, 1867The following shall be excluded from the communion: 1. The emphyteusis of limited duration, successor to which can be freely appointed, until they are converted into hereditary emphyteusis; 2. The assets gifted or bequeathed on condition of incommunicability or those substituted in their place; 3. The assets inherited by the re-married father or mother on the death of the child of the other marriage if there are full blood brothers/sisters of the deceased child, or children of the deceased full blood brothers/sisters, in accordance with Article 1236; 4. Half of the assets held by the spouse who remarries or which are inherited from his/her relatives or received by way of gift, when he has issues or other descendants from the previous marriage, in accordance with Article 1235; 5. Clothes, garments and other objects of personal and exclusive use of the spouses and betrothal ornaments given by the spouses before the marriage. § Sole paragraph. The incommunicability of the assets mentioned in this Article does not include the fruits and the income from the said assets, the value of the improvements, nor the price of the emphyteusis acquired during the subsistence of the marriage.
