Requirements of the guarantor

Statutory text
When any debtor is bound to furnish a guarantee, the creditor is not bound to accept the surety who does not have: 1. Capacity to contract; 2. Immovable properties free and without encumbrances, which are sufficient to secure the obligations and are situated within the jurisdiction of the court where the payment should be made.
