Assignment by onerous title of litigious obligation

The debtor of any litigious obligation, transferred for consideration, may have himself discharged upon payment to the transferee of the amount which he had paid for the same, with interest, and additional expenses for acquiring the same, except where the transfer has been made: 1. In favour of heir or the co-owners of the right transferred; 2. In favour of the possessor of the immovable, which is the object of such right; 3. To the creditor in payment of his debt.
