Article 1492 – Revocation or reduction for inofficiousness A gift, regardless of who the donee is, may be revoked or reduced as inofficious, if it affects the legitime of the donor’s mandatory heirs. § 1 - But, if the prejudice to the legitime does not cover the full value of the gift, the gift shall be reduced only to the extent necessary to fulfill the legitime. § 2 - In order to determine if there was inofficiousness, the moiety shall be calculated in the manner laid down in the title on successions.
