Payment by third party without consent of the debtor

Whoever pays, on behalf of the debtor, without consent, acquires right of the creditor only in the following cases; 1. Where the person, who makes the payment, is a guarantor or is interested in any other manner, that such a payment may be made. 2. Where the creditor, who receives the payment, transfers his rights in accordance with the following section or subrogates in his rights the person who has made the payment provided that the subrogation is done expressly at the time of payment.
