Modalities of assignment

The contracting parties may agree:- 1. That the assets, income of which is entrusted, continue in possession of the debtor. 2. That they pass to the possession of the creditor. 3. That they pass to the possession of a third party, by way of lease or by other title. § 1. The application of income, however, does not prevent in any of such cases that the debtor dispose by any means the assets income of which is under entrustment, but the rights of the creditors are always safeguarded. § 2. In case of clause 2 of this article, the creditor is equated to lessee, in order that the provisions of this Code relating to lease may apply, wherever possible.
