Statutory text
The father may appoint in his will, or by an authentic act inter vivos, a guardian for a child who is a minor or has been interdicted, if the mother is deceased or if she has been prohibited from exercising parental authority. § Sole paragraph – In the absence or impediment of the father, the mother has the same power; however, if she appoints her second husband, the appointment will depend upon the approval of the family council.
