Mode of constituting statutory mortgage in favour of legally disabled and absentees

Once the indication, as referred to in the preceding article is made, the family council, taking into consideration the value of the movables and of the income, which the appointee is likely to collect, and retain in his hands, shall determine the value of the mortgage, and shall indicate the assets in relation to which the same is to be registered, and the period during which the registration is to be completed and to that effect the resolution is to be passed.

§ Sole paragraph - Wherever, no appointment of family council has been made, in accordance with the law, the powers of the family council shall be exercised to that extent, by the Court after hearing the General Curator.
