Deposition by party

Judicial admission may be spontaneous, or may be made in the examination applied for by the opposite party; but such a request may be made:- 1. From persons who can sue and can be sued; 2. On personal facts, certain and specific, relating to the object in controversy, or of which the deponent may have knowledge. Sole paragraph: A party summoned to depose on pain of being deemed to have admitted, shall be taken as such, if he refuses to appear without any just cause.
