Judicial capacity of wife

A married woman shall not move the Court without the consent of the husband, except: 1. In criminal cases in which she is the accused; 2. In any suits against her husband; 3. In proceedings which have, as its sole object, the maintenance or preservation of her own and exclusive rights; 4. In cases in which she has to exercise the rights and duties inherent in parental control in respect of her legitimate issues or of her illegitimate issues born from another.
