Disposal of Legal reserve

If the donor dies without disposing of the legal reserve, this shall be deemed to belong to the donee. § Sole paragraph - If, however, the reserve has been made by an explicit provision in the deed of gift, and the donor dies without disposing it, the said reserve shall belong to the intestate heirs within the fourth degree, and only when these do not exist will it belong to the donee.
