Effects of annulment

After the contract is rescinded, each of the contracting parties shall get back whatever has been given by him, or its value, if the restoration in kind is not possible. § 1 - In the cases of mistake, which does not arise from fraud or bad faith, there is no obligation to restore fruits or benefits. § 2 - In the cases where there is fraud or bad faith, there is an obligation to pay compensation.
