Manner of contributing to the expenditure under the charge of the executor

Where there is no sufficient cash in the estate to meet the expenditure under the charge of the executor and the heirs do not want or are unable to advance necessary sums of money, it shall be lawful for the said executor to cause the sale of the movables, and if they are not enough, the sale of one or more immovables, but always after hearing the heirs. § Sole paragraph – If, however, one of heirs is minor, absentee or under interdiction, the sale, of movables as well as of immovables, shall be done by way of public auction.
