Deduction of encumbrances in rem in the partition

Where the immovable assets are enlisted for the partition alongwith the said charges, or any other charges they shall be valued as if there were no charges; thereafter the capital corresponding to the charge shall be deducted and the heir, who remains with the immovable asset, shall exclusively pay the said charge.
