Heir entitled simultaneously by Will and ab intestate

The heir, who is entitled to the inheritance by Will and intestate, and renounces it under the first title, is assumed to have renounced equally under the second one, but if he renounces it as heir intestate, without being aware of the Will, he may well accept it under the latter title notwithstanding the former renunciation.
