Reservation of the inheritance for charitable purpose or public utility

Where the testator has entrusted the executor to utilize the income of a certain part of the estate in some charitable or public utility foundation or institution, the executor shall be likewise bound to take recourse to the inventory and to cause the sale of the said properties by public auction, with summons to the parties, or their legal representatives and with participation of the Public Ministry. § Sole paragraph – This provision is not applicable where the inheritance or legacy were left, for the aforesaid purpose, to an already existing corporation with juridical capacity.
