Composition and functions of the council of guardianship
The Portuguese Civil Code, 1867The guardian, the pro-guardian, the curator of orphans, any relative of the minor or any other interested party in a decision of the family council may appeal the said decision to the guardianship council, except in the case foreseen in Article 1062. § 1 - The guardianship council is composed of the division judge, his/ her two immediate substitutes and the curator of orphans, who will have a merely advisory role. § 2 - A decision of the guardianship council confirming a decision of the family council cannot be appealed. § 3 - If the decision of the family council is not confirmed, there is a possibility of appeal to the High court, which shall decide finally. § 4 - These appeals suspend the effects of the appealed decisions, except in the cases where the law explicitly foresees the opposite.
