Guarantor’s recourse against co-guarantor

Where there are two or more sureties of the same debtor, and for the same debt, the surety who had paid the whole debt, may demand that others, may effect payment pro rata to him. § 1 - Where one of them becomes insolvent, his share will fall on others proportionately. § 2 - The provision of this article is applicable only when the payment is demanded through Court or when the principal debtor is found to be insolvent.
