Presumption regarding ownership of fence of living plants

If two properties are separated by a fence or hedge of living plants, it shall be presumed that it belongs to the one who needs it the most and if both are in the same situation it shall be taken to be common, if there is no local custom by which the ownership of such fences is decided.
