Payment of donor’s debts in other cases

In the absence of a stipulation concerning the donor’s debts, the following shall apply: § 1 - If the gift relates to certain and specified assets, the donee shall not be responsible for the donor’s debts, except in the case of mortgage or fraud, to the prejudice of the creditors. § 2 – If the gift is of all the assets, the donee shall be liable for all the prior debts of the donor unless otherwise stipulated.
