Irregularity in representation of disabled party

Where the contract is rescinded, because the representative of the legally disabled person was not authorized, action can be taken only against the contracting party who is in good faith, when the incapable person cannot be compensated from the properties of his representative but, even in such case, the contracting party may opt for compensation or restoration of the thing. § Sole paragraph - This remedy is not available against the subsequent acquirers, unless malafides are proved.
