Provisions relating to personnel
The Madhya Pradesh Electricity Reforms Act, 2000(1) The State Government may provide for the transfer of the personnel of the Board to the First Transferee or the Second Transferee, as the case may be, in the event of the transfer of any part of the undertaking of the Board transferred under Section 23 and such transfer shall be effective in the same manner as in the case of transfer under Section 23. (2) Such transfer shall be to the personnel, as the case may be, the First or Second Transferee, under such terms and conditions as may be determined in the Reorganization Scheme and shall hold office or service subject to the following, namely :— (a) the terms and conditions of service applicable to them in the service of the Board immediately before the transfer shall not be less favourable or inferior to the terms and conditions of service applicable to them under the First or Second Transferee; (b) continuity of service in all respects of the personnel shall be maintained; and (c) all service benefits accrued prior to the transfer shall be recognized and taken into account, including payment for any or all service benefits. (3) Notwithstanding anything contained in the Industrial Disputes Act, 1947 (14 of 1947) or any other law for the time being in force, and except for the provisions contained in this Act, the personnel shall not be entitled to any compensation or damages under this Act or any other Central or State law or general law due to the transfer of employment by reason of the provisions of this part. Explanation.—For the purposes of this part and the Reorganization Scheme, "personnel" means all persons who are employees of the Board on the effective date by whatever name they are known.
