Creation of Municipal Courts for trial of offences under the Act.
The Sikkim Municipalities Act, 2007(1) The State Government shall, with the concurrence of the High Court of Sikkim, designate a Court of Civil Judge-cum-Judicial Magistrate as the Municipal Court at such place or places as the State Government may deem necessary to deal with the cases, and the trial of offences, under - (a) this Act, and (b) the rules and the regulations made thereunder, and may prescribe the time within which, and the place or the places at which, such Municipal Court shall sit for such trial of offences. (2) Every such Municipal Court shall exercise all other powers, and discharge all other functions as provided in this Act. (3) Each such Municipal Court shall have jurisdiction over such municipal area or areas as may be specified by the State Government with the concurrence of the High Court of the State, by notification. (4) The procedure in every such Municipal Court shall, except where otherwise specifically provided in this Act, be in accordance with the provisions of the Code of Criminal Procedure, 1973, and such other law, if any, as may be applicable.
