Power of Board to appoint agents
The M.P. Asangthit Karamkaar Kalyan Adhiniyam, 2003(1) Notwithstanding anything contained in this Act, the Board may, for the performance of all or any of the following tasks, appoint agents from one or more of the bodies referred to in sub-section (2) or sub-section (3): (i) registration of members and/or employers; (ii) collection of contributions from members and/or employers; (iii) issuance of identity cards to members and their renewal; (iv) receipt of applications from members for providing benefits, processing such applications and sanctioning benefits; (v) collection of instalments of any loan or advance given by or on behalf of the Board: Provided that the task of registration of employers and collection of their contributions shall be assigned only to those local bodies as are appointed as agents. (2) The Madhya Pradesh Rural Unorganised Labourers Welfare Board may appoint as agent under sub-section (1) any one or more of the following bodies: (i) Zila or Janpad Panchayat under the M.P. Panchayat Raj Avam Gram Swaraj Adhiniyam, 1993 (No. 1 of 1993); (ii) Nagar Panchayat constituted under the Madhya Pradesh Municipalities Act, 1961 (No. 37 of 1961); (iii) District Cooperative Union or any of its constituent units under the M.P. Rajya Laghu Vanopaj (Vyapar Avam Vikas) Sahkari Sangh; (iv) M.P. State Cooperative Dairy Federation or any of its constituent units; (v) M.P. State Cooperative Fisheries Federation or any of its constituent units; (vi) Any other Cooperative Society registered under the M.P. Cooperative Societies Act, 1960 (No. 17 of 1961) or M.P. Swayat Sahkarita Adhiniyam, 1999 (No. 2 of 2000); (vii) Any Labour Welfare Board constituted under any Central or State Act by whatever name called; (viii) Trade Union registered under the Trade Unions Act, 1926 (16 of 1926); (ix) Any voluntary agency working for the welfare of unorganised labourers, registered under the Societies Registration Act, 1973 (No. 44 of 1973). (3) The Madhya Pradesh Urban Unorganised Labourers Welfare Board may appoint as agent under sub-section (1) any one or more of the following: (i) Municipal Corporation or Municipal Council constituted under the M.P. Municipal Corporation Act, 1956 (No. 23 of 1956) or M.P. Municipalities Act, 1961 (No. 37 of 1961); (ii) District Urban Development Agency; (iii) Any Cooperative Society registered under the M.P. Cooperative Societies Act, 1960 (No. 17 of 1961) or M.P. Swayat Sahkarita Adhiniyam, 1999 (No. 2 of 2000); (iv) Any Labour Welfare Board constituted under any Central or State Act by whatever name called; (v) Trade Union registered under the Trade Unions Act, 1926 (16 of 1926); (vi) Any voluntary agency working for the welfare of unorganised labourers, registered under the Societies Registration Act, 1973 (No. 44 of 1973). (4) The Board shall obtain prior consent of any body other than Municipal Corporation, Municipal Council, Nagar Panchayat, Zila Panchayat and Janpad Panchayat before appointing such body as its agent under sub-section (2) or sub-section (3). (5) The Board shall make regulations to regulate the appointment and functioning of its agents.
