Requirements regarding Memorandum of Association
The Chhattisgarh Societies Registraion Act, 1973(1) The following matters shall be stated in the Memorandum of Association of every society - (a) The name of the society (b) The object of the society (c) The place of the head office of the society (d) The names, addresses and occupations of the Governors, Council, Directors, Committee or other Governing Body to whom the management of the affairs of the society is entrusted by the Regulations of the society. (2) No such name shall be proposed for the Memorandum of Association - (a) which is the same as, or identical with, the name of any existing society which has been previously registered anywhere in the State, or (b) which - (one) consists of such words as appear to suggest or are calculated to suggest the patronage of the Government of India or the Government of any State, or (two) consists of such words of national, international or global importance or such other words as the State Government may, from time to time, specify by notification, or (three) consists of such words as in the opinion of the Registrar are likely to mislead the public. (3) A copy of the Regulations of the Society, certified to be a true copy by at least three members of the Governing Body, shall be filed with the Memorandum of Association. (4) The persons by whom or on whose behalf such memorandum is submitted shall give such further information about the society as the Registrar may require. (1) No society shall be registered under a name which is identical with, or too nearly resembles, the name of any other society or any body corporate which has been previously registered and is still subsisting under this Act or any other law for the time being in force. (2) No society shall be registered under a name which— (i) is prohibited under the Emblems and Names (Prevention of Improper Use) Act, 1950 (No. 12 of 1950) or is likely to be prohibited under that Act or any other law for the time being in force; (ii) consists of such words of national, international or worldwide importance or such other words as the State Government may, by notification, specify from time to time; or (iii) consists of such words as are, in the opinion of the Registrar, likely to cause public deception. (3) A copy of the by-laws of the society, certified by at least three members of the governing body to be a true copy, shall be filed with the memorandum of association. (4) The persons by or on whose behalf such memorandum is submitted shall furnish such further information about the society as the Registrar may require.
