Review of orders.—
- (1) The State Government and every revenue or survey officer may, either on its or his own motion or on the application of any party interested, review any order passed by itself or himself or any of its or his predecessors in office and pass such order in reference thereto as it or he thinks fit: Provided that—
- (i) no officer being below the rank of a Collector shall pass any order in review without first obtaining the written permission of the officer not below the rank of Collector immediately superior to him;
- (ii) no order shall be modified or reversed unless notice has been given to the parties interested to appear and be heard in support of such order;
- (iii) an order against which an appeal has been preferred shall not be reviewed.
- (2) No application for review of an order shall be entertained unless it is made within ninety days from the date of the order: Provided that any such application may be admitted after the period of ninety days if the applicant satisfies the State Government or the revenue or survey officer, as the case may be, that he had sufficient cause for not making the application within such period.
- (3) No order shall be reviewed except on the following grounds, namely:—
- (a) discovery of new and important matter or evidence which, after the exercise of due diligence, was not within the knowledge of the party or could not be produced by him at the time when the order was passed;
- (b) mistake or error apparent on the face of the record; or
- (c) any other sufficient reason.
- (4) For the purposes of this section, the Collector shall be deemed to be the successor in office of any revenue or survey officer who has left the district or who has ceased to exercise powers as a revenue or survey officer and to whom there is no successor in the district.
- (5) An order passed in review shall, on no account, be reviewed.
