Collector how to proceed in order to evict any person wrongfully in possession of land.—
- (1) Where it is provided by this Code that the Collector may summarily evict any person from any land, such eviction shall be made by a notice in writing, served in the manner provided by section 173, requiring such person to vacate the land within such time as may be specified in the notice, and if such person fails to comply with the notice, by removing or deputing a subordinate officer to remove such person from the land and if such person resists or obstructs the removal, the Collector may cause him to be arrested and if the need for such resistance or obstruction continues, may order him to be taken in custody to the nearest Magistrate, or where the person is removed, take such steps as may be necessary for the purpose of putting any person who may be entitled to the possession of such land in such possession.
- (2) Anything done or any action taken by the Collector under this section shall not prejudice the right of any person to institute a civil suit in a court of competent jurisdiction to establish title to the land from which he was evicted.
