Payment out of costs and security deposits and return of such deposits

(1) Costs, including pleader's fees, shall be in the discretion of the authorized officer. (2) If an order as to costs under the provisions of this Chapter directs a party to pay costs to any person, such costs, if not paid already, shall be paid, on an application made in writing to the Deputy Commissioner for this purpose within one year from the date of such order by the person in whose favour the costs have been awarded, out of the security deposit made by such party under this Chapter, either in full or as far as possible. (3) If any balance remains in the security deposit after payment of the costs specified in sub-section (1), or where no costs have been awarded or no such application as aforesaid has been made within the said period of one year, the whole of such security deposit shall, on an application made in writing to the Deputy Commissioner for this purpose, be returned to the person who deposited the security, or if such person has died after making such deposit, to his legal representative.
