Presentation of petition
The H.P. Panchayati Raj Act, 1994-(Hindi version(1) Any voter of a Panchayat may, on furnishing the prescribed security in the prescribed manner, present a written election petition to the authorized officer within 30 days of the publication of the result on one or more of the grounds specified in sub-section (1) of section 175, against the election of any person under this Act: Provided that if an official of the Panchayat was not eligible or was disqualified for being elected under this Act before his election and such disqualification continues even after his election to such office, then in such cases, the limitation period of 30 days shall not apply. (2) An election petition shall be deemed to have been presented to the authorized officer: (a) when it is delivered to the authorized officer: (i) by the person making the petition; or (ii) by a person authorized in writing in this behalf by the person making the petition; (b) when it is sent by registered post and is delivered to the authorized officer or any other officer empowered to receive it.
