Limitation

Every suit instituted before a Circle Panchayat after the period of limitation prescribed therefore in the Schedule shall be dismissed, even though limitation has not been set up as a defence. (1) The Deputy Commissioner shall appoint the Deputy Director or any other officer not below the rank of Assistant Collector of the first Grade for the disposal of election petitions, provided that where the petition relates to an election under sub-section (3) or sub-section (5) of Section 44 of the Act. The petition shall be referred to the prescribed authority for disposal. (2) On the application of any party to an election petition, if the Deputy Commissioner is satisfied that there are reasonable grounds for transfer of the election petition from the officer appointed under sub-rule (1), he may make a fresh appointment as in sub-rule (1).
