Supersession of Market Committee

2[(1) If in the opinion of the Managing Director, a Market Committee is not competent to perform or persistently makes default in performing the duties imposed on it by or under this Act or abuses its power the Managing Director may, by an order in writing supersede such Committee for a period not exceeding one year and on expiry of first six months of the period of supersession, action to hold the elections for the constitution of Market Committee shall be started and the period of supersession shall be deemed to expire on the date of first general meeting of the Market Committee so constituted : 1. ׊ØÂý¼ðàæ ¥çÏçÙØ× ·ý¤. 24 âÙ÷ 1986 mæÚUæ (ç¼Ù梷¤ 27-7-1986 âð) ¥‹ÌÑSÍæçÂÌÐ 2. ׊ØÂý¼ðàæ ¥çÏçÙØ× ·ý¤. 11 âÙ÷ 1979 mæÚUæ (ç¼Ù梷¤ 12-6-1985 âð) ÂýçÌSÍæçÂÌÐ 3. ׊ØÂý¼ðàæ ¥çÏçÙØ× ·ý¤. 27 âÙ÷ 1997 mæÚUæ (ç¼Ù梷¤ 15-7-1997 âð) ÂýçÌSÍæçÂÌÐ 4. ׊ØÂý¼ðàæ ¥çÏçÙØ× ·ý¤. 18 âÙ÷ 1979 mæÚUæ (ç¼Ù梷¤ 7-6-1979 âð) ÂýçÌSÍæçÂÌÐ
Provided that before passing an order of supersession under this sub-section the Managing Director shall give a reasonable opportunity to the Market Committee for showing cause against the proposal and shall consider the explanations and objections, if any, of the Market Committee :

Provided further that where the new Market Committee could not be constituted within one year of its supersession, the State Government may, in special circumstances, extend the period of supersession which shall not, in any case, exceed beyond the term of the Market Committee specified in1[sub-section (2) of section 13].
2[(2) Upon the passing of an order under sub-section (l) superseding a Market Committee, the following consequences shall ensue namely :-
(a)All the members as well as the Chairman and Vice Chairman of the Market Committee shall, as from the date of such order, be deemed to have vacated their offices;

- (4) Any Officer-in-Charge appointed under sub- section (3) may at any time be removed by the Managing Director, who shall have power to appoint another person in his place.
