Definitions.- (1) In this Act, unless the context otherwise requires,(a) “agricultural produce” means all

produce1 [***] of agriculture, horticulture, animal husbandry, apiculture, pisciculture or forest as specified in this Schedule;

1[(b) “agriculturist” means a person whose source of livelihood is wholly dependent on agricultural produce and who cultivates land on one’s own account,—

1. (i) by one’s own labour ; or
2. (ii) by the labour of the either spouse ; or
3. (iii) under the personal supervision of oneself or any member of one’s family referred to in subclause (ii) above by hired labour or by servants on wages payable in cash or kind but not as corp share ; but does not Include a trader, commission agent, processor, broker, weighmen, or hammal of agricultural produce although such trader, commission agent, processor, broker weighmen or hammal may also be engaged in the production of agricultural produce;] ¹ðÌè ·¤ÚUÌæ ãUô, ç·¤‹Ìé ©Uâ·ð¤ ¥‹Ì»üÌ ·ë¤çá©UÂÁ ·¤æ ·¤ô§ü ÃØæÂæÚUè, ¥æɸUçÌØæ¡, Âýâ¢S·¤ÚU‡æ·¤•ææü (ÂýôâðâÚU), ¼ÜæÜ, ÌéÜñØæ Øæ ãU•×æÜ ÙãUè´ ¥æÌæ ãñU ÖÜð ãUè °ðâæ ÃØæÂæÚUè ¥æɸUçÌØæ, Âýâ¢S·¤ÚU‡æ·¤•ææü, ¼ÜæÜ, ÌéÜñØæ Øæ ãU•×æÜ ·ë¤çá-©UÂÁ ·ð¤ ©UˆÂæ¼Ù ×ð´ Öè Ü»æ ãéU¥æ ãUô;

1. (bb) “Family” means a person and his/ her, wife or husband, as the case may be, and his/ her children, father, mother, sister, and brothers, dependent on and residing with him.” “(¹ ¹)— “ÂçÚUßæÚU” âð ¥çÖÂýðÌ ãñU ÃØç€Ì ÌÍæ ©Uâ·¤æ/©Uâ·¤è ˆÙè Øæ ÂçÌ, Áñâè Öè çSÍçÌ ãUô °ß¢ ©Uâ·ð¤ Õ‘¿ð´, çÂÌæ,×æÌæ, ÕãÙ °ß¢ Öæ§ü, Áô ©Uâ ÂÚU ¥æçŸæÌ ãUô ÌÍæ ©Uâ·ð¤ âæÍ çÙßæâ ·¤ÚU ÚUãðU ãUô´”, 1. ׊ØÂý¼ðàæ ¥çÏçÙØ× ·ý¤. 11 âÙ÷ 1985 mæÚUæ (ç¼Ùæ·¤ 12-6-1985 âð) ÂýçÌSÍæçÂÌÐ 2. 2. (c) “Board” means the Chhattisgarh state Agricultural Marketing Board established under this Act ;
3. (d) “Bye-laws” means the bye-laws made under Section 80; 1[(dd) “Collector” means the Collector of the District and includes anAdditional Collector;]

(ee) Omitted*** 1[(eee) “Contract farming” means farming of agricultural produce on contract basis by a person on his land under a written agreement with another person to the effect that his farm produce should be purchased at a rate specified in the agreement. (eeeeee) “Contract farming buyer” means a person, company or partnership firm who purchases agricultural produces from contract farming producer under a written agreement of contract farming. “2[(eeeeeee) “Farmer Producer Organization” means an organization which is built up by the share holder farmer producers for the purpose of agricultural activities and is a body corporate/ companies registered under the Companies Act, 2013 ( No. 18 of 2013) and engaged in trading related activities of the transaction of primary produce and works for the benefit of the farmer producer and part of its benefit be divided among the farmer producers and remaining amount be invested in its share capital or reserve fund. ” [(f) “Managing Director” means the Managing Director of the Chhattisgarh State Agriculture Marketing Board appointed under this Act and he shall also be the Commissioner Mandi Chhattisgarh;] (ÀU) “ׇÇUè” âð ¥çÖÂýðÌ ãñU ÏæÚUæ 4 ·ð¤ ¥ÏèÙ SÍæçÂÌ ·¤è »§ü ×¢ÇUè;

7. (h) “market area” means the area for which a market is established under section 4 :
   • (i) “market committee” means a committee constituted under section 11;
8. (j) “market functionary” includes a broker, a commission agent, an exporter, a ginner, an Importer, a presser, a processor, a stockist, a trader, weighman, warehouseman, hammal, surveyor and such other person as may be declared under the rules or the bye-laws to be a market functionary :

11. (o) “Secretary” means the secretary of a Market Committee;

(p) “Trader” means a person who in his normal course of business buys or sells any notified agricultural produce, and includes a person engaged in processing of agricultural produce, but does not include an agriculturist as defined in clause (b) of this sub-section. 2. (2) If a question arises whether any person is an agriculturist or not for the purpose of this Act, the decision of the Collector of the district in which such person is engage in the production or growth of agricultural produce shall be final.
