section 6 or section 30.- Whoever contravenes the provisions of clause (b) of section 6 2[or section 31, sub-section (2) of section 37] shall, on conviction, be punished with imprisonment for a term which may extend to six months or with fine which may extend to 2[five
thousandU] rupees, or with both; and in the case of a continuing contravention, with a further fine which may in case of contravention of clause (b) of section 6 extend to one hundred rupees and in the case of 1[contravention of section 31 or sub-section (2) of section 37] to fifty rupees per day during which the contravention is continued after the first conviction:

Provided that in absence of special and adequate reasons to the contrary mentioned in the judgment of the court the punishment for the second or any subsequent offence shall not be less than imprisonment for a term of three months and a fine of five thousand rupees.

Chapter IX Penalty
49. Penalty for contravention of other sections
( 1) Whoever in contravention of the provisions of section 35 makes or recovers any unauthorised trade allowance shall on conviction, be punished with imprisonment which may extend to three months, or with fine which may extend to 2[two thousand] rupees or with both and in case of subsequent contravention with imprisonment which may extend to six months or with fine which may extend to 2[five thousand] rupees with both.

- (2) Whoever contravenes any con- dition of a licence granted by a market committee shall, on conviction, be punished with fine which may extend to2[five thousand] rupees.
- (3) Whoever obstructs any officer in carrying out the inspection of accounts or holding an enquiry into affairs of a market committee or fails to obey any order issued under clause (d) of sub-section (1) of section 54 shall, on conviction, be punished with fine which may extend to 1[two thousand] rupees for every day during which the offence continues.

- (4) If any officer, servant or mem- ber of a market committee, when required to furnish information in regard to the affairs or proceedings of a market committee under clause (a) of sub-section (1) of section 54(a) wilfully neglects or refuses to furnish any information: or (b) wilfully furnishes false information, shall, on conviction, be punished with fine which may extend to1[five thousand] Rupees.
- (5) Whoever in contravention of the provisions of sub-section (3) of section 54 obstructs any authorised persons in seizing or taking possession of any books, records, funds or property of the market committee or fails to give delivery thereof to such person, shall, on conviction, be punished with fine which may extend to 1[two thousand] rupees.
- (6) Any person who fraudulently evades the payment of any fee or other sum due to the market committee under the provisions of this Act or the rules or bye-laws made thereunder or evades the payment due towards remuneration to any weighman or hammal, or demands remuneration without authority of the seller or buyer for his employment or demands remuneration otherwise than in accordance with the provisions of the rules and bye-laws made under this Act, shall, on conviction, be punished with 1. - (2) ©UÂÏæÚUæ (1) ·ð¤ ¥ÏèÙ ç·¤Øð »Øð ¥æ¼ðàæ âð ÃØçÍÌ ·¤ô§ü Öè ÃØç€Ì, °ðâð ¥æ¼ðàæ ·ð¤ çßL¤h ¥ÂèÜ, °ðâð ÃØç€Ì mæÚUæ ¥æ¼ðàæ ·¤è ÂýæçŒÌ ·¤è ÌæÚUè¹ âð ‹¼ýãU ç¼Ù ·ð¤ ÖèÌÚU, ÂýÕ¢Ï â¢¿æÜ·¤ ·¤ô ·¤ÚU â·ð¤»æ ¥õÚU ©Uâ ÂÚU ÂýÕ¢Ï â¢¿æÜ·¤ ·¤æ çßçÙà¿Ø ¥¢çÌ× ãUô»æÐ 1[51. ׇÇUè àæôŠØô´ ·¤è ßâêÜè — ÁÕ ·¤Öè ·¤ô§ü ÃØç€Ì §â ¥çÏçÙØ× ·ð¤ ¥ÏèÙ ¼‡ÇUÙèØ ç·¤âè ¥ÂÚUæÏ ·¤æ çâh¼ôá ÆUãUÚUæØæ ÁæØ, ÌÕ ×çÁSÅþðUÅU, fine which may extend to 2[five thousand] rupees and in case of continuing offence with a further fine which may extend to one hundred rupees for every day during which such offence is continued after conviction therefor.
- (7) Whoever contravenes any provision of thisAct or any rules or bye-laws made thereunder shall, if no other penalty is provided for the offence, be punished with fine which may extend to 2[two thousand]U rupees.
Chapter IX Penalty
50. Powers of market committee and Chairman to impose penalties.-
- (1) A market committee and the Chairman thereof may impose the penalties of censure or of fine on any licensed market functionary or seller for contravention of any byelaw : Provided that the market committee shall not be competent to impose fine exceeding 2[two thousand] rupees and the Chairman shall not be competent to impose fine exceeding 2[five hundred]U rupees. Provided further that no penalty shall be imposed under this section without giving the person concerned a reasonable opportunity of being heard.
- (2) Any person aggrieved by an order made under sub-section (1) may prefer an appeal against such order to the Managing Director within fifteen days from the date of receipt of order by such person and the decision of the Managing Director thereon shall be final.

52. Cognizance of offences. (1) No court inferior, to that of a Magistrate of the second class shall try any offence under this Act or any rules or bye-laws made thereunder.
1[(2) No court shall take cognizance of any offence punishable under thisAct or any rule or any byelaws made thereunder except on the complaint made by the Collector or the Chairman,Vice-Chairman or Secretary of the market committee or of any person duly authorised by the market committee in this behalf]

53. Composition of offence
(1)A market committee or its sub - committee may accept from any person who is alleged to have committed an offence punishable under this Act or Rules or Byelaws made thereunder in addition to the fees or other amount so recoverable, a sum of money not exceeding rupees 2[five thousand] byway of composition for such offence.
