Chapter VII Market Committee Fund

(1) All moneys received by a market committee shall be paid into a fund to be called, "The Market Committee Fund" and all expenditure incurred by the market committee under or for the purposes of this Act shall be defrayed out of the said fund.Any surplus remaining with the market committee after such expenditure has been met, shall be invested in such manner as may be prescribed: ¥ŠØæØ 7. ׇÇUè âç×çÌ çÙçŠæ

38. ×´ÇUè âç×çÌ çÙçŠæ—(1) ×´ÇUè âç×çÌ mæÚUæ ÂýæŒÌ ãéU° â×SÌ ŠæÙ °·¤ çÙçŠæ ×ð´ Áæð ÒÒ×´ÇUè âç×çÌ çÙçŠæÓÓ ·¤ãUÜæØð»è, â´Î•æ ç·¤Øð ÁæØð´»ð ¥æñÚU ×´ÇUè âç×çÌ mæÚUæ §Uâ ¥çŠæçÙØ× ·ð¤ ¥ŠæèÙ Øæ ©Uâ·ð¤ ÂýØæðÁÙæð´ ·ð¤ çÜ° ©UÂ»Ì ç·¤Øð »Øð â×SÌ ÃØØ ·¤è ÂêçÌü ç·¤Øð ÁæÙð ·ð¤ Âà¿æÌ÷ ×´ÇUè âç×çÌ ·ð¤ Âæâ Õ¿æ ãéU¥æ ·¤æð§üU ¥çŠæàæðá °ðâè ÚUèçÌ ×ð´ Áñâè ç·¤ çßçãUÌ ·¤è ÁæØ, çßçÙçãUÌ ç·¤Øæ ÁæØð»æ Ñ

Provided that all such sums of money received by the market committee as security deposit, contributions to Provident Fund or for payment. in respect of any notified agricultural produce, or charges payable to weighman, hammal and other functionaries shall not form part of market committee fund but shall be accounted for separately.

2[(2)All moneys in the market committee fund and other sums specified in sub-section (1) shall be deposited in a Cooperative Bank which fulfils the condition of section (11)1 of Banking Regulation Act, 1949 or in post office or in any of such eligible Banks as specified by the State Government.

39. ×´ÇUè âç×çÌ çÙçŠæ ·¤æ ©UÂØæðÁÙŠææÚUæ 38 ·ð¤ ©UÂÕ´Šææ𴠷𤠥ŠØŠæèÙ ÚUãUÌð ãéU°, ×¢ÇUè âç×çÌ çÙçÏ ·ð¤ßÜ çÙ•ÙçÜç¹Ì ÂýØôÁÙô´ ·ð¤ çÜ° ÃØØ ·¤è Áæ â·ð¤»è, ¥ÍæüÌ÷—

Subject to the provisions of section 38, the market committee fund may be expended for the following purposes only, namely:

1. (i) the acquisition of a site or sites for the market yards;
2. (ii) the maintenance and improvement of the market yards;
3. (iii) the construction and repairs of buildings necessary for the purposes of the market and for convenience or safety of the persons using the market yard;
4. (iv) the maintenance of standard weights and measures;
5. (v) the meeting of establishment charges including payments and contributions towards provident fund, pension and gratuity of the officers and servants employed by a market committee;
6. (vi) the payment of interest on the loans that may be raised for the purpose of the market and provisions of sinking fund in respect of such loans;
7. (vii) the collection and dissemination or information relating to crops statistics and marketing of agricultural produce; (viii)(a) the expenses incurred in auditing the accounts of the market committee;

1. (b) payment of honorarium to Chairman, travelling allowance of Chairman, Vice-Chairman and other members of the market committee and sitting fees payable to member for attending the meeting;
2. (c) contribution to State marketing development fund; (») ÚUæ’Ø ç߇æÙ çß·¤æâ çÙçŠæ ·ð¤ ÂýçÌ ¥çÖÎæØ; (ƒæ) ÚUæ’Ø âÚU·¤æÚU ·ð¤ ¥æÎðàæ ·¤æð ·¤æØæüç‹ßÌ ·¤ÚUÙð ·ð¤ çÜ° ÌÍæ ç·¤âè ¥‹Ø ¥çŠæçÙØ× ·ð¤ ¥ŠæèÙ ×´ÇUè âç×çÌ ·¤æð ‹ØSÌ ç·¤Øð »Øð ç·¤âè ¥‹Ø ·¤æØü ·ð¤ çÜ° ç·¤âè ÃØØ ·¤è ÂêçÌü;
3. (d) meeting any expenditure for carrying out order of the State Government and any other work entrusted to market committee under any other Act;
4.    • (ix) any other purpose whereon the expenditure of the market committee fund is in the public interest, subject to the prior sanction of the State Government.
