Chapter VI Regulation of Trading

No person shall, in respect of any notified agricultural produce, operate in the market area as commission agent, trader, 1[broker,]1 weighman, hammal, surveyor, warehouse-man, owner or occupier of processing or pressing factories or 2[Farmer Producer Organization or operator of private market yard or operator of private sub market yard or operator of private farmer consumer yards or Terminal Market Complex]2 or such other market functionary except in accordance with the provision of this Act and the rules and byelaws made thereunder. 31.×´ÇUè ÿæð˜æ ×ð´ ·¤æØü ·¤ÚUÙð ßæÜð ÃØç€ÌØæð´

32. ´ÁèØÙ ×´ÁêÚU ·¤ÚUÙð ·¤è àæç€Ì—

(1)ŠææÚUæ 31×ð´ çßçÙçÎücÅU ç·¤Øæ »Øæ ÂýˆØð·¤ ÃØç€Ì, Áæð ×´ÇUè ÿæð˜æ ×ð´ ·¤æØü ·¤ÚUÙæ ¿æãUÌæ ãUæð, ´ÁèØÙ ·¤æð ×´ÁêÚUè Øæ ©Uâ·ð¤ Ùßè·¤ÚU‡æ ·ð¤ çÜ° ×´ÇUè âç×çÌ ·¤æð °ðâè ÚUèçÌ ×ð´ ÌÍæ °ðâè ·¤æÜæßçŠæ ·ð¤ ÖèÌÚU, Áñâè ç·¤ ©UÂçßçŠæØæð´ mæÚUæ çßçãUÌ ·¤è ÁæØð, ¥æßðÎÙ ·¤ÚÔU»æÐ

1. (2) °ðâð ÂýˆØð·¤ ¥æßðÎÙ-Â˜æ ·ð¤ âæÍ °ðâè Ȥèâ â´Ü»A ·¤è ÁæØð»è Áñâè ç·¤ ÂýÕ´Šæ â´¿æÜ·¤, çßçãUÌ ·¤è »§üU âè×æ¥æ𴠷𤠥ŠØŠæèÙ ÚUãUÌð ãéU°, §Uâ â´Õ´Šæ ×ð çßçÙçÎüCU ·¤ÚÔ´UÐ

3. (3) The market committee may grant or renew the registration or for reasons to be recorded in writing refuse to grant or renew the registration: 1[ÂÚU‹Ìé ØçÎ ç·¤ ׇÇUè âç×çÌ, ´ÁèØÙ ·¤è ×´ÁêÚUè Øæ ©Uâ·ð¤ Ùßè·¤ÚU‡æ ·ð¤ çÜ° ¥æßðÎÙ˜æ Âýæ# ãUæðÙð ·¤è ÌæÚUè¹ âð ÀUÑ â#æãU ·ð¤ ÖèÌÚU ´ÁèØÙ ×´ÁêÚU ·¤ÚUÙð ×ð´ Øæ ´ÁèØÙ ·¤æ Ùßè·¤ÚU‡æ ·¤ÚUÙð ×ð´ ¿ê·¤ ·¤ÚUÌè ãñU, Ìæð ØãU â×Ûææ ÁæØð»æ ç·¤ ´ÁèØÙ ØÍæçSÍçÌ ×´ÁêÚU ·¤ÚU Îè »§üU ãñU Øæ ©Uâ·¤æ Ùßè·¤ÚU‡æ ·¤ÚU çÎØæ »Øæ ãñUÐ] 2[ÂÚU‹Ìé ØãU ¥æñÚU Öè ØçÎ ç·¤âè ¥æßðη¤ ·ð¤ 1[Provided that if the market committee fails to grant or renew a registration within a period of six weeks from the date of receipt of application therefor the registration shall be deemed to have been granted or renewed, as the case may be.] 2[Provided further that the registra- tion shall not be renewed, if any Mandi committee dues including dues under the Chhattisgarh Nirashriton Avam Nirdhan Vyaktion Ki Sahayata Adhiniyam, 1970 are outstanding against the applicant: çßL¤h ׇÇUè âç×çÌ ·ð¤ àææðŠØ, çÁٷ𤠥‹Ì»üÌ ÀU•æèâ»É¸U çÙÚUæçŸæÌæð´ °ß´ çÙŠæüÙ ÃØç€ÌØæð´ ·¤è âãUæØÌæ ¥çŠæçÙØ×, 1970 ·ð¤ ¥ŠæèÙ àææðŠØ Öè ¥æÌð ãñ´U, Õ·¤æØæ ãñ´U Ìæð ¢ÁèØÙ Ùßè·ë¤Ì ÙãUè´ ·¤è Áæ°»è Ñ Provided also that no registration shall be granted to a minor]. 4. (4) All registration granted or renewed under this section shall be subject to the provisions of this Act and the rules and bye-laws mademe thereunder.

6. (2) ÚUæ’Ø âÚU·¤æÚU mUæÚUæ ¥çŠæâêç¿Ì ÂýæçŠæ·¤æÚUè/ ¥çŠæ·¤æÚUè ´ÁèØÙ ×´ÁêÚU ·¤ÚU â·ð¤»æ Øæ ©Uâ·¤æ ÙßèÙè·¤ÚU‡æ ·¤ÚU â·ð¤»æ Øæ Üð¹ÕhU ç·¤Øð ÁæÙð ßæÜð ·¤æÚU‡ææð´ âð ´ÁèØÙ ·¤æð ×´ÁêÚU ·¤ÚUÙð Øæ ©Uâ·¤æ ÙßèÙè·¤ÚU‡æ ·¤ÚUÙð âð §´U·¤æÚU ·¤ÚU â·ð¤»æÐ
7. 8. Registration for establishment of private market yard/ private sub- market yard and private farmer consumer yard.-
9. (1) Every person/ organization/ farmer producer organization, who desires to establish private market yard/ private sub- market yard/ private farmer consumer yard in the market area, shall apply to the Board of registration or renewal thereof in such manner and within such period and on such conditions as may be prescribed in the rules.
10. (2) Board may grant or renew the registration or for reasons to be recorded in writing refuse to grant or renew the registration.

(1) Subject to the provisions of sub-section (4) a market committee may, for reason to be recorded in writing, suspend or cancel a registration

1. (a) if the registration has been obtained through willful misrepresentation or fraud; or
2. 2. (4) §Uâ ŠææÚUæ ·ð¤ ¥ŠæèÙ ·¤æð§üU ´ÁèØÙ ÌÕ Ì·¤ çÙÜ´çÕÌ Øæ ÚUg ÙãUè´ ·¤è ÁæØð»è, ÁÕ Ì·¤ ©Uâ·ð¤ ŠææÚU·¤ ·¤æð °ðâð çÙÜ•ÕÙ Øæ ÚUg·¤ÚU‡æ ·ð¤ çßL¤h ·¤æÚU‡æ ÎàææüÙð ·¤æ Øéç€ÌØé€Ì ¥ßâÚU Ù Îð çÎØæ »Øæ ãUæðÐ
   • (c) If the holder of the registration in combination with other registration holders commits any act or abstains from carrying on his normal business in the market area with the intention of willfully obstructing, suspending or stopping the marketing of notified agricultural produce in the market yard/ yards and in consequence whereof the marketing of any produce has been obstructed, suspended or stopped.
   • (d) if the holder of the registration haws become an insolvent;
   • (e) if the holder of the registration incurs any disqualification as may be prescribed, or
   • (f) If the holder of the registration is convicted of any offence under this Act.
3. (2) Subject to the provisions of subsection (4), the Chairman may, for reasons to be recorded in writing, suspend a registration for a period not exceeding one month for any reason for which a market committee may suspend a registration under sub-section (1): Provided that such order shall cease to have effect on expiry of a period of seven days from the date on which it is made, unless confirmed by the market committee before such expiration.
4. (3) Notwithstanding anything contained in sub- section (1) but subject to the provision of sub-section (4), the Director may, for reasons to be recorded in writing, by order suspend or cancel any registration granted or renewed by the market committee: Provided that no order under this sub-section shall be made without notice to the market committee.
5. (4) No registration shall be suspended or cancelled under this section, without giving an opportunity to show cause against such suspension or cancellation. 1[33- ·¤. çÙÁè ׇÇUè Âý´æ»‡æ/çÙÁè ©UÂׇÇUè Âýæ´»‡æ ÌÍæ çÙÁè ç·¤âæÙ ©UÂÖæðQ¤æ Âý´æ»‡æ ·ð¤ ´ÁèØÙ ÚUÎ÷Î ·¤ÚUÙð Øæ çÙÜ´çÕÌ ·¤ÚUÙð ·¤è àæçQ¤.- 1[33-A. Power to cancel or suspend registration for private market yard/ private sub- market yard and private farmer consumer yard.-
6. (1) Subject to the provision of sub-section (3), the board may for the reasons to be communicated to the registration holder in writing, suspend or cancel registration-
   • (a) If the registration has been obtained through willful misrepresentation or fraud; or
   • (b) If the holder of the registration or any servent or anyone acting on his behalf with his ( registration holder’s) expressed or implied permission, commits, a breach of any of the terms or conditions of registration; or
   • (c) If the holder of the registration in association with other registration holder, commits any act or abstains from carrying on his normal business in the market area with the intention of willfully obstructing, suspending or stopping the marketing of notified agricultural produce in the market, yard/ sub- market yard/ special produce market yard/ farmer consumer sub- market yard and in consquence whereof the marketing of any notified agricultural produce has been obstructed, suspended, or stopped; or
   • (d) If the holder of the registration has become an insolvent; or
   • (e) If the holder of the registration incurs any disqualification, as may be prescribed; or
7. (2) Notwithstanding anything contained in sub- section (1), but subject to the provisions of sub- section (3), the State Government may for the reasons to be communicated in writing to the registration holder, by order suspend or cancel his/ its registration granted or renewed by the Board.
8. (3) No registration shall be suspended or cancelled under this section without giving a reasonable opportunity to its holder to show cause against such suspension or cancellation.]1

(1)Any person aggrieved by an order of the Chairman market committee or the Managing Director passed under 1[Section 32 or section 33 as the case may be] prefer an appeal

1. (a) to the market committee, where such order is passed by the Chairman;
2. (b) to the Director where such order is passed by the market committee; and
3. 6. (1) Any person aggrieved by an order of the Board passed under Section 32- B or 33-A, as the case may be, may prefer an appeal to the State Government, within forty days of receipt of the order.
7. (2) The Appellate Authority if it con- siders it necessary, may stay the order appealed against for such period as it may deem fit.
8. (3) The order passed by the State Gov- ernment, shall subject to the order in the appeal under this section, be final and shall not be called in question in any court of law.

(1) No trade allowance, other than an allowance prescribed by or under this Act, shall be made or received by any person in any market area in any transaction in respect of the notified agricultural produce and no civil court, shall, in any suit or proceeding arising out of any such transaction, have regard to any trade allowance not so prescribed.

1. (2) The weight of a container shall be counter- balanced by the same type of container and no deduction in any form whatsoever shall be allowed for counterbalancing the weight of the container.

2. (2) Such notified agricultural produce be purchased by the licensed traders from outside the market area in the course of commercial transaction may be brought and sold any where in market area in accordance with the provisions of the bye-laws.

Provided that the weighment, measurement or counting as the case may be, of Plantain, Papaya or any other perishable agricultural produce as may be specified by the State Government, by notification, shall be done by a licensed weighman in the place where such produce has been grown.]

(1) Any person who buys notified agricultural produce in the market area shall execute an agreement in triplicate in such form as may be prescribed, in favour of the seller. One copy of the agreement shall be kept by the buyer, one copy shall be supplied to the seller and the remaining copy shall be kept in the record of the market committee, 2[(2) (a) The price of the agricultural produce bought in the market yard shall be paid on the same day to the seller at the market yard;

(b) In the case purchaser does not make payment under clause (a), he shall be liable to make additional payment at the rate of one percent, per day of the total price of the agricultural produce payable to the seller within five days; 1. (c) in case the purchaser does not make payment with additional payment to the seller under clause (a) and (b) above within five days from the day of such purchase, his licence shall be deemed to have been cancelled on the sixth day and he or his relative shall not be granted any licence under this Act for a period of one year from the date of such cancellation. 1. (3) No wholesale transaction of notified agricultural produce shall be entered into directly by licensed traders with producers of such produce except in 1[the market yards or such other place]1 as provided in the bye - laws.
2. (4) The Commission agent shall re- cover his commission only from his principal at such rates as may be specified in the bye-laws including all such expenses as may be incurred by him in storage of the produce and other services rendered by him.

   • (a) to keep the goods of his principal in safe custody without any charge other than the commission payable to him;

4. (2) ·ýð¤Ìæ, â´çßÎæ ¹ðÌè ·ð¤ çÜç¹Ì ·¤ÚUæÚU ·ð¤ ÚUçÁSÅþè·¤ÚU‡æ ·ð¤ çÜØð ×´ÇUè âç×çÌ ·¤æð °·¤ ¥æßðÎÙ ÂýSÌéÌ ·¤ÚÔU»æ ×´ÇUè âç×çÌ, ©Uâð °ðâè ÚUèçÌ ×ð´ ÌÍæ °ðâð çÙÕ´ŠæÙæð´ ÌÍæ àæÌæðü ÂÚU Áñâè ç·¤ ©UÂçßçŠæØæð´ mUæÚUæ çßçãUÌ ·¤è Áæ° ÚUçÁSÅUÚU ·¤ÚÔU»èÐ 1[37-A. Rmegulation of marketing of notified agricultural produce under contract farming -
5. (1) The contract farming shall be performed under a written agreement ( in model from shown in Schedule-A) between producer and buyer of 2[Produce of contract farming]2 in such manner and in accordance with such procedure as may be prescribed the bye- laws. Explanation- For the purpose of this section “Producer and buyer” means the person who respectively produce and buy agricultural produce under a written agreement of contract farming.
6. (2) The buyer shall submit an application for registration of the written agreement contract farming to the market committee. The Market Committee shall register in such manner and on such Terms and conditions as may be prescribed by the bye- laws.
7. (3) If any dispute arise between the parties in respect of provisions of the agreement the either party may submit an application to the Chairman of Market Committee to arbitrate upon the dispute. The Chairman of the Market Committee shall resolve the dispute after the parties a reasonable opportunity if being hears.
8. (4) The party aggrieved by the de- cision of the Chairman of the Market Committee under sub- section (3) may prefer an appeal to the managing Director or the officer authorized by him in this behalf within thirty days from the date of decision. The Managing Director or the officer authorized by him shall dispose of the apper after giving the parties a reasonable opportunity of being heard and the decision of the Managing Director or the officer authorized by him shall be final.

10. (5) The agricultural produced under contract farming shall be sold to the buyer or out the market yard as may be prescribed by the bye- laws. The market fees shall payble by the buyer of agricultural produce at the rates prescribed under section 19 in such manner as may be prescribed by bye- laws.]1
