3. विनिर्दिष्ट क्षेत्र में अधिसूचित कृषि-उपज के विपणन का विनियमन करने के आशय की अधिसूचना
(1) किसी ऐसे क्षेत्र के, जिसके कि लिये मण्डी का स्थापित किया जाना प्रस्तावित हो, स्थानीय प्राधिकारी द्वारा या किसी कृषि उपज पैदावार करने वालों द्वारा किये गये अभ्यावेदन पर या अन्यथा, राज्य शासन, अधिसूचना द्वारा तथा ऐसी अन्य रीति में जो कि विहित की जाए, कृषि-उपज के क्रय-विक्रय का ऐसे क्षेत्र में विनियमन करने के लिये, जो कि अधिसूचना में विनिर्दिष्ट किया जाए, मण्डी स्थापित करने के अपने आशय की घोषणा कर सकेगी।
(2) उपधारा (1) के अधीन अधिसूचना में यह कथित होगा कि किसी भी ऐसी आपत्ति या सुझाव पर राज्य शासन द्वारा विचार किया जायेगा जो कि राज्य शासन को, अधिसूचना विनिर्दिष्ट की जाने वाली कालावधि के, जो एक मास से कम न हो भीतर प्राप्त हो।
4. मण्डी की स्थापना तथा उसमें अधिसूचित कृषि उपज के विपणन का विनियमन
धारा 3 के अधीन जारी की गई अधिसूचना में विनिर्दिष्ट की गई कालावधि का अवसान होने के पश्चात और ऐसी आपत्तियों तथा सुझावों पर, जो ऐसे अवसान के पूर्व प्राप्त हुये हों, विचार करने के पश्चात तथा ऐसी जांच, यदि कोई हो जो आवश्यक हो, करने के पश्चात राज्य शासन अन्य अधिसूचना द्वारा धारा 3 के अधीन अधिसूचना में विनिर्दिष्ट किये गये क्षेत्र या उसके किसी भाग के लिये, इस अधिनियम के प्रयोजन के लिये अनुसूची में विनिर्दिष्ट की गई कृषि उपज के संबंध में मण्डी स्थापित कर सकेगी और इस प्रकार स्थापित की गई मण्डी ऐसे नाम से जानी जायेगी, जो कि उस अधिसूचना में विनिर्दिष्ट किया जाए।

(1) (क) प्रत्येक मण्डी क्षेत्र में -
(एक) एक मण्डी प्रांगण होगा और (दो) एक से अधिक उप मण्डी प्रांगण हो सकेंगे। (ख) प्रत्येक मण्डी प्रांगण या उप मण्डी प्रांगण के लिये एक मूल मण्डी होगी।
(2) राज्य शासन धारा 4 के अधीन अधिसूचना जारी होने के पश्चात यथाशक्य शीघ्र अधिसूचना द्वारा - (क) किसी विनिर्दिष्ट स्थान को, जिसके अंतर्गत मण्डी क्षेत्र में कोई संरचना, अहाता, खुला स्थान या परिक्षेत्र आता है, यथा स्थिति मण्डी-प्रांगण या उप मण्डी प्रांगण घोषित करेगी और (ख) यथास्थिति ऐसे मण्डी-प्रांगण या उप मण्डी प्रांगण के संबंध में, मण्डी क्षेत्र के किसी विनिर्दिष्ट क्षेत्र को मूल मण्डी घोषित करेगी।

Control of marketing of notified agricultural produce. धारा 4 के अधीन किसी मण्डी की स्थापना होने पर -
(क) कोई भी स्थानीय प्राधिकारी, तत्समय प्रवृत्त किसी अधिनियमिति में अंतर्विष्ट किसी बात के होते हुये भी, मण्डी क्षेत्र के किसी स्थान का किसी अधिसूचित कृषि-उपज के विपणन के लिये न तो निर्माण करेगा न उसकी स्थापना करेगा, न उसको चालू रखेगा और न उसको उपयोग में लायेगा या उसका निर्माण किये जाने, न उसकी स्थापना की जाने, न उसको चालू रखे जाने और न उसको उपयोग में लाये जाने की अनुज्ञा ही देगा;
(ख) कोई भी व्यक्ति इस अधिनियम के तथा उसके अधीन बनाये गये नियमों और उपविधियों के उपबंधों के अनुसार के सिवाय - (एक) मण्डी-क्षेत्र के किसी स्थान को अधिसूचित कृषि-उपज के विपणन के लिये उपयोग में नहीं लायेगा; या (दो) मण्डी क्षेत्र में मण्डी कृत्याधिकारी के रूप में कार्य नहीं करेगाः
परंतु इसमें की कोई भी बात - (क) ऐसी कृषि उपज के विक्रय या क्रय को - (एक) जिसका कि उत्पादक स्वयं उसका विक्रेता हो और ऐसा विक्रय किसी ऐसे व्यक्ति को, जो कि उसे अपने स्वयं के घरेलू उपभोग के लिये खरीदता हो, एक बार में चार क्विंटल से अनधिक परिमाण में किया जाता हो; (दो) जो सिर पर रखकर लाई गई हो; (तीन) जिसका क्रय या विक्रय किसी छोटे व्यापारी द्वारा किया जाता हो; (चार) लुप्त; (पांच) जिसका क्रय किसी प्राधिकृत उचित मूल्य की दुकान के दुकानदार द्वारा भारतीय खाद्य निगम से, मध्य प्रदेश राज्य वस्तु व्यापार निगम से या किसी अन्य ऐसे अभिकरण या संस्था से किया जाता हो जिसे राज्य सरकार द्वारा लोक वितरण पद्धति से आवश्यक वस्तुओं का वितरण करने के लिये प्राधिकृत किया गया हो; (ख) किसी सहकारी सोसायटी से कोई अग्रिम प्राप्त करने के प्रयोजन के लिये ऐसी कृषि उपज के उससे किये गये अंतरण को लागू नहीं होगीः
परंतु यह और भी कि राज्य सरकार, अधिसूचना द्वारा, उसमें विनिर्दिष्ट किये जाने वाले कारणों से ऐसे मण्डी क्षेत्र के संबंध में, जो कि अधिसूचना में विनिर्दिष्ट किया जाये, उस छूट को withdraw the exemption कर सकेगी जो कि पूर्ववर्ती परंतु के खंड (क) के उपखंड (दो) के अधीन दी गई हो।
7. Establishment and incorporation of Market Committee
Establishment and incorporation of Market Committee. (1) प्रत्येक मण्डी-क्षेत्र के लिये एक मण्डी समिति होगी जिसकी अधिकारिता संपूर्ण मण्डी-क्षेत्र पर होगी।
(2) प्रत्येक मण्डी समिति उस नाम से, जो कि ऐसी मण्डी के लिये धारा 4 के अधीन अधिसूचना में विनिर्दिष्ट किया गया हो, एक निगमित निकाय (Body Corporate) होगी। उसका शाश्वत उत्तराधिकार (Perpetual Succession) होगा तथा उसकी एक सामान्य मुद्रा होगी और वह अपने निगमित नाम से वाद चला सकेगी तथा उक्त नाम से उसके विरुद्ध वाद चलाया जा सकेगा और ऐसे निर्बंधनों (Restrictions) के जो कि इस अधिनियम द्वारा या उसके अधीन अधिरोपित किये जायें, अध्यधीन रहते हुये, वह संविदा करने के लिये तथा किसी भी संपत्ति को अर्जित (acquire) करने, धारण करने, पट्टे पर देने, बेचने या अन्यथा अंतरित (Transfer) करने के लिये और इस अधिनियम के प्रयोजनों के लिये आवश्यक समस्त अन्य बातें करने के लिये सक्षम होगी।
(3) तत्समय प्रवृत्त किसी भी अधिनियमिति में अंतर्विष्ट किसी भी बात के होते हुये भी, प्रत्येक मण्डी समिति समांतर प्रयोजनों के लिये स्थानीय प्राधिकारी समझी जायेगी।

(1) मण्डी समिति किसी स्थानीय प्राधिकारी से यह अपेक्षा कर सकेगी कि वह उसे अपनी कोई ऐसी भूमि या भवन, जो मण्डी-प्रांगण के भीतर स्थित हो और जो मण्डी की स्थापना के अव्यवगत पूर्व (immediately before the establishment of the market) स्थानीय प्राधिकारी द्वारा मण्डी के प्रयोजनों के लिये उपयोग में लाया जाता था, अंतरित कर दे और स्थानीय प्राधिकारी अध्यापेक्षा प्राप्त होने के एक मास के भीतर यथास्थिति भूमि या भवन, को ऐसे निर्बंधनों पर, जिनका कि उनके बीच करार हो जाये, मण्डी समिति को अंतरित कर देगा।
(2) जहां स्थानीय प्राधिकारी को उपधारा (1) के अधीन अध्यापेक्षा (requisition) प्राप्त होने की तारीख से तीस दिन की कालावधि के भीतर स्थानीय प्राधिकारी तथा मण्डी समिति के बीच उक्त उपधारा के अधीन कोई करार न हो पाये, वहां मण्डी समिति द्वारा अपेक्षित भूमि या भवन इस अधिनियम के प्रयोजनों के लिये समिति में निहित हो जायेगा और स्थानीय प्राधिकारी को ऐसे प्रतिकर (compensation) का संदाय कर दिया जायेगा जैसा कि कलेक्टर द्वारा उपधारा (5) के अधीन अवधारित किया जायेः
परंतु किसी स्थानीय प्राधिकारी को कोई प्रतिकर किसी ऐसी भूमि या भवन के संबंध में देय नहीं होगा जो ऐसे स्थानीय प्राधिकारी के गठन से संबंधित अधिनियमिति में अंतर्विष्ट उपबंधों के आधार पर इसमें निहित हुआ था किंतु ऐसे निहित होने के लिये किसी भी रकम का संदाय नहीं किया गया थाः
परंतु यह और भी कि कलेक्टर के आदेश से व्यथित कोई भी पक्षकार, ऐसे आदेश की तारीख से तीस दिन के भीतर, राज्य सरकार को अपील कर सकेगा।
(3) स्थानीय प्राधिकारी उपधारा (2) के अधीन मण्डी समिति में निहित होने वाली भूमि या भवन का कब्जा ऐसे निहित होने से सात दिन की कालावधि के भीतर परिदत्त कर देगा और पूर्वोक्त कालावधि के भीतर स्थानीय प्राधिकारी के ऐसा करने में चूक होने पर, कलेक्टर उस भूमि या उस भवन का कब्जा ले लेगा और उसे मण्डी समिति को परिदत्त (Delivered) करा देगा।
(4) राज्य सरकार का आदेश तथा उस आदेश के अध्यधीन रहते हुये उपधारा (2) के अधीन कलेक्टर का आदेश अंतिम होगा और दोनों पक्षकारों पर आबद्धकर होगा।
(5) कलेक्टर भूमि या भवन के लिये प्रतिकर की रकम निम्नलिखित बातों को ध्यान में रखते हुये नियत करेगा :- (एक) वार्षिक भाटक (annual rent) जिस पर उस भवन को वर्ष प्रति वर्ष भाड़े पर दिये जाने की युक्तियुक्त रूप से प्रत्याशा की जा सकती हो; (दो) भवन की दशा; (तीन) ऐसे भूमि के अर्जन (acquisition) के लिये स्थानीय प्राधिकारी द्वारा दी गई प्रतिकर की रकम और उस भूमि का वर्तमान बाजार मूल्य; और (चार) स्थानीय प्राधिकारी द्वारा उस भूमि पर परिसीमित किये गये किसी भवन की या भूमि पर निष्पादित किये गये किसी अन्य कार्य की लागत या उसका बाजार मूल्य।
9. Acquisition of land for Board or Mandi Committee
(1) When any land within the Mandi area is required for the purposes of this Act and the Board or the Mandi Committee is unable to acquire it by agreement, the State Government may, at the request of the Board or, as the case may be, the Mandi Committee, proceed to acquire such land under the provisions of the Land Acquisition Act, 1894 (No. 1 of 1894) and on payment by the Mandi Committee of the compensation awarded and of any other charges incurred by the State Government in connection with such acquisition, the land shall vest in the Board or, as the case may be, the Mandi Committee. (2) Any land which has been acquired for the Board or Mandi Committee under sub-section (1) and vests in it, shall be disposed of by sale, by lease or otherwise only in accordance with the rules made by the State Government for this purpose. (3) Any provision contained in the Madhya Pradesh Land Revenue Code, 1959 (No. 20 of 1959) and the rules made thereunder, in so far as it relates to diversion of land, revision of land revenue as a result of change in the use of land from agriculture to any other purpose and other matters incidental thereto, shall not apply to any land which has been acquired by the Mandi Committee under sub-section (1) or which has been acquired by transfer, purchase, gift or otherwise and used for the purpose of establishment of any Mandi yard or any sub-Mandi yard: Provided that the premises used for Mandi yard, sub-Mandi yard or for the purpose of the Board shall not be deemed to be included within the limits of Municipal Corporation, Municipal Council, Notified Area, Gram Panchayat or Special Area Development Authority, as the case may be.

Appointment of officer-in-charge until the first Market Committee is formed. (1) When a Mandi is first established under this Act, the Managing Director shall, by order, appoint a person to be the Officer-in-Charge for a period not exceeding two years. The Officer-in-Charge, while remaining under the control of the Managing Director, shall exercise all the powers and perform all the duties of the Mandi Committee under this Act: Provided that in the event of death, resignation, leave or suspension of the Officer-in-Charge, it shall be deemed that a casual vacancy has occurred in such post and such vacancy shall be filled by the Managing Director as early as possible by appointing a person to that post, and until such appointment is made, the person specified by the Collector shall act as the Officer-in-Charge: Provided further that if the Mandi Committee is constituted before the expiry of the aforesaid period, such Officer-in-Charge shall not continue in his post from the date fixed for the first general meeting of the newly constituted Mandi Committee. (2) Any Officer-in-Charge appointed under sub-section (1) may be removed at any time by the Managing Director, who shall have the power to appoint any other person in his place. (3) Any person appointed as Officer-in-Charge under sub-section (1) shall receive from the Mandi Committee fund such salary and allowances for his services as may be determined by the Managing Director. (4) The Officer-in-Charge appointed under sub-section (1) shall continue to hold office notwithstanding the expiry of his term under that sub-section until the date fixed for the first general meeting of the newly constituted Mandi Committee under sub-section (1) of section 13.
11. Constitution of Market Committee
Constitution of Market Committee. (1) A Mandi Committee shall consist of the following: (a) Chairman elected under section 12; (b) Ten representatives of farmers who possess such qualifications as may be prescribed, who have been elected by direct election in accordance with the provisions of this Act and the rules made thereunder from the constituencies of the Mandi area. Explanation: In this clause, the expression "representatives of farmers" shall not include any such farmer of the Mandi area if any relative of such farmer, namely, wife, husband, father, mother, brother, sister, son, daughter, father's father, father's brother, father's sister, mother's father, mother's brother or sister, father's brother's son or daughter, father's sister's son or daughter, mother's brother's son or daughter, mother's sister's son or daughter, brother's son or daughter, sister's son or daughter, son's wife, daughter's husband, sister's husband, wife's sister's husband, father's sister's husband, mother's sister's husband, son's son or daughter, daughter's son or daughter, wife's father or mother, wife's brother or sister, wife's brother's son or daughter, wife's sister's son or daughter, husband's brother, husband's brother's wife, husband's brother's son or daughter, holds a trader-licence from any Mandi Committee of the State; (c) One representative of traders who possesses such qualifications as may be prescribed, who shall be elected by and from amongst those persons who have held a licence as traders or owners or occupiers of processing factories from the Mandi Committee under this Act for a continuous period of two years: Provided that in the case of a Mandi Committee established for the first time under section 10, such qualifying period for holding the licence from the Mandi Committee shall be six months: Provided further that no person shall be eligible to be a representative of traders of the Mandi Committee if he has more than two living children, one of whom is born on or after 26th January, 2001: Provided further that any elected representative of traders shall be disqualified from holding such office if one child is born on or after 26th January, 2001, whereby the number of his children exceeds two: Provided further that no person shall be a voter of more than one Mandi Committee at a time: Provided further that any person shall be a voter only when— (i) he has attained the age of 18 years; (ii) he is not a defaulter of the Mandi Committee. Explanation: The expression "defaulter" includes a person who has made default in payment of the destitute fee to be recovered by the Mandi Committee under the provisions of the Madhya Pradesh Destitute Persons and Poor Assistance Act, 1970 (No. 12 of 1970). (d) Such members of the State Legislative Assembly and Lok Sabha whose constituency's at least fifty percent population resides in such rural areas which are outside the local limits of any Municipal Corporation, Municipal Council or Nagar Panchayat: Provided that in such constituency where more than one Mandi Committee exists, the member of Lok Sabha shall have to give his option as to which Mandi Committee he wants to be a member of: Provided further that a member of Lok Sabha or a member of the State Legislative Assembly who is a member of the Mandi Committee may nominate his representative, who possesses such qualifications as may be prescribed, for the purpose of attending the meeting of the Mandi Committee; (e) One representative of the cooperative marketing society working in such Mandi area, who shall be elected by the managing committee of such society: Provided that if more than one society is working in such Mandi area, such member shall be elected by all the members of the managing committees of such societies: Provided further that nothing in this clause shall apply if the managing committee of any society has been superseded under the provisions of the Madhya Pradesh Cooperative Societies Act, 1960 (No. 17 of 1961). (f) One officer of the Agriculture Department of the State Government, who shall be nominated by the Collector; (g) One representative of weighmen and hamals working in the Mandi area who holds a licence from the Mandi Committee, who shall be nominated by the Chairman; (h) One representative of the District Central Cooperative Bank, who shall either be the Chairman of such bank or such other member of its management committee as may be nominated by the Chairman of such bank; (i) One representative of the District Land Development Bank, who shall either be the Chairman of such bank or such other member of its management committee as may be nominated by the Chairman of such bank; (j) One representative of the Gram Panchayat, Janpad Panchayat or Zila Panchayat falling within the jurisdiction of the Mandi area, who shall be nominated by the Zila Panchayat Chairman: Provided that in the Mandi Committees situated at District Headquarters, such representative shall be nominated only from among the members of the Zila Panchayats. (2) All the members under sub-section (1) shall have the right to vote, except such members who have been nominated under clause (f) and such members who are special invitees under the second proviso of clause (d) of sub-section (1). (3) The State Government may make rules for the preparation of voter lists and for the conduct of elections. (4) If the electoral college under clause (b) or (c) of sub-section (1) fails to elect a representative, the Collector shall nominate the representative of the farmers or traders, as the case may be. (5) Every election and nomination of a member shall be notified in the Gazette by the Collector.
12. Election of Chairman and Vice-Chairman
(1) The Chairman shall be elected by the persons who are qualified for voting in the election of representatives of agriculturists and traders in the prescribed manner: Provided that no person shall be eligible for election as Chairman unless he is qualified for being elected under sub-section (2) and (3) of section 11B. (2) The office of the Chairman shall be reserved for the Scheduled Castes and the Scheduled Tribes and the proportion of the number of such reserved offices to the total number of such offices in the State shall, as far as possible, be the same as the proportion of the population of the Scheduled Castes and the Scheduled Tribes in the State to the total population of the State and such offices shall be allotted by the Managing Director for the mandi committees in the prescribed manner. (3) Twenty-five percent of the total number of offices of Chairman shall be reserved for the Other Backward Classes and such offices shall be allotted by the Managing Director in the prescribed manner to those mandi committees which are not reserved for the Scheduled Castes or the Scheduled Tribes. (4) Not less than one-third of the total number of offices of the Chairman reserved under sub-section (2) and (3) shall be reserved for women of the Scheduled Castes, the Scheduled Tribes or the Other Backward Classes, as the case may be. (5) Not less than one-third (including the number of offices reserved for women belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes) of the total number of offices of Chairman in the State shall be reserved for women and such offices shall be allotted by the Managing Director for different mandi committees in the prescribed manner. (6) No person shall be eligible to contest for the post of Chairman and member simultaneously. (7) If any mandi area fails to elect a Chairman, new election proceedings to fill that post shall be initiated within six months: Provided that further process of constitution of mandi committee shall not be stopped during the pendency of the election of the Chairman: Provided further that during the pendency of the election of the Chairman under this sub-section, the Vice-Chairman shall discharge all the functions of the Chairman. (8) There shall be a Vice-Chairman of the Mandi Committee who shall be elected by the elected members of the Mandi Committee and from amongst them in the prescribed manner at the first meeting of the Mandi Committee called under sub-section (1) of section 13: Provided that if the Chairman of the Mandi Committee does not belong to the Scheduled Castes, Scheduled Tribes or Other Backward Classes, the Vice-Chairman shall be elected from amongst the elected members of such castes or tribes or classes: Provided further that no person shall be eligible for election as Vice-Chairman unless he is an agriculturist. (9) Every election of the Chairman and Vice-Chairman shall be notified by the Collector in the Gazette.

First meeting, term of office of Chairman, Vice-Chairman or member, their resignation and vacancy in their office. (1) The first meeting of the Mandi Committee shall be called by the Collector within one month from the date of publication of the results of the election of the Chairman and members in the Gazette. (2) The Chairman, Vice-Chairman and members of the Mandi Committee shall hold office for a period of five years from the date of the first meeting of the Mandi Committee: Provided that if, on the expiry of the Mandi Committee, a new Mandi Committee is not constituted, the State Government, by notification, may extend the term of the Mandi Committee for a period of six months recording the reasons for such extension from the date of such expiry, and if a new Mandi Committee is not constituted within this extended period, it shall be deemed to have been dissolved and in that case the provisions of section 57 shall apply. (3) The Chairman, Vice-Chairman or any member may resign their office at any time by addressing the Collector in writing and such resignation shall be effective from the date of its acceptance by the Collector. (4) Any person who is elected as a Chairman or Vice-Chairman of any Municipal Corporation, Municipal Council, Nagar Panchayat, Panchayat or any Co-operative Society, if he is elected as a Chairman or Vice-Chairman of a Mandi Committee, or vice versa, i.e., elected Chairman or Vice-Chairman in the Mandi Committee is elected as Chairman or Vice-Chairman of the aforesaid bodies, then by a notice in writing, signed by him and delivered to the Collector within thirty days from the date of his being elected in that capacity or the later of such dates, shall declare which office he wishes to hold and thereupon his place in such other body, where he does not wish to hold office, shall become vacant, and on failure to give such declaration within the aforesaid period, upon the expiry of that period, his place in the Mandi Committee shall become vacant. (5) In the event of death, resignation, removal, vacancy under sub-section (4) or otherwise of the Chairman, Vice-Chairman or any member before the expiry of their term of office, it shall be deemed that a casual vacancy has occurred in such office and such vacancy shall be filled by election according to the provisions of this Act and rules within six months and the person so elected or nominated shall hold office for the residue of the term of his predecessor: Provided that no such vacancy shall be filled if the remaining period of office is less than six months. (6) In the event of death, resignation, removal or otherwise of the Chairman, or if the office of the Chairman also becomes vacant, then notwithstanding anything contained in this Act, such member of the Mandi Committee elected under clause (b) of sub-section (1) of section 11, as the Collector may appoint, shall exercise the powers and perform the functions of the Chairman until the Chairman is duly elected.

17. Powers and duties of the Mandi Committee
(1) इस अधिनियम के उपबंधों के अव्याधीन रहते हुये मंडी समिति का यह कर्तव्य होगा कि वह-- (क) इस अधिनियम तथा उसके अधीन बनाये गये नियमों एवं उपविधियों के उपबंधों को मंडी क्षेत्र में कार्यान्वित करे; (ख) अधिसूचित कृषि उपज का उसमें (मंडी क्षेत्र में) विपणन करने के लिये ऐसी सुविधाओं का प्रबंध करना जैसा कि प्रबंधक संचालक समय-समय पर निर्देश दे; (ग) ऐसे अन्य कार्य करना, जो कि मंडी के अधीक्षण, संचालन तथा नियंत्रण के संबंध में या अधिसूचित कृषि-उपज का मंडी क्षेत्र में किसी स्थान पर विपणन करने का विनियमन करने के लिये तथा पूर्वोक्त विषयों से संबंधित प्रयोजनों के लिये आवश्यक हो और वह उस प्रयोजन के लिये ऐसी शक्तियों का प्रयोग तथा ऐसे कृत्यों का निर्वहन कर सकेगी जैसे कि इस अधिनियम द्वारा या उसके अधीन उपबंधित किया जाये। (2) पूर्वगामी उपबंधों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना मंडी समिति-- (एक) मंडी प्रांगणों तथा उपमंडी प्रांगणों का सन्निर्माण, अनुरक्षण तथा प्रबंधन करेगी और मंडी क्षेत्र में हाट बाजारों के विकास का प्रोन्नयन करेगी; (दो) मंडी प्रांगण में कृषि-उपज के विपणन के लिये आवश्यक सुविधाओं का प्रबंध करेगी; (तीन) मंडी कृत्यकारियों को अनुज्ञप्तियां मंजूर करेगी या मंजूर करने से इंकार करेगी और ऐसी अनुज्ञप्तियों को नवीकृत, निलंबित या रद्द करेगी; (चार) मंडी कृत्यकारियों के आचरण का पर्यवेक्षण करेगी; (पांच) मंडी-प्रांगणों में व्यापार आरंभ करने, बंद करने तथा निलंबित करने का विनियमन करेगी; (छह) अनुज्ञप्तियों की शर्तों को प्रवर्तित करेगी; (सात) अधिसूचित कृषि-उपज के विपणन से संबंधित विक्रयों का करार करने, उसके कार्यान्वयन तथा प्रवर्तन या रद्दकरण का, अधिसूचित कृषि-उपज के विपणन से संबंधित तौल, परिदान, भुगतान तथा समस्त अन्य विषयों का विनियमन करेगी; (आठ) ऐसे समस्त विवादों को, जो कि अधिसूचित कृषि-उपज के विपणन से संबंधित किसी भी प्रकार के संव्यवहार से विक्रेता तथा क्रेता के बीच उद्भूत हुये हों, तय करने के लिये तथा उससे अनुषक्त समस्त मामलों के लिये उपबंध करेगी; (नौ) अधिसूचित कृषि-उपज के उत्पादन, विक्रय, भंडारण, प्रसंस्करण, कीमतों तथा संचलन के संबंध में जानकारी संग्रहीत करेगी तथा उसे बनाये रखेगी और ऐसी जानकारी को प्रबंधक संचालक द्वारा निर्देशित किये गये अनुसार प्रसारित करेगी; (दस) माल में अपमिश्रण को रोकने के लिये तथा अधिसूचित कृषि-उपज के श्रेणीकरण तथा मानकीकरण के संप्रवर्तन के लिये समस्त संभव कार्यवाही करेगी; (ग्यारह) मंडी में स्थिरता बनाये रखने की दृष्टि से-- (क) यह सुनिश्चित करने के लिये यथोचित उपाय करेगी कि व्यापारी अपनी सामर्थ्य के परे, कृषि-उपज का क्रय न करे तथा उपज का व्ययन करने में विक्रेताओं को होने वाली जोखिम न रहे; और (ख) क्रेताओं की हैसियत के अनुसार नकद या बैंक गारंटी के रूप में आवश्यक प्रतिभूति अभिप्राप्त करने के पश्चात ही अनुज्ञप्तियां मंजूर करेगी; (बारह) फीस तथा अन्य शोध्य प्रभारों से संबंधित समस्त धन, जिसे प्राप्त करने के लिये मंडी समिति प्राधिकृत है, उद्ग्रहीत करेगी तथा वसूलेगी; (तेरह) (क) यह सुनिश्चित करेगी कि मंडी प्रांगण में या मूल मंडी में हुये संव्यवहारों के संबंध में भुगतान विक्रेता को उसी दिन किया जाये, और इसमें व्यतिक्रम होने पर प्रश्नगत कृषि-उपज को तथा संबंधित व्यक्ति की अन्य संपत्ति को अभिगृहीत करेगी तथा उसके पुनः विक्रय के लिये व्यवस्था करेगी और हानि होने की दशा में, उस हानि को तथा हानि, यदि कोई हो, की मूल क्रेता से वसूली करने संबंधी प्रभारों को मूल क्रेता से वसूली करेगी और कृषि उपज की कीमत का भुगतान विक्रेता को करायेगी; (ख) तुलाई तथा हम्माली से संबंधित प्रभारों को वसूलेगी और उन्हें तुलइयों तथा हम्मालों में वितरित करेगी; (चौदह) इस अधिनियम के तथा उसके अधीन बनाये गये नियमों एवं उपविधियों के उपबंधों के दक्षतापूर्ण कार्यान्वयन के लिये आवश्यक संख्या में अधिकारियों तथा सेवकों को नियोजित करेगी; (पंद्रह) मंडी प्रांगण में व्यक्तियों के प्रवेश तथा गाड़ियों के यातायात का विनियमन करेगी; (सोलह) इस अधिनियम के तथा उसके अधीन बनाये गये नियमों एवं उपविधियों के उपबंधों का अतिक्रमण करने के लिये, व्यक्तियों को अभियोजित करेगी और यदि आवश्यक हो तो ऐसे अपराधों का शमन करेगी; (सत्रह) अपने कर्तव्यों का दक्षतापूर्ण पालन करने के प्रयोजन से किसी भी जंगम या स्थावर संपत्ति को अर्जित करेगी, धारण करेगी तथा उसका व्ययन करेगी; (अठारह) कोई वाद, कार्य, कार्यवाही, आवेदन पत्र या माध्यस्थम संस्थापित करेगी या उसमें प्रतिरक्षा करेगी और ऐसे वाद, कार्य, कार्यवाही, आवेदन पत्र या माध्यस्थम में समझौता करेगी; (उन्नीस) मंडी-प्रांगण में किये गये संव्यवहारों के संबंध में माल के तोलने तथा उसके परिवहन के लिये तुलइयों तथा हम्मालों का बारी-बारी से नियोजन करने की व्यवस्था करेगी: परंतु इस खंड की कोई भी बात उन हम्मालों के नियोजित किये जाने के लिये लागू नहीं होगी जो कि व्यापारियों द्वारा मंडी प्रांगण से अपने गोदामों तक अपने माल के परिवहन के लिये नियोजित किये जायें। (3) प्रबंधक संचालक की पूर्व मंजूरी से, मंडी समिति, अपने विवेकानुसार निम्नलिखित कर्तव्यों का भार अपने ऊपर ले सकेगी: (एक) इस हेतु से कि कृषि उपज के परिवहन तथा भंडारण में सुविधा हो या इस प्रयोजन से कि मंडी प्रांगण का विकास हो, मंडी क्षेत्र में सड़कों या गोदामों के सन्निर्माण के लिये (बोर्ड या राज्य सरकार के लोक निर्माण विभाग या किसी अन्य विभाग या उपक्रम) को या प्रबंधक संचालक द्वारा प्राधिकृत किये गये किसी अन्य अभिकरण को अनुदान देना या अग्रिम निधि देना; (दो) विक्रय हेतु उर्वरक, नाशक-जीवहर (पेस्टिसाइट्स), कीटनाशक (इन्सेक्टिसाइट्स), उन्नत बीज, कृषि संबंधी उपस्करों और आधानों (इनपुट्स) का स्टॉक बनाये रखना; (तीन) कृषकों को, कृषि उपज का स्टॉक रखने के लिये भंडारण सुविधायें भाड़े पर देने की व्यवस्था करना; (चार) गौशाला या संस्थाओं के जो मध्यप्रदेश गौसेवा आयोग अधिनियम, 1995 (क्रमांक 18 सन् 1995) के अधीन पंजीकृत की गई हैं, अनुरक्षण के लिये अनुदान देना। (4) पूर्व में वर्णित कर्तव्यों के अतिरिक्त मंडी समिति निम्नलिखित के लिये भी उत्तरदायी रहेगी: (एक) अपने अधिकारियों द्वारा प्राप्त हुई प्राप्तियों तथा किये गये भुगतानों पर उचित अंकुश बनाये रखना; (दो) मंडी समिति की निधि पर भारित किया जा सकने वाले समस्त कार्यों का समुचित निष्पादन; (तीन) इस अधिनियम तथा उसके अधीन बनाये गये नियमों तथा जारी की गई अधिसूचनाओं की और अपनी उपविधियों की एक-एक प्रति निःशुल्क निरीक्षण के लिये अपने कार्यालय में रखना; और (चार) सांसर्गिक पशु रोग फैलने की रोकथाम के लिये निवारक उपायों की व्यवस्था करना। (5) मंडी समिति किसी ऐसे निर्देश को कार्यान्वित करेगी जिसे कि राज्य सरकार मंडी प्रांगण में युक्तियुक्त सुविधाओं का प्रबंध करने के लिये समय-समय पर जारी करे। (6) यदि मंडी समिति, उपधारा (5) के अधीन जारी किये गये किसी निर्देश का युक्तियुक्त समय के भीतर अनुपालन करने में चूक करे, तो राज्य सरकार को, मंडी समिति के खर्चे पर ऐसे निर्देश को प्रवर्तन करने के लिये आवश्यक समस्त शक्तियां प्राप्त होंगी। (7) यदि कोई समिति, किसी भी ऐसी राशि का, जिसकी कि रकम उपधारा (5) के अधीन जारी किये गये किन्हीं निर्देशों के आधार पर नियत की गई हो या देय हो भुगतान करने में व्यतिक्रम करे, तो राज्य सरकार, ऐसे व्यक्ति को, जिसके अभिरक्षा में मंडी समिति की निधि का अतिशेष हो, यह निर्देश देते हुये एक आदेश दे सकेगी कि वह ऐसी भुगतान या तो पूर्ण रूप से या ऐसे भाग में, जो ऐसी निधि में संभव हो, करे। (8) मंडी समिति ऐसी समस्त जानकारी देगी जिसकी कि कलेक्टर या संचालक या इनमें से किसी के भी द्वारा सम्यक रूप से प्राधिकृत अधिकारी को अपेक्षा हो।
18. Appointment of sub-committees and delegation of powers
ऐसी शर्तों तथा निबंधनों के अव्याधीन रहते हुये, जैसी कि विहित की जाये, मंडी समिति, अपने कर्तव्यों या कृत्य में से किसी भी कर्तव्य या कृत्य के पालन या किसी विषय पर रिपोर्ट देने या राय देने के लिये उप समितियां नियुक्त कर सकेगी जिसमें उसका एक या एक से अधिक सदस्य होंगे और उनमें से किसी भी ऐसी उप समिति को अपनी शक्तियों में से ऐसी शक्तियां प्रत्यायोजित कर सकेगी जैसी कि आवश्यक हो।

(1) प्रत्येक मंडी समिति-- (एक) अधिसूचित कृषि उपज, चाहे वह राज्य के भीतर से या राज्य के बाहर से किसी मंडी क्षेत्र में लाई गई हो, के विक्रय पर; और (दो) अधिसूचित कृषि उपज पर, चाहे वह राज्य के भीतर से या राज्य के बाहर से किसी मंडी क्षेत्र में लाई गई हो और प्रसंस्करण में उपयोग के लिये लाई गई हो, ऐसी दरों से, जो कि राज्य सरकार द्वारा समय-समय पर, कीमत के प्रत्येक एक सौ रुपये पर न्यूनतम पचास पैसे की दर के और अधिकतम दो रुपये की दर के अव्याधीन रहते हुये नियत की जाये, विहित रीति में मंडी फीस का उद्ग्रहण करेगी: परंतु उस मंडी समिति को छोड़कर, जिसके मंडी क्षेत्र में अधिसूचित कृषि उपज, यथास्थिति, किसी कृषक या व्यापारी द्वारा प्रथम बार विक्रय या प्रसंस्करण हेतु लाई गई हो, कोई मंडी समिति ऐसी मंडी फीस का उद्ग्रहण नहीं करेगी। (2) मंडी-फीस अधिसूचित कृषि उपज के क्रेता द्वारा संदेय होगी और विक्रेता को संदेय कीमत में से नहीं काटी जायेगी: (परंतु जहां किसी अधिसूचित कृषि उपज का क्रेता पहचाना न जा सके, वहां समस्त फीस उस व्यक्ति द्वारा संदेय होगी जिसने कि उपज को बेचा हो या जो उपज को मंडी क्षेत्र में विक्रय के लिये लाया हो; परंतु यह और कि मंडी क्षेत्र में व्यापारियों के बीच वाणिज्यिक संव्यवहार होने की दशा में मंडी फीस विक्रेता द्वारा संग्रहीत की जायेगी तथा संदत्त की जायेगी; परंतु यह और भी कि कृषि-उपज पर, जिसे राज्य सरकार, अधिसूचना द्वारा, इस संबंध में विनिर्दिष्ट करे, 31 मार्च 1990 तक कोई फीस उद्गृहीत नहीं की जायेगी यदि ऐसी उपज किसी कृषक द्वारा किसी ऐसी सहकारी सोसायटी को, जिसका कि वह सदस्य है, मंडी प्रांगण या उपमंडी प्रांगण के बाहर बेची गई हो; परंतु यह भी कि वाणिज्यिक संव्यवहार के लिये या प्रसंस्करण के लिये मंडी क्षेत्र में लाई गई कृषि-उपज पर मंडी फीस, यथास्थिति, क्रेता या प्रसंस्करणकर्ता द्वारा, उस दशा में मंडी समिति के कार्यालय में 14 दिन के भीतर जमा की जायेगी, यदि क्रेता या प्रसंस्करणकर्ता ने धारा 19 की उपधारा (6) के अधीन जारी किया गया अनुज्ञापत्र प्रस्तुत नहीं किया है)। (3) उपधारा (1) में विनिर्दिष्ट मंडी फीस किसी अधिसूचित कृषि उपज पर-- (एक) राज्य में से एक से अधिक मंडी क्षेत्र में; या (दो) उसी मंडी क्षेत्र में एक से अधिक बार; उस दशा में उद्गृहीत नहीं की जायेगी जब कि उसका पुनःविक्रय-- (क) ऊपर (एक) की दशा में, उस मंडी क्षेत्र से, जिसमें वह यथास्थिति किसी कृषक या व्यापारी द्वारा प्रथम बार विक्रय हेतु लाई गई थी या क्रय की गई थी या बेची गई थी और उस पर उस मंडी क्षेत्र में फीस लग चुकी है, भिन्न मंडी क्षेत्र में; या (ख) ऊपर (दो) की दशा में उस मंडी क्षेत्र में-- व्यापारियों के बीच वाणिज्यिक संव्यवहारों के अनुक्रम में या उपभोक्ताओं को किया जाता है, बशर्ते संबंधित व्यक्ति द्वारा ऐसे प्रारूप में, जो उपविधियों में विहित किया जाये, इस प्रभाव की सूचना दे दी गई हो कि इस प्रकार पुनः बेची जा रही उस अधिसूचित कृषि-उपज पर राज्य के अन्य मंडी क्षेत्र में फीस पहले ही लग चुकी है।

21. Determination of fee at best judgment
Determination of fee at best judgment. (1) Every trader, processor or commission agent who is engaged in the business of notified agricultural produce shall, before 30th April of every year, submit a statement of the purchase or sale made by him or through him during the previous financial year ending on 31st March, to the Secretary in the prescribed manner.
(2) Any person aggrieved by the action of the Secretary may appeal to the Market Committee within 30 days from the date of communication of the notice.
(3) Any officer authorized by the State Government or the Board may, either on his own motion or on an application made to the State Government, re-verify the statement verified by the Secretary within two years from the date of verification, and such officer shall exercise the powers under Section 20 for this purpose.
(4) If any person, who has been required to produce accounts or furnish information under sub-section (1) of Section 20, fails to produce such accounts or furnish information or knowingly gives incomplete or false accounts or information or has not kept proper accounts of sale, purchase and delivery of notified agricultural produce, then the Secretary shall assess the fee to be levied under Section 19 on such person in the prescribed manner.
(5) The re-verification or re-assessment made by the officer empowered by the State Government or the Board shall be final.
22. Power to remove encroachment from market yard
The Secretary shall, subject to such directions as the Market Committee may give in this behalf, have the power to remove any encroachment made in any open space of the market yard and the expenses of such removal shall be paid by the person who has caused the said encroachment and they shall be recovered in the same manner as any amount due to the Market Committee is recoverable under Section 61.
23. Power to stop vehicles
Power to stop vehicles. (1) At any time, when: (i) any officer or servant of the Board or any government officer or servant, who is authorized in this behalf by the Board or Collector in any market area; or (ii) any member of the 'State Mandi Board Service' in the concerned market area; or (iii) any officer or servant of the Market Committee, who is authorized in this behalf by the Market Committee in the concerned market area; makes such a request, the driver or any other person in charge of any vehicle, boat or other transport, as the case may be, shall stop such vehicle, boat or other transport and keep it standing for such time as may be reasonably necessary and shall allow such persons to examine the contents of such vehicle, boat or other transport and inspect all records related to the notified agricultural produce being carried, and shall furnish his name and address and the name and address of the owner of the said vehicle, boat or other transport and the name and address of the owner of the notified agricultural produce being carried in such vehicle, boat or other transport.
(2) The persons empowered under sub-section (1) shall have the power to seize any such notified agricultural produce, which has been brought into the market-area or taken out of the market-area in any vehicle, boat or other transport, or which is proposed to be taken out of the market-area, if such person has reason to believe that any fee or other amount due under this Act or the value payable to the seller in respect of such produce has not been paid.
(3) If any person empowered under sub-section (1) has reason to suspect that any person is trying to evade the payment of any market-fee due from him under Section 19 or that any person has purchased or stored any notified agricultural produce in violation of any of the provisions of this Act or the rules or bye-laws in force in the market-area, he may enter or search any such place of business, warehouse, office, establishment or godown about which the person who is empowered under sub-section (1) has reason to believe that such person keeps the stock of notified agricultural produce there or such person had kept the stock of notified agricultural produce at that time; and may seize the agricultural produce kept in the storage and the agricultural produce so seized may be confiscated in the favour of the Market Committee in such manner as may be prescribed for this purpose: Provided that before confiscation of agricultural produce, the concerned person shall be given a reasonable opportunity of being heard.
(4) The provisions of Section 100, 457, 458 and 459 of the Code of Criminal Procedure, 1973 (No. 2 of 1974) shall apply to the entry, search and seizure under sub-section (1), (2) and (3) in the same manner as they apply to the entry, search and seizure of property by a police officer. The report of such seizure shall be submitted immediately by the aforesaid person to the Magistrate having jurisdiction to try offences under this Act.
24. Power to borrow
Power to borrow. Any Market Committee may, with the prior approval of the Director of Management, borrow money required for carrying out the purposes of this Act from any other public financial institution and nothing contained in sub-section (2) of Section 38 shall apply to the money so borrowed.

26. Constitution of State Mandi Board Service
(1) For the purpose of managing the officers and employees for the Board and Market Committees, a service shall be constituted by the Board which shall be called the State Mandi Board Service. (2) The Board shall make regulations regarding the recruitment, qualification, appointment, promotion, pay scale, leave, leave salary, acting allowance, loan, pension, gratuity, annuity, compassionate fund, provident fund, dismissal, removal, conduct, departmental inquiry, punishment, appeal and other service conditions of the members of the State Mandi Board Service. (3) The required pay, allowances, gratuity and other payments to be given to the members of the State Mandi Board Service, who are working under the control of the Market Committee, shall be a charge on the Market Committee fund. (4) Such officers and employees, appointed or absorbed under any rules or regulations, who were members of the State Marketing Service, Board Service immediately before the constitution of the State Mandi Board Service under sub-section (1) and the nakadars (Assistant Sub-inspectors) of the Market Committee service, shall be deemed to be members of the State Mandi Board Service.
27. Secretary and other officers
(1) Every Market Committee shall have a Secretary and such other officers who shall be members of the State Mandi Board Service or who are such members of the services of the State Government or government-aided co-operative institutions or public sector undertakings, whose services have been obtained on deputation by the Board: Provided that an officer may be appointed for more than one Market Committee. (2) The Secretary shall be the Chief Executive Officer of the Market Committee and all officers and employees posted in the Market Committee shall be subordinate to him. (3) The Secretary shall be responsible to the Market Committee and shall be under the control of the Market Committee.
30. Appointment of staff
Appointment of staff. (1) Every Market Committee may appoint such other officers and servants as are necessary and proper for the efficient discharge of its duties: Provided that no post shall be created without the prior approval of the Managing Director. (2) The Market Committee may make by-laws to regulate the appointment, pay, leave, leave allowances, pension, gratuity, contribution to provident fund and other service conditions of the officers and servants appointed under sub-section (1) and to delegate powers, duties and functions to them. (3) Notwithstanding anything contained in this Act or the rules or by-laws made thereunder, the Managing Director, subject to the conditions specified in sub-section (4), may transfer on deputation to any other Market Committee within that revenue division any such officer or servant of a Market Committee whose maximum pay scale is more than Rs. 600 and it shall not be necessary for the Managing Director to consult the concerned Market Committee or the officer or servant before passing the order of transfer on deputation under this sub-section. (4) The concerned officer or servant transferred under sub-section (3) - (a) Shall retain his lien on the post held in the parent Market Committee; (b) Shall not be placed in a disadvantageous position regarding such pay or allowances to which he would be entitled in case he continued in the parent Market Committee; (c) Shall be entitled to receive deputation allowance at such rate as the Managing Director may specify by general or special order; and (d) Shall be governed by such other terms and conditions, including disciplinary control, as the Managing Director may specify by general or special order.
31. Regulation of persons operating in market area
Regulation of persons operating in market area. No person shall act as an arhatiya, trader, broker, weighman, hamal, surveyor, warehouseman, owner or occupier of a processing factory, or such other market functionary in a market area in relation to any notified agricultural produce except in accordance with the provisions of this Act and the rules and by-laws made thereunder.

(1) Every person specified in section 31, if he desires to act in more than one market area, shall make an application to such authority/officer notified by the State Government for the grant or renewal of the license in such manner and within such period and on such terms and conditions as may be prescribed in the rules. (2) The authority/officer notified by the State Government may grant or renew the license or may refuse to grant or renew the license for reasons to be recorded in writing.
33. Power to cancel or suspend licenses
Power to cancel or suspend licenses. (1) Subject to the provisions of sub-section (4), the Market Committee may, for reasons to be recorded in writing, suspend or cancel any licence: (a) if the licence has been obtained through wilful misrepresentation or fraud; or (b) if the holder of the licence or any servant or any person acting on his behalf with his express or implied permission commits a breach of any of the terms or conditions of the licence; or (c) if the holder of the licence in combination with other licence holders commits any act or remains dormant in his normal business in the market area with the intention of wilfully obstructing, suspending or stopping the marketing of notified agricultural produce in the market yard/yards and as a result whereof the marketing of any produce has been obstructed or suspended; (d) if the holder of the licence has become insolvent; (e) if the holder of the licence incurs any such disqualification, as may be prescribed; or (f) if the holder of the licence is convicted of an offence under this Act. (2) Subject to the provisions of sub-section (4), the Chairman may, for any such reason for which a Market Committee can suspend a licence under sub-section (1), suspend a licence for a period not exceeding one month, for reasons to be recorded in writing: Provided that such order shall not remain effective on the expiry of a period of 10 days from the date of its making, if before such expiry the said order is not confirmed by the Market Committee. (3) Notwithstanding anything contained in sub-section (1), but subject to the provisions of sub-section (4), the Managing Director may, for reasons to be recorded in writing, by order, suspend or cancel any licence which has been granted or renewed by the Market Committee: Provided that no order under this sub-section shall be made without giving notice to the Market Committee. (4) No licence under this section shall be suspended or cancelled until the holder thereof has been given a reasonable opportunity to show cause against such suspension or cancellation.
34. Appeal
(1) Any person aggrieved by an order of the Chairman, Market Committee or Managing Director, as the case may be, passed under section 32 or section 33, may prefer an appeal: (a) where such order is passed by the Chairman, to the Market Committee; (b) where such order is passed by the Market Committee, to the Managing Director; and (c) where such order is passed by the Managing Director, to the State Government. (2) Appeals under sub-section (1) shall be made: (1) where such appeal is against the order of the Chairman, within seven days from the date of receipt of the order; and (2) where such appeal is against the order of the Market Committee or the Managing Director, within thirty days from the date of receipt of the order, in such manner as may be prescribed. (3) The appellate authority may, if it deems necessary so to do, stay the order against which the appeal has been preferred for such period as it may deem fit. (4) The order passed by the Chairman, Market Committee and Managing Director shall, subject to the order passed in appeal under this section, be final and shall not be questioned in any court of law.
36. Sale of notified agricultural produce in markets
(1) All notified agricultural produce brought for sale in the principal market yard shall, subject to the provisions of sub-section (2), be sold in the market yard/yards or such other place specified for such produce in the bye-laws: Provided that agricultural produce produced under contract farming shall not be required to be brought into the market yard and shall be sold to any person at any other place who has agreed to purchase it under an agreement. (2) Such notified agricultural produce as may be purchased by licensed traders in the course of commercial transaction from outside the market area may be brought and sold anywhere in the market area as per the provisions of the bye-laws. (3) The price of notified agricultural produce brought for sale in the market yard shall be decided by tender system or open auction method and no deduction shall be made from the price decided for any reason: Provided that the price of such agricultural produce in the market yard for which support price has been declared by the State Government shall not be determined less than the price so declared and no bid shall be allowed to start below the price so fixed. (4) All notified agricultural produce purchased as such shall be weighed or measured by such person and by such process as may be provided in the bye-laws or shall be weighed or measured at any other place specified by the Market Committee for this purpose: Provided that in case of banana, papaya or any other perishable agricultural produce, as the State Government may by notification specify, it shall be weighed, measured or counted, as the case may be, by any licensed weighman at the place where such produce is grown.
37. Terms of purchase and sale
Terms of purchase and sale. (1) Any person who purchases notified agricultural produce in the market area shall execute an agreement in favour of the seller in triplicate in such form as may be prescribed. One copy of the agreement shall be kept by the buyer, one copy shall be given to the seller and the remaining copy shall be kept in the records of the Market Committee. (2) (a) The payment of the price of agricultural produce purchased in the market yard shall be made to the seller on the same day in the market yard; (b) If the buyer does not make payment under clause (a), he shall be liable to make additional payment to the seller at the rate of one percent per day of the total price of the agricultural produce payable, within five days; (c) If the buyer does not make the additional payment along with the payment to the seller under the aforesaid clauses (a) and (b) within five days from the day of such purchase, his licence shall be deemed to have been cancelled on the sixth day and no licence under this Act shall be granted to him or his relative for a period of one year from the date of such cancellation. Explanation: For the purpose of this clause, "relative" means such relative as specified in the explanation of clause (d) of sub-section (1) of section 11. (3) No wholesale transaction of such produce shall be made directly with the producers of notified agricultural produce by the licensed traders except in the market yard or such other places as specified in the bye-laws. (4) An Arhatiya shall collect his commission from his employer trader only at such rates as specified in the bye-laws, which commission shall include such expenses as are incurred by him in respect of storage of produce and other services rendered by him. (5) Every Arhatiya shall be responsible: (a) to keep his employer's goods in safe custody without any charge other than the commission payable to him; and (b) to make payment of the price to his employer as soon as the goods are sold whether he has received the price from the buyer of such goods or not.
37-A. Regulation of marketing of notified agricultural produce under contract farming
(1) Contract farming shall be done under a written agreement between the producer and the buyer of agricultural produce of contract farming in such manner and in accordance with such process as may be prescribed in the bye-laws. The agreement to be executed for contract farming shall be in such form as containing such specifications, terms and conditions as may be prescribed by the bye-laws. Explanation: (1) For the purpose of this section, "producer and buyer" means such person who produces and purchases agricultural produce respectively under a written agreement of contract farming. (2) The buyer shall submit an application to the Market Committee for registration of the written agreement of contract farming. The Market Committee shall register it in such manner and on such terms and conditions as may be prescribed by the bye-laws. (3) If any dispute arises between the parties in respect of the provisions of the agreement, any party may submit an application to the Chairman of the Market Committee for arbitration on the disputes. The Chairman of the Market Committee shall resolve the dispute after giving the parties a reasonable opportunity of being heard. (4) A party aggrieved by the decision of the Chairman of the Market Committee under sub-section (3) may prefer an appeal to the Managing Director or an officer authorised by him in this behalf within thirty days from the date of the decision. The Managing Director or the officer authorised by him shall dispose of the appeal after giving a reasonable opportunity of being heard to the parties and the decision of the Managing Director or the officer authorised by him shall be final. (5) Agricultural produce produced under contract farming shall be sold to the buyer outside the market yard as may be prescribed by the bye-laws. Market fee shall be payable by the buyer of agricultural produce at the rates prescribed under section 19 in such manner as may be prescribed by the bye-laws.
38. Mandi Committee Fund
(1) All money received by the Market Committee shall be paid into a fund to be called "Market Committee Fund" and all expenses incurred by the Market Committee under or for the purposes of this Act shall be defrayed out of the said fund. Any surplus remaining with the Market Committee after meeting such expenses shall be disposed of in such manner as may be prescribed: Provided that all such sums as may be received by the Market Committee as security deposits, contributions towards provident fund or for payment in respect of any notified agricultural produce or for charges payable to weighmen, hammals and other functionaries shall not form part of the Market Committee Fund but shall be accounted for separately. (2) All money of the Market Committee Fund and other sums specified in sub-section (1) shall be deposited in a co-operative bank or if no such bank exists at the headquarters of the Market Committee, then in the Post Office Savings Bank or in such bank as may be specified as a new bank in the First Schedule to the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (No. 5 of 1970) for the time being.
39. Application of Mandi Committee Fund
Application of Market Committee Fund. Subject to the provisions of Section 38, the Mandi Samiti Fund shall be expended only for the following purposes, namely: (1) Acquisition of place or places for Mandi premises; (2) Maintenance and improvement of Mandi premises; (3) Construction and repair of buildings necessary for the purposes of the Mandi and for the convenience or safety of persons using the Mandi premises; (4) Maintaining standard weights and measures; (5) Meeting establishment charges including payment and contributions to the provident fund, pension and gratuity accounts of officers and servants employed by the Mandi Samiti; (6) Payment of interest on loans taken for the purposes of the Mandi and provision of a sinking fund in respect of such loans; (7) Collection and dissemination of crop statistics and information on marketing of agricultural produce; (8) (a) Expenses incurred in auditing the accounts of the Mandi Samiti; (b) Honorarium to the Chairman, travelling allowance of the Chairman, Vice-Chairman and other members of the Mandi Samiti and payment of meeting fee to members for attending the meetings; (c) Contribution to the State Marketing Development Fund; (d) Meeting expenses for implementing the order of the State Government and for any other work entrusted to the Mandi Samiti under any other Act; (e) Contribution towards any scheme for promotion of agricultural production and scientific storage; (p) For development of Mandi area in the prescribed manner; (n) With the prior permission of the Managing Director, undertaking the work of educating people for the promotion of production or for its promotion and undertaking the work of sale of agricultural inputs; (nn) Undertaking the work of development of cattle markets for marketing of agricultural produce; (t) Payment of expenses on elections under this Act; (9) Subject to the prior approval of the State Government, any other purpose which the expenditure from the Mandi Samiti fund is in the public interest.
40. Madhya Pradesh State Agricultural Marketing Board
(1) From such date as the State Government may, by notification, appoint in this behalf, there shall be established a Board for the State of Madhya Pradesh to be called the Madhya Pradesh State Agricultural Marketing Board. (2) The Board shall be a body corporate, shall have perpetual succession and a common seal, and shall may sue and be sued in its corporate name and shall be competent to acquire and hold property, to lease, sell or otherwise transfer any property and to contract and to perform all other matters necessary for the purposes of this Act.
40-A. Power of State Government to give directions
(1) The State Government may issue directions to the Board and the Mandi Samitis. (2) The Board and the Mandi Samitis shall be bound to comply with the directions issued by the State Government under sub-section (1).
41. Constitution of the Board
Constitution of Board. (1) The State Government shall constitute the Board consisting of a Chairman and the following members, namely: A-Ex-officio members: (a) Minister in charge of Agriculture Department, Madhya Pradesh; (b) Secretary/Special Secretary, Government of Madhya Pradesh, Agriculture Department; (c) Registrar, Cooperative Societies, Madhya Pradesh; (d) Director of Agriculture, Madhya Pradesh; (e) The Managing Director appointed under clause (p) of sub-section (1) of Section 2; B-Members nominated by the State Government: (f) Two members of the Madhya Pradesh Legislative Assembly, nominated in consultation with the Speaker of the Assembly; (g) Ten Chairmen of Mandi Samitis, with not more than one from any single Revenue Commissioner division; (h) Two representatives of traders holding licenses in any Mandi Samiti within the State; (i) The Chairman or Managing Director of the M.P. State Cooperative Marketing Federation and M.P. State Commodity Trading Corporation; (j) Two experts in the field of marketing of agricultural produce. (2) The Minister in charge of Agriculture Department, Madhya Pradesh, shall be the Chairman of the Board and the Vice-Chairman of the Board shall be nominated by the State Government from among the members other than the ex-officio members referred to in sub-section (1). (3) If a casual vacancy occurs in the office of the Chairman, the State Government shall make interim arrangements for it.
42. Term of office of Vice-Chairman and members
(1) Save as otherwise provided by or under this Act, the Vice-Chairman or any member other than an ex-officio member of the Board shall hold office for a period of three years from the date of his nomination: Provided that the Vice-Chairman or any member shall continue to hold office on expiration of his term until his successor takes office. (2) The term of office of a member of the Board shall expire immediately upon his ceasing to hold the office by virtue of which he was nominated. (3) If the State Government thinks fit, it may remove any member of the Board before the expiry of his term, but before doing so, it shall give him a reasonable opportunity to show cause against his removal.
42-A. Resignation by Vice-Chairman or member
(1) Any person holding the office of Vice-Chairman or member may at any time resign by addressing the Secretary, Government of Madhya Pradesh, Agriculture Department, in writing, and his office shall become vacant on the expiry of fifteen full days from the date of such resignation, provided he has not withdrawn the resignation in writing within that fifteen-day period. (2) In the event of death, resignation, disqualification or removal of the Vice-Chairman or any member of the Board before the expiry of his term, it shall be deemed a casual vacancy and such vacancy shall be filled as soon as possible by nomination by the State Government. The person so nominated shall hold office for the remaining term of his predecessor.
42-B. Allowances to members of the Board
Members other than ex-officio members of the Board shall be paid such meeting fees and allowances out of the Madhya Pradesh State Marketing Development Fund for attending its (Board's) meetings or performing any other work, as may be fixed by the State Government from time to time.
42-C. Disqualification of member of the Board
No person shall be a member of the Board who: (a) Is or has been an adjudged insolvent; (b) Is or has been convicted of an offense which, in the opinion of the State Government, involves moral turpitude; (c) Is of unsound mind and has been declared so by a competent court; (d) Is a director, secretary, manager or other salaried officer or employee of any company or firm which has a contract with the Board or any Mandi Samiti; (e) Is found guilty under Section 58 or has been found guilty at any time; (f) Has, in the opinion of the State Government, so abused his position as a member that his continuance in the Board is detrimental to the public interest.
42-D. Appointment of Managing Director and other officers and employees of the Board
(1) The Board shall have a Managing Director who shall be appointed by the State Government. (2) The Managing Director appointed under sub-section (1) shall also perform the duties as ex-officio Secretary of the Board. (3) The Board may appoint such other officers and employees as may be necessary for the efficient discharge of its duties and functions under this Act. (4) The superintendence and control over all officers and employees of the Board shall vest in the Managing Director.
42-E. Appointment of Sub-Committees
The Board may appoint sub-committees for the performance of any of its duties or functions or for giving advice on auxiliary matters, consisting of three or more members including the Chairman or Vice-Chairman and the Managing Director, and may delegate to any such sub-committee any of its duties or functions that it deems necessary.
43. State Marketing Development Fund
(1) Every Mandi Samiti shall pay to the Board by the 10th of every month such percentage of its gross receipts, including license fees and Mandi fees, as the State Government may notify from time to time by notification; the amount so paid and collected shall be called the "Madhya Pradesh State Marketing Development Fund". (2) All expenses incurred by the Board according to the budget approved by it shall be paid out of the said fund. (3) The annual accounts and balance sheet of the Board shall be prepared by the Managing Director, and all money received by it or from any source, as well as all amounts disbursed or paid, shall be recorded in the accounts. (4) The audit of the Board's accounts shall be done by the Director, Local Fund Audit, Madhya Pradesh. (5) The Managing Director shall present all accounts, registers, documents and such other relevant papers that may be demanded by the Audit Officer for the purposes of audit. Necessary clarifications demanded by such officer to resolve any discrepancy shall be given immediately. (6) Once the accounts are audited, they shall be printed; copies of the accounts and the audit report, along with the comments thereon, shall be placed before the Board. The audit report, along with the comments of the Board, shall be sent to the State Government. (7) All money received in the Madhya Pradesh State Marketing Development Fund shall be kept in a cooperative bank or, if no such bank exists at the Board's headquarters, in a post office savings bank or in such bank as may be allowed under the banking company (Acquisition and Transfer of Undertakings) Act.

(1) The Managing Director may— (a) inspect or cause to be inspected the accounts and offices of a Mandi Committee; (b) hold an enquiry into the affairs of a Mandi Committee; (c) call for such returns, statements, accounts or reports as he may think fit to require from a Mandi Committee; (d) require a Mandi Committee to— (i) consider any objection which appears to exists to the doing of anything which is about to be done or is being done by or on behalf of such committee on the ground of illegality, impropriety or irregularity; (ii) consider any information which he (Managing Director) may suggest and which appears to him (Managing Director) should be done by such committee; (e) give directions that any matter which is being done or is to be done should not be done pending consideration of the objection, and any matter which should be done but is not being done, should be done within such time as he may direct. (2) When the affairs of a Mandi Committee are investigated under this section or proceedings of a Mandi Committee are examined by the State Government under section 59, the Chairman, Vice-Chairman, Secretary and all other officers and servants and members of such committee shall furnish such information in their possession in regard to the affairs or proceedings of the Mandi Committee as the State Government, Managing Director or authorized officer may require. (3) Any officer who is investigating the affairs of a Mandi Committee under sub-section (1), or the State Government which is examining the proceedings of a Mandi Committee under section 59, shall have the power to summon and enforce the attendance of the officers or members of the Mandi Committee and to compel them to give evidence and produce documents, in the same manner and as far as possible in the same way as is provided by the Code of Civil Procedure, 1908 (No. 5 of 1908) in the case of a Civil Court. (4) Where the Managing Director has reason to believe that the books and records of a Mandi Committee are likely to be tampered with or destroyed or that the funds or property of a Mandi Committee are likely to be misappropriated or misapplied, the Managing Director may issue an order directing any person duly authorized by him in writing to take over and obtain possession of such books, records, funds and property of the Mandi Committee, and such officer or officers of the Mandi Committee who are responsible for the custody of such books, records, funds and property shall deliver them to such authorized person.
55. Removal of member, Chairman and Vice-Chairman of Mandi Committee
Removal of member, Chairman and Vice-Chairman of Market Committee. (1) The Managing Director may, on his own motion or on a resolution passed by a two-thirds majority of the members constituting the Mandi Committee, remove any member of the Mandi Committee for misconduct or for neglect of or incapacity to perform his duty, and upon such removal, he shall not be eligible for re-election or re-nomination as a member of the Mandi Committee for a period of six years from the date of such removal: Provided that no order of such removal shall be passed unless such member has been given a reasonable opportunity of showing cause why such order should not be passed. (2) The Managing Director may remove any Chairman or Vice-Chairman of a Mandi Committee from his office for misconduct or for neglect of or incapacity to perform his duty or for being persistently remiss in the discharge of his duties, and upon such removal, such Chairman or Vice-Chairman, as the case may be, shall not be eligible for re-election as Chairman or Vice-Chairman during the remainder of his term of office as a member of the Mandi Committee: Provided that no order of removal shall be passed unless the Chairman or Vice-Chairman, as the case may be, has been given a reasonable opportunity of showing cause why such order should not be passed. (3) The State Government may suspend any such member or Chairman or Vice-Chairman of a Mandi Committee on whom notice under sub-section (1) or sub-section (2) has been served, as the case may be, and against whom complaints have been received or who commits irregularities after the service of such notice, for such period as it deems fit until final decision of his case, from the date of receipt of the complaint or the date of the irregularities coming to the knowledge of the Managing Director.
56. Supersession of Market Committee
Supersession of Market Committee. (1) If, in the opinion of the Managing Director, a Mandi Committee is not competent to perform the duties imposed on it by or under this Act, or persistently makes defaults in the performance of such duties, or abuses its powers, the Managing Director may, by order in writing, supersede such committee for a period not exceeding one year, and after the expiry of the first six months of the period of supersession, proceedings shall be initiated for conducting the election for the constitution of the Mandi Committee, and the period of supersession shall be deemed to have expired on the date of the first general meeting of the Mandi Committee so constituted: Provided that before passing the order of supersession under this sub-section, the Managing Director shall give the Mandi Committee a reasonable opportunity of showing cause against the proposal and shall consider the explanations and objections, if any, of the Mandi Committee: Provided further that where a new Mandi Committee cannot be constituted within one year of its supersession, the State Government may, in special circumstances, extend the period of supersession which shall in no case exceed the period of the Mandi Committee specified in section 13(2). (2) Upon the passing of the order superseding a Mandi Committee under sub-section (1), the following consequences shall ensue, namely: (a) all the members as well as the Chairman and Vice-Chairman of the Mandi Committee shall, from the date of the passing of such order, be deemed to have vacated their respective offices; (b) all assets vested in the Mandi Committee shall, subject to all its liabilities, vest in the State Government. (3) Where a Mandi Committee has been superseded, the Managing Director may, by order, appoint any person to execute the functions of the Mandi Committee and to exercise its powers, who shall be known as the Officer-in-charge, and the Managing Director may transfer all such assets and liabilities of the superseded Mandi Committee, as they exist on the date of such transfer, to the Officer-in-charge: Provided that in the event of death, resignation, leave or suspension of the Officer-in-charge, it shall be deemed that a casual vacancy has occurred in such office, and such vacancy shall be filled by the Managing Director as soon as possible by appointing any person to that office, and until such appointment is made, the person nominated by the Collector shall act as the Officer-in-charge. (4) Any Officer-in-charge appointed under sub-section (3) may be removed at any time by the Managing Director, who shall have the power to appoint any other person in his place. (5) Any person appointed as an Officer-in-charge under sub-section (3) shall receive such salary and allowances for his services, as may be fixed by the Managing Director, from the Mandi Committee fund. (6) At any time before the expiry of the period of supersession, the State Government may reconstitute a new committee under section 11 and may transfer such assets and liabilities of the superseded committee as they exist on the date of such transfer to it. (7) From the date fixed for the first general meeting of the reconstituted Mandi Committee, the Officer-in-charge shall cease to hold his office.

(1) Where a Mandi Committee is dissolved under the proviso to sub-section (2) of section 13, the following consequences shall ensue, namely: (a) all the members of the Mandi Committee and its Chairman and Vice-Chairman shall be deemed to have vacated their respective offices from the date of such dissolution of the Mandi Committee under the said sub-section; (b) all the powers of the Mandi Committee under this Act shall be exercised and all its duties shall be performed by such person as the Managing Director may, by order, appoint in this behalf, subject to the control of the Managing Director, and he shall be known as the Officer-in-charge: Provided that in the event of death, resignation, leave or suspension of the Officer-in-charge, it shall be deemed that a casual vacancy has occurred in such office, and such vacancy shall be filled by the Managing Director as soon as possible by appointing any person to that office, and until such appointment is made, the person nominated by the Collector shall act as the Officer-in-charge; (c) all property vested in the Mandi Committee shall vest in trust in the Officer-in-charge for the purposes of this Act. (2) Any Officer-in-charge appointed under sub-section (1) may be removed at any time by the Managing Director, who shall have the power to appoint any other person in his place. (3) Any person appointed as an Officer-in-charge under sub-section (1) shall receive such salary and allowances for his services, as may be fixed by the Managing Director, from the Mandi Committee fund. (4) From the date fixed for the first general meeting of the reconstituted Mandi Committee, the Officer-in-charge shall cease to hold his office.
58. Liability of Chairman, Vice-Chairman, members and employees for loss, waste or misappropriation, etc.
Liability of Chairman, Vice-Chairman, members and employees for loss, waste or misappropriation, etc. (1) If in the course of an inquiry under section 54 or an inspection made or in the course of an audit made under this Act, it is found that any person who has been entrusted with the management of any Mandi Committee or has been so entrusted or any deceased, former or present Chairman, Vice-Chairman, member, Officer-in-charge, Secretary of the Mandi Committee or any other officer or employee thereof or any officer of the State Government has made or authorised, by giving consent to or participating in any affirmative vote or proceeding relating thereto, any payment or application of any money or other property belonging to such committee or under its control, for any purpose, which is contrary to the provisions of this Act or the rules or byelaws made thereunder, or by gross negligence or misconduct has caused any deficiency or loss, or has misappropriated or fraudulently retained any money or other property of the Mandi Committee, the Managing Director may, of his own motion or on an application received from the Mandi Committee, inquire into the conduct of such person within two years from the date on which report of the audit, inquiry or inspection, as the case may be, was made, or may direct any of his subordinate officers duly authorised by him in this behalf by an order in writing to conduct such inquiry.
(2) If, after an inquiry under sub-section (1), the Managing Director is satisfied that there are good grounds for passing an order under this sub-section, he may, by order, require such person or in case of a deceased person, his legal representative to whom his estate has been inherited, to repay or restore the money or the property or any part thereof with interest at such rate or to pay contribution and costs or compensation to such extent as the Managing Director may consider just and equitable:
Provided that no order under this sub-section shall be made unless the person concerned has been given a reasonable opportunity of being heard in the matter:
Provided further that the liability of the legal representative of the deceased shall be limited to the extent of the property of the deceased inherited by such legal representative.
(3) Any person aggrieved by an order passed under sub-section (2) may, within thirty days from the date on which the order was communicated to him, prefer an appeal to the State Government and subject to the order of the State Government, the order of the Managing Director shall be final and conclusive:
Provided that in computing the period of limitation, the time required for obtaining a copy of the order against which appeal is directed shall be excluded.
(4) No order passed under sub-section (2) or sub-section (3) shall be questioned in any court of law.
(5) Any order passed under sub-section (2) or sub-section (3) shall be enforced by any civil court having local jurisdiction on an application of the Managing Director in the same manner as if it were a decree of such court; or any such sum, directed to be paid by such order, shall be recoverable as arrears of land revenue.
(6) If, on the basis of an affidavit, upon inquiry or otherwise, the Managing Director is satisfied that any person, with the intent to delay or obstruct the enforcement of any order that may be passed against him under this section:-
(a) is about to dispose of his whole property or any part thereof; or
(b) is about to remove his whole property or any part thereof from the State, then the Managing Director may, unless adequate security is furnished, direct that the said property or any part thereof as he deems necessary, be attached conditionally and such attachment shall have the same effect as if it had been made by a competent civil court.
75. Effect of division
Effect of splitting. (1) Upon the issuance of a notification under section 71 bifurcating any Mandi area into two or more Mandi areas, the following consequences shall ensue, namely: (ka) all such rules, byelaws and orders which were in force in the area of the original Mandi Committee immediately before the bifurcation of the Mandi area of such Mandi Committee under section 71 shall remain in force in the areas included in the new Mandi Committees until they are varied, amended or repealed in accordance with the provisions of this Act; (kha) all such powers and duties which are to be exercised or performed by various authorities under this Act shall, until the Mandi Committee for each of the new Mandi areas is constituted, be exercised and performed by the Collector or such other officer as the State Government may direct by notification; (ga) all property vested in the original Mandi Committee shall, subject to any orders of the State Government, be held and disposed of by the Collector or such other officer for the purposes of the areas of the newly constituted Mandi Committee; and (gha) until the Mandi Committees are constituted, the Collector or such other officer shall be deemed to be the representative of the original Mandi Committee for the purposes of filing suits by the original Mandi Committee or filing suits against it, or for continuing such pending suits or proceedings which were filed by or against the said original Mandi Committee. (2) On the day the Mandi Committees are constituted in the new Mandi areas, the Collector shall entrust the administration to the Mandi Committee of each such Mandi area in relation to the area under its jurisdiction.
76. Apportionment of assets and liabilities of divided Mandi Committee
Apportionment of assets and liabilities of split market committee. (1) The assets and liabilities of a Mandi Committee of an original Mandi area shall be apportioned among the various Mandi Committees of the newly constituted Mandi areas in accordance with the provisions of this Act. (2) Such officer not below the rank of Deputy Collector, as the State Government may appoint by order in this behalf, shall submit a report to the Collector in respect of the following matters, namely: (ka) assets and liabilities of the Mandi Committee of the original Mandi area; (kha) apportionment of assets and liabilities among the Mandi Committees of the new Mandi areas; (ga) the manner in which the existing officers, servants and other permanent employees of the Mandi Committee of the original Mandi areas should be absorbed by the Mandi Committees of the new Mandi areas; (gha) generally in respect of all matters incidental or supplemental to the constitution of the Mandi Committees of the new Mandi areas. (3) The report referred to in sub-section (2) shall be sent to the State Government which shall publish it in such manner as may be prescribed. (4) Any person interested may submit a written representation to the State Government against the proposals made in the report within one month from the date of its publication. (5) Upon the expiry of the period specified in sub-section (4), the State Government may consider the report of the officer appointed under sub-section (2) and the representations received, if any, and pass such orders in relation thereto as it deems fit. (6) The orders of the State Government given on all such matters shall be final and shall not be questioned in any court of law.
77. Suits by or against the new Mandi Committee
(1) In relation to matters which fall under the decision of the State Government under section 76, the Mandi Committees of the new Mandi areas shall, separately, be deemed to be representatives of the original Mandi Committee for the purposes of filing suits by the Mandi Committee of the original Mandi area and for filing suits against it or for continuing such pending suits or proceedings which were filed by or against the said Mandi Committee. (2) In relation to matters which do not fall under the decision of the State Government under the provisions of section 76, the Mandi Committees of the new Mandi areas shall, jointly, be deemed to be representatives of the original Mandi Committee for the purposes of filing suits by the Mandi Committee of the original Mandi area and for filing suits against it or for continuing such pending suits or proceedings which were filed by or against the said Mandi Committee. (3) If any dispute arises between the Mandi Committees of the new Mandi areas regarding their respective liabilities or claims under any decree or order, the matter shall be referred to the State Government, whose decision shall be final. (32) All matters which are required to be prescribed by the rules under this Act. (32-A) The manner of service of notice under this Act. (33) Generally for the guidance of the Mandi Committee. (33-A) Any manner in which the immovable property of the Mandi Committee or Board shall be transferred. (3) In making any rule, the State Government may direct that a breach thereof shall be punishable with a fine which may extend to two hundred rupees. (4) Every rule made under this Act shall be laid on the table of the Legislative Assembly.
78. Savings regarding existing employees of amalgamated or divided Mandi Committee or Committees
Saving in relation to existing employees of amalgamated or split market committee or committees. Where a new Mandi Committee is formed by the amalgamation of two or more Mandi Committees under section 71 or where an existing Mandi Committee is bifurcated and two or more new Mandi Committees are formed under section 71, the salary and allowances, pension and retirement benefits, if any, of all permanent officers and servants or other employees of the amalgamated or bifurcated Mandi Committee or Committees, shall be the same salary and allowances, pension and retirement benefits as were in force immediately before the date of amalgamation or bifurcation, as the case may be.
79. Power to make rules
(1) The State Government may, after previous publication, make rules to carry out the purposes of this Act. (2) In particular and without prejudice to the generality of the foregoing powers, such rules may provide for the following: (i) [Deleted]; (i-a) other modes of publication of notification under section 3(1); (ii) (ka) qualifications which shall be under section 11(1)(kha) for the representatives of farmers; (kha) qualifications which shall be under section 11(1)(ga) for the representatives of traders; (ga) the authority that shall conduct the elections under section 11(3), determination of constituencies, preparation and maintenance of voter list, disqualifications for being elected as a member or being a member, right to vote, payment and forfeiture of deposit, election offences, determination of election-related disputes and all matters incidental thereto; (iii) powers to be exercised and duties to be performed by the Mandi Committee and its Chairman and Vice-Chairman; (iv) election of the Chairman and Vice-Chairman of the Mandi Committee; (iv-a) procedure for meetings of the Mandi Committee under section 15 and quorum; (iv-b) [Deleted]; (v) management of the Mandi, procedure for recovery of Mandi fee, fine for evasion of Mandi fee and manner of determination of Mandi fee in case of default in submitting returns; (vi) classification of Mandi functionaries for grant of licenses, regulation of licenses under this Act, persons who are required to take licenses, forms in which and the terms and conditions subject to which such licenses shall be issued or renewed; (vii) provision for persons by whom and the form in which copies of documents and entries in the books of the Mandi Committee may be certified and the charges to be levied for the supply of such copies; (viii) types and specifications of weights and measures and weighing and measuring instruments to be used in the Mandi yard in transactions of notified agricultural produce; (ix) periodic inspection of all weights and measures and weighing and measuring instruments being used in the Mandi yard; (x) trade allowances that may be given or received by any person in any transaction of notified agricultural produce in the Mandi yard; (xi) facilities for settlement by arbitration, conciliation or otherwise of any dispute between any buyer and seller of notified agricultural produce or their agents, including disputes relating to quality or weight of goods, payment for goods sold and deductions made for containers, bags, dirt or impurities or deductions made for any other reason; (xii) provision for space for storage of any agricultural produce brought to the Mandi; (xiii) preparation of designs and estimates for construction works proposed to be built partly or fully at the expense of the Mandi Committee and grant of approval for such designs and estimates; (xiv) the form in which the accounts of the Mandi Committee shall be maintained, audit and publication of such audit and inspection of audit memos of accounts and supply of such memos; (xv) preparation of annual budget and submission of the same for approval and reports and returns to be given by the Mandi Committee; (xvi) time during which and the manner in which any trader or broker or commission agent shall give such returns to the Mandi Committee as may be required by it; (xvii) regulation of advances made by brokers or commission agents or traders to farmers, if any; (xviii) grading and standardization of agricultural produce; (xix) recording of arrival of agricultural produce and its average prices; (xx) manner in which auction of agricultural produce shall be conducted in the Mandi and bids shall be made and accepted; (xxi) recovery of fee leviable by or under this Act and its expenditure; (xxii) compounding of offences under this Act or rules or byelaws made thereunder and fixing of compensation for the same; (xxiii) [Deleted]; (xxiv) [Deleted]; (xxv) limit of expenditure that may be incurred on welcoming special guests; (xxvi) limits of honorarium of the Chairman, traveling allowances of members or meeting fees payable to members for attending meetings; (xxvii) manner of disposal of surplus in the Mandi Committee Fund and Madhya Pradesh State Marketing Development Fund; (xxviii) procedure for drafting, amending or repealing byelaws and for their prior and final publication; (xxix) classification of Mandi Committees on the basis of annual income for all or any of the purposes of this Act; (xxx) term of office of the Chairman, Vice-Chairman and members of the Board; (xxxi) powers to be exercised by the Chairman and Vice-Chairman of the Board.
80. Power to make bye-laws
(1) Subject to the provisions of this Act and the rules made thereunder, a Mandi Committee may, in respect of the Mandi area under its management, make bye-laws for the following: (i) Regulation of its business; (ii) Terms and conditions of trade in the Mandi; (iii) Delegation of powers, duties and functions to officers and servants, their appointment, pay, punishment, pension, gratuity, leave, leave allowance, subscription to any provident fund established for the benefit of such officers and servants and other conditions of service; (iv) Delegation of powers, duties and functions to any sub-committee, if any; (v) Such Mandi functionaries as may be required to take license; (vi) Any other matter for which bye-laws are to be made under this Act or in respect of which it may be necessary that bye-laws be framed for the effective implementation of the provisions of this Act and the rules made thereunder in the Mandi area. (2) No bye-law made under sub-section (1) shall be effective until it has been confirmed by the Managing Director. (3) In making any bye-law, the Mandi Committee may direct that a breach (thereof) shall be punishable with a fine which may extend to one hundred rupees, and where the breach is a continuing breach, it shall be punishable with such further fine which may extend to five hundred rupees for every such day after the first breach during which the breach is proved to continue.
81. Power of Managing Director to direct to make or amend bye-laws
Power of Managing Director to direct to make bye-laws or amend them. (1) If it appears to the Managing Director that it is necessary or desirable to make a bye-law or amend a bye-law in the interest of any Mandi or Mandi Committee, he may, by order, require the concerned Mandi Committee to make a bye-law or amend the bye-law within such time as may be specified in such order. (2) If the Mandi Committee fails to make such a bye-law or amend the bye-law within the specified time, then the Managing Director, after giving a reasonable opportunity of being heard to the Mandi Committee, may by order make such bye-law or amend the bye-law in such manner and thereafter, subject to any order under sub-section (3), such bye-law or such amendment of the bye-law shall be deemed to have been made or amended by the Mandi Committee in accordance with the provisions of this Act or rules made thereunder, and thereafter such bye-law or amendment shall be binding on the Mandi Committee. (3) An appeal against any order of the Managing Director under sub-section (2) shall lie to the State Government within thirty days from the date of such order and the order of the State Government on such appeal shall be final.

82. Repeal and Savings
(1) The Madhya Pradesh Agricultural Produce Markets Act, 1960 (No. 19 of 1960), the Madhya Pradesh Agricultural Produce Markets (Validation) Act, 1962 (No. 12 of 1962), the Madhya Pradesh Krishi Upaj Mandi Samiti (Election Postponement) Repeal Act, 1967 (No. 24 of 1967), the Madhya Pradesh Krishi Upaj Mandi (Amendment) Act, 1968 (No. 17 of 1968), the Madhya Pradesh Krishi Upaj Mandi (Amendment and Validation) Act, 1970 (No. 2 of 1970), the Madhya Pradesh Krishi Upaj Mandi (Amendment and Validation) Act, 1970 (No. 23 of 1970), the Madhya Pradesh Krishi Upaj Mandi (No. 22 of 1971) and the Madhya Pradesh Krishi Upaj Mandi (Amendment and Validation) (Amendment) Act, 1972 (No. 30 of 1972) are hereby repealed. (2) Notwithstanding such repeal: (i) All Mandi Committees constituted or appointed under the said Acts or any enactment repealed by them, the officer-in-charge appointed or committee-in-charge appointed, Mandis established, Mandi areas declared, agricultural produce notified, rules made or bye-laws made, notifications issued, fees levied, contracts made, licenses granted, suits instituted and proceedings taken or any other thing done or acts done, in so far as they are not inconsistent with the provisions of this Act, shall be deemed to have been, respectively, constituted, appointed, issued, levied, granted and instituted under this Act until they are superseded by any thing done or any act taken under this Act; (ii) Until the State Government directs otherwise, the Mandi Committees referred to in clause (1) and their President, Vice-President and members shall continue in their offices until the expiry of their term or tenure under the repealed Act or until the constitution of the Mandi Committee in accordance with the provisions of this Act, whichever is earlier. (3) Upon the issuance of a direction under clause (ii) of sub-section (2), the provisions of section 57 shall apply from such date as may be specified in the direction as if the Mandi Committee were dissolved on that date.
19&[k. Power to levy Mandi fee
(1) प्रत्येक मंडी समिति-- (एक) अधिसूचित कृषि उपज, चाहे वह राज्य के भीतर से या राज्य के बाहर से किसी मंडी क्षेत्र में लाई गई हो, के विक्रय पर; और (दो) अधिसूचित कृषि उपज पर, चाहे वह राज्य के भीतर से या राज्य के बाहर से किसी मंडी क्षेत्र में लाई गई हो और प्रसंस्करण में उपयोग के लिये लाई गई हो, ऐसी दरों से, जो कि राज्य सरकार द्वारा समय-समय पर, कीमत के प्रत्येक एक सौ रुपये पर न्यूनतम पचास पैसे की दर के और अधिकतम दो रुपये की दर के अव्याधीन रहते हुये नियत की जाये, विहित रीति में मंडी फीस का उद्ग्रहण करेगी: परंतु उस मंडी समिति को छोड़कर, जिसके मंडी क्षेत्र में अधिसूचित कृषि उपज, यथास्थिति, किसी कृषक या व्यापारी द्वारा प्रथम बार विक्रय या प्रसंस्करण हेतु लाई गई हो, कोई मंडी समिति ऐसी मंडी फीस का उद्ग्रहण नहीं करेगी। (2) मंडी-फीस अधिसूचित कृषि उपज के क्रेता द्वारा संदेय होगी और विक्रेता को संदेय कीमत में से नहीं काटी जायेगी: (परंतु जहां किसी अधिसूचित कृषि उपज का क्रेता पहचाना न जा सके, वहां समस्त फीस उस व्यक्ति द्वारा संदेय होगी जिसने कि उपज को बेचा हो या जो उपज को मंडी क्षेत्र में विक्रय के लिये लाया हो; परंतु यह और कि मंडी क्षेत्र में व्यापारियों के बीच वाणिज्यिक संव्यवहार होने की दशा में मंडी फीस विक्रेता द्वारा संग्रहीत की जायेगी तथा संदत्त की जायेगी; परंतु यह और भी कि कृषि-उपज पर, जिसे राज्य सरकार, अधिसूचना द्वारा, इस संबंध में विनिर्दिष्ट करे, 31 मार्च 1990 तक कोई फीस उद्गृहीत नहीं की जायेगी यदि ऐसी उपज किसी कृषक द्वारा किसी ऐसी सहकारी सोसायटी को, जिसका कि वह सदस्य है, मंडी प्रांगण या उपमंडी प्रांगण के बाहर बेची गई हो; परंतु यह भी कि वाणिज्यिक संव्यवहार के लिये या प्रसंस्करण के लिये मंडी क्षेत्र में लाई गई कृषि-उपज पर मंडी फीस, यथास्थिति, क्रेता या प्रसंस्करणकर्ता द्वारा, उस दशा में मंडी समिति के कार्यालय में 14 दिन के भीतर जमा की जायेगी, यदि क्रेता या प्रसंस्करणकर्ता ने धारा 19 की उपधारा (6) के अधीन जारी किया गया अनुज्ञापत्र प्रस्तुत नहीं किया है)। (3) उपधारा (1) में विनिर्दिष्ट मंडी फीस किसी अधिसूचित कृषि उपज पर-- (एक) राज्य में से एक से अधिक मंडी क्षेत्र में; या (दो) उसी मंडी क्षेत्र में एक से अधिक बार; उस दशा में उद्गृहीत नहीं की जायेगी जब कि उसका पुनःविक्रय-- (क) ऊपर (एक) की दशा में, उस मंडी क्षेत्र से, जिसमें वह यथास्थिति किसी कृषक या व्यापारी द्वारा प्रथम बार विक्रय हेतु लाई गई थी या क्रय की गई थी या बेची गई थी और उस पर उस मंडी क्षेत्र में फीस लग चुकी है, भिन्न मंडी क्षेत्र में; या (ख) ऊपर (दो) की दशा में उस मंडी क्षेत्र में-- व्यापारियों के बीच वाणिज्यिक संव्यवहारों के अनुक्रम में या उपभोक्ताओं को किया जाता है, बशर्ते संबंधित व्यक्ति द्वारा ऐसे प्रारूप में, जो उपविधियों में विहित किया जाये, इस प्रभाव की सूचना दे दी गई हो कि इस प्रकार पुनः बेची जा रही उस अधिसूचित कृषि-उपज पर राज्य के अन्य मंडी क्षेत्र में फीस पहले ही लग चुकी है।
40 (part). Regulation of wholesale transactions
(1) From such date as the State Government may, by notification, appoint in this behalf, there shall be established a Board for the State of Madhya Pradesh to be called the Madhya Pradesh State Agricultural Marketing Board. (2) The Board shall be a body corporate, shall have perpetual succession and a common seal, and shall may sue and be sued in its corporate name and shall be competent to acquire and hold property, to lease, sell or otherwise transfer any property and to contract and to perform all other matters necessary for the purposes of this Act.
57&d. Consequences of dissolution under section 13
(1) Where a Mandi Committee is dissolved under the proviso to sub-section (2) of section 13, the following consequences shall ensue, namely: (a) all the members of the Mandi Committee and its Chairman and Vice-Chairman shall be deemed to have vacated their respective offices from the date of such dissolution of the Mandi Committee under the said sub-section; (b) all the powers of the Mandi Committee under this Act shall be exercised and all its duties shall be performed by such person as the Managing Director may, by order, appoint in this behalf, subject to the control of the Managing Director, and he shall be known as the Officer-in-charge: Provided that in the event of death, resignation, leave or suspension of the Officer-in-charge, it shall be deemed that a casual vacancy has occurred in such office, and such vacancy shall be filled by the Managing Director as soon as possible by appointing any person to that office, and until such appointment is made, the person nominated by the Collector shall act as the Officer-in-charge; (c) all property vested in the Mandi Committee shall vest in trust in the Officer-in-charge for the purposes of this Act. (2) Any Officer-in-charge appointed under sub-section (1) may be removed at any time by the Managing Director, who shall have the power to appoint any other person in his place. (3) Any person appointed as an Officer-in-charge under sub-section (1) shall receive such salary and allowances for his services, as may be fixed by the Managing Director, from the Mandi Committee fund. (4) From the date fixed for the first general meeting of the reconstituted Mandi Committee, the Officer-in-charge shall cease to hold his office.
71 (continued). Effect of amalgamation
Procedure after notification under Section 70. (1) Any resident of the Mandi areas affected by the notification issued under sub-section (1) of section 70, if he has any objection regarding anything contained in such notification, may submit his written objections to the State Government within the period specified for this purpose in the said notification. (2) When the period specified in the said notification has expired, and when the State Government has considered the objections which were submitted to it within the said period and has passed orders, the State Government may, by notification— (a) include such area or any part thereof in a Mandi area or exclude it therefrom; or (b) constitute a new Mandi committee for the amalgamated Mandi areas; or (c) split up any existing Mandi area and constitute two or more Mandi committees for such areas; or (d) dis-establish the Mandi. (x) all such rules, byelaws, orders and notifications, which were in force in the areas of the Mandi Committees amalgamated under section 71 immediately preceding the date of amalgamation, shall, except the rules, byelaws, orders and notifications related to the subjects specified by the State Government by notification issued in this regard, stand repealed, and the rules, byelaws, orders and notifications related to the subjects specified therein shall remain in force throughout the area of the new Mandi Committee until they are varied, amended or repealed in accordance with the provisions of this Act: Provided that such repeal shall include the provisions of section 10 of the Madhya Pradesh General Clauses Act, 1957 (No. 03 of 1958) in relation to all actions taken and things done; and (gh) any such officer, privilege, obligation or liability which may have been acquired, accrued or incurred by the Mandi Committees amalgamated under section 71, shall be deemed to be a right, privilege, obligation or liability acquired, accrued or incurred by the new Mandi Committee.
