1. Short title, extent and commencement
Short title, extent and commencement.—(1) This Act may be called the Chhattisgarh Vishwavidyalaya (Sanshodhan) Adhiniyam, 2020.
- (2) It shall extend to the whole State of Chhattisgarh.
- (3) It shall come into force from the date of its publication in the Official Gazette.

2. Definitions
After Section 69 of the Chhattisgarh Vishwavidyalaya Adhiniyam, 1973 (No. 22 of 1973) (hereinafter referred to as the Principal Act), the following shall be added, namely:- “70. Ordinance, Statute and Regulation for new established University.- The same Ordinance, Statute and Regulation for the newly established University, as a result of amendment of Part-II (Revised) of the Second Schedule of the Act, shall be deemed to be applicable which is applicable for the existing University, from which the new University has been formed.

3. University
"University" means a University established or deemed to have been established under this Act;

4. Incorporation of the University
Incorporation of the University.—
- (1) The first Kulpati and the first members of the Court, the Executive Council and the Academic Council of the University and all persons who may hereafter become such officers or members so long as they continue to hold such office or membership are hereby constituted a body corporate by the name of the University and shall have perpetual succession and a common seal and shall sue and be sued by the said name.
- (2) The University shall be competent to acquire and hold property, both movable and immovable, to lease, sell or otherwise transfer any movable or immovable property which may have become vested in, or may have been acquired by it, for the purpose of the University and to borrow moneys from the Central Government, the State Government or from any other source approved by the State Government and to contract and to do all other things necessary for the purposes of this Act: Provided that no immovable property shall be transferred without the prior sanction of the State Government.
- (3) The headquarters of the University shall be at the place specified in the Second Schedule.
- (4) In all suits and other legal proceedings by or against the University, the pleading shall be signed and verified by the Registrar and all processes in such suits and proceedings shall be issued to and served on the Registrar.
- (5) The University shall exercise the powers and perform the duties as specified in the Second Schedule.

5. Jurisdiction of the University
Jurisdiction of the University.—
- (1) The jurisdiction of the University shall extend to the areas comprised within the limits of the Revenue Districts specified in Part-I (Revised) and Part-II (Revised) of the Second Schedule: Provided that the State Government may, by notification, include any other area within the jurisdiction of the University or exclude any area from it: Provided further that the jurisdiction of the University shall not extend to the areas of any other University established under any other enactment for the time being in force except the University specified in the Second Schedule. (1-a) The territorial jurisdiction of the University established under Part-I (Revised) and Part-II (Revised) of the Second Schedule shall be as specified in the corresponding entry in column
- (4) of the said Schedule: Provided that the State Government may, by notification, include or exclude any area from the jurisdiction of such University.
- (2) No college or institution situated within the local limits of the jurisdiction of the University shall, save with the consent of the University and the sanction of the State Government, be associated with or admitted to the privileges of any other University.
- (3) Any college or institution situated outside the local limits of the jurisdiction of the University may, with the consent of the University and the sanction of the State Government, be associated with or admitted to the privileges of the University.

6. University open to all castes, classes, creeds and sexes
University open to all castes, classes, creeds and sexes.— No person shall, on grounds only of religion, race, caste, sex, descent, place of birth, residence or any of them, be ineligible for, or discriminated against in respect of, any employment or office under the University or membership of any of the authorities or bodies of the University or admission to any course of study or degree or any other educational qualification of the University.

7. Teaching in the University
("Teaching in the University")
- (1) No person shall be recognized as a teacher except by the University or by a constituent or an affiliated college.
- (2) No person shall be recognized as a teacher of the University except in accordance with the Statutes.
- (3) All teachers of the University shall, in the absence of any agreement to the contrary, be appointed under a written contract which shall be lodged with the University and a copy thereof shall be deposited with the Vice-Chancellor.

8. Powers of the University
("Powers of the University")
The University shall have the following powers, namely:
- (i) to provide for instruction in such branches of learning as the University may think fit and to make provision for research and for the advancement and dissemination of knowledge;
- (ii) to establish, maintain and manage colleges, departments and institutes;
- (iii) to affiliate colleges to the University and to recognize colleges not maintained by the University;
- (iv) to establish and maintain hostels;
- (v) to institute and confer degrees, diplomas and other academic distinctions;
- (vi) to institute and award fellowships, scholarships, exhibitions, medals and prizes;
- (vii) to demand and receive such fees as may be prescribed;
- (viii) to supervise and control the residence and discipline of students of the University and to make arrangements for promoting their health and general welfare;
- (ix) to make such provisions as may enable constituent and affiliated colleges to undertake specialization of studies;
- (x) to exercise such control over the students of the University as will ensure their physical and mental well-being;
- (xi) to hold and manage endowments, and to institute and award fellowships, scholarships, studentships, medals and prizes and other awards;1[***]
- (xii) to institute and create academic, administrative, ministerial and other posts and to make appointments thereto;
- (xiii) to establish and maintain libraries, laboratories, research stations and museums for the purpose of the University;
- (xiv) to provide for the inspection of colleges and for the taking of measures to ensure that academic standards are maintained by them;
- (xv) to supervise, control and regulate the conduct and discipline of the students of the University and institutions affiliated thereto;
- (xvi) to make provisions for research and advisory services and for that purpose to enter into such arrangements with other institutions or bodies as the Executive Council may deem necessary;
- (xvii) to organize and carry on continuing education and extension services; (xviii) to recognize or maintain hostels and to recognize places of residence for students of the University;
- (xix) to co-operate with other universities and authorities in such manner and for such purposes as the University may determine;
- (xx) to do all such other acts and things, whether incidental to the powers aforesaid or not, as may be required in order to further the objects of the University.

9. Inspection and control
("Inspection and control")
- (1) The State Government shall have the right to cause an inspection to be made by such person or persons, as it may direct, of the University, its buildings, laboratories, workshops, equipment, hostels and other places maintained by the University, and of the institution, hostel or other place administered by it, and also of the teaching and other work conducted by the University or under its auspices and to cause an enquiry to be made in the like manner in respect of any matter connected with the administration and finances of the University.
- (2) The State Government shall, in every case, give notice to the University of its intention to cause an inspection or enquiry to be made and the University shall be entitled to be represented thereat.
- (3) The State Government shall communicate to the University the result of such inspection or enquiry and the University shall communicate to the State Government such action, if any, as it is proposed to take or has been taken by it upon the result of such inspection or enquiry.
- (4) Where the University does not, within a reasonable time, take action to the satisfaction of the State Government, the State Government may, after considering any explanation furnished or representation made by the University, issue such directions as it may think fit and the University shall comply with such directions.

10. Officers of the University
("Officers of the University") The following shall be the officers of the University, namely:
- (i) The Kuladhipati (Chancellor);
- (ii) The Kulapati (Vice-Chancellor);
- (iii) The Rector;
- (iv) The Registrar;
- (v) The Dean of Student Welfare;
- (vi) The Librarian;
- (vii) The Controller of Examination;
- (viii) Such other officers in the service of the University as may be declared by the Statutes to be officers of the University.

11. The Kuladhipati
The Kuladhipati.—(1) The Governor of Chhattisgarh shall be the Kuladhipati of the University.
- (2) The Kuladhipati shall, by virtue of his office, be the head of the University and shall, when present, preside at convocations of the University and at meetings of the Court.
- (3) The Kuladhipati shall have such other powers as may be conferred on him by this Act or the Statutes.

12. The Kulapati
The Kulapati.—(1) The Kulapati shall be a whole-time salaried officer of the University and shall be appointed by the Kuladhipati from a panel of not less than three persons recommended by a Committee constituted under sub-section
- (1) of section 13: Provided that the first Kulapati shall be appointed by the Kuladhipati in such manner as he deems fit.
- (2) The Kulapati shall hold office for a term of five years from the date on which he enters upon his office and shall be eligible for re-appointment for one additional term of five years: Provided that the Kulapati shall, notwithstanding the expiration of his term, continue to hold his office until his successor is appointed and enters upon his office: Provided further that the Kulapati may, by writing under his hand addressed to the Kuladhipati, resign his office.
- (3) The Kulapati shall be the principal academic and executive officer of the University and shall, in the absence of the Kuladhipati, preside at convocations of the University and at meetings of the Court. He shall be an ex-officio member and Chairman of the Executive Council, the Academic Council and the Finance Committee.
- (4) In the event of the occurrence of any vacancy in the office of the Kulapati by reason of his death, resignation, leave, illness or otherwise, the Rector and if no Rector has been appointed or if the Rector is not available, then the Dean of any faculty or the Senior most Professor of the University Teaching Department or any Officer not below the rank of Special Secretary of the State Government to be nominated by the Kuladhipati for that purpose shall act as the Kulapati until the date on which Kulapati is appointed, for filling such vacancy, under sub-section
- (1) or sub-section
- (7) of Section 13 enters or re-enters, as the case may be, upon his office: Provided that the arrangement contemplated in this sub-section shall not continue for a period of more than six months.
- (5) The Kulapati shall exercise control over the affairs of the University and shall be responsible for the due maintenance of discipline in the University.
- (6) The Kulapati shall ensure that the provisions of this Act, the Statutes, the Ordinances and the Regulations are faithfully observed and shall perform such other functions as may be necessary for the efficient working of the University.

13. Appointment of Kulapati
Appointment of Kulapati. —
- (1) The Kulapati shall be appointed by the Kuladhipati from a panel of not less than three persons recommended by a committee constituted under sub-section (2).
- (2) The committee shall consist of following members, namely: —
- (i) One person elected by the Executive Council;
- (ii) One person nominated by the Chairman of the University Grants Commission;
- (iii) One person nominated by the Kuladhipati. The Kuladhipati shall appoint one of the members of the committee to be its Chairman.
- (3) The committee shall submit a panel of not less than three persons, in alphabetical order, to the Kuladhipati, who shall appoint, the Kulapati from the panel: Provided that the Kuladhipati may, if he does not approve of any of the persons so recommended, call for a fresh panel.
- (4) The Kulapati shall hold office for a period of four years and shall not be eligible for re-appointment: Provided that a Kulapati shall, notwithstanding the expiration of his term continue to hold office until his successor is appointed and enters upon his office.
- (5) The Kulapati shall be a whole-time officer of the University and shall be entitled to such salary, allowances and perquisites as may be determined by the State Government.
- (6) If the office of the Kulapati becomes vacant due to any reason, the Kuladhipati may appoint the Rector or any other Professor of the University or the Vice-Chancellor of any other University established by law in the State of Chhattisgarh to perform the functions of the Kulapati until a new Kulapati is appointed: Provided that the arrangement contemplated in this sub-section shall not continue for a period of more than six months.
- (7) Notwithstanding anything contained in sub-section (1), the first Kulapati after the commencement of this Act shall be appointed by the State Government, for a period not exceeding three years on such terms and conditions as it may deem fit.

14. Rector
Rector. —
- (1) The Rector shall be appointed by the Executive Council from a panel of three persons recommended by the Kulapati. (2) Provided that the Kulapati shall not recommend any person for the post of Rector unless he is a Professor and has an experience of not less than five years as a Professor.
- (3) The Rector shall hold office for a period of four years or until he attains the age of 65 years, whichever is earlier and shall be eligible for re-appointment. Provided further that the person concerned shall cease to hold office on attaining the age of 65.
- (4) The Rector shall perform such of the functions of the Kulapati as the Kulapati may, with the approval of Executive Council, direct.
- (5) The Rector shall be entitled to such salary, allowances and perquisites as may be determined by the State Government.

15. The Registrar
The Registrar. —
- (1) The Registrar shall be a whole time salaried officer of the University and shall be appointed by the Kulpati in accordance with the statutes to be made in this behalf : Provided that the person appointed as Registrar shall be an officer of the State Government not below the rank of a Deputy Collector or a Senior Lecturer/Reader in the University or a College having at least 15 years teaching or administrative experience : Provided further that the State Government shall have power to appoint a Registrar from the academic cadre of the University or from the State Administrative Service, as the case may be, on deputation and the person so appointed shall hold office for a period of three years which may be extended by the State Government for a further period of two years.
- (2) The Registrar shall exercise such powers and perform such duties as may be prescribed by the Statutes and Ordinance of the University.
- (3) The Registrar shall be ex-officio Secretary of the Court, the Executive Council, the Academic Council and such other authorities, bodies and committees as may be provided by the Statutes and Ordinance.
- (4) The Registrar shall exercise general supervisory control over the Officers and Staff of the University.

16. The Finance Officer
The Finance Officer. —
- (1) The Finance Officer shall be a whole time salaried officer of the University and shall be appointed by the Kulpati in accordance with the Statutes to be made in this behalf : Provided that the person appointed as Finance Officer shall be an officer of the State Accounts Service not below the rank of Deputy Director (Accounts) or an equivalent post or a person having at least 15 years experience in the field of accounting and finance : Provided further that the State Government shall have power to appoint a Finance Officer from the State Accounts Service on deputation for a period of three years which may be extended by the State Government for a further period of two years.
- (2) The Finance Officer shall exercise such powers and perform such duties as may be prescribed by the Statutes and Ordinances of the University : Provided that the Finance Officer shall exercise the powers of drawing and disbursing officer in respect of the University.
- (3) The Finance Officer shall be the ex-officio Secretary of the Finance Committee.

17. Other Officers
("Other Officers")
- (1) The following shall also be officers of the University, namely:—
- (i) Dean of Student Welfare;
- (ii) Controller of Examination;
- (iii) Librarian;
- (iv) Such other officers in the service of the University as may be declared by the Statutes to be officers of the University. (2)
- (i) The Dean of Student Welfare shall be appointed by the Kulapati from amongst the Professors of the University for a term of two years.
- (ii) The Dean of Student Welfare shall hold office for a period of two years and shall be eligible for re-appointment.
- (iii) The person who is appointed as Dean of Student Welfare shall continue to hold his lien on his substantive post.
- (iv) The powers and duties of the Dean of Student Welfare shall be such as may be prescribed by the Ordinances.
- (3) The Controller of Examination shall be a whole time salaried officer of the University and shall be appointed by the Executive Council on the recommendation of the Selection Committee. He shall hold office for a period of five years and shall be eligible for re-appointment.
- (4) The Librarian shall be a whole time salaried officer of the University and shall be appointed by the Executive Council on the recommendation of the Selection Committee.

18. Authorities of the University
("Authorities of the University")
The following shall be the authorities of the University, namely:—
- (i) The Court;
- (ii) The Executive Council;
- (iii) The Academic Council;
- (iv) The Board of Studies;
- (v) The Finance Committee;
- (vi) Such other Board and bodies of the University as may be declared by the Statutes to be the authorities of the University.

19. The Court
("The Court")
- (1) The Court shall be the supreme authority of the University and shall have the power to review the acts of the Executive Council and the Academic Council (save where the Executive Council or the Academic Council has acted in accordance with the powers conferred on it under this Act, the Statutes or the Ordinances) and shall exercise all the powers of the University not otherwise provided for by this Act or the Statutes.
- (2) The Court shall consist of the following members, namely:—
- (a) The Kuladhipati;
- (b) The Kulpati;
- (c) The Rector;
- (d) The Commissioner of the Division in which the University is situated;
- (e) The Secretary to the Government of the State in the Department of Higher Education or his nominee not below the rank of Deputy Secretary;
- (f) The Secretary to the Government of the State in the Finance Department or his nominee not below the rank of Deputy Secretary;
- (g) The Director of Higher Education, Madhya Pradesh;
- (h) The Director of Medical Education, Madhya Pradesh;
- (i) The Director of Technical Education, Madhya Pradesh;
- (j) The Director of Agriculture, Madhya Pradesh;
- (k) The Members of the State Legislature nominated by the State Government;
- (l) The Mayor of the Municipal Corporation, if any, in whose jurisdiction the University is situated;
- (m) The President of the Zila Panchayat concerned;
- (n) The Dean of the Students Welfare;
- (o) The Proctor;
- (p) The Dean of Faculty;
- (q) The Heads of University Teaching Departments;
- (r) Such number of Principals of Colleges not exceeding ten, to be nominated by the Kulpati; Such number of teachers of the University Teaching Departments or Schools of Studies, not exceeding ten, to be nominated by the Kulpati;
- (t) Five representatives of the registered Graduates of the University, to be elected in accordance with the Statutes;
- (u) Such number of students as may be determined by the Statutes;
- (v) Persons not exceeding five, to be nominated by the Kuladhipati from amongst eminent educationists, social workers, sports persons or persons representing trade, industry, commerce or labour.

20. Meetings of the Court
("Meetings of the Court")
- (1) The Court shall, on a date to be fixed by the Kulpati, meet at least once a year at a meeting to be called the Annual Meeting.
- (2) The Kulpati may, whenever he thinks fit and shall, upon a requisition in writing signed by not less than twenty-five members of the Court, convene a special meeting of the Court.

21. The Executive Council
("The Executive Council")
- (1) The Executive Council shall be the chief executive body of the University.
- (2) The Executive Council shall consist of the following members, namely :
- (i) The Kul-Guru (Vice-Chancellor);
- (ii) The Rector;
- (iii) One nominee of the Kuladhipati;
- (iv) Two University Professors of the University teaching departments, nominated by the Kuladhipati by rotation in the prescribed manner;
- (v) Four Principals of affiliated colleges, nominated by the Kuladhipati by rotation in the prescribed manner;
- (vi) Two members, who are not teachers of the University or of any college, nominated by the Kuladhipati;
- (vii) One member of the State Legislative Assembly, nominated by the State Government.
- (3) The Kul-Guru shall be the Chairman of the Executive Council and the Registrar shall be the Secretary.
- (4) The term of the members of the Executive Council, other than the ex-officio members, shall be three years.
- (5) One-third of the members of the Executive Council shall form a quorum for a meeting of the Executive Council.

22. Other powers and duties of the Executive Council
("Other powers and duties of the Executive Council") Subject to the provisions of this Act and the Statutes and Ordinances, the Executive Council shall have the following powers and duties, namely:
- (i) To hold, control and administer the property and funds of the University;
- (ii) To enter into, vary, carry out and cancel contracts on behalf of the University;
- (iii) To regulate and determine all matters concerning the University in accordance with this Act, the Statutes and the Ordinances;
- (iv) To provide for the common seal of the University and provide for its safe custody;
- (v) To administer and control the colleges and institutions maintained by the University;
- (vi) To manage and regulate the finances, accounts, investments, property and all other administrative affairs of the University;
- (vii) To make, amend or repeal Statutes and Ordinances in the manner prescribed by this Act;
- (viii) To accept, manage and dispose of any trust, endowment, donation or bequest for the furtherance of the objectives of the University;
- (ix) To appoint the officers, teachers and other employees of the University and to define their duties and conditions of service;
- (x) To promote and coordinate the academic programmes and research activities of the University;
- (xi) To exercise such other powers and perform such other duties as may be conferred or imposed upon it by this Act, the Statutes or the Ordinances.

23. The Academic Council
The Academic Council.—(1) The Academic Council shall consist of the following members, namely:—
- (i) The Kulapati;
- (ii) The Rector;
- (iii) The Deans of Faculties;
- (iv) The Heads of the University Teaching Departments;
- (v) The Principals of autonomous colleges not exceeding five to be nominated by the Kulapati;
- (vi) The Principals of constituent colleges;
- (vii) The Principals of affiliated colleges not exceeding ten to be nominated by the Kulapati;
- (viii) The Librarian of the University;
- (ix) Three persons, one each from the field of Agriculture, Industry or Commerce, Education Area and Social Work shall be nominated by the Kuladhipati on the recommendation of the State Government;
- (x) One Professor from each University Teaching Department to be nominated by the Kulapati by rotation according to seniority;
- (xi) Three eminent educationists to be nominated by the Kuladhipati;
- (xii) The Director of Collegiate Education (ex-officio).
- (2) All nominated members shall hold office for a period of three years.
- (3) The Kulapati shall be the Chairman and the Registrar shall be the Secretary of the Academic Council.

24. Other powers and duties of the Academic Council
Other powers and duties of the Academic Council.—Subject to the provisions of this Act and the Statutes and Ordinances, the Academic Council shall have the following powers and duties, namely:—
- (i) To make recommendations to the Executive Council in the matter of creation, abolition or classification of teaching posts in the University and the emoluments and the duties attached thereto;
- (ii) To formulate and modify or revise schemes for the organization of faculties and to assign to such faculties their respective subjects and also to report to the Executive Council as to the expediency of the abolition or sub-division of any faculty or the creation of new faculties;
- (iii) To make arrangements, through Regulations, for the instruction and examination of persons other than those enrolled in the University;
- (iv) To promote research within the University and to require from time to time reports on such research;
- (v) To consider proposals and to make such recommendations to the Executive Council as it deems fit in respect of the appointment of examiners and conduct of examinations;
- (vi) To recognize diplomas and degrees of other Universities and institutions and to determine their equivalent qualifications in relation to the diplomas and degrees of the University;
- (vii) To fix, subject to any conditions accepted by the Executive Council, the time, mode and conditions of competition for fellowships, scholarships and other prizes and to award the same;
- (viii) To make recommendations to the Executive Council in regard to the appointment of necessary number of teachers in the University departments;
- (ix) To make regulations for the encouragement of co-operation and reciprocity among colleges and for the maintenance of a high standard of education;
- (x) To make arrangements for the guidance and counseling of students;
- (xi) To exercise such other powers and perform such other duties as may be conferred or imposed on it by or under this Act, the Statutes, Ordinances or Regulations.

25. The Faculty
("The Faculty")
- (1) The University shall have such faculties as may be specified in the Statutes.
- (2) Each faculty shall consist of such departments of studies as may be assigned to it by the Ordinances.
- (3) The faculty shall consist of—
- (a) the Dean, who shall be the Chairman;
- (b) the Professors and Readers in the departments of studies comprised in the faculty;
- (c) such other teachers of the University as may be specified in the Statutes;
- (d) such other persons as may be appointed to the faculty under the Statutes.

26. Deans of Faculties
("Deans of Faculties")
- (1) There shall be a Dean for each faculty who shall be appointed by the Kulpati in such manner and for such period as may be prescribed by the Statutes.
- (2) The Dean shall be the Chairman of the faculty and shall be responsible for the due observance of the Statutes, Ordinances and Regulations relating to the faculty.
- (3) The Dean shall perform such other duties as may be prescribed by the Ordinances.

27. Board of Studies
Board of Studies. —
- (1) The University shall have a Board of Studies for each subject or for a group of subjects as the Academic Council may determine.
- (2) The Board of Studies shall consist of—
- (a) the Head of the University Teaching Department in the subject: Provided that if there are more than one University Teaching Departments in the same subject, the seniority shall be determined in accordance with the Statute made in this behalf and the senior-most Head shall be the member; (b)
- (i) one Professor of the University Teaching Department to be nominated by the Kulapati by rotation according to seniority;
- (ii) two Readers of the University Teaching Department to be nominated by the Kulapati by rotation according to seniority;
- (iii) two Lecturers of the University Teaching Department to be nominated by the Kulapati by rotation according to seniority;
- (c) one Professor from any of the affiliated colleges to be nominated by the Kulapati by rotation according to seniority: Provided that if no Professor is available in the affiliated colleges, a Reader may be nominated in his place;
- (d) two teachers of the subject from the affiliated colleges to be nominated by the Kulapati by rotation according to seniority;
- (e) two experts in the subject to be co-opted by the Board, one of whom shall be from outside the University and the other may be from within the University.
- (a) the Head of the University Teaching Department in the subject: Provided that if there are more than one University Teaching Departments in the same subject, the seniority shall be determined in accordance with the Statute made in this behalf and the senior-most Head shall be the member; (b)
- (3) The term of the Board of Studies shall be three years.
- (4) The Head of the University Teaching Department shall be the Chairman of the Board of Studies: Provided that where there is no University Teaching Department in a subject, the Kulapati shall nominate a senior teacher of the subject from an affiliated college to be the Chairman.
- (5) The powers and functions of the Board of Studies shall be to recommend the courses of studies in the subject, to recommend text-books and supplementary reading, to suggest a panel of paper-setters and examiners and to report on all matters relating to the subject as may be referred to it by the Academic Council or the Executive Council.

28. Finance Committee
Finance Committee. —
- (1) There shall be a Finance Committee consisting of—
- (a) the Kulapati (Chairman);
- (b) the Rector (if any);
- (c) the Registrar;
- (d) the Finance Officer (Secretary);
- (e) two members to be nominated by the Executive Council from amongst its members;
- (f) one member to be nominated by the Kuladhipati.
- (2) The Finance Committee shall—
- (a) examine the annual accounts and the financial estimates of the University and suggest modifications to the Executive Council;
- (b) review the financial position of the University from time to time;
- (c) make recommendations to the Executive Council on all matters relating to the finances of the University;
- (d) make recommendations to the Executive Council on all proposals involving expenditure for which no provision has been made in the budget or which involve expenditure in excess of the amount provided in the budget.
- (3) The Finance Committee shall meet at least three times in a year.
- (4) The presence of at least three members shall be necessary to form the quorum for a meeting of the Finance Committee.

- (1) The following shall also be the authorities of the University, namely:
- (i) The Board of Studies;

- (iii) Such other bodies as may be declared by the Statutes to be the authorities of the University.

("Statutes")
- (1) Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:
- (a) The constitution, powers and duties of the authorities of the University;
- (b) The election, appointment and continuance in office of the members of the authorities of the University, the filling up of vacancies of members and all other matters relating to those authorities;
- (c) The appointment, powers and duties of the officers of the University;
- (d) The constitution of a pension or provident fund and the establishment of an insurance scheme for the benefit of the officers, teachers and other employees of the University;
- (e) The conferment of honorary degrees;
- (f) The withdrawal of degrees, diplomas, certificates and other academic distinctions;
- (g) The establishment and maintenance of the departments, research institutions, constituent colleges, affiliated colleges and institutes of the University;
- (h) The maintenance of a register of registered graduates;
- (i) The management and control of the colleges and other institutions of the University;
- (j) The rules of procedure for the meetings of the authorities of the University;
- (k) All other matters which by this Act are to be or may be provided for by the Statutes.

31. Statutes how made
Statutes how made.—(1) The first statutes of the University shall be prepared by the State Government.
- (2) The Executive Council may, from time to time make, amend or repeal any statute in the manner hereinafter provided in this Section.
- (3) The Academic Council may propose to the Executive Council, the draft of any new statute or of any amendment to, or of repeal of an existing statute to be passed by the Executive Council and such draft shall be considered by the Executive Council at its next meeting: Provided that the Academic Council shall not propose the draft of any statute or any amendment of a statute affecting the status, power or constitution of any existing authority of the University until such authority has been given any opportunity to express its opinion upon the proposal and any opinion so expressed shall be considered by the Executive Council.
- (4) The Executive council may consider the draft proposed by the Academic Council under sub-section
- (3) and may either pass or reject or return the draft with or without amendment to the Academic Council for reconsiderations. (5)
- (a) Any member of the Executive Council may propose to the Executive Council the draft of a Statutes and the Executive Council may either accept, or reject the draft, if it relates to a matter not falling within the purview of the Academic Council;
- (b) In case such draft relates to a matter within the purview of the Academic Council, the Executive Council shall refer it for consideration of the Academic Council, which may,—
- (i) either report to the Executive Council that it does not approve the draft, which shall then be deemed to have been rejected by the Executive Council;
- (ii) or submit the draft to the Executive Council in such form as the Academic Council may approve and the Executive Council may either approve, with or without amendment or reject the draft.
- (6) A statute passed by the Executive Council shall be sent to the State Government who with its recommendation shall submit it before the Kuladhipati. Kuladhipati may give or withhold his assent thereto or refer it back for further consideration.
- (7) A Statutes passed by the Executive Council shall have no validity unless it has been assented to by the Kuladhipati.

Maintenance of Discipline.—(1) The Kulapati may, if he is satisfied that it is necessary in the interest of the University, or in the interest of students or teachers of the University, by order in writing, direct that any student or teacher shall not be admitted to a particular college or department of the University or University Teaching Department, and thereupon such student or teacher shall not be admitted to the college or department as directed.
- (2) The Kulapati may exercise all powers as may be necessary or expedient for the maintenance of discipline and order.

44. Proceedings of University authorities not invalidated by vacancies.—No act or proceeding of any authority or body of the University shall be invalidated merely by reason of the existence of any vacancy or defect in the constitution of such authority or body of the University.

Protection of action taken in good faith.—No suit or other legal proceedings shall lie against the University or any authority, officer or employee of the University or any person in respect of anything which is in good faith done or intended to be done in pursuance of any of the provisions of this Act or the Statutes, Ordinances or Regulations made thereunder.

- (1) There shall be a Committee of Selection for the purpose of making recommendations to the Executive Council for appointment to the posts of University Professor, Reader and Lecturer.
- (2) The members of the committee of selection shall be:
- (i) The Kulapati shall be Chairman of the Selection Committee:
- (ii) Three experts in the concerned subject nominated by the Kulapati out of the panel approved by the Academic Council of the University;
- (iii) Dean of the concerned faculty, wherever applicable;
- (iv) Head of the Department if he/she holds the post of Professor in the Department;
- (v) An academician nominated by the Kuladhipati;
- (vi) An academician representing Scheduled Castes/Scheduled Tribes/Other Backward Classes/Minorities/Differently-abled categories to be nominated by the Kulapati or acting Kulapati, if any of the above members of the Selection Committee does not belong to that category.
- (3) Four members including two outside subject experts shall constitute a quorum for a meeting of the Committee of Selection.
- (4) The Committee of Selection shall consider the applications and interview the candidates and make recommendations to the Executive Council.

48. Payment of salary to teachers and employee

- (1) The salary of the teachers and employees of the University and its affiliated/constituent colleges or institutions shall be paid through the Bank account only.
- (2) It shall be mandatory for every University and college/institution to ensure that the payment of salary to their teachers and employees is made by bank transfer.

51. Annual report
Annual report.—(1) The Annual Report of the University shall be prepared under the direction of the Executive Council and shall be submitted to the Kuladhipati on or before such date as may be prescribed by the Statutes.
- (2) The Annual report submitted to the Kuladhipati shall be laid before the State Legislature.

52. Accounts
Accounts.—(1) The annual accounts and financial estimates of the University shall be prepared under the direction of the Executive Council and shall be submitted to the Kuladhipati and the State Government.
- (2) The accounts of the University shall be audited at least once in every year by the auditors appointed by the State Government.
- (3) The accounts when audited shall be printed and copies thereof together with the audit report shall be submitted by the Executive Council to the Kuladhipati and the State Government.
- (4) The accounts when audited shall be laid before the State Legislature and a copy thereof shall be provided to the Kuladhipati.

53. Appointment of College teachers
Appointment of College teachers.—
- (1) Appointments of teachers in affiliated colleges shall be made by the governing body of the college in accordance with the qualifications prescribed by the University and on the recommendation of a selection committee constituted by the governing body with the approval of the Kulapati: Provided that no appointment on the post of teacher shall be made without the prior approval of the Kulapati.
- (2) Every teacher appointed in an affiliated college shall enter into a written agreement with the college, a copy of which shall be sent to the University.
- (3) The terms and conditions of service of teachers of affiliated colleges shall be such as may be prescribed by the Statutes.

54. Powers of University to require affiliated Colleges to take adequate action
Powers of University to require affiliated Colleges to take adequate action.—
- (1) The University may require any affiliated college to take such action as it may consider necessary in respect of any of the following matters:—
- (a) adequacy of the financial resources of the college;
- (b) standard of teaching and maintenance of discipline and order among the students;
- (c) appointment of qualified teaching staff and maintenance of record of their service;
- (d) management of the college;
- (e) conditions of appointments and service of the members of the staff;
- (f) such other matters as may be prescribed by the Statutes or Ordinances.
- (2) If the college fails to take the action required by the University within a reasonable time, the University may, after considering the explanation, if any, furnished by the college, take such action as it deems fit, including withdrawal of affiliation of the college or suspension of the college from the privileges of the University.

55. Registered Graduates
("Registered Graduates")
- (1) The following persons shall be entitled to have their names entered in the register of registered graduates, namely :-
- (a) any graduate of the University;
- (b) any person who holds the degree of Bachelor of Arts, Bachelor of Science, Bachelor of Commerce, Bachelor of Education, Bachelor of Engineering, Bachelor of Medicine, Bachelor of Law or of any other faculty of any other statutory University and who has been residing within the territorial jurisdiction of the University for such period as may be prescribed by the Statutes: Provided that the person referred to in clause
- (b) shall have to pay such fee as may be prescribed by the Statutes for enrolment as a registered graduate: Provided further that no person shall be entitled to have his name entered in such register if he is a student of any University.
- (2) The register of registered graduates shall be maintained in the prescribed manner.

56. Removal from register of Registered Graduates
("Removal from register of Registered Graduates")
- (1) The Kulpati may, on the recommendation of the Executive Council, remove from the register of registered graduates the name of any person,—
- (a) who is of unsound mind and stands so declared by a competent court;
- (b) who is an undischarged insolvent;
- (c) who has been convicted by a court of law of any offence which, in the opinion of the Executive Council, involves moral turpitude: Provided that no action under this sub-section shall be taken unless the person concerned is given a reasonable opportunity of being heard.
- (2) Any person aggrieved by an order under sub-section (1), may appeal to the Kuladhipati, whose decision shall be final.

57. Disputes between University and its employees
Disputes between University and its employees.—(1) Any dispute arising out of any contract between the University and any officer or teacher of the University shall, on the request of the officer or the teacher concerned, be referred to a Tribunal of Arbitration consisting of one member nominated by the Executive Council, one member nominated by the officer or teacher concerned and an umpire to be appointed by the Kuladhipati.
- (2) The decision of the Tribunal shall be final and shall not be questioned in any court.
- (3) No suit or proceeding shall lie in any civil court in respect of the matters which are required to be referred to the Tribunal of Arbitration under this section.

58. Tribunal of Arbitration
Tribunal of Arbitration.—
- (1) The Tribunal of Arbitration shall consist of—
- (a) one member to be nominated by the Executive Council;
- (b) one member to be nominated by the employee concerned;
- (c) an umpire to be appointed by the Kuladhipati.
- (2) The provisions of the Arbitration and Conciliation Act, 1996 (No. 26 of 1996) shall apply to all arbitrations under this Act.

59. General fund
General fund. —
- (1) The University shall have a general fund to which shall be credited—
- (a) its income from fees, endowments, grants, donations and gifts, if any;
- (b) any contribution or grant made by the State Government;
- (c) any other contributions or grants made by the Central Government, the University Grants Commission, or any local authority or any corporation owned or controlled by the Government; and
- (d) any other sums received by the University.
- (2) The general fund shall be in conformity with the provisions of this Act and the Statutes.

60. Power to borrow
Power to borrow. — The University may, with the previous sanction of the State Government, borrow on the security of the University property or otherwise, any sum of money for the purposes of the University.

- (1) The State Government may, by order, call for such information from the University on any matter relating to the affairs of the University as it may consider necessary.

- (1) If the University does not comply with the direction issued by the State Government under section 69 within the specified time, the State Government may take such action as it deems fit to ensure compliance.
- (2) Without prejudice to the generality of the foregoing power, the State Government may, if necessary, appoint an officer or a committee to carry out the direction on behalf of the University.

66. Special powers of the State Government
Special powers of the State Government.
- (1) Notwithstanding anything contained in this Act, the State Government shall have the power to issue such directions to the University as it may consider necessary for the effective implementation of the provisions of this Act or for the general improvement of the functioning of the University.
- (2) It shall be the duty of the University to comply with such directions.
- (3) The State Government may, from time to time, review the progress made by the University in complying with these directions and may take such further steps as it may consider appropriate.

67. Power to make rules
Power to make rules.—(1) The State Government may, by notification in the Official Gazette, make rules to carry out all or any of the purposes of this Act.
- (2) Every rule made under this Act shall be laid, as soon as may be after it is made, before each House of the State Legislature, while it is in session, for a total period of thirty days which may be comprised in one session or in two or more successive sessions, and if, before the expiry of the session in which it is so laid or the successive sessions aforesaid both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule.

68. Removal of difficulties
Removal of difficulties.—If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by order, do anything not inconsistent with the provisions of this Act, which appears to it to be necessary or expedient for the purpose of removing the difficulty:

Transitional Provisions Transitional Provisions.-
- (1) Notwithstanding anything contained in this Act or in any law for the time being in force, the statutes, ordinances and regulations made or deemed to be made under the Chhattisgarh Vishwavidyalaya Adhiniyam, 1973 as amended from time to time shall continue to be in force and applicable to the respective Universities until new statutes, ordinances and regulations are made under this Act.
- (2) All the appointments, decisions, orders, notices or notifications issued by the University before the commencement of this Act shall be deemed to have been made or issued under the corresponding provisions of this Act.

70. Ordinance, Statute and Regulation for new established University
Ordinance, Statute and Regulation for new established University.- The same Ordinance, Statute and Regulation for the newly established University, as a result of amendment of Part-II (Revised) of the Second Schedule of the Act, shall be deemed to be applicable which is applicable for the existing University, from which the new University has been formed.
