The Chhattisgarh Nagar Tatha Gram Nivesh (Amendment and Validation) Act, 2017
1. Short title and commencement.
(1) This Act may be called the Chhattisgarh Nagar Tatha Gram Nivesh (Amendment and Validation) Act, 2017. (2) Save as otherwise provided in this Act, Section 2 to 45 shall come into force on such date as the State Government may, by notification in the Official Gazette, appoints.
2. Substitution of Preamble.
In the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973) (hereinafter referred to as the Principal Act), for the Preamble, the following shall be substituted and shall be deemed to have been substituted with effect from 1st day of November, 2000, namely:-"An Act to make provision for planning, development and use of land in Regions established for that purpose; to make provisions of regional plan, to make better provisions for the preparation of Development Plan and District Plan, in context of privileged local self-governance, with a view to ensure that town development schemes are made in a proper manner and their execution is made effective; to constitute Town and Country Development Authority for proper implementation of town development schemes and matters connected thereto; to make provisions for Reconstitution of plots etc,. to make provisions for giving building permissions through Transfer of Development Rights, Premium FAR, to provide for the development, administration and management of special areas through Special Area Development Authority for purposes connected with the matters aforesaid, to make provisions for the acquisition of land required for public purposes in respect of the plan and purposes connected to the matters aforesaid and for matters connected therewith and incidental thereto."
3. Amendment of Section 2.
In Section 2 of the Principal Act, (a) for clause (g), the following shall be substituted and shall be deemed to have been substituted with effect from 1st day of November, 2000, namely:-"(g) "development plan" means a plan for the development or redevelopment or improvement of a planning area or part of planning area;" (b) after clause (g), the following shall be inserted, namely:-"(g-a) "development right" means right to carry out development or to develop the land or building or both and shall include the Transferable Development Right in the form of right to utilize the Floor Area Ratio of land utilizable either on the remainder of the land partially reserved for a public purpose or elsewhere, as the Final development control regulations provide in this behalf in the Development Plan or town development scheme;" (c) after clause (i), the following shall be inserted and shall be deemed to have been inserted with effect from 1st day of November, 2000, namely:-"(i-a) "final plot" means a plot reconstituted and allotted under the Town Development Scheme as final plot;" (d) in clause (k), after sub-clause (iii), the following shall be inserted and shall be deemed to have been inserted with effect from 1st day of November, 2000, namely:-"(iv) any authority constituted under this Act." (e) after clause (o), the following shall be inserted and shall be deemed to have been inserted with effect from 1st day of November, 2000, namely:-"(o-a) "planning unit(s)" means any part or section of the development plan; "(o-b) "plot" means a portion of land held in one ownership and enclosed by definite boundary, area and numbered;" (f) after clause (o-b), the following shall be inserted, namely:-"(o-c) "premium floor area" means the extra floor area, over and above the regular floor area, which can be granted by paying a premium amount, to the extent as may be decided in the development plan or town development scheme, as the case may be;" (g) after clause (o-c), the following shall be inserted and shall be deemed to have been inserted with effect from 1st day of November, 2000, namely:-"(o-d) "public purpose" means purposes as stated under Section 55 of the Act; (o-e) "reconstituted plot" means a plot which is in any way altered by the making of a town development scheme; Explanation - for the purposes of this clause "altered" includes the alteration of ownership of a plot partly or fully and its boundaries as per Section 19 and 50 of the Act;" (h) clause (oo) shall be omitted and shall be deemed to have been omitted with effect from 1st day of November, 2000. (i) for clause (u), the following shall be substituted and shall be deemed to have been substituted with effect from 1st day of November, 2000, namely:-"(u) "town development scheme" means the scheme prepared under this Act and includes a plan or plans, together with descriptive matter, if any, relating to such scheme;" (j) after clause (v), the following shall be inserted, namely:-"(v-a) "transfer of development rights" means a development right to transfer the potential of a plot designated for a public purpose or otherwise, as specified in regulations, expressed in terms of total permissible built space calculated on the basis of Floor Area Ratio allowable for that plot, for utilization by the owner himself or by way of transfer by him to someone else from the present location to a specified area in the planning area as additional built space over and above the permissible limit: Provided that in the case when a plot is designated for public purpose, the development rights will be transferred in lieu of compensation for the surrender of the concerned plot to the concerned authority free from all encumbrances;" (k) clause (w) shall be omitted and shall be deemed to have been omitted with effect from 1st day of November, 2000.
4. Insertion of Section 38-A
After section-38 of the Principal Act the following section shall be inserted, namely :- 38-A ( 1) The Stale Government may, by notification establish Housing and Urban Deve-lopment Authority or Chhattisgarh. (2) The duty or implementing the proposals in 1hc development plans. housing schemes, preparing one or more town development schemes, acquisition and development of land for the purpose of expansion, constructing houses and improvement of the area specified in the notification under sub-section ( 1) shall. subject to the provision of lhis Act vest in the Housing and Urban Development Authority of Chhattisgarh.
5. Amendment of Section 14
In Section 14 of the Principal Act, with effect from 1st day of November, 2000,- (a) for marginal heading "Director to prepare development plans", the marginal heading "Preparation of Development Plan" shall be deemed to have been substituted; and (b) for clauses (a) and (b) respectively, the fallowing shal be deemed to have been substituted, namely:- "(a) prepare an existing land use map for planning area; (b) prepare a development plan for the whole or any part of the planning area in conformity with the plan prepared under the Chhattisgarh Zila Yojana Samiti Adhiniyam, 1995 (No. 19 of 1995): Provided that, in the case where the proposals so incorporated in the development plan are contrary to the plan prepared under the Chhattisgarh Zila Yojana Samiti Adhiniyam, 1995 (No. 19 of 1995), the same shall be in'corporated in the Development Plan after recording the reasons thereof and the State Government shall after taking into consideration the reasons recorded, may either approve or reject such proposal incorporated in the Development Plan;"
6. Amendment of Section 16
In Section 16 of the PrincipaJ Act, after sub-section (1), the following shall be added, namely:- "(2) The permission under sub-section (1) may be granted in such cases and subject to such conditions as may be prescribed. (3) An Application under sub-section (1) shall be made in writing to the Director in such form accompanied by such fees and documents as may be prescribed. (4) The provisions of Section 30 for the grant or refusal of permission to an application under Section 29 shall apply mutatis mutandis to an application for permission under sub-section (1). (5) The Provision of appeal, revision and review of permission under Sections 30-A, 31, 32 and 33 respectively, which are applicable to an order granting or refusing permission under Section 30, shall apply mutatis mutandis to an order made under sub-section (1)."
7. Substitution of Section 17
For Section 17 of the Principal Act, the following shall be substituted and shall be deemed to have been substituted with effect from 1st day of November, 2000, namely:- "17. Contents of development plan.- (1) A draft development plan shall generally indicate the use of land and regulations in the area covered by it and the manner in which the development of land therein shall be carried out. (2) In particular, it shall provide, so far as may be necessary, for all or any of the following matters, namely:- (a) indicate broadly the land use proposed in the planning area; (b) allocate broadly areas of land, keeping in view regulations for natural hazard prone areas for:- (i) designation of land use for residential, industrial, mixed use, commercial, educational, agricultural, recreational or such other purposes; (ii) open spaces, parks and gardens, green belts, zoological gardens, playgrounds, natural reserves, water bodies, water course and sanctuaries; (iii) such special purposes as the Director may deem fit; (c) lay down the pattern of National and State Highways connecting the planning area with the rest of the region, ring roads, arterial roads and the major roads within planning area; (d) provide for the location of air-ports, railway stations, bus terminus and indicate the proposed extension and development of railways and canals; (e) make proposals for general landscaping and preservation of natural areas; (f) Project the requirement of the planning area of such amenities and utilities as water, drainage, electricity and suggest their fulfillment; (g) Propose broad based regulations for planning units, by way of guidelines, within such planning units sector of the location, height, size of buildings and structures, open spaces, court yards and the use to which such buildings, structures and land may be put; (h) lay down the broad based traffic circulation patterns in a city; (i) suggest architectural control features elevation and frontages of buildings and structures; (j) indicate measures for flood control, prevention of air and water pollution, disposal of garbage and general environmental control; (k) indicate the land liable to acquisition for public purpose for the purposes of the Union Government, any State, Local Authority or any other Authority or body established by or under any law for the time being in force; (l) proposals for transfer of development rights, identification of planning units where it will be consumed and its manner of utilization; (m) such other proposals for public or other purposes as may from time to time be approved by the State Government in this behalf."
8. Amendment of section 21
In section 21 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:- "(1) The Director, Town and Country Planning, on receipt of the application, shall either grant the permission with or without conditions or reject the same, after ensuring that the development is in conformity with the Master Plan and the provisions of this Act."
9. Regional plan to be finalized
(1) The State Government may, after considering the draft regional plan submitted under section 8, with or without modifications, or reject it or return it to the Director to reconsider it. (2) Immediately after the draft regional plan is approved under sub-section (1), the State Government shall publish a notice in such manner as may be prescribed, stating that the regional plan has been approved and shall mention the place where copies of such plan shall be available for inspection at all reasonable times, and shall specify in such notice the date on which such regional plan shall come into operation: Provided that where the State Government approves the regional plan with modifications, it shall not be published until the State Government has published such modifications in the Gazette along with a notice in respect thereof, inviting objections and suggestions within such period which shall not be less than thirty days from the date of publication of such notice, and until such objections and suggestions have been considered after giving reasonable opportunity of being heard to the persons affected by them.
10. Restriction on use of land or its development
(1) Notwithstanding anything contained in any other law for the time being in force, no person, authority, department of Government or any other person shall, on or after the date of publication of the draft regional plan, without the prior approval of the Director or any such officer authorized by the Director, not being lower than the rank of Deputy Director, change the use of any land for any purpose other than agriculture or carry out any development in relation to any land, which is contrary to the provisions of the draft plan. (2) Notwithstanding anything contained in any other law for the time being in force, permission referred to in sub-section (1) shall be given only in conformity with the provisions of the draft plan or final plan and not otherwise, and any permission, if given, shall not be deemed to confer any legal right on the person to whom such permission has been sought. (3) If any work is carried out in violation of the provisions of this section, Municipal Corporation or Municipal Council within its local area and the Collector outside such local areas, may remove or demolish such work at the expense of the person in default, which expense shall be recovered from him in the same manner as arrears of land revenue: Provided that no action under this sub-section shall be taken unless the concerned person has been given a reasonable opportunity of being heard, and has not been required by notice to remove or demolish such work within the time specified in the notice. (4) Any person aggrieved by such order of the Municipal Corporation, Municipal Council or Collector, as the case may be, by which the removal or demolition of the work has been required, may appeal to the Director within 15 days from the receipt of the notice under sub-section (3) and the order of the Director in such appeal shall be final.
11. Substitution of Section 23-A
For Section 23-A of the Principal Act, the following shall be substituted and shall be deemed to have been substituted with effect from 1st day of November, 2000, namely:- "23-A. Modification of Development Plan by the State Government in Certain Circumstances.- (1) (a) Notwithstanding anything contained in this Act, the State Government may, on its own motion, or on the request of Town and Country Development Authority, make modifications in the development plan, for any proposed project of the Government of India or the State Government and its enterprises or for a proposed project related to development of the State or for implementing a town development scheme of a Town and Country Development Authority, and the modifications so made in development plan shall be an integral part of the sanctioned Development Plan; (b) The State Government, in accordance with the rules made in this behalf, may on an application from any person or an association of persons for modification of development plan, for the purpose of undertaking an activity or scheme which is considered by the State Government or the Director, on the advise of the Committee constituted by the State Government for this purpose to be beneficial to the society, make such modification in the development plan as may be deemed necessary in the circumstances of the case and the modification so made in the development plan shall be an integral part of the sanctioned development plan. The application for modification of development plan shall be in such form and accompanied by such fee and documents, as may be prescribed; (c) If the proposed modification application as stated in clause (a) or (b) of sub-section (1), is below 5% of the total area covered under the development plan, then such modification, if sanctioned by state government, shall also, be deemed to have been approved under the Chhattisgarh Zila Yojana Samiti Adhiniyam, 1995 (No. 19 of 1995) and in the case when the proposed modification application is more than 5%, then the same shall be sent for its approval to the committee constituted under the Chhattisgarh Zila Yojana Samiti Adhiniyam, 1995 (No. 19 of 1995). (2) The State Government shall publish a notice of preparation of the draft modified plan and the place or places where such draft modified plan may be inspected, for one day in two daily newspapers, which are in the approved list of Government for advertisement purpose having circulation in the area to which it relates and a copy thereof shall be affixed in a conspicuous place in the office of the Collector, inviting objections and suggestions in writing from any person with respect thereto within fifteen days from the date of publication of such notice and after considering all the objections and suggestions as may be received within the period specified in the notice and giving reasonable opportunity to all persons affected thereby of being heard, the State Government may modify the plan as it deems fit, and thereby confirm the modified development plan: Provided that the State Government may: (i) impose such conditions as it considers appropriate while modifying the plan; (ii) prescribe the minimum size of land for each category of land use which may be considered for change; (iii) While modifying the plan, levy a charge to the applicant under clause (b) of sub-section (1) of section 23-A, not exceeding 10% of the market value of the land involved. The scale of levy for various categories of cases and the manner in which the market value may be determined shall be such as may be prescribed; (iv) prescribe the category of the cases which may be exempted from clause (ii) and/or (iii). (3) The provisions of Sections 18 and 19 shall not apply in case of modification made by the State Government. (4) Notwithstanding anything contained in this section, the permissible limits of floor area ratio shall not be modified in case of an application made under clause (b) of sub-section (1)."
12. Review of regional plan
(1) The Director may, on his own motion, at any time after the regional plan has come into operation, undertake the work of review and evaluation of the regional plan and may make such modifications therein as may be justified by circumstances or as may be required by the State Government, and shall undertake the review and evaluation of the regional plan at any time after the regional plan has come into operation and shall make such modifications therein as may be justified by circumstances. (2) The preceding provisions of this Chapter shall, in so far as they can be applied, apply to the modifications under sub-section (1) as they apply to the preparation, publication and approval of the regional plan.
13. Planning areas
(1) The State Government may, by notification, constitute planning areas for the purposes of this Act and define their boundaries. (2) The State Government may, by notification: (a) alter the boundaries of the planning area so as to include such area as may be specified in the notification, or exclude it from the planning area; (b) merge two or more planning areas so as to constitute one planning area; (c) divide any planning area into two or more planning areas; or (d) declare that the whole or any part of the area constituting the planning area shall cease to be a planning area or a part thereof. (3) Notwithstanding anything contained in the Madhya Pradesh Municipal Corporation Act, 1956 (No. 23 of 1956), Madhya Pradesh Municipalities Act, 1961 (No. 31 of 1961) or Madhya Pradesh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994), the Municipal Corporation, Municipal Council or Nagar Panchayat or any Panchayat, as the case may be, shall cease to exercise such powers, perform such functions and discharge such duties in relation to planning areas from the date of issuance of notification under sub-section (1), which the State Government or the Director is competent to exercise, perform and discharge under this Act.
14. Director to prepare development plans
Subject to the provisions of this Act and rules made thereunder, the Director shall: (a) prepare a map of the existing land use; (b) prepare a development plan; (c) Deleted; (d) carry out such surveys and inspections and obtain such relevant reports from Government departments, local authorities and public institutions as are necessary for the preparation of plans; (e) perform such duties and functions as may be supplementary, incidental or consequential to any previous duties and functions, or as may be assigned by the State Government for the purposes of implementing the provisions of this Act.
15. Map regarding existing land use
(1) The Director shall conduct a survey and prepare a map showing the areas prone to natural hazards regarding the existing land use and shall immediately publish it in such manner as may be prescribed, along with a public notice regarding the preparation of the map and stating the place or places where the copies could be inspected, in which objections and suggestions in writing in respect of the map shall be invited from any person within thirty days from the date of publication of such notice. (2) After the expiry of the period specified in the notice published under sub-section (1), the Director, after giving a reasonable opportunity of being heard to all such persons who have filed objections or suggestions, may make such modifications therein as may be deemed desirable. (3) After the map has been adopted with or without modifications, the Director shall, as soon as possible, publish a public notice regarding the adoption of the map and the place or places where its copies can be inspected. (4) A copy of such notice shall also be published in the Gazette and it shall be conclusive evidence that the map has been duly prepared and adopted.
16. Fixation of land use
Upon publication of the map regarding existing land use under section 15: (a) No person shall, without the written permission of the Director, institute or change the use of any land or carry out any development of the land for any purpose other than that shown in the existing land use map; provided that the Director shall not refuse to grant permission if the change is for the purpose of agriculture. (b) No local authority or any officer or other authority shall, notwithstanding anything contained in any other law for the time being in force, grant permission for any change in the use of land, other than the change shown in the existing land use map, without the written permission of the Director.
17. Subject matter of development plan
In the development plan, for the district in which the planning area is situated, the draft of the five-year and annual development plan prepared under the Madhya Pradesh District Planning Committee Act, 1995 (No. 19 of 1995) shall be considered and therein: (a) the proposed land use in the planning area shall be shown in broad terms; (b) subject to the regulations for natural hazard prone areas, the areas or zones of land for the following shall be earmarked in broad terms: (i) residential, industrial, commercial or agricultural purposes; (ii) open spaces, groves and gardens, green belts, zoological gardens and playgrounds; (iii) public institutions and offices; (iv) such special purposes as the Director deems fit; (c) the patterns for national and state highways connecting the planning area with the rest of the State and the ring roads, arterial roads, and major roads within the planning area shall be declared; (d) provisions shall be made for the location of airports, railway stations, bus terminals, and the proposed expansion and development of railways and canals shall be shown; (e) proposals shall be made for general landscaping and preservation of natural areas.

21. Amendment of section 35
In section 35 of the principal Act, in sub-section (1), for the words "Municipal Council" the words "Municipal Council or Nagar Panchayat" shall be substituted and shall be deemed to have been substituted with effect from the 1st January, 2000.
22. Amendment of section 38
In section 38 of the principal Act, with effect from the 1st January, 2000,— (a) for sub-section (1), the following sub-section shall be substituted, namely:— "(1) If the Director feels that the Town and Country Development Authority has failed to perform its duties or has failed to perform its duties in accordance with the provisions of this Act or has exceeded its powers, he may, after giving reasonable opportunity to the Town and Country Development Authority to show cause, dissolve the Authority."; (b) in sub-section (1), after the proviso, the following sub-sections shall be inserted and shall be deemed to have been inserted, namely:— "(1-a) The Authority, before dissolution under sub-section (1), may be given time for the completion of incomplete works or for the purpose of removing irregularities. (c) In clauses (a), (b), (c) (dend) of sub-section (1), the word "Government" wherever it occurs, the word "Director" shall be substituted. After clause (d) of sub-section (1), the following clauses shall be inserted, namely:— (e) the Director may, by order, appoint an Administrator for the Authority, who shall be capable to perform the function of the Authority; (f) if the Director is satisfied, that the functions of the Authority are not being performed properly, he may, by order, assign the functions of the Authority to any other officer or body; (g) the officer or body appointed under clause (1-e) shall perform the functions as the Authority until the new Authority is constituted."; (1-h) "(1-h) In case of dissolution of the Authority, the Director shall make such arrangements for the management of the assets and liabilities of the dissolved Authority as he deems fit, and he shall issue instructions for the same, and the property of the Authority shall vest in the Director until the new Authority is constituted."; (1-i) "(1-i) The order of the Director issued under sub-section (1-a), (1-e) or (1-f) shall be binding on the Authority."; (2) for sub-section (2), the following sub-section shall be substituted, namely:— "(2) The Director may, for the performance of the duties of the Authority, take such steps as he may deem necessary, and the expenses incurred in such performance shall be paid by the Authority within the period specified by the Director."
23. Review and revision of development plan or zonal plan
(1) The Director may, on his own motion, undertake the review and evaluation of the development plan or, if so required by the State Government, shall undertake the review and evaluation of the development plan. (2) The Director may, if necessary, propose the modification of the plan under sub-section (1). (3) The Director shall, if so required by the State Government, undertake the proceedings for review of any investment unit of any development plan and propose modification. (4) The Local Authority shall, on its own motion or if so required by the State Government or the Director, undertake the review and evaluation of the Zonal Plan. (5) The provisions of sections 18 and 19 shall, as far as may be, apply to the modification under sub-section (2), review and modification under sub-section (3) and review and evaluation under sub-section (4) as they apply to the preparation, publication and approval of any development plan. Explanation - For the purposes of this section, "investment unit" means the area shown as an investment unit in the development plan.
23-A. Modification in development plan or zonal plan by State Government in certain circumstances
(1-a) The State Government may, on its own motion or on an application of the Town and Country Development Authority, make modification in the development plan or zonal plan for any project proposed in relation to development in the State for the Government of India or the State Government and its undertakings or for the implementation of any scheme of the Town and Country Development Authority and the modification so made in the development plan or zonal plan shall be an integral part of the revised development plan or zonal plan. (b) The State Government may, on an application of any person or persons for the purpose of undertaking any such activity or scheme for the modification of the development plan or regional plan, which may be considered beneficial for the society by the State Government or the Director on the advice of a committee constituted by the State Government for this purpose, make such modifications in the development plan or regional plan as may be considered necessary in the circumstances of the case and the modification so made in the development plan or regional plan, shall be a consolidated part of the revised development plan or regional plan. (2) The State Government shall publish the draft of the modified plan in two daily newspapers circulating in the area concerned, twice, informing the place or places where the copies of the draft modified plan can be inspected, which are in the approved list of the State Government for the purpose of advertisement and a copy thereof shall be pasted at a conspicuous place on the notice board of the Collector's office, inviting written objections and suggestions from any person within fifteen days from the date of publication of such notice. After considering all objections and suggestions received within the period specified in the notice and after giving a reasonable opportunity of being heard to all persons affected thereby, the State Government shall confirm the modified plan. (3) The provisions of sections 18, 19 and 22 shall not apply to the modification made by the State Government. Explanation - Deleted.
24. Control of development and use of land by State Government
(1) The entire control of development and use of land in the State shall vest in the State Government. (2) Subject to the provisions of sub-section (1) and the rules made under this Act, the entire control of development and use of land in the investment area shall vest in the Director from such date as the State Government may, by notification, appoint in this behalf. (3) The State Government may make rules to regulate the control of development and use of land in the investment area and non-investment area in the State and may, by notification, apply such rules to any investment area or non-investment area from such date as may be specified therein, and where such rules are applied to any non-investment area, the limits of such non-investment area shall be defined in such notification. (4) Upon the application of such rules to any investment area, the provisions of this Chapter shall, in relation to the application to such investment area, be subject to the provisions of such rules. (5) Upon the application of such rules to any non-investment area, the following consequences shall ensue, namely:- (i) The relevant provision of the law relating to the local authority by which the local authority has been empowered to control the development and use of land, or any other such enactment under which such authority has been constituted and the rules or by-laws made thereunder, if any, shall not apply to the area included within the limits of such local authority or any other authority as the case may be. (ii) That local authority or any other authority, whose duty it is under any law relating to the local authority or under any other enactment for the time being in force, to control the development and use of land, shall, notwithstanding anything contained in any such law or enactment, be bound to give effect to the provisions of the rules made under this Act.
24-A. Construction of additional floor in residential building
Where any other law for the time being in force regulating the construction of additional floor or construction of residential building, which has been enacted under Entry 5 of the State List of the Seventh Schedule to the Constitution of India, or any rules or regulations or by-laws made thereunder, permits the construction of less than three floors, then notwithstanding anything contained in the aforesaid Act or law or rules or regulations or by-laws, the construction of one additional floor in such residential building shall be permissible subject, as the case may be, to the approval under the aforesaid Act or law.
25. Conformity to development plan
(1) After the development plan has come into operation, the use and development of land shall conform to the provisions of the development plan: Provided that the Director may, in his discretion, permit the continued use of any land, for such purpose for which it was being used at the time the development plan came into operation: Provided further that such permission shall not be granted for a period exceeding seven years from the date of the development plan coming into operation. (2) Notwithstanding anything contained in section 172 of the Madhya Pradesh Land Revenue Code, 1959 (No. 20 of 1959), every permission for diversion of land granted under that section shall be subject to the provisions of this Act.
26. Prohibition of development without permission
After the development plan has come into operation, no person shall change the use of any land or implement any development work of any land without the written permission of the Director: Provided that no such permission shall be necessary for - (a) the carrying out of works for the maintenance, repair or alteration of any building which does not materially affect the external appearance of the building; (b) the carrying out of works for the improvement or maintenance of any highway, road or public street by the Union or State Government or by any authority established under this Act or by any local authority having jurisdiction, provided that such maintenance or improvement does not involve any change contrary to the provisions of the development plan in the road alignment; (c) the purpose of inspection, repair or renewal of any drains, sewers, mains, pipes, cables, telephone or other apparatus, including the breaking open of any road or other land for that purpose; (d) excavation or soil-shaping in the interest of agriculture; (e) the restoration of land to its normal use where the land has been used temporarily for other purposes; (f) the use of any building for human habitation or for a purpose incidental to the use of any other building or land attached to such building; (g) the construction of any road intended solely for access to land for agricultural purposes. Provided further that in any such investment area to which the rules made under sub-section (3) of section 24 are applied, such permission may be granted by the authority as may be provided in the said rules.
27. Development work undertaken by Union or State Government
(1) When the Union Government or the State Government intends to develop any land for the purpose of its departments or offices or authorities, the officer in charge thereof shall inform the Director in writing of the intention of the Government to do so, at least thirty days before taking up such development work, in which full specifications thereof shall be given and with which such documents and plans shall be sent in compliance with the provisions of by-laws, rules and Acts relating to development control of such natural hazard prone area, as may be prescribed. (2) Where the Director has raised any objection on the basis of the proposed development that the development work is not in accordance with the provisions of the development plan, then the officer shall: (i) make necessary modifications in the development proposals to resolve the objections raised by the Director; or
28. Application of section 27 to authorities
28 जहां कोई प्राधिकारी या इस अधिनियम के अधीन विशेष रूप से गठित किया गया कोई प्राधिकारी किसी भूमि का, उस प्राधिकारी के प्रयोजन के लिए विकास करने का आशय रखता हो, वहां संघ या राज्य सरकार को धारा 27 के अधीन लागू होने वाली प्रक्रिया, यथा आवश्यक परिवर्तनों सहित, ऐसे प्राधिकारी के बारे में लागू होगी।
29. Amendment of Section 29
(3) If a person intends to surrender his land or part thereof to the Government or any of its Department/ Authority for implementation of any scheme prepared under this Act or otherwise, he may be allowed to use the FAR as specified in regulations, on submission of a written application to the Director in the manner prescribed in the regulations, and he will not be entitled for any compensation of such land surrender. (4) If a person intends to develop the built area over and above the normal FAR provided at the place of construction, he may be allowed to do so in part or whole of the premium FAR fixed for the planning unit at the premium rates decided, from time to time, in the State Government, on submission of a written application to the Director in the manner as may be prescribed in the regulation.
30. Amendment of Section 30
In Section 30 of the Principal Act, in sub-section (1), (a) in clause (c), for the punctuation full stop ".", the punctuation colon ":" shall be substituted; and (b) below clause (c), the following shall be inserted, namely:- "provided that in case of an application under sub-section (3) of Section 29, the Director shall not pass any order under clause (a) or (b) hereinabove unless he has heard such persons as may have interest in the proposed modification and considered encumbrance, if any created in the land or building. The interest and encumbrances that may be considered, procedure for such consideration, manner in which encumbrances, if any, may be remedied and the form of order shall be such as may be prescribed."
30-A. Insertion of new Section 30-A.
After section 30 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973) (hereinafter referred to as the Principal Adhiniyam), the following Section shall be inserted, namely :- 30-A (1) Any applicant may submit an application to the director in such manner as may be prescribed for amendment in the approved layout plan provided that such amendment is in conformity with the development plan, within the permitted time period from the date of communication of the order issued conditionally under sub-section (3) of section 30. (2) All such reasons for which amendment is sought shall be mentioned while submitting the application to the Director. (3) The Director on submission of such application, may pass appropriate order after giving a reasonable opportunity of hearing to the applicant.
30-B. Insertion of new Section 30-B
"30-B. Merger or division of a plot.- (1) The State Government or an officer so authorized by it may, subject to the provisions of this Act and such conditions as may be prescribed, allow merger or division of the plot, as per the regulations made under this Act or as per the provision of sanctioned Town Development Scheme: Provided that,- (a) plots for economically weaker sections and low income groups shall not be merged; (b) except in the case of town development scheme, the number of dwelling units permissible in the plot formed after merger shall not exceed the sum of the dwelling units permissible in the plots that were merged. (2) An application under sub-section (1) of section 30 shall contain such details, documents and fees as may be prescribed."
31. Amendment of Section 31.
For sub-section (1) of section 31 of the Principal Adhiniyam, the following shall be substituted, namely :- (1) Any applicant aggrieved by an order granting permission on condition or refusing permission under section 30 or amendment under section 30-A may, within thirty days of the date of communication of the order to him, prefer an appeal to such authority, in such manner and accompanied by such fees as may be prescribed.
32. Revision
32 राज्य सरकार किसी भी समय, किंतु आदेश के पारित होने के अधिक से अधिक बारह माह के भीतर, स्वप्रेरणा से या धारा 31 के अधीन अपील प्राधिकारी के किसी आदेश से व्यथित व्यक्ति द्वारा आदेश के उसे संसूचित किये जाने की तारीख से तीस दिन के भीतर, फाइल किये गये आवेदन पर, भी ऐसे मामले के जो धारा 30 के अधीन संचालक द्वारा या धारा 31 के अधीन अपील प्राधिकारी द्वारा निपटाया गया हो, अभिलेख को आदेश की शुद्धता के सम्बन्ध में तथा ऐसे संचालक की या अपील प्राधिकारी की किसी कार्यवाही की नियमितता के सम्बन्ध में स्वयं का समाधान करने के प्रयोजन के लिए मंगा सकेगी तथा उसकी परीक्षा कर सकेगी और ऐसा अभिलेख मंगाते समय यह निर्देश दे सकेगी कि आदेश का निष्पादन निलंबित कर दिया जाये। राज्य सरकार अभिलेख की परीक्षा करने के पश्चात ऐसा आदेश पारित कर सकेगी जैसा की वह उचित समझे और उसका आदेश अंतिम होगा तथा उसके पुनरीक्षण या पुनर्विलोकन के लिए कोई आवेदन नहीं होगा : परन्तु कोई भी आदेश तब तक पारित नहीं किया जायेगा जब तक कि उससे प्रभावित हुए व्यक्ति को तथा संचालक को सुनवाई का युक्तियुक्त अवसर न दे दिया गया हो।
33. Lapsing of permission
33 ऐसी प्रत्येक अनुज्ञा जो धारा 30 या 31 या धारा 32 के अधीन दी गयी हो, उसके ऐसे दिये जाने की तारीख से तीन वर्ष की कालावधि तक प्रवृत्त रहेगी और उसके पश्चात वह व्यपगत हो जायेगी : परन्तु संचालक, आवेदन किये जाने पर, ऐसी कालावधि को वर्षानुवर्ष बढ़ा सकेगा किंतु कुल कालावधि, उस तारीख से जिसको कि अनुज्ञा प्रारंभ में दी गयी थी, किसी भी दशा में पांच वर्ष से अधिक नहीं होगी। परन्तु यह और भी कि कोई ऐसा व्यपगत होना इस अधिनियम के अधीन अनुज्ञा के लिए किसी पश्चातवर्ती आवेदन का वर्जन नहीं करेगा।
33-A. Insertion of new Section 33-A
"33-A. Power of revocation and modification of permission to development.- (1) On the request of Director or on its own, if it appears to the State Government, that it is necessary or expedient, having regard to the development plan that may have been prepared or may be under preparation or having regard to any modification made in the final development plan, that any permission granted under Section 30 should be revoked or modified, the director, after giving the person concerned, an opportunity of being heard, by order, revoke or modify the permission to such extent as appears to it to be necessary: Provided that where the permission relates to the carrying out of any building or other operation, in or over any land, no such order shall affect such of the operations as may have already been carried out in pursuance of the permission; and no such order shall be passed after such operations have substantially progressed or have been completed. (2) Where any permission is revoked or modified by an order made under sub-section (1) and any owner claims within the time and in the manner as may be prescribed, compensation for the expenditure incurred in carrying out any development in accordance with such permission which has been rendered abortive by the revocation or modification, the Director shall, after giving the owner a reasonable opportunity of being heard, assess and offer such compensation to the owner as it may thinks fit. (3) If the owner does not accept the compensation and give notice within such time as may be prescribed of his refusal to accept the compensation, the Director shall refer the matter, in the Court of District Judge or a first class magistrate of the concerned planning Area and the decision of such Judge shall be final and binding on the owner and Director."
34. धारा 58-क का अन्तःस्थापन
धारा 58-क में विकास प्राधिकरण के कार्यों के विनियमन हेतु शक्ति प्रदान की गई है।
35. Amendment of Section 35
In Section 35 of the Principal Act, in sub-section (1), the words "or Zoning Plan", wherever they occur, shall be omitted and shall be deemed to have been omitted with effect from 1st day of November, 2000.
36. Penalty for unauthorized development or for use otherwise than in conformity with development plan
कोई भी व्यक्ति जो चाहे अपनी स्वयं की प्रेरणा पर या किसी अन्य व्यक्ति की प्रेरणा पर - (क) इस अधिनियम के अधीन अपेक्षित अनुज्ञा के बिना, (ख) दी गयी अनुज्ञा के या किसी ऐसी शर्त के जिसके कि अधीन ऐसी अनुज्ञा दी गयी हो, उल्लघन में, (ग) विकास संबंधी अनुज्ञा के सम्यक: प्रतिसंहृत कर दिये जाने के पश्चात, या (घ) ऐसी अनुज्ञा के जो सम्यक: उपांतरित कर दी गयी हो, के उल्लंघन में, किसी भी भूमि के विकास का कोई कार्य प्रारंभ करेगा, हाथ में लेगा या उसे कार्यान्वित करेगा या उसके किसी उपयोग में तब्दीली करेगा, किसी भी ऐसी कार्यवाही पर, जो कि धारा 37 के अधीन की जा सकती हो, प्रतिकूल प्रभाव डाले बिना, सादा कारावास से जिसकी अवधि छ: माह तक की हो सकेगी, जुर्माने से जो दो हजार रुपये तक का हो सकेगा, या दोनों से, और चालू रहने वाले अपराध की दशा में, अतिरिक्त जुर्माने से, जो अपराध के प्रथम बार किये जाने के लिए दोषसिद्धि के पश्चात प्रत्येक ऐसे दिन के लिए जिसके दौरान अपराध चालू रहे, दो सौ पचास रुपये तक का हो सकेगा, दंडित किया जायेगा।
37. Power to require removal of unauthorized development
(1) जहां धारा 36 में यथा उपदर्शित कोई विकास कार्यान्वित किया गया हो, वहां संचालक, ऐसे विकास के पांच वर्ष के भीतर, स्वामी पर एक सूचना तामील कर सकेगा जिसमें उससे यह अपेक्षा की जायेगी कि वह ऐसी कालावधि के भीतर जो सूचना की तामील की तारीख से एक माह से कम तथा तीन माह से अधिक न हो, जैसी कि उसमें विनिर्दिष्ट की जाये - (क) उन मामलों में, जो कि धारा 36 के खंड (क) या (ग) विनिर्दिष्ट किये गये हैं, भूमि को उसकी उस अवस्था में प्रत्यावर्तित करें जो कि उक्त विकास के किये जाने के पूर्व थी, (ख) उन मामलों में जो धारा 36 के खंड (ख) या (घ) में विनिर्दिष्ट किये गये हैं, शर्तों के या यथा उपांतरित अनुज्ञा का अनुपालन सुनिश्चित करें, परंतु जहां सूचना में भूमि के किसी उपयोग को बंद कर दिये जाने की अपेक्षा की जाये, वहां सूचना की तामील अधिभोगी पर भी की जायेगी। (2) विशिष्टतया, ऐसी सूचना में उपधारा (1) के प्रयोजन के लिए, (क) किसी भवन या किन्हीं संकर्मों को तोड दिये जाने या परिवर्तित किये जाने, (ख) भूमि पर कोई निर्माण संबंधी या अन्य संक्रियाएं कार्यान्वित किये जाने, या (ग) भूमि के किसी उपयोग को बंद कर दिये जाने की अपेक्षा की जा सकेगी। (3) ऐसी सूचना से व्यथित कोई भी व्यक्ति सूचना की प्राप्ति से पंद्रह दिन के भीतर तथा विहित रीति में संचालन को इस बात की अनुज्ञा के लिए आवेदन कर सकेगा कि उस भूमि पर किसी ऐसे भवन या संकर्मों को, जिनसे कि सूचना संबंधित है, बना रहने दिया जाये या उस भूमि के किसी ऐसे उपयोग को, जिससे कि सूचना संबंधित है, चालू रहने दिया जाये और जब तक कि आवेदन का निपटारा न हो जाये तब तक सूचना प्रत्याहृत रहेगी। (4) इस अध्याय के पूर्वगामी उपबंध जहां तक कि वे लागू हो सकते हों, उपधारा (3) के अधीन किये गये आवेदन को लागू होंगे। (5) यदि वह अनुज्ञा, जिसके कि लिए आवेदन किया गया है, दे दी जाती है तो सूचना प्रत्याहत हो जायेगी, किंतु यदि वह अनुज्ञा जिसके लिए आवेदन किया गया है, नहीं दी जाती है, तो सूचना प्रवृत रहेगी, या यदि ऐसा अनुज्ञा केवल कुछ भवनों या संकर्मों के बनाये रखे जाने के लिए या भूमि के केवल किसी भाग का उपयोग चालू रखने के लिए दी जाती है, तो सूचना, ऐसे भवनों या संकर्मों के बारे में या भूमि के ऐसी भाग के बारे में या भूमि के अन्य भागों के बारे में प्रवृत रहेगी, और तदुपरी स्वामी इस बात के लिए अपेक्षित किया जायेगा कि वह ऐसे अन्य भवनों, संकर्मों या भूमि के भाग के बारे में उपधारा (1) के अधीन सूचना में विनिर्दिष्ट की गयी कार्यवाही करें। (6) यदि सूचना में विनिर्दिष्ट की गयी कालावधि के भीतर या आवेदन के निपटारे के पश्चात उतनी ही कालावधि के भीतर, सूचना का या उसके उतने भाग का, जो कि प्रवृत हो, अनुपालन किया जाये, तो संचालक - (क) सूचना का अनुपालन न करने के लिये स्वामी को अभियोजित कर सकेगा, और जहां सूचना में भूमि के किसी उपयोग को बंद कर दिये जाने की अपेक्षा की गयी हो, वहां किसी ऐसे अन्य व्यक्ति को भी, जो सूचना के उल्लंघन में भूमि का उपयोग करता हो, या जो सूचना के उल्लंघन में भूमि का उपयोग करवाता हो या किये जाने देता हो, अभियोजित कर सकेगा, और (ख) जहां सूचना में किसी भवन या संकर्मों के तोड दिये जाने या परिवर्तित किये जाने या किन्हीं निर्माण संबंधी या अन्य संक्रियाओं के कार्यान्वित किये जाने की अपेक्षा की गयी हो, वहां वह स्वयं, उस भूमि को उस अवस्था में प्रत्यावर्तित करवा सकेगा जिसमें कि वह विकास किये जाने के पूर्व थी और ऐसी कार्यवाही जैसी कि संचालक आवश्यक समझे, जिसके अंतर्गत किसी भवन या संकर्मों का तोडा जाना या परिवर्तित किया जाना या कोई निर्माण संबंधी या अन्य संक्रियाओं का कार्यान्वित किया जाना आता है, करके अनुज्ञा की शर्तों के या यथायुपांतरित अनुज्ञा का अनुपालन सुनिश्चित कर सकेगा और उसके द्वारा इस संबंध में उपगत किये गये व्ययों की रकम स्वामी से भू-राजस्व के बकाया की भांति वसूल कर सकेगा। (7) कोई भी व्यक्ति, जो उपधारा (6) के खंड (क) के अधीन अभियोजित किया गया हो, दोषसिद्धि पर सादा कारावास से जिसकी अवधि छ: माह तक की हो सकेगी, या जुर्माने से दो हजार रुपये तक का हो सकेगा या दोनों से और चालू रहने वाले अपराध की दशा में अतिरिक्त जुर्माने से, जो अपराध के प्रथम बार किये जाने के लिए दोषसिद्धि के पश्चात प्रत्येक ऐसे दिन के लिए जिसके दौरान अपराध चालू रहे, दो सौ पचास रुपये तक का हो सकेगा, दंडित किया जायेगा।
38. Amendment of Section 38
In Section 38 of the Principal Act, with effect from 1st day of November, 2000,- (a) for sub-section (1), the following shall be deemed to have been substituted, namely:- "(1) The State Government may, by notification, establish a Town and Country Development Authority by such name and for such area as may be specified in the notification and the said authority shall be deemed to be Local Authority under this Act." (b) after sub-section (1), the following shall be deemed to have been inserted, namely:- "(1-A) The State Government may, instead of constituting a Town and Country Development Authority under sub-section (1), designate any local authority as stated in sub-clause (i), (ii), and (iii) of clause (k) of section 2 already functioning in such area, as may be specified in the notification and perform the functions assigned to the Town and Country Development Authority under this Act. (1-B) The local authority designated under sub-section (1-A) as the Town and Country Development Authority, shall perform the functions assigned to the Town and Country Development Authority under this Act and for performing the said functions, shall set up a planning committee consisting of the following members, namely:- (i) six elected members of the local authority designated under sub-section (1-A), out of whom one shall be designated as chairman; (ii) one person having specialized knowledge in the field of planning; (iii) one official of the State Government to be nominated by the State Government, ex-officio; (iv) chief officer or, as the case may be, secretary of the local authority designated under sub-section (1-A); (v) chairman of the committee constituted under the Chhattisgarh Zila Yojana Samiti Adhiniyam, 1995 (No. 19 of 1995): Provided that in case the local authority designated under sub-section (1-A) does not set up the planning committee within the period of three months from the date on which it is required to set up such committee, then, the State Government shall appoint such committee. (1-C) The Planning Committee set up under sub-section (1-B) shall have all the powers, responsibilities and status as are given to a standing committee, or as the case may be executive committee, if any, appointed under the Act under which the local authority is constituted." (c) for sub-section (2), the following shall be deemed to have been substituted, namely:- "(2) The duty to prepare one or more town development scheme and execute the said scheme, and development of land for the purpose of expansion or improvement of the area specified in the notification under sub-section (1) shall subject to provisions of this Act vest in the Town and Country Development Authority establish for the said area."
39. Incorporation of Town and Country Development Authority
प्रत्येक नगर तथा ग्राम विकास प्राधिकारी धारा 38 के अधीन अधिसूचना में विनिर्दिष्ट किये गये नाम से एक निगमित निकाय होगा और उसका शाश्वत उत्तराधिकार होगा तथा उसकी एक सामान्य मुद्रा होगी और जंगम तथा स्थावर दोनों प्रकार की संपत्ति अर्जित करने तथा धारण करने और उस अधिनियम के या उसके अधीन बनाये गये किन्हीं नियमों के उपबंधों के अधिन रहते हुए, उसके द्वारा धारित किसी संपत्ति को अंतरित करने, संविदा करने तथा ऐसी समस्त अन्य बातें, जो इस अधिनियम का प्रयोजनों के लिए आवश्यक हों, करने की शक्ति होगी और वह अपने निगमित नाम से वाद चला सकेगा तथा उक्त नाम से उसके विरुद्ध वाद चलाया जा सकेगा।
40. Amendment of Section 70
In Section 70 of the Principal Act,- (a) for sub-section (2) the following shall be substituted, namely:-"(2) The Special Area Development Authority may for all or any of the purposes of this Act,- (a) accept grants from the State Government and Government of India, Companies, Corporations and Boards constituted by the State Government and Government of India, multilateral agencies and financial institutions or local authorities or with prior permission of the Government from any other entities. (b) raise loans or advances from the State Government, Government of India, Companies, Corporations, Boards constituted by the State Government/ Government of India, multilateral agencies and financial institutions or local authorities or with prior permission of the Government from any other entities or by issue of bonds or debentures or through any other mode permitted by Law. (c) The Authority may raise such loans and advances on the security of the immovable property vested in the Authority or of all or any user charges, fees and dues authorised by this Act or or both the immovable property and all or any user charges, fees and dues as may be required." (b) After sub-section (2), the following shall be added, namely:- "(3) The Authority may constitute such special funds as may be specified by regulations and such other funds as may be necessary for the purposes of this Act."
41. Term of office of Chairman, Vice-Chairman and other members
(1) अध्यक्ष, उपाध्यक्ष तथा अन्य सदस्यों के नाम राजपत्र में अधिसूचित किये जायेंगे। (2) अध्यक्ष, उपाध्यक्ष तथा अन्य सदस्यों की पदावधि ऐसी होगी जैसी कि विहित की जाये। (3) वह व्यक्ति, जो अपनी पदावधि का अवसान हो जाने के कारण अध्यक्ष, उपाध्यक्ष या सदस्य न रहे, यदि वह अन्यथा अर्हित हो, पुनर्नियुक्ति के लिए पात्र होगा।
42. Resignation of members and casual vacancy
(1) ऐसा व्यक्ति जो धारा 40 के खंड (घ) (च) (छ) के अधीन सदस्य बना हो, किसी भी समय अध्यक्ष को संबोधित किये गये स्वहस्ताक्षरित लेख द्वारा अपना पद त्याग सकेगा तथा अध्यक्ष को त्यागपत्र प्राप्त हो जाने पर उस सदस्य का पद रिक्त हो जायेगा। (2) यदि राज्य सरकार यह समझती हो कि किसी सदस्य का पद पर बना रहना लोकहित में नहीं है, तो राज्य सरकार उसकी नियुक्ति का पर्यवसान करते हुए आदेश कर सकेगी और तदुपरी वह नगर तथा ग्राम विकास प्राधिकारी का सदस्य नहीं रहेगा, भले ही उस अवधि का, जिसके लिए वह नियुक्त किया गया था, अवसान न हुआ हो। (3) अध्यक्ष, उपाध्यक्ष या किसी सदस्य के पद में रिक्त होने के दशा में वह रिक्त, धारा 40 के उपबंधों के अनुसार राज्य सरकार द्वारा भरी जायेगी और इस प्रकार नियुक्त किया गया व्यक्ति अपने पूर्वाधिकारी की अवधि के शेष भाग के लिए पद धारण करेगा।
43. Remuneration of Chairman and Vice-Chairman
(1) अध्यक्ष से भिन्न कोई भी सदस्य, उन भत्तों के सिवाय, जो कि विहित किये जाएं, कोई उपलब्धियां प्राप्त नहीं करेगा।
44. Absence leave and appointment of Acting President and Vice-President
(1) The State Government may grant to the President or Vice-President leave of absence on such terms and conditions as may be prescribed. (2) Whenever leave of absence is granted to the President, the Vice-President nominated by the President and where leave of absence is granted to both the President and Vice-President, any other member appointed by the State Government shall act as the President.
45. Validation
(1) Notwithstanding anything contained in the Principal Act, or in any rules or regulations made thereunder or in the development plan or town development scheme or in any judgment, decree or order of any court of law, tribunal or other authority, or any law for the time being in force,- any action of the State Government or the Town and Country Development Authority or the Director taken pursuance to the development plan and town development scheme under the provisions of the Principal Act, or any rules or regulations made thereunder, prior to the date of commencement of the Chhattisgarh Nagar Tatha Gram Nivesh (Amendment and Validation) Act, 2017, shall be deemed to be validly done and shall be deemed to be always validly done under the provisions of the Principal Act, as amended by this Bill, and no suit, prosecution or other legal proceedings shall lie in any court or before any tribunal or other authority on the ground that, the provisions of the Principal Act or the Development Plan and Town Development Scheme prepared thereunder, prior to such commencement, did not provide for such power to the State Government, Director or the Town and Country Development Authority. No suit, prosecution or other legal proceedings shall lie or be maintained or continued in any court or before any tribunal or other authority, for such action taken and implemented by the Director or Town And Country Development Authority under the Principal Act. (2) Notwithstanding anything contained in the Principal Act, or in any rules or regulations made thereunder, any judgment, decree or order of any court of law, tribunal or other authority, or any law for the time being in force, the Raipur Development Plan (punarvilokit) 2021 (Master Plan), which is already prepared and sanctioned by the State Government on 7.4.2008 and the Town Development Scheme No.4 (Kamal Vihar), which is prepared and already implemented so far as 4300 land owners are concerned and, is in progress as regards remaining 656 land owners, who have also already given their consent to be the part of the scheme, the said scheme shall be deemed to have and always be valid in the Principal Act, as amended by this Bill and the reconstituted plots which are already transferred to 4300 land owners and the reconstituted plots which are already agreed to be transferred to remaining 656 land owners shall be construed as legal transfer and the roads, drainage, electricity and other facilities which are already constructed or is in progress, shall be deemed to be construed legally constructed by the Raipur Development Authority (Town and Country Development Authority) under the Town Development Scheme No:4 (kamal Vihar) and all the land owners shall be construed as legally valid in possession of the said
46. Chief Executive Officer
(1) Every Town and Country Development Authority shall have a Chief Executive Officer who shall act as the Secretary of the Authority. (2) The Chief Executive Officer shall be appointed from among the members of the State Cadre of the Development Authority Service by the State Government or, if necessary, from among the members of the State Technical/Administrative Services.
47. Other officers and servants
Every Town and Country Development Authority may have such other officers and servants as may be necessary and proper for the efficient discharge of its duties. Appointments to the posts of officers and servants included in the State Cadre of the Development Authority Service described in Section 76(b) shall be made by the State Government, and appointments to the posts of officers and servants included in the Local Cadre of the said services shall be made by the concerned Town and Country Development Authority: Provided that no post shall be created in any Authority except with the prior approval of the State Government.
48. Terms of service of Executive Officer and other officers and servants
The Chief Executive Officer appointed under section 46 and other officers and servants appointed under section 47 shall, subject to the provisions of this Act and the rules, act under the superintendence and control of the Authority.
49. Substitution of Section 49
For Section 49 of the Principal Act, the following shall be substituted and shall be deemed to have been substituted with effect from 1st day of November, 2000, namely:- "49. Preparation and contents of a town Development scheme.- (1) Subject to the provisions of this Act or any other law for the time being in force, the Town and Country Development Authority may make one or more town development scheme for the area as may be specified, and the directions issued by a general or specific order by the State Government, from time to time, if any. (2) A town development scheme may be made in accordance with the provisions of this Act in respect of any land which is,- (i) in the course of development; (ii) likely to be used for residential or commercial or industrial or for building purposes; or (iii) already built upon. Explanation.- For the purpose of this sub-section the expression "land likely to be used for building purposes" shall include any land likely to be used as, or for the purpose of providing open spaces, roads, streets, parks, pleasure or recreation grounds, parking spaces or for the purpose of executing any work upon or under the land incidental to a town development scheme, whether in the nature of a building work or not. (3) A town Development scheme may make provision for any of the following matters, namely:- (a) the laying out or relaying out of land, either vacant or already built upon;
50. Preparation of Town Development Schemes
For Section 50 of lhe Principal Act, the following shall be substituted and shall be deemed to have been substituted with effect from 1st day of November, 2000, namely:-"50. Preparation of Town Development Sche mes.- ( 1) Declaration of Intention: The Town and Country Development J\uthority may, at any time, by resolution, declare ils intention to prepare a Lown development scheme in respect of such area: Provided that no such declaration of intent sha11 be made without prior approval of the State Government. (2) Publication of Intention: Not later than thirty days from lhe date of such declaration of intention under sub-section ( J) to mal<.e a town development scheme, the Town and Country Development Authority shall publish the declaration in the Official Gazette and in such ot ll..'I' manners, as mDy be. prescri b( cl . (3 ) Pre parat ion and publication of Draft sch e m e : (i) Nol later than two years from Lhe date of pu blica t.ion of the declaration under sub-section (2), the Town and Country Development Authority shall prepare a town development scheme in draft form and publish it in such form and manner as may be prescribed together with a notice inviting objections and suggestions from any person with respect Lo the said draft town development scheme before such dale as may be specified therein, such date being not earlier than thirty days from the date of publications of such notice; (ii)Contents of Draft Scheme:- A draft scheme shall contain the following particulars so far as may be necessary, that is to say,- (a) the area, ownership and tenure of each original plot; (b) The particu lars of land allotted or reserved under clause (e) of sub-section (3) of Section 49 with general indication of the uses to which such land· is to be pu t and the terms and condition, subject to which such land is to be put to sut h uses: (c) The extent to v.•hich it is proposed to alter the boundaries of original plots; (d) A full descripLlon of all the details of the scheme under sub-secUon (3) of Section 49 a may be applicable; (c) an estimate of the net cost of the scheme to be borne by the Town and Country Development Authority; (f) to form a final plot by the reconstitution of an original plot by the alteration of its boundaries, if necessary; (g) to form a final plot from an original plot by the transfer of any adjoining lands; (h) to provide with the consent of the owners that two or more original plots which are owned by several persons or owned by persons jointly be held in ownership in common as a final plot, with or without alteration of boundaries; (i) to allot a final plot to any owner dispossessed of land in furtherance of the scheme; U) to transfer the ownership of a plot from one person to another; and (k) any other prescribed particulars. (4 ) Finalization of the Draft Sch e m e : The Town and Country Development Authority shall consider all the objections and suggestions as may be received within the period specified m the notice under sub-section (3) and after incorporating necessary modifications, as it think fits in the Draft Scheme, submit the draft scheme to the State Government along with all the suggestions and objections for sanction. (5) ( 1) Power of the State Government to Sanction Draft Scheme: (i) On receiving draft scheme under sub-section (4), the State Government may, not later than six months from the date of its receipt, by notification, sanction such scheme with or without modifications or subject lo such conditions as it may think fit to impose or refuse to sanction it; (ii) The State Government may if deemed fit, by notification in the official gazelle, return Lhe scheme to the Town and Country Development Authority Lo carry out such modifications as may be directed, including the direction to include or exclude an) land in question in the Scheme; (iii) The Town and Cou ntry Development Au thori Ly shall com ply with the directions of the State Government and shall after following the procedure as laid down under sub-section (3) of Section 50, submit the scheme within the specified lime limit to the State Government; (iv) If the State Government sanctions such scheme, it shall in such notification state at what place and time the draft scheme shall be open for the inspection of the public. (2) Vesting of Land in Town and Country Development Authority- (i). As Soon as the date on which the draft scheme is sanctioned by the State Government under sub-clause (iv) of clause (1) of sub-section (5) of Section 50, all the lands required by the Town and Country Development Authority for the purposes specified in clause (c), (D, (g) or (h) of sub-section (3) of Section 49 shall vest absolutely in the Town and Country Development Authority free from all encumbrances; (ii) Nothing in sub-clause (i) shall affect cmy rig1J1 nl the m11. ncr of I he land vesting in Lhc Town and Counlry Devclopmenl Au Lhority under that section; (iii)The provision of sub-section (8) of Section 50 shall mu tatis mutandis apply to the sanctioned drafl scheme for 1 he purpose as specified under sub-clause (i), as if the sanctioned draft scheme were a final scheme (6)Within one month from the date on which the notification sanctioning the draft scheme by the State Government is published m the official gazette, the State Government shall for the purposes or one or more Town Development Schemes received by it for sanction, constitute a committee consisting of such officers as may be prescribed, who shall prepare the Final Scheme in accordance with Lhe sanctioned draft scheme and call for objections and suggestions with regard to the final Scheme in the manner as prescribed; (7) ( 1) The committee constituted under sub-section (6) shall consider the objections and suggestions and g1, 1 11<:-.~rin.2, to such person~ ;-is are desirous of being heard and shall submit its Final Scheme to the Stalr Government within such time a s it may fix along with proposals as under:- (i) define and demarcate the a reas allotted to or reserved for any public purpose on plan; (ii) demarcate the reconstituted final plots on plan; (iii) provide for the total or partial transfer of any right in an original plot to a final plot or provide for the transfer of any right in an original plot in accordance with the provisions of Section 58-D; (iv) evaluate the value of original plot and reconstituted plot; (v) estimate the value and fix the difference between the total values of the original plots and the plots included in the final scheme in accordance with the provisions of this Act; (vi) determine whether the areas used, allotted, or reserved for public purpose or public purposes of town and country development authority are beneficial wholly or partly to the residents or owners \hhin the area of the scheme, if applica blc; (vii) estimate the portion of the sums payable as compensation on each plot used, allotted or reserved for a public purpose or for the purpose of the Town and Country Development authority, which is beneficial partly to the owners or residents within the area of the scheme and partly to the general public, which shall be included in the cost of scheme; (viii) Calculate the contribution to be levied under section 58-C, on each plot used, allotted or reserved for a public purpose or for the purpose of the town and country development authority which is beneficial partly lo the owners or residents within the area of the scheme and partly to the general public; (ix) Estima te the. increment to accrue in respect of each plot included in the scheme in accordance with the provisions
50-A. Increasing or decreasing area of town development scheme
If at any time before a draft scheme is submitted to the State Government for sanction, the Town and country Development Authority is of the opinion that additional area to be included within the scheme or area to be excluded from the scheme, the Town and Country Development Authority may, after taking approval from the State Government and giving notice in the official gazette and also in one or more local newspapers, include such additional area in the scheme or exclude such area, and thereupon all the provisions of Section 49, 50, shall apply in relation to such additional area, as they apply to such area of the scheme, and draft scheme shall be prepared accordingly and submitted to the State Government for Sanction.
50-B. Effect of Scheme
On the day on which the final scheme comes into force,- (a) all lands required by the Town and Country Development Authority shall, unless otherwise determined in such scheme, vest absolutely in the authority free from all encumbrances; (b) all the rights in the original plots, which have been reconstituted into final plots shall determine and the final plots shall become subject to the rights settled by the Committee so constituted; (c) land use prescribed while allotting the final plot to the owner under the town development scheme shall be final and no permission for such diversion of land use under any other law for the time being in force, shall be necessary.
50-C. Power of authority to evict summarily
On and after the date on which a final scheme comes in to force, any person continuing to occupy any land which he is not entitled to occupy under the final scheme shall, in accordance with the prescribed procedure, be summarily evicted by the Town and Country Development Authority.
50-D. Power to enforce scheme
(1) On and after the date on which the final scheme comes into force, the Town and Country Development Authority shall, after giving the prescribed notice and in accordance with the provisions of the scheme,- (a) remove, pull down, or alter any building or other work in the area included in the scheme, which is as such contravenes the scheme or in the erection or carrying out of which any provision of the scheme has not been complied with; (b) execute any work which is the duty of any person to execute under the scheme, in any case where it appears to the Town and Country Development Authority that delay in the execution of the work would prejudice the efficient operation of the scheme. (2) Any expenses incurred by the Town and Country Development Authority under this section shall be recovered from the person in default or from the owner of the plot in the manner provided for the recovery of sums due to the Town and Country Development Authority under the provisions of this Act. (3) If any question arises as to whether any building or work contravenes a town development scheme or whether any provision of a town development scheme is not complied with in the erection or carrying out of any such building or work, it shall be referred to the State Government and the decision of the State Government shall be final and binding on all persons. (4) No person shall be entitled to compensation in respect of any damage, loss or injury resulting from any action taken by the Town and Country Development Authority under the provisions of this section except in respect of the building or work being before the date referred to in sub-section (1) and only in so far as such building or work has proceeded until that date: Provided that any claim to compensation, which is not barred by this sub-section shall be subject to the condition of any agreement entered into between the claimant and the Town and Country Development Authority. (5) The provisions of this section shall not apply to any construction undertaken by the Central Government or a State Government.
50-E. Certain decisions of the Committee shall be final
Except in matters arising out of sub-clauses (vii), (viii), (ix), (x), (xi) and (xiii) of clause (1) of sub-section (7) of Section 50, every decision of the Committee so constituted shall be final and binding on all persons.
51. Appeal
(1) Any person aggrieved by the decision of the committee taken under sub-clause (vii), (viii), (ix), (x), (xi) and (xiii) of clause (1) of sub-section (7) of Section 50 may within thirty days from the date of the publication of the final scheme, file the Appeal before the Appellate Authority constituted by the State Government consisting of a person, who has been a district judge or a first class Magistrate, who may call for and examine the decision taken by the Committee and after examining the record, pass such order as he may thinks fit and thereby communicate the said decision to the State Government for its sanction and the State Government may, if it deems fit accept the said modification, and the modification so accepted, will be part of the sanctioned final scheme as if enacted in the Act: Provided that no order shall be passed unless the person affected thereby and the Town and Country Development Authority have been given a reasonable opportunity of being heard. Provided further that if no appeal has been presented under sub-section (1) within the statutory period, then the decisions of the committee in respect of matter arising out under sub-clause (vii), (viii), (ix), (x), (xi) and (xiii) of clause (1) of sub-section (7) of Section 50 shall be final and binding on the parties. (2) The State Government shall appoint such other persons, possessing such qualifications and experience, as may be prescribed, for assisting the Appellate Authority to decide the appeal under sub-section (1). (3) Notwithstanding anything contained under sub-section (1), the pendency of Appeal, will not be a ground for not implementing the town development scheme.
52. Powers of the state government to give direction
(1) The State Government may, if considers it necessary in public interest so to do, or on the request of the Town and Country Development Authority, as the case may be, direct the Town And Country Development Authority,- (a) to frame a town development scheme; (b) to modify a town development scheme during execution; (c) to revoke a town development scheme, for reasons to be specified in such directions: Provided that no sue-motto direction to modify or revoke a town development scheme shall be given unless the Town and Country Development Authority is given an opportunity to present its case. (2) The directions given by the State Government under this section shall be binding on the Town and Country Development Authority and all the land owners whose lands has been included

54. Completion of scheme
54. Completion of scheme.- If the Town and Country Development Authority fails to complete its implementation within a period of five years from the date of notification of the final scheme under Section 50, it shall on expiration of the said period of five years, record its reasons for the same and forward it to the State Government and the State Government may take such actions against the Town And Country Development Authority as it deems fit: Provided that, if a dispute between the authority and parties, if any aggrieved by such scheme, is brought before a Court or Tribunal of competent jurisdiction for consideration, the period for which such dispute is pending before such Court or Tribunal shall not be reckoned for determination of the completion of the Scheme.
55. Development plan/ town development scheme, public purpose
55. Development plan/ town development scheme, public purpose.- Land needed for the purposes of town development scheme or development plan shall be deemed to be a land needed for a public purpose within the meaning of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (No.30 of 2013).

No fees for Registration, stamp duty on instrument of agreement, plans or maps in connection with town Development scheme.- (1) Notwithstanding anything contained in the Registration Act, 1908 (No.16 of 1908) or any other law for the time being in force, no instrument executed between any owner of the land and the Town and Country Development Authority for giving effect to an agreement under this Act shall be chargeable with any fee under that Act. (2) Notwithstanding anything contained in the Indian Stamp Act, 1899 (No.2 of 1899), no instrument executed between any owner of the land and the Town and Country Development Authority for giving effect to an agreement under this Act shall be chargeable with any duty under that Act.

58-A. Cost of Scheme
58-A Cost of Scheme.- (1) The town development scheme shall include,- (i) A brief summary of all the costs including the cost of development cost of compensation, Legal expenses if any, establishment cost etc; (ii) A brief summary of the revenue generation from the scheme, Loan component repayment and grants, if any; (iii) all sums payable by the Town and Country Development authority under the provisions of this Act, which are not specifically excluded from the costs of the scheme; (iv) all sums spent or estimated to be spent by the Town and Country Development Authority in the making and execution of the scheme; (v) all sums payable as compensation for land reserved or designated for any public purpose or for the purpose's of the Town and Country Development Authority which is solely beneficial to the owners of land or residents within the area of the scheme; (vi) such portion of the sums payable as compensation for land reserved or designated for any public purpose or for the purpose of the Town and Country Development Authority, which is beneficial partly to the owners of land or residents within the area of the scheme and partly to the general public, as is attributable to the benefit accruing to the owners of land or residents within the area of the scheme from such reservation or designation; (vii) all legal expenses incurred by the Town and Country Development Authority in the making and in the execution of the scheme; (viii) any amount by which the total amount of the values of the original plots exceeds the total amount of the values of the plots included in the final scheme, each of such plots being estimated at its market value at the date of the declaration of intention to make a scheme, with all the buildings and works thereon at the said date and without reference to improvements contemplated in the scheme other than improvements due to alteration of its boundaries; (ix) Amount towards cost of infrastructure as may be prescribed for the area adjacent to the area of the scheme as is necessary for the purpose of and incidental to the scheme. (2) If in any case the total amount of the values of the plots included in the final scheme exceeds the total amount of the values of the original plots, each of such plots being estimated in the manner provided in clause (viii) of sub-section (1), then the amount of such excess shall be deducted in arriving at the costs of the scheme as defined in sub-section (1).
58-B. Composition of offences
(1) Any officer authorised by the Director or the Town and Country Development Authority in this behalf may, either before or after the institution of the proceedings, compound any offence made punishable by or under this Act or the rules made thereunder: Provided that no offence shall be compounded unless the offender pays such amount as may be determined by the authorised officer, which shall not, in any case, exceed the maximum amount of fine prescribed for the offence. (2) On payment of such amount as may be determined by the authorised officer under sub-section (1), the accused person, if in custody, shall be set at liberty and no further proceedings shall be taken against him in respect of the offence so compounded.
58-C. Contribution towards costs of scheme
58-C. Contribution towards costs of scheme.- (1) The costs of the scheme shall be meet wholly or in part by a contribution to be levied by the Town and Country Development Authority on each plot included in the final scheme calculated in proportion to the increment which is estimated to accrue in respect of such plot: Provided that, - (i) (a) where the cost of the scheme does not exceed half the increment, the cost shall be met wholly by a contribution; and (b) where it exceeds half the increment, to the extent of half the increment it shall be met by a contribution and the excess shall be borne by the Town and Country development authority; (ii) where a plot is subject to a mortgage with possession or to a lease, the committee shall determine in what proportion the mortgagee or lessee on the one hand and the mortgagor or lessor on the other hand shall pay such contribution; (iii) no such contribution shall be levied on a plot used, allotted or reserved for a public purpose or for the purpose of the Town and Country Development Authority which is solely beneficial to the owners of land or residents within the area of the scheme; and (iv) the contribution levied on a plot used, allotted or reserved for a public purpose or for the purpose of the Town and Country Development Authority which is beneficial partly to the owners of land or residents within the area of the scheme and partly to the general public shall be calculated in proportion to the benefit estimated to accrue to the general public from such use, allotment or reservation. (2) The owner of each plot included in the final schemes shall be primarily liable for the payment of the contribution leviable in respect of such plot.
58-D. Offences by companies
(1) If the person committing an offence under this Act is a company, every person who, at the time the offence was committed, was in charge of, and was responsible to, the company for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly: Provided that nothing contained in this sub-section shall render any such person liable to any punishment provided in this Act, if he proves that the offence was committed without his knowledge or that he exercised all due diligence to prevent the commission of such offence. (2) Notwithstanding anything contained in sub-section (1), where an offence under this Act has been committed by a company and it is proved that the offence has been committed with the consent or connivance of, or is attributable to any neglect on the part of, any director, manager, secretary or other officer of the company, such director, manager, secretary or other officer shall also be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.
58-E. Compensation in respect of property or right injuriously affected by scheme
58-E. Compensation in respect of property or right injuriously affected by scheme.- The owner of any property or right which is injuriously affected by the making of a town development scheme shall, if he makes a claim before the Committee within the prescribed time, be entitled to be compensated in respect thereof by the Town and Country Development Authority or by any person benefitted or partly by the Town and Country Development Authority and partly by such person as the Committee may in each case determine: Provided that the value of such property or rights shall be deemed to be its market value at the date of the declaration of intention to make a scheme without reference to improvements contemplated in the scheme, as the case may be.
58-F. Exclusion of compensation in certain cases
58-F. Exclusion of compensation in certain cases.- (1) No compensation shall be payable in respect of any property or private right which is alleged to be injuriously affected by reason of any provisions contained in the town development scheme, if under any other law for the time being in force applicable to the area for which such scheme is made no compensation is payable for such injurious affection. (2) Any property or private right shall not be deemed to be injuriously affected by reason of any provision inserted in a town development scheme which imposes any conditions and restrictions in regard to any of the matters specified in clause (o) of sub-section (3) of section 49.
58-G. Provision for cases in which amount payable to owners exceeds amount due from him or less than amount payable by owner

Provision for cases in which amount payable to owners exceeds amount due from him or less than amount payable by owner.- (1) If the owner of an original plot is not provided with a plot in the final scheme or if the contribution to be levied from him is less than the total amount to be deducted therefrom under any of the provisions of this Act, the net amount of his loss shall be payable to him by the Town and Country Development Authority in cheque or in such other manner as may be agreed upon by the parties.
58-H. Payment by adjustment of account
All payments due to be made to any person by the Town and Country Development Authority under this Act shall, as far as possible, be made by adjustment in such account with the Town and Country Development Authority in respect of the plot concerned or of any other plot in which he has an interest and failing such adjustment, shall be paid in cheque or in such other manner as may be agreed upon by the parties.
61. Fund of Town and Country Development Authority

63-A. Power of State Government to issue directions
The State Government may, from time to time, issue such directions to the Town and Country Development Authority as it may deem necessary for the proper implementation of the provisions of this Act, and the Authority shall be bound to comply with such directions.
63-B. Power of Town and country development Authority to make agreement
The Town and Country Development Authority shall be competent to make any agreement with any person in respect of any matter, which is to be provided for in a town development scheme, subject to the powers of the State Government to modify or disallow such agreement.
63-d. Recovery of dues as arrears of land revenue

64. Constitution of Special Areas
(1) If the State Government is satisfied that any area, town or city has been designated as a Special Area in a regional plan, or if the State Government is satisfied in any other manner that it is expedient in the public interest that any area, town or city should be developed as a Special Area, it may, by notification, designate such area as a Special Area by such name as may be specified in the notification. (2) In such notification, the boundaries of the Special Area shall be defined. (3) The State Government may, by notification: (a) alter the boundaries of the Special Area so as to include in or exclude from it such area as may be specified in the notification; (b) declare that the Special Area shall cease to be as such. (4) [Deleted]
65. Registration of documents
(1) No document as is referred to in the Indian Registration Act, 1908 (No. 16 of 1908), which purports to create, assign, limit or extinguish any right, title or interest in any land or building in a town development area, shall be registered unless the owner thereof produces a certificate from the Town and Country Development Authority to the effect that the proposed transfer is in accordance with the development plan. (2) Notwithstanding anything contained in the Indian Registration Act, 1908, the Registering Officer shall refuse to register any document which is not accompanied by the certificate as required under sub-section (1). (3) (a) The application for certificate shall be made in such Form as may be prescribed. (b) The Town and Country Development Authority shall, within sixty days from the date of receipt of the application, either grant the certificate or refuse to grant it, and if it fails to do so, it shall be deemed that the certificate has been granted.
65-A. Meetings of Special Area Development Authority
(1) The meetings of the Authority shall be held at such time, at such place and in such manner as may be specified by regulations: Provided that until regulations are made in this behalf, such meeting shall be convened by the Chairman. (2) The Authority may, by resolution, direct that any power exercisable by it under this Act, except the power to make Regulations and Bye-laws may also be exercised by the Chief Executive Officer or officer of the Authority as may be specified in the notification subject to such restrictions and conditions as may be specified therein. (3) (a) The Authority may from time to time appoint committees consisting of the President of the committee and such other members as it thinks fit, and may, associate with such committees in such manner and for such period as may be prescribed by rules, any person or persons whose assistance or advise it may desire and refer to such committees for inquiry and report any subject relating to the purposes of this Act. (b) Every such committee appointed under the clause (a) of sub-section (3) shall conform to any instructions that may, from time to time, be given to it by the Authority and the Authority may at any time alter the constitution of any committee so appointed or rescind any such appointment.
65-B. Chief Executive Officer
(1) There shall be a Chief Executive Officer (CEO) to the Authority, who shall be the Member-Secretary and also the principal executive and administrative officer of the Authority and subject to the overall control of the Authority, all other officers and servants of the Authority shall be sub-ordinate to him. (2) The Chief Executive Officer shall have such powers and shall perform such duties as may be prescribed by the State Government. (3) The Chief Executive Officer may by order direct that any power exercisable by him under this Act may also be exercised by the officers of the Authority subject to such restrictions and conditions as may be specified therein.
66. Incorporation of Special Area Development Authority
Every Special Area Development Authority shall be a body corporate, having perpetual succession and a common seal, with power to acquire, hold and dispose of property, both movable and immovable, and to contract, and shall sue and be sued by the name specified in sub-section (1) of section 64.
67. Staff
Every Special Area Development Authority shall have such officers and servants as may be necessary and proper for the efficient discharge of its duties, and appointments to the posts of officers and servants included in the relevant cadre of the development authority service shall be made in accordance with the provisions of Chapter IX-A and the rules made thereunder by the concerning Town and Country Development Authority. Provided that no post shall be created in any authority except with the prior approval of the State Government.
68. Functions
The functions of the Special Area Development Authority shall be,- (i) to prepare, revise if required, and implement, the Development Plan and Town Development scheme; (ii) to carry out construction activity, to provide, operate, maintain, manage and regulate amenities; (iii) For the purpose of implementation of the plans specified in clause (i), can acquire, hold, develop, manage and dispose of land and other property; and (iv) to otherwise perform all such functions and exercise such powers with regard to the special area as the State Government may, from time to time, direct.
69. POWERS
The Special Area Development Authority shall,- (a) (i) for the purposes of this Act, enter into an agreement of purchase or otherwise with the owner of the land, situated within the special area for development of such land in the manner as may be prescribed by rules; (ii) where, on the representation from the Authority, it appears to the State Government that, for the purposes of this Act, which shall be deemed to be a public purpose, it is necessary that any land within special area should be acquired, the State Government may acquire under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (No.30 of 2013). (b)(i) For the purpose of planning, preparation of development plan and revision thereof, as the case may be, within the special area, shall exercise the powers, which the Director, Town and Country Planning has under this Act and also shall have the power to control and regulate the Development and use of land in its jurisdiction. if directed to do so by the State Government. (ii) For the purpose of planning. preparation and implementation of town development scheme within special area, shall exercise the powers which the Town and Country Planning Development Authority has under this Act. (c) (i) Contracts by or on behalf of the Authority shall be made by the Chief Executive Officer, after taking the sanction from Authority. (ii) No such contract for any purpose which, is not in accordance with any provision of this Act or any other Act, shall be made by him. (iii) The manner and procedure for giving contract, shall be such as may be prescribed. (iv) The Authority, in order to take assistance in technical, financial or other matters, may engage the services of a qualified individual consultant or consultancy firm and the procedure for the appointment of such consultant shall be subject to rules made in this behalf. (v) The Authority may take assistance of a company, firm, society, trust or any other agency or any Government agency that is established under any existing rules, to execute any type of project relating to urban infrastructure related with facilities. The Authority, can also execute works with the help of such private agency. (vi) Private sector participation agreements for development, operation, maintenance, providing service or any combination thereof shall be such as may be prescribed. (d) The Authority shall have power to pull down, demolish, remove, or take such appropriate action against any development undertaken by any Authority or person in contravention to rules made under Section 24 of this Act. (e) Notwithstanding anything contained in this Act or any law for time being in force, the Authority shall have power to levy one or more of the following user charges, fees, premium, toll and duty in the manner and at such rates as may be prescribed by rules, namely:- (i) General Amenities User Charges; (ii) charges for completion of internal and/or external developmental work; (iii) Water Supply, Sewerage, Solid Waste Management, charges for use of Information and Communication Technology (ICT) based project/ projects; (iv) Any other user charge which the State Government may notify from time to time.
69-A. Power and procedure for collecting user charges
(1) The manner and procedure of presentation of bill of User Charges, and recovery thereof shall be as specified by regulation. (2) Any user charges due, but not paid to the Authority within the time specified in the regulation shall be recovered as dues recoverable as an arrear of land revenue under the provisions of Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959).
69-B. Power of Authority in matters of unauthorized entry, etc. and offences
(1) In the matter of unauthorized entry, development or use of Land within special area, the Authority shall exercise the powers which the Director, Town and Country Planning has, under this Act. (2) Whoever,- (a) obstructs any person, with whom the Authority has entered into a contract, in the performance of his duty or of anything which is empowered or required to do under this Act; or (b) removes any mark set-up for the purpose of indicating any level or direction necessary to the execution of the work authorized under this Act, Shall be punishable with simple imprisonment for a term which may extend to three months or with fine which may extend to fifty thousand rupees, or with both. (3) Whoever damages any infrastructure such as retaining wall, parapet, railing, sewerage line, water supply line, drainage, electric line, plants, street or furniture, Information Communication Technology (ICT) system etc. then he shall be liable to pay the cost of the repair along with 100% of the cost of
69-C. Compounding of offences
(1) Notwithstanding anything contained in the Code of Criminal Procedure, 1973(2 of 1974), any offence punishable under this Act may, either before the institution of prosecution (before filing of charge-sheet) or with the permission of the Court after the institution of the prosecution, be compounded by the Authority on payment to the Authority such compounding fees as may be notified. (2) Where an offence is compounded under subsection (1), no proceeding or further proceeding, as the case may be, shall be taken against the offender in respect of the offence so compounded and the offender, if in custody, shall be released forthwith.
70. Functions of the Board
(1) Subject to the provisions of the Madhya Pradesh/Chhattisgarh Road Transport Services (Development) Act, 1973 (No. 2 of 1974) and the rules made thereunder, the Board constituted under section 69 shall perform such functions as may be assigned by the State Government from time to time. (2) The State Government may, by order, generally or in any specific matter relating to the Board, give such directions as it may deem fit and the Board shall be bound to comply with such directions.
71. Annual Budget
(1) The Chairman shall, by 10th March at the latest, every year, submit to the Special Area Development Authority an estimate of the income and expenditure of that Authority for the year commencing on the first day of the ensuing April, in such detail and such form as that Authority may direct from time to time. (2) Such estimate shall make provision for the due fulfillment of all the liabilities of the Special Area Development Authority and for the efficient implementation of this Act, and such estimate shall be complete and a copy thereof shall be sent to every member of that Authority at least ten days before the meeting at which the estimate is to be placed. (3) The Special Area Development Authority shall consider the estimate so presented and shall approve it either in its original form or subject to such modifications as it may deem proper. (4) The budget so approved shall be sent to the State Government which may approve it with or without modifications. (5) If the State Government approves the budget with modifications, the Special Area Development Authority shall take action to amend it, and the budget so modified and amended shall be in force during that year.
71-A. Maintaining of accounts
After Section 71 of the Principal Act, the following shall be inserted, namely:-"71-A. Maintaining of accounts.- (1) The Authority shall keep accounts in such form and in such a manner as it may by regulations made in this behalf determine. (2) The Authority shall adopt accrual-based double entry system of accounts and shall endeavor to adopt international best practices in regard to financial documentation. (3) The Authority may provide for internal Audit of the day to day Accounts of the Authority. (4) The accounts of the Authority shall be audited by the Auditor, appointed by the State Government from time to time in this regard. (5) The audit shall be as thorough a possible, and be made in such manner as may be determined by the regulations from time to time."
72. Power of State Government to supervise and control
The State Government shall have the power of supervision and control over the acts and proceedings of the officers appointed under section 3 or the authorities constituted under this Act.
72-A. Powers of the State Government to rectify, revoke or modify
After Section 72 of the Principal Act, the following shall be inserted, namely:-"72-A.Powers of the State Government to rectify, revoke or modify.- The State Government may, at any stage or time, rectify, revoke or modify any of the acts, proceedings or decisions taken by the officers appointed under Section 3 as well as of the authorities constituted under this Act."
73. Power of State Government to give directions
(1) The officers appointed under section 3 and the authorities constituted under this Act shall, in the discharge of their duties, be bound by such directions on questions of policy as may be given by the State Government. (2) If any dispute arises between the State Government and any authority as to whether a question is a question of policy or not, the decision of the State Government shall be final.
74. Power of Government to review plans etc. to ensure conformity
Notwithstanding anything contained in any other enactment for the time being in force, the State Government may review any Town Improvement Schemes, building plans or permit for construction, which have been approved or granted by any authority under any enactment for the time being in force, with a view to satisfy whether there is any adversity in respect of the provisions of this Act or the rules made thereunder or whether any adversity arises, and may revoke, alter or modify any scheme, plan, permit or approval so that such scheme, plan, permit or approval may be made in accordance with the provisions of this Act. Provided that no order under this section shall be passed without giving a reasonable opportunity of being heard to the persons affected thereby.
75. Delegation of powers
(1) The State Government may, by notification, delegate to any officer or authority subordinate to it all or any of the powers conferred on it by or under this Act, other than the power to make rules. (2) Subject to such restrictions as may be imposed by the State Government by general or special order, the Director may, by written order, delegate to any officer subordinate to him all or any of the powers exercisable by him under this Act or the rules made thereunder, other than the power to hear appeals and revisions.
76. Dissolution of authorities
(1) Whenever, in the opinion of the State Government, the continued existence of any authority constituted under this Act is unnecessary or undesirable, the State Government may, by notification, declare that such authority shall be dissolved from such date as may be specified in the notification, and such authority shall be dissolved accordingly. (2) From the said date: (a) all assets and liabilities of the authority shall vest in the Municipal Corporation of that area and such Corporation shall have all such powers as may be necessary to take possession of and recover such assets and to deal with them, and to discharge such liabilities: Provided that in cases where the area of such authority falls under different Municipal Corporations, the assets and liabilities of such authority shall be distributed among such Municipal Corporations in such manner as the State Government may, by order, determine. (b) all pending proceedings, to which the authority was a party, shall continue as if the Municipal Corporation was a party thereto in place of the authority.

81. Bar of legal proceedings
For Section 81 of the Principal Act, the following shall be substituted, namely:-"81. Bar of legal proceedings. - (1) No suit, prosecution or other legal proceeding shall lie against the State Government, the Town and Country Development Authority/ Special Area Development Authority", or any public servant or person duly appointed or authorized under this Act, in respect of anything done in good faith or purporting to be done under the provisions of this Act or any rules or regulations, byelaws or notification made or issued there under. (2) No suit for damages or specific performance shall be maintainable against any of the Authority constituted under this Act its chairman, or any of its officer or member thereof; on the ground that any of the duties specified in this Act have not been performed."
82. Act of Town and Country Development Authority or Special Area Development Authority etc. not to be invalidated by vacancy
No act of the Town and Country Development Authority or the Special Area Development Authority or any of its committees shall be deemed to be invalid by reasons only of the fact that— (a) there is any vacancy in it or defect in its constitution; (b) there is any defect in the appointment of a person acting as its Chairman or member; or (c) there is any irregularity in its procedure which does not affect the merits of the case.
83. Chairman or member to hold office until successor takes charge
The Chairman or a member of the Town and Country Development Authority or the Special Area Development Authority shall, notwithstanding the expiry of his term of office, continue to hold office until his successor takes charge of the office.
84. Interpretation of Regional Plan etc.
(1) If any question arises regarding the interpretation of a Regional Plan, the matter shall be referred to the Director who shall pass such order thereon as he may deem fit. (2) Any person aggrieved by the decision of the Director may appeal to the State Government within such time and in such manner as may be prescribed. (3) Subject to the decision of the State Government, the decision of the Director, and subject to the decision of the State Government, the decision of the Director shall be final.
85. Power to make rules
(1) The State Government may, after previous publication, make rules for carrying out the purposes of this Act: Provided that the condition of previous publication shall not apply to the rules made under clause (17) of sub-section (2). (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:— (1) the other categories of officers who may be appointed under clause (e) of sub-section (1) of section 3; (2) the form of notice and the manner of inviting objections and suggestions under sub-section (1) of section 8; (3) the manner of publication of the Regional Plan under sub-section (2) of section 9; (4) the manner of publication of the existing land use map for inviting objections and suggestions under sub-section (1) of section 15; (5) the manner of publication of the draft Development Plan under sub-section (1) of section 18; (6) the manner of publication of public notice under sub-section (4) of section 19; (7) the documents and charts to be sent along with information under sub-section (1) of section 27; (8) (a) the form of application, the particulars which it shall contain and the documents which shall accompany such application under sub-section (1) of section 29; (b) the fee which shall be paid along with the application under sub-section (2) of section 29; (9) (a) the form in which permission shall be granted under sub-section (3) of section 30; (b) the manner of communication of the order under sub-section (4) of section 30; (10) the authority to which and the manner in which an appeal shall be made and the fee that shall be payable on the memorandum of appeal under sub-section (1) of section 31; (11) the time within which, the manner in which and the documents along with which notice shall be served under sub-section (1) of section 34; (12) the manner in which application shall be made under sub-section (3) of section 37; (12-a) the term of office of the Chairman, Vice-Chairman and other members under sub-section (2) of section 41; (12-aa) the terms and conditions under which the Chairman and Vice-Chairman, as the case may be, may be granted leave under sub-section (1) of section 44; (13) (a) the manner of publication of declaration under sub-section (2) of section 50; (b) the form in which and the manner in which the Town Development Scheme shall be published as a draft under sub-section (3) of section 50; (c) the manner in which the final Town Development Scheme shall be published under sub-section (7) of section 50; (14) the terms and conditions subject to which land shall vest in the Town and Country Development Authority under section 56; (15) (a) the form in which and the manner in which the notice shall be published under sub-section (1) of section 60; (b) the form in which notification shall be issued under sub-section (4) of section 60; (16) the terms and conditions subject to which the Town and Country Development Authority may issue debentures or borrow money under section 63; (16-a) the term of office of the Chairman, Vice-Chairman and other members under sub-section (2) of section 65; (17) the terms and conditions subject to which loans may be taken under sub-section (2) of section 70; (17-a) the recruitment and conditions of service of officers appointed in the Development Authority service under sub-section (2) of section 76-B; (18) any other matter which is to be or may be prescribed. (3) All rules made under this Act shall be laid on the table of the Legislative Assembly.
86. Regulations
(1) The Town and Country Development Authority or the Special Area Development Authority, as the case may be, may, generally for carrying out the purposes of this Act, make regulations, subject to the provisions of this Act and the rules made thereunder. (2) In particular and without prejudice to the generality of the foregoing power, such regulations may provide for all or any of the following matters, namely:— (a) the convening of meetings and the conduct of business at such meetings, the time and place where such meetings shall be held; (b) the procedure for disposal of developed lands, houses, buildings and other structures under section 58; (c) the management of property and the maintenance and audit of accounts; (d) the manner of appointment of committees, the convening and conduct of meetings and business of such committees; (e) any other matters which may be necessary for the exercise of powers and performance of duties and functions by the Town and Country Development Authority or the Special Area Development Authority, as the case may be, under this Act.
87. Repeal and Saving
(1)(a) From the date of the commencement of the provisions of the second chapter, any reference to the Chief Town Planner in any enactment for the time being in force shall be construed as a reference to the Director. (b) From the date of constitution of a planning area, the following consequences shall ensue, namely:— (1) The Madhya Pradesh Town Planning Act, 1948 (No. 67 of 1948) shall stand repealed in such area; (2) Any land use map, draft development plan or development plan prepared under the said Act shall be deemed to have been prepared under this Act and all papers relating thereto shall be transferred to the Director. (c) From the date of the establishment of the Town and Country Development Authority for any area, the following consequences shall ensue in relation to that area, namely:— (1) The Madhya Pradesh Town Improvement Trust Act, 1960 (No. 14 of 1961) shall stand repealed in its application to the said area; (2) The Town Improvement Trust functioning within the jurisdiction of the Town and Country Development Authority so established shall stand dissolved and any Town Improvement Scheme prepared under the said Act, in so far as it is not inconsistent with the provisions of this Act, shall be deemed to have been prepared under this Act; (3) All assets and liabilities of the Town Improvement Trusts shall be the assets and liabilities of the Town and Country Development Authority constituted under section 38 in place of such Town Improvement Trust; (3-a) All grants and subscriptions payable to the Town Improvement Trust shall continue to be payable to the Town and Country Development Authority established under section 38 in place of such Town Improvement Trust; (4) All employees who were immediately before the aforesaid date in the service of, or under the control of, such Town Improvement Trust as are referred to in sub-clause (2) shall be deemed to be the employees of the Town and Country Development Authority established under section 38 for such area: Provided that the terms and conditions of service of such employees shall, until altered by the Town and Country Development Authority with the prior approval of the State Government, be the same: Provided further that no such approval under the foregoing provision shall be given by the State Government unless the person affected thereby (by the approval) has been given a reasonable opportunity of hearing; (5) All records and papers of the Town Improvement Trust referred to in sub-clause (2) shall vest in and be transferred to the Town and Country Development Authority established under section 38 in place of such Trust. (2) Notwithstanding the repeal of the Madhya Pradesh Town Improvement Trust Act, 1960 (No. 14 of 1961) (hereinafter referred to as the repealed Act) under sub-clause (1) of clause (c) of sub-section (1):— (a) all cases relating to the acquisition of land under section 71 of the repealed Act and compensation regarding the vesting of such land in the Town Improvement Trust, which are pending immediately before the date of such repeal before the Town Improvement Trust or the Tribunal or the court of the District Judge or the High Court, shall be disposed of and proceedings continued by: (1) the Town and Country Development Authority constituted under section 38 in place of such Town Improvement Trust; (2) the Tribunal to be constituted under section 73 of the repealed Act after the commencement of the Madhya Pradesh Nagar Tatha Gram Nivesh (Sanshodhan) Adhiniyam, 1979; (3) the court of the District Judge; (4) the High Court; as the case may be, in accordance with the provisions of the repealed Act as if this Act had not been passed; (b) The Town and Country Development Authority, the Tribunal, the court of the District Judge or the High Court, as the case may be, may proceed from the stage at which such cases were left at the time of the repeal for the purpose of carrying out the proceedings and disposing of them.
88. Repeal
The Madhya Pradesh Nagar Tatha Gram Nivesh Adhyadesh, 1973 (No. 2 of 1973) is hereby repealed.

राज्य सरकार को विकास सम्बंधी प्रस्थापना संचालक द्वारा उठायी गयी आपत्तियों सहित विनिश्चय के लिए प्रस्तुत करेगा : परन्तु यदि प्रस्तावित विकास सम्बंधी योजना की प्राप्ति से तीस दिन के भीतर संचालक द्वारा कोई रूपांतरण प्रस्तावित नहीं किया जाता है तो ऐसी योजना उस सीमा तक अनुमोदित मानी जायेगी जहां तक कि विकास योजना, परिक्षेत्रीय योजना, नगर विकास स्कीम के उपबंधों या इस अधिनियम या ततसमय प्रवृत्त किसी अन्य अधिनियम के अधीन बनाये गये नियमों का अतिक्रमण नहीं होता हो।

(3) राज्य सरकार विकास सम्बंधी प्रस्थापनाओं के संचालक द्वारा उठायी गई आपत्तियों सहित प्राप्त होने पर, या तो प्रस्थापनाओं को रूपांतरणों सहित या रूपांतरणों के बिना अनुमोदित करेगी या तो अधिकारी को यह निर्देश देगी कि वह प्रस्थापनाओं में ऐसे रूपांतरण करे जैसे कि वह परिस्थितियों के अनुसार आवश्यक समझे।

(5) राज्य सरकार, अधिसूचना द्वारा, किसी भी भूमि के विकास कार्य को जो कि उसमें विनिर्दिष्ट किसी परियोजना का कार्य चालन सम्बंधी सन्निर्माण के प्रयोजन के लिए संघ या राज्य सरकार की ओर से हाथ में लिया हो, इस धारा के प्रवर्तन से छूट दे सकेगी।
29(1). Application for permission for development by other persons
29 (1) संघ सरकार, राज्य सरकार, किसी स्थानीय प्राधिकारी या इस अधिनियम के अधीन गठित किये गये किसी विशेष प्राधिकारी से भिन्न कोई व्यक्ति जो किसी भूमि पर कोई विकास कार्य करने का आशय रखता हो, अनुज्ञा के लिए संचालक को लिखित आवेदन करेगा जो ऐसे प्रारूप में होगा तथा जिसमें ऐसी विशिष्टियां अंतर्विष्ट होंगी और जिसमें साथ ऐसी दस्तावेज भेजें ऐसे प्राकृत परिसंकट उन्मुख क्षेत्र जो, विहित किया जाये, के विकास, नियंत्रण सम्बंधी अधिनियमों, नियमों तथा उपविधियों के उपबंधों का अनुपालन करते हुए भेजी जायेगी।
29(2). Application for permission for development by other persons
(2) ऐसे आवेदन के साथ ऐसी फीस भी होगी जो विहित की जाये।
30(1). Grant or refusal of permission
30 (1) धारा 29 के अधीन आवेदन प्राप्त होने पर, संचालक इस अधिनियम के उपबंधों के अधयाधीन रखते हुए, लिखित आदेश द्वारा - (क) बिना शर्त के अनुज्ञा दे सकेगा, (ख) ऐसी शर्तों के, जैसी कि परिस्थितियों में आवश्यक समझी जाये, अधयाधीन रहते हुए अनुज्ञा दे सकेगा, (ग) अनुज्ञा देने से इनकार कर सकेगा।
30(2). Grant or refusal of permission
(2) शर्तों के अधयाधीन रहते हुए अनुज्ञा देने वाले प्रत्येक आदेश में या अनुज्ञा देने से इनकार करने वाले प्रत्येक आदेश में ऐसी शर्तें अधिरोपित करने के या ऐसे इनकार करने के आधार कथित किये जायेंगे।
30(3). Grant or refusal of permission
(3) कोई भी अनुज्ञा, जो उपधारा (2) के अधीन, शर्तों के साथ या शर्तों के बिना दी गयी हो, ऐसे प्रारूप में होगी, जैसा कि विहित किया जाये।

(4) उपधारा (2) के अधीन प्रत्येक आदेश आवेदक को ऐसी रीति में संसूचित किया जायेगा, जैसा कि विहित की जाये।

(क) ऐसा अभिधान या आरक्षण या आवंटन को अंतिम विकास योजना या परिक्षेत्रिक योजना में से निकाल दिये जाने की मंजूरी देने के लिए राज्य सरकार से निवेदन कर सकेगा। (2) समुचित प्राधिकारी से ऐसा निवेदन प्राप्त होने पर संचालक या जैसी भी कि दशा हो, राज्य सरकार सुसंगत योजनाओं में से ऐसे अभिधान या आरक्षण या आवंटन को निकाल दिये जाने की मंजूरी देते हुए आदेश दे सकेगा / दे सकेगी : परंतु संचालक, या जैसी कि दशा हो, राज्य सरकार, कोई आदेश देने के पूर्व ऐसी जांच कर सकेगा / कर सकेगी, जैसी कि वह आवश्यक समझे और अपना यह समाधान कर सकेगा / कर सकेगी कि ऐसे आरक्षण या अभिधान या आवंटन की लोकहित में और अधिक आवश्यकता नहीं है। (3) उपधारा (2) के अधीन आदेश दिये जाने पर भूमि ऐसे अभिधान, आरक्षण या जैसी भी कि दशा हो, आवंटन से विमुक्त समझी जायेगी और वह पार्श्वस्थ भूमि के मामले में सुसंगत योजना के अधीन अन्यथा अनुज्ञेय विकास प्रयोजन के लिए स्वामी को उपलब्ध हो जायेगी।

(5) यदि संचालक, अनुज्ञा देने या अनुज्ञा देने से इनकार करने के सम्बन्ध में अपना विनिश्चय आवेदक को उस तारीख से, जिसको कि उसका आवेदन प्राप्त हुआ हो, साठ दिन के भीतर संसूचित न करें, तो समझा जायेगा कि ऐसी अनुज्ञा आवेदक को साठ दिन का अवसान होने की तारीख के ठीक पश्चात आने वाली तारीख को दे दी गयी है : परन्तु साठ दिन की कालावधि की संगणना करने में आवेदक से कोई अतिरिक्त जानकारी या दस्तावेजों के लिए अधयापेक्षा करने की तारीख के तथा आवेदक से ऐसी जानकारी या दस्तावेज प्राप्त होने की तारीख के बीच की कालावधि को अपवर्जित कर दिया जायेगा।
31(1). Appeal
31 (1) कोई भी आवेदक, जो धारा 30 के अधीन सशर्त अनुज्ञा देने वाले या अनुज्ञा देने से इनकार करने वाले किसी आदेश से व्यथित हो, उस आदेश के उसे संसूचित किये जाने की तारीख से तीस दिन के भीतर, अपील ऐसे प्राधिकारी को, ऐसी रीति में तथा उसके साथ ऐसी फीस देकर कर सकेगा जैसा कि विहित किया जाए।
31(2). Appeal
(2) उपधारा (1) के अधीन अपील प्राधिकारी, तथा अपीलार्थी और संचालक को सुनवाई का युक्तियुक्त अवसर देने के पश्चात आदेश द्वारा, अपील खारिज कर सकेगा या बिना शर्त के या यथा रूपांतरित शर्तों के अधयाधीन अनुज्ञा प्रदान करते हुए अपील मंजूर कर सकेगा।

(3) धारा 32 के उपबंधों के अधयाधीन रहते हुए, अपील प्राधिकारी का आदेश अंतिम होगा।
34(1). Obligation to acquire land
34 (1) जहां किसी भूमि को किसी योजना द्वारा - (क) नगर विस्तार या नगर सुधार के प्रयोजन के हेतु विकास के लिए, या (ख) संघ या राज्य सरकार या किसी स्थानीय प्राधिकारी या इस अधिनियम के अधीन गठित किये गये किसी विशेष प्राधिकारी के प्रयोजन के हेतु विकास के लिए, या (ग) राजमार्ग या लोकउपयोगी सेवा के रूप में विकास के लिए, अनिवार्य अर्जन के अधयाधीन होना अभिहित किया गया हो और उस भूमि का स्वामी - (एक) यह दावा करता हो कि वह भूमि अपनी वर्तमान स्थिति में युक्तिपूर्वक रूप से फायदेमंद उपयोग के लिए अयोग्य हो गयी हो, या (दो) जहां भूमि का विकास करने की अनुज्ञा शर्तों के अधयाधीन रहते हुए दी गयी हो वहां वह दावा करता हो कि अनुज्ञात विकास को उन शर्तों के अनुसार कार्यान्वित करके भूमि को युक्तिपूर्वक रूप से फायदेमंद उपयोग के योग्य नहीं बनाया जा सकता, (तीन) यह दावा करता हो कि उस भूमि को अर्जन या विकास के लिए अभिहित किये जाने के कारण उस भूमि का विक्रय मूल्य कम हो गया हो, तो स्वामी, सरकार पर ऐसे समय के भीतर, ऐसी रीति में तथा ऐसी दस्तावेजों के साथ, जैसी कि विहित की जाये, एक सूचना तामील कर सकेगा जिसमें समुचित प्राधिकारी से यह अपेक्षा की जायेगी कि वह भूमि में के हित का इस अधिनियम के उपबंधों के अनुसार क्रय कर लें।

(2) उपधारा (1) के अधीन सूचना प्राप्त होने पर, राज्य सरकार, संचालक तथा समुचित प्राधिकारी से ऐसी रिपोर्ट या ऐसे अभिलेख या दोनों, जैसा आवश्यक हो, तत्काल मंगायेगी, जिसे/जिन्हें कि वे प्राधिकारी यथासम्भव शीघ्र किंतु उनकी अधयापेक्षा की तारीख से अधिक तीस दिन के भीतर राज्य सरकार को भेजेंगे।
34(3). Obligation to acquire land
(3) ऐसे अभिलेख या ऐसी रिपोर्ट प्राप्त होने पर राज्य सरकार - (क) यदि उसका यह समाधान हो जाये कि उपधारा (1) में विनिर्दिष्ट की गयी शर्तें पूरी हो गयी हैं, और यह कि अनुज्ञा के लिए सम्यक रूप से आदेश या विनिश्चय, इस आधार पर नहीं किया गया था कि आवेदक ने इस अधिनियम के या उसके अधीन बनाये गये नियमों के उपबंधों में से किसी उपबंध का अनुपालन नहीं किया, तो वह सूचना की पुष्टि कर सकेगी या यह निर्देश दे सकेगी कि अनुज्ञा शर्तों के बिना या ऐसी शर्तों के, जो कि भूमि को युक्तिपूर्वक रूप से फायदेमंद उपयोग के योग्य बना देंगी, अधयाधीन रहते हुए दी जाये, (ख) किसी अन्य मामले में, सूचना की पुष्टि करने से इनकार कर सकेगी, किंतु उस दशा में आवेदक को सुनवाई का युक्तियुक्त अवसर दिया जायेगा।
34(4). Obligation to acquire land
(4) यदि उस तारीख से, जिसको कि सूचना की तामील की गयी हो, एक वर्ष की कालावधि के भीतर, राज्य सरकार उस पर कोई अंतिम आदेश पारित न करें तो यह समझा जायेगा कि उस कालावधि का अवसान हो जाने की तारीख पर सूचना की पुष्टि कर दी गयी है।
34(5). Obligation to acquire land
(5) सूचना की पुष्टि हो जाने पर, राज्य सरकार, ऐसी पुष्टि के एक वर्ष की कालावधि के भीतर उस भूमि का या किसी भूमि के उस भाग को, जिसके कि सम्बन्ध में सूचना की पुष्टि कर दी गयी हो, इस अधिनियम के उपबंधों के अनुसार अर्जित करने के लिए अग्रसर होगी।
35(1). Deletion of designation of land for public purpose
35 (1) समुचित प्राधिकारी, यदि उसका यह समाधान हो जाये, कि भूमि की ऐसे लोक प्रयोजन के लिए जिसके लिए वह प्रारूप विकास योजना या परिक्षेत्रीय योजना में या अंतिम विकास योजना या परिक्षेत्रीय योजना में अभिहित या आरक्षित या आवंटित की गयी हो, और अधिक आवश्यकता नहीं है, तो वह (क) ऐसे अभिधान या आरक्षण या आवंटन को प्रारूप विकास योजना या परिक्षेत्रीय योजना में से निकाल दिये जाने की मंजूरी देने के लिए संचालक से निवेदन कर सकेगा, या
37(5). Amendment of Section 37.
For sub-section (5) of section 37 of the Principal Adhiniyam, the following sub-section shall be substituted, namely :- (5) If the permission-applied for, on depositing the compounding fees prescribed by the State Government by issuing notification from time to time, is granted, the notice shall stand withdrawn: but if not granted, the notice shall stand: or if such permission is granted for the retention only or some buildings or works, or for the continuance of use of only a part of the land or or development of land, the notice shall stand withdrawn in respect of such buildings or works or such part of the land, as the case may be: and thereupon the owner shall be required to take steps specified in the notice under sub-section (1) in respect of such other buildings, works or part of the land.
37(7). Amendment of Section 37.
For sub-section (7) of section 37 of the Principal Adhiniyam, the following sub-section shall be substituted, namely :- (7) Any person prosecuted under clause (a) of sub-section (6) shall, on conviction, be punished with simple imprisonment for a term which may extend to six months or with fine of minimum ten thousand rupees or with both, and in the case of a continuing offence with further fine which may extend to one thousand rupees for every day during which the offence continues after conviction for the first offence.
42(2). Section 42(2)
If the contribution amount which would be due to the Town and Country Development Authority under the provisions of this Act from the owner of a plot to be included in the final scheme exceeds the value of such plot estimated on the assumption that the scheme has been completed, the owner of such plot shall make payment to the Town and Country Development Authority of the amount of such excess.
42(3). Section 42(3)
If such owner fails to make such payment under sub-section (2) within the prescribed period, the Town and Country Development Authority shall acquire the Final plot of such defaulter and apportion the compensation among the owner and other persons interested in the plot on payment by the Town and Country development Authority of the value of such plot estimated at its market value at the date of the declaration of intention to make a scheme and without reference to improvements contemplated in the scheme; and thereupon the plot included in the final scheme shall vest absolutely in the Town and Country Development Authority free from all encumbrances but subject to the provisions of this Act: Provided that the payment made by the Town and Country Development Authority on account of the value of the original plot shall not be included in the costs of the scheme.
49 (partial). Contents of Town Development Scheme
(b) the filling up or rccla1m-uion of lov\1-laying. swampy or unhealthy a reas, or leveling up of land; (c) lay-ou l of new streets or roads, construct ion, diversion, extension, alteration, improvement and closing up of streets and roads and discontinuance of communications; (d) the construction, alteration and removal of buildings, bridges and other structures; (e) the allotment or earmarked of land for roads, open spaces, gardens, recreation grounds, schools, markets, green belts, dairies, transport facilities, public purposes of all kinds; (f) drainage, inclusive of sewerage, surface or sub-soil drainage and sewage disposal; (g) lighting; (h) water supply; (i) the preservation of objects of historical or national interest or natural beauty, and of buildings actually used for religious purposes; U) the reservation of land to the extent of Len per cent; or such percentage as near thereto as possible of lhe net residcnliaJ area covered under the scheme. for the purpose or providing housing accommodation Lo the members of Economically Weaker SecUon of the society and Lower lncome Group. (kl (a) the allotment of land from the total area covered under Lhc scheme, to the extent of Fifty percent for the following purposes:- (i) roads; (ii) parks, playgrounds, gardens and open space; (iii) social infrastructure such as school, dispensary, fire brigade public utility place, industrial development; (iv) sale by Country Town and Development Authority for residential, commercial, industrial use or any other use ,to raise the funds to provide infrastructure facilities under the scheme area depending upon the nature of development. (b) the proceeds from the sale of land ref erred to in paragraph (iv) of sub-clause (a) of Clause Wl, shall be used for the purpose of providing infra, truc-tural lr1cilitie-s and its mr1 in tenance. (1) reconstitution of plots for fulfilhng the purposes as prescribed under this section; (m) the town development Scheme may also provide the social facilities as per rules made under this Act; (n) The proposals of the Town development Scheme shall be treated as "Public Purpose"; (o) lo prepare development control regulations for town development scheme or schemes; (p) the suspension, so far as may be necessary, for the proper carrying out of the scheme, of any rule, bye-law, regulation, notification or order made or issued under any Act of the State Legislature or any of the Acts which the State Legislature is competent to amend; (q) exclude the areas of Village settlement, as identified under the Development Plan for the purpose of town development scheme; (r) proposals to allocate transferable development right to any final plot owner in lieu of loss of area from lhe original plot with the consent of the owner; (~) est imnt ~ or the totc1 I cu!'-.t of th<' scheme- ;rnd manner in \ hich the cost to be r<:>covered including the levy of betterment charges and/ or deYelopment charges; and (t) such other mallers nol inconsistent with the objects of this Act as may be pre cribcd .

50-क. विकास प्राधिकरण का गठन
For Section 50 of lhe Principal Act, the following shall be substituted and shall be deemed to have been substituted with effect from 1st day of November, 2000, namely:-"50. Preparation of Town Development Sche mes.- ( 1) Declaration of Intention: The Town and Country Development J\uthority may, at any time, by resolution, declare ils intention to prepare a Lown development scheme in respect of such area: Provided that no such declaration of intent sha11 be made without prior approval of the State Government. (2) Publication of Intention: Not later than thirty days from lhe date of such declaration of intention under sub-section ( J) to mal<.e a town development scheme, the Town and Country Development Authority shall publish the declaration in the Official Gazette and in such ot ll..'I' manners, as mDy be. prescri b( cl . (3 ) Pre parat ion and publication of Draft sch e m e : (i) Nol later than two years from Lhe date of pu blica t.ion of the declaration under sub-section (2), the Town and Country Development Authority shall prepare a town development scheme in draft form and publish it in such form and manner as may be prescribed together with a notice inviting objections and suggestions from any person with respect Lo the said draft town development scheme before such dale as may be specified therein, such date being not earlier than thirty days from the date of publications of such notice; (ii)Contents of Draft Scheme:- A draft scheme shall contain the following particulars so far as may be necessary, that is to say,- (a) the area, ownership and tenure of each original plot; (b) The particu lars of land allotted or reserved under clause (e) of sub-section (3) of Section 49 with general indication of the uses to which such land· is to be pu t and the terms and condition, subject to which such land is to be put to sut h uses: (c) The extent to v.•hich it is proposed to alter the boundaries of original plots; (d) A full descripLlon of all the details of the scheme under sub-secUon (3) of Section 49 a may be applicable; (c) an estimate of the net cost of the scheme to be borne by the Town and Country Development Authority; (f) to form a final plot by the reconstitution of an original plot by the alteration of its boundaries, if necessary; (g) to form a final plot from an original plot by the transfer of any adjoining lands; (h) to provide with the consent of the owners that two or more original plots which are owned by several persons or owned by persons jointly be held in ownership in common as a final plot, with or without alteration of boundaries; (i) to allot a final plot to any owner dispossessed of land in furtherance of the scheme; U) to transfer the ownership of a plot from one person to another; and (k) any other prescribed particulars. (4 ) Finalization of the Draft Sch e m e : The Town and Country Development Authority shall consider all the objections and suggestions as may be received within the period specified m the notice under sub-section (3) and after incorporating necessary modifications, as it think fits in the Draft Scheme, submit the draft scheme to the State Government along with all the suggestions and objections for sanction. (5) ( 1) Power of the State Government to Sanction Draft Scheme: (i) On receiving draft scheme under sub-section (4), the State Government may, not later than six months from the date of its receipt, by notification, sanction such scheme with or without modifications or subject lo such conditions as it may think fit to impose or refuse to sanction it; (ii) The State Government may if deemed fit, by notification in the official gazelle, return Lhe scheme to the Town and Country Development Authority Lo carry out such modifications as may be directed, including the direction to include or exclude an) land in question in the Scheme; (iii) The Town and Cou ntry Development Au thori Ly shall com ply with the directions of the State Government and shall after following the procedure as laid down under sub-section (3) of Section 50, submit the scheme within the specified lime limit to the State Government; (iv) If the State Government sanctions such scheme, it shall in such notification state at what place and time the draft scheme shall be open for the inspection of the public. (2) Vesting of Land in Town and Country Development Authority- (i). As Soon as the date on which the draft scheme is sanctioned by the State Government under sub-clause (iv) of clause (1) of sub-section (5) of Section 50, all the lands required by the Town and Country Development Authority for the purposes specified in clause (c), (D, (g) or (h) of sub-section (3) of Section 49 shall vest absolutely in the Town and Country Development Authority free from all encumbrances; (ii) Nothing in sub-clause (i) shall affect cmy rig1J1 nl the m11. ncr of I he land vesting in Lhc Town and Counlry Devclopmenl Au Lhority under that section; (iii)The provision of sub-section (8) of Section 50 shall mu tatis mutandis apply to the sanctioned drafl scheme for 1 he purpose as specified under sub-clause (i), as if the sanctioned draft scheme were a final scheme (6)Within one month from the date on which the notification sanctioning the draft scheme by the State Government is published m the official gazette, the State Government shall for the purposes or one or more Town Development Schemes received by it for sanction, constitute a committee consisting of such officers as may be prescribed, who shall prepare the Final Scheme in accordance with Lhe sanctioned draft scheme and call for objections and suggestions with regard to the final Scheme in the manner as prescribed; (7) ( 1) The committee constituted under sub-section (6) shall consider the objections and suggestions and g1, 1 11<:-.~rin.2, to such person~ ;-is are desirous of being heard and shall submit its Final Scheme to the Stalr Government within such time a s it may fix along with proposals as under:- (i) define and demarcate the a reas allotted to or reserved for any public purpose on plan; (ii) demarcate the reconstituted final plots on plan; (iii) provide for the total or partial transfer of any right in an original plot to a final plot or provide for the transfer of any right in an original plot in accordance with the provisions of Section 58-D; (iv) evaluate the value of original plot and reconstituted plot; (v) estimate the value and fix the difference between the total values of the original plots and the plots included in the final scheme in accordance with the provisions of this Act; (vi) determine whether the areas used, allotted, or reserved for public purpose or public purposes of town and country development authority are beneficial wholly or partly to the residents or owners \hhin the area of the scheme, if applica blc; (vii) estimate the portion of the sums payable as compensation on each plot used, allotted or reserved for a public purpose or for the purpose of the Town and Country Development authority, which is beneficial partly to the owners or residents within the area of the scheme and partly to the general public, which shall be included in the cost of scheme; (viii) Calculate the contribution to be levied under section 58-C, on each plot used, allotted or reserved for a public purpose or for the purpose of the town and country development authority which is beneficial partly lo the owners or residents within the area of the scheme and partly to the general public; (ix) Estima te the. increment to accrue in respect of each plot included in the scheme in accordance with the provisions

(3 ) Pre parat ion and publication of Draft sch e m e : (i) Nol later than two years from Lhe date of pu blica t.ion of the declaration under sub-section (2), the Town and Country Development Authority shall prepare a town development scheme in draft form and publish it in such form and manner as may be prescribed together with a notice inviting objections and suggestions from any person with respect Lo the said draft town development scheme before such dale as may be specified therein, such date being not earlier than thirty days from the date of publications of such notice; (ii)Contents of Draft Scheme:- A draft scheme shall contain the following particulars so far as may be necessary, that is to say,- (a) the area, ownership and tenure of each original plot; (b) The particu lars of land allotted or reserved under clause (e) of sub-section (3) of Section 49 with general indication of the uses to which such land· is to be pu t and the terms and condition, subject to which such land is to be put to sut h uses: (c) The extent to v.•hich it is proposed to alter the boundaries of original plots; (d) A full descripLlon of all the details of the scheme under sub-secUon (3) of Section 49 a may be applicable; (c) an estimate of the net cost of the scheme to be borne by the Town and Country Development Authority; (f) to form a final plot by the reconstitution of an original plot by the alteration of its boundaries, if necessary; (g) to form a final plot from an original plot by the transfer of any adjoining lands; (h) to provide with the consent of the owners that two or more original plots which are owned by several persons or owned by persons jointly be held in ownership in common as a final plot, with or without alteration of boundaries; (i) to allot a final plot to any owner dispossessed of land in furtherance of the scheme; U) to transfer the ownership of a plot from one person to another; and (k) any other prescribed particulars. (4 ) Finalization of the Draft Sch e m e : The Town and Country Development Authority shall consider all the objections and suggestions as may be received within the period specified m the notice under sub-section (3) and after incorporating necessary modifications, as it think fits in the Draft Scheme, submit the draft scheme to the State Government along with all the suggestions and objections for sanction. (5) ( 1) Power of the State Government to Sanction Draft Scheme: (i) On receiving draft scheme under sub-section (4), the State Government may, not later than six months from the date of its receipt, by notification, sanction such scheme with or without modifications or subject lo such conditions as it may think fit to impose or refuse to sanction it; (ii) The State Government may if deemed fit, by notification in the official gazelle, return Lhe scheme to the Town and Country Development Authority Lo carry out such modifications as may be directed, including the direction to include or exclude an) land in question in the Scheme; (iii) The Town and Cou ntry Development Au thori Ly shall com ply with the directions of the State Government and shall after following the procedure as laid down under sub-section (3) of Section 50, submit the scheme within the specified lime limit to the State Government; (iv) If the State Government sanctions such scheme, it shall in such notification state at what place and time the draft scheme shall be open for the inspection of the public. (2) Vesting of Land in Town and Country Development Authority- (i). As Soon as the date on which the draft scheme is sanctioned by the State Government under sub-clause (iv) of clause (1) of sub-section (5) of Section 50, all the lands required by the Town and Country Development Authority for the purposes specified in clause (c), (D, (g) or (h) of sub-section (3) of Section 49 shall vest absolutely in the Town and Country Development Authority free from all encumbrances; (ii) Nothing in sub-clause (i) shall affect cmy rig1J1 nl the m11. ncr of I he land vesting in Lhc Town and Counlry Devclopmenl Au Lhority under that section; (iii)The provision of sub-section (8) of Section 50 shall mu tatis mutandis apply to the sanctioned drafl scheme for 1 he purpose as specified under sub-clause (i), as if the sanctioned draft scheme were a final scheme (6)Within one month from the date on which the notification sanctioning the draft scheme by the State Government is published m the official gazette, the State Government shall for the purposes or one or more Town Development Schemes received by it for sanction, constitute a committee consisting of such officers as may be prescribed, who shall prepare the Final Scheme in accordance with Lhe sanctioned draft scheme and call for objections and suggestions with regard to the final Scheme in the manner as prescribed; (7) ( 1) The committee constituted under sub-section (6) shall consider the objections and suggestions and g1, 1 11<:-.~rin.2, to such person~ ;-is are desirous of being heard and shall submit its Final Scheme to the Stalr Government within such time a s it may fix along with proposals as under:- (i) define and demarcate the a reas allotted to or reserved for any public purpose on plan; (ii) demarcate the reconstituted final plots on plan; (iii) provide for the total or partial transfer of any right in an original plot to a final plot or provide for the transfer of any right in an original plot in accordance with the provisions of Section 58-D; (iv) evaluate the value of original plot and reconstituted plot; (v) estimate the value and fix the difference between the total values of the original plots and the plots included in the final scheme in accordance with the provisions of this Act; (vi) determine whether the areas used, allotted, or reserved for public purpose or public purposes of town and country development authority are beneficial wholly or partly to the residents or owners \hhin the area of the scheme, if applica blc; (vii) estimate the portion of the sums payable as compensation on each plot used, allotted or reserved for a public purpose or for the purpose of the Town and Country Development authority, which is beneficial partly to the owners or residents within the area of the scheme and partly to the general public, which shall be included in the cost of scheme; (viii) Calculate the contribution to be levied under section 58-C, on each plot used, allotted or reserved for a public purpose or for the purpose of the town and country development authority which is beneficial partly lo the owners or residents within the area of the scheme and partly to the general public; (ix) Estima te the. increment to accrue in respect of each plot included in the scheme in accordance with the provisions

50(5). Amendment of Section 50.
For sub-section (5) of section 50 of the Principal Adhiniyam, the following sub-section shall be substituted, namely :- (5) Where the town development scheme relates to reconstitution of plots, the Town and Country Development Authority shall, notwithstanding anything contained in sub-section (4), constitute a committee consisting of the Chief Executive Officer of the said Authority and two other members of whom one shall be representative of the district collector, not below the rank of Deputy Collector and the other shall be an officer of the Town & Country Planning Department not below the rank of Deputy Director nominated by the Director of Town & Country Planning for the purpose of hearing objections and suggestions received under sub-section (3).
50(7)(x)-(xv). Powers and duties of the Committee regarding town development scheme
(x) Calculate the proportion of the contribution to be levied on each plot in the final scheme to the increment estimated to accrue in respect of such plot under Section 58-C; (xi) Calculate the contribution to be levied on each plot included in the final scheme; (xii) determine the amount to be deducted from, added to, as the case may be, the contribution leviable from a person in accordance with the Section 58-C. (xiii) estimate the claims made before it, after notice has been given in the prescribed manner and in the prescribed form, the compensation to be paid to the owner of any property or right injuriously affected by the making of the town development scheme in accordance with the provisions of Section 58-E; (xiv) draw in prescribed form the final scheme in accordance with the sanctioned draft scheme Provided that the Committee may make modification from the draft scheme, but no such variation, if it is of a substantial nature shall be made except with the previous sanction of the State Government, and except after hearing the Town and Country Development Authority; Explanation.- for the purpose of clause (xiv), substantial variation means increase in the total cost of the draft scheme by more than 20 percent, on account of new works or reservation of additional sites for public purposes included in the final scheme drawn up by the committee. (xv) determine such other matters as may be prescribed. (2) The Committee shall decide the matters referred to in the clause (1) within a period of three months, which may be extended by the State Government, from time to time, after recording reasons in writing, submit the Final Scheme together with a copy of objections and suggestions received by it, to the State government for its sanction.
50(8). Sanction of Scheme
(1) The State Government on receipt of the Final Scheme under clause (2) of sub-Section (7) of Section 50 may within three months from the date of its receipt, by notification sanction the Final Scheme: Provided that in sanctioning such scheme, the State Government may make modifications as may in its opinion, be necessary for the purpose of correcting an error, irregularity or informality. (2) Immediately after the town development scheme is sanctioned by the State Government under clause (1), the same shall be publish in the Gazette and in such other manner as may be prescribed, as a final town development scheme and specify the date on which it shall come into operation. (3) On and after the date fixed in such notification under clause (2), a town development scheme shall have effect as if it were enacted in this Act. (4) Within a period of one year from the date of publication of final notification of enforcement of Town Development Scheme, plots specified in the scheme shall have to be allotted to the land owners.

428(2). Validation of Town Development Scheme no. 4 (Kamal Vihar)
reconstituted plots and shall be deemed to be validly transferred to the land owners by the Government instrumentality or the transfer to the Government instrumentality by the said land owners, under the Principal Act, as amended by this Act, excluding those 13 land owners whose acquisition is quashed by the Honourable Supreme Court of India and all action taken by the Raipur Development Authority of preparing the town development Scheme no.4 (Kamal Vihar) and all the acts done in furtherance thereof shall be deemed to be validly done under the provisions of the Principal Act, as amended by this Act and shall not be challenged in any court of law, tribunal or Authority and no person included within the Town Development Scheme -4 (Kamal Vihar), will be entitled for any return of the original plot or for compensation covered under the Scheme.
428(3). Validation of Town Development Scheme 'Indraprasth Phase-2'
Notwithstanding anything contained in the Principal Act, or in any rules or regulations made thereunder, any judgment, decree or order of any court of law, tribunal or other authority, or any law for the time being in force, the Town Development Scheme nomenclature as "Indraprasth Phase-2", which is already prepared and notified in the gazette notification, wherein the process of executing the agreements for acquiring the lands by mutual consent has already been began since 1.2.2014 by the Raipur Development Authority with the land owners under Section 56 of the Principal Act and wherein majority of the agreements are already executed by the Raipur Development Authority with the mutual consent of the land owners since then and the development of the said lands is already in progress and substantial developmental work has already been completed by the Raipur Development Authority in the said scheme, wherein the majority of the lands owners have also already given their consent to be the part of the scheme, the said scheme shall be deemed to have and always be valid in the Principal Act, as amended by this Act and the reconstituted plots which are already transferred and the reconstituted plots which are already agreed to be transferred to remaining land owners shall be construed as legal transfer and the roads, drainage, electricity and other facilities which are already constructed or is in progress, shall be deemed to be construed legally developed by the Raipur Development Authority (Town and Country Development Authority) under the Town Development Scheme "Indraprasth Phase-2" and all the land owners shall be construed as legally valid in possession of the said reconstituted plots and shall be deemed to be validly transferred to the land owners by the Government instrumentality or the transfer to the Government instrumentality by the said land owners, under the Principal Act, as amended by this Act, and all the acts done in furtherance thereof shall be deemed to be validly done under the provisions of the Principal Act as amended by this Act and shall not be challenged in any court of law, tribunal or Authority and no person included within the Town Development Scheme Indraprasth Phase-2, will be entitled for any return of the original plot or for compensation covered under the said Scheme.
428(4). Validation of Town Development Scheme 'Specialized Commercial Zone'
Notwithstanding anything contained in the Principal Act, or in any rules or regulations made thereunder, any judgment, decree or order of any court of law, tribunal or other authority, or any law for the time being in force, the Town Development Scheme nomenclature as "Specialized Commercial Zone", wherein the Raipur Development Authority has already notified the said Draft Town Development scheme and published in gazette notification dated 17.2.2012 under sub-section (3) of Section 50 of the Principal Act and wherein the committee is already constituted and objections are already heard under sub-section (5) of Section 50 of the Act and wherein the recommendation of the committee are submitted under sub-section (6) of Section 50 of the Principal Act to the Raipur Development Authority-Town and Country Development Authority, the actions already taken under the said scheme shall be deemed to have and always be valid in the Principal Act, as amended by this Act and, and all the acts done in furtherance thereof shall be also deemed to be validly done under the provisions of the Principal Act as amended by this Act and shall not be challenged in any court of law, tribunal or Authority.
