Order for demolition of alteration of buildings

If any building or part of any building has been commenced or constructed not in conformity with the provisions of this Chapter or any rules or by-laws made in relation to buildings, the Corporation may, in addition to any prosecution that may be instituted under this Act, apply to a Magistrate and the Magistrate may order such building or such portion thereof as the case may be to be demolished after giving the owner of such building an opportunity of being heard and of adducing evidence, if he is satisfied that the building or the portion thereof is affecting or is likely to affect the health or comfort of the owner or occupier of any other building or the sanitation of the safety of any other building, or the site or has encroached upon any public street,
