Nothing in this section shall apply to the payment of fees to a legal practitioner for services rendered by him in his professional capacity.

Personal liability of Councillors :— (1) A person shall be liable for any expenditure made from Municipal Fund contrary to law where such illegal payment has been authorised by him while acting as Chairperson, Vice-Chairperson. '[* * *] Councillor or Executive Officer.

Provided that the State Government may in their discretion for reasons to be stated in writing condone any such illegal payment.

In any such case, where an application has not been condoned by the State Government, a suit for compensation may be instituted against the person in pursuance of the decision of the municipality at a meeting.

2[(2) Nothing in sub-section (1) shall apply to a person who is liable under Section 73-A.]
