Effect of non- compliance with requisition under section 338 or 340.

If any requisition made under section 338 or 340 is not complied with, the notice given under section 337 shall be deemed not to have been given.

Section 338 was re-numbered as section 338 (1) by Bom. 5 of 1905, s. 45(1). Clause (a) was substituted for the original clause (a) by Mah. 10 of 1998, s. 45(2). These words were inserted by Bom. 1 of 1916, s. 5(1). Clause (b) was substituted for the original clause (6) by Bom. 5 of 1905, s. 45(2). These words were substituted for the words “a scale of not less one inch to every forty feet” by Bom. 1 of 1916, s. 5(2). These words were added by Bom. 5 of 1905, s. 45(3). Sub-section (2) was inserted by Bom. 5 of 1905, s. 45(4).
