The Uttarakhand Road Infrastructure Protection Act, 2014

(1) This Act may be called the Uttarakhand Road Infrastructure Protection Act, 2014. (2) It shall extend to the whole of the State of Uttarakhand. (3) It shall come into force at once.

In this Act, unless the context otherwise requires:— (क) "Agriculture" includes horticulture, dairy farming, poultry farming and planting of trees in any orchard and its maintenance; (ख) "Appellate Authority" means the Regional Chief Engineer of the Public Works Department of Uttarakhand, appointed by the Government by notification in the Official Gazette to perform any or all the functions conferred by this Act and the rules made thereunder; (ग) "Building" means any structure of a residential, hut or other roof, whether for any purpose or constructed of any material, and any part thereof, and includes any wall or pucca house or pucca trench or drain therein, but does not include any tent or fencing for agricultural purposes; (घ) "Building line" means a line on one side of a road or part of a road as specified by the Government by notification in the Official Gazette in such road or part thereof, in the prescribed manner; (ङ) "Approval Authority" means any authority not below the rank of Executive Engineer of the Public Works Department of Uttarakhand, appointed by the Government by notification in the Official Gazette to perform any or all the functions conferred by this Act and the rules made thereunder; (च) "Controlled Area" means any area declared under section 3 of the Uttar Pradesh Roadside Land Control Act, 1945 (as amended from time to time) for the purposes of this Act; (छ) "Controlled line" means any area of the road or part of the road other than the building line specified in the prescribed manner by the Government by notification in the Official Gazette; (ज) "Department" means such department of the Uttarakhand Government which performs activities related to road infrastructure; (झ) "Government" means the Government of Uttarakhand; (ञ) "Map" means the road infrastructure map of any part notified by the State Government under section 4 of this Act; (ट) "Official Gazette" means the Gazette of Uttarakhand; (ठ) "Place of Worship" includes temple, church, mosque, imam bara, dargah, karbala, takiya, idgah, samadhi, math, sati place or gurudwara; (ड) "Prescribed" means prescribed by rules made under this Act; (ढ) "Prescribed Authority" means any authority not below the rank of Junior Engineer of the Public Works Department of Uttarakhand, appointed by the Government by notification in the Official Gazette to perform any or all the functions conferred by this Act and the rules made thereunder; (ण) "Review Authority" means the Secretary of the Public Works Department of Uttarakhand, appointed by the Government by notification in the Official Gazette to perform any or all the functions conferred by this Act and the rules made thereunder; (त) "Road" means the road under protection of the Uttarakhand Government or any local authority and does not include the National Highway; (थ) "Road Infrastructure" means any road, path and street for traffic or communication, and includes— (one) width of the acquired road land; (two) all types of roads and their structure, such as road kharanja, edges, retaining wall, breast wall, general wall, drains, turns, roadside drains, road junction, medians, speed breakers, road lights, traffic lights etc.; (three) any traffic and communication method road auxiliary structure; (four) bridges including approach road, retaining wall, breast wall, protective work and supporting structures; (five) express ways including interchange, grade separation, dual-carriageway and other necessary infrastructure; (six) road facilities like parapets, railings, mile stones, kilometer stone, bench, signs, view and sign boards, barricading and crash barriers; (seven) road over bridge, flyovers and access roads and their supporting structures; (eight) road side parking site; (nine) road side plantation, nursery, hedge and other landscape elements; (ten) toll booth/plaza; (eleven) tunnels and necessary structures; (twelve) road side amenities/structures like shelter for protection from rain, bus lane, public amenities, park and open space situated on land adjoining the road; (द) "Secretary" means the Secretary of the Government of Uttarakhand for the Public Works Department and includes any person appointed for the time being as Secretary to perform any or all functions conferred by this Act and the rules made thereunder by notification; (ध) "Work Inspector" means any employee of the Public Works Department appointed by the State Government by notification and includes work agent of the department.

No person shall— (one) encroach upon the government land under road infrastructure; (two) construct any permanent, temporary or movable structure on the road or road infrastructure; (three) execute any workshop or any commercial activities including tying of animals on road infrastructure which results in misuse of the road; (four) obstruct/damage the system of roadside and cross-drains; (five) dump garbage from private properties on the road; (six) scatter excavated soil/debris or any other material on the road and shall not store materials/goods permanently in an unauthorized manner; (seven) damage/dig the road infrastructure without the permission of the competent authority; (eight) install any handpump or petrol pump in an unauthorized manner; (nine) damage the approach road, retaining wall, breast wall, parapet, railing, and lighting system, protective works, tunnel, their supporting structures and other structures like road kharanja, edges, retaining wall, breast wall, boundary wall, drainage and roadside drains, road junction, speed breakers, street light, traffic light.

(1) सड़क संरचना का प्रभारी अधिशासी अभियन्ता 1.500 माप पर अपने क्षेत्राधिकार में सड़क संरचना का एक नक्शा जो कि सड़क की लम्बाई और चौड़ाई को प्रदर्शित करें, तैयार करेगा। (2) नक्शे में महत्वपूर्ण स्थलों जिसमें भवन और नियंत्रण रेखाएं तथा राजस्व विभाग द्वारा नियत स्थल सहित सड़क संरचना के रूप में सड़क संरचना के चिन्हांकन और पुनः सीमांकन के लिए संदर्भ बिन्दु भी प्रदर्शित करेगा और नक्शे को सम्बन्धित क्षेत्रीय मुख्य अभियन्ता द्वारा अनुमोदित किया जायेगा। (3) सरकार समाचार पत्रों में प्रकाशित कर लोगो को सड़क के नक्शे के विद्यमान्यता के सम्बन्ध में उसकी चाहरदीवारी तथा अन्य महत्वपूर्ण स्थलो को दर्शायेगा तथा सड़क संरचना के प्रभारी अधिशासी अभियन्ता के कार्यालय में लोक निरीक्षण के लिए नक्शे को उपलब्ध करायेगा तथा समाचार पत्र में सूचना के प्रथम प्रकाशन के दिन से साठ दिन के भीतर लोगो से आपत्तियां आमंत्रित करेगा और इसी प्रकार से प्रत्येक विस्तार अथवा परिवर्तन क्रमशः प्रदर्शित करेगा। (4) उठायी गई आपत्तियों के निस्तारण पश्चात् सरकार ऐसे नक्शे को अंतिम रूप देगी और उसकी विधिमान्यता और अधिशासी अभियन्ता के कार्यालय में संदर्भ तथा प्रयोग की उपलब्धता के सम्बन्ध में जनता को सूचित करेगा। (5) उपधारा 3 के अधीन कार्यवाही कर लिये जाने पश्चात् उत्तराखण्ड लोक निर्माण विभाग के खण्ड में सड़क संरचनात्मक के संदर्भ अभिलेख में रख दिया जायेगा और वह खण्ड के सड़क संरचना नक्शा के रूप में जाना जायेगा। (6) विहित/अनुमोदित प्राधिकारी के क्षेत्राधिकार के भीतर सभी प्रतिषिद्ध गतिविधियों के होने पर उत्तराखण्ड लोक निर्माण विभाग के सम्बन्धित खण्ड के सड़क संरचना नक्शे को निर्धारण हेतु संदर्भित किया जायेगा। (7) सड़क संरचना नक्शा जन सामान्य के निरीक्षण के लिए खण्ड में उपलब्ध रहेगा और विहित शुल्क के भुगतान करने पर क्षेत्र के सम्बन्धित अधिशासी अभियन्ता से उसकी सत्यापित प्रति प्राप्त की जा सकेगी। (8) राजमार्ग सहित भूमि के नियंत्रण के लिए और अतिक्रमण को हटाने के लिए सरकार चिन्हित करेगी और सड़क के किनारे की निजी सम्पत्ति को भवन क्रम और नियंत्रण रेखा से दूर करने के लिए बाध्य करेगी।

विहित प्राधिकारी अथवा कार्य निरीक्षक का यह कर्तव्य होगा कि वह यह सुनिश्चित करें कि उसके क्षेत्राधिकार में अधिनियम की धारा 3 के अधीन कोई प्रतिषिद्ध गतिविधियां नही हो रही है।

(1) धारा 3 के अधीन प्रतिषिद्ध किसी गतिविधि की जानकारी होने पर विहित प्राधिकारी दोषी व्यक्ति को प्रतिषिद्ध गतिविधियों रोकने के लिए आदेश जारी करेगा एवं आवश्यकता होने पर सड़क संरचना को यथास्थिति बनाये रखने के आदेश देगा। (2) उपधारा 1 के अधीन विहित प्राधिकारी का आदेश प्रतिषिद्ध गतिविधि को स्पष्ट रूप से वर्णित करते हुए लिखित रूप में होगा और स्कैच के माध्यम से भी प्रतिषिद्ध गतिविधि के प्रकटन की स्थिति नक्शे के सम्बन्धित भाग पर इंगित करेगा तथा ऐसी गतिविधि के विस्तार पर हुई क्षति अथवा होने वाली क्षति से अवगत करायेगा। (3) विहित प्राधिकारी दोषी व्यक्ति को निर्दिष्ट अवधि के भीतर सड़क संरचना को अपने मूल स्थिति में लाने हेतु निर्देशित करेगा व नोटिस जारी करने के तीन दिन के भीतर यथास्थिति बनाये रखने की प्रक्रिया प्रारम्भ करने और पूर्ण करने अनुदत्त समय भी प्रदान करेगा। (4) विहित प्राधिकारी इस धारा के अधीन दिये गये कोई निर्देश अथवा पारित आदेश का अनुपालन में असफल रहने वाले विशेष रूप से दोषी व्यक्ति के मूल्य और उसके जोखिम पर यथास्थिति बनाये रखे जाने के लिए कार्यवाही करेगा, इसके अतिरिक्त मौलिक रूप में लाने हेतु मूल्य को अधिरोपित कर सकेगा। इस प्रकार आय-व्यय की वसूली भू-राजस्व के रूप में की जा सकेगी और विहित प्राधिकारी तदनुसार सरकार को सुनिश्चित करेगा और विहित रीति से किसी प्रतिषिद्ध गतिविधि के फलस्वरूप उपयोग में लायी गई सम्पत्ति को जब्त कर बिक्री करेगा। (5) नोटिस की तामील सिविल प्रक्रिया संहिता, 1908 में दी गई रीति के अनुरूप होगी। (6) इस धारा के अधीन पारित किसी आदेश को किसी आधार पर किसी सिविल न्यायालय में चुनौती नही दी जा सकेगी।

इस अधिनियम की धारा 11 में जैसा अभिव्यक्त रूप से उपबन्धित है, विहित प्राधिकारी सड़क संरचना पर छोड़े गये वाहन/मशीन/सामाग्री को कब्जे में लेगा और इसके अतिरिक्त हटाने के मूल्य पर विहित प्राधिकारी की अभिरक्षा में वाहन/मशीन/सामाग्री रखने की अवधि के लिए बीस हजार रुपये लेकिन न्यूनतम पांच हजार तक का दण्ड अधिरोपित कर सकेगा, परन्तु यह कि विहित प्राधिकारी की अभिरक्षा में लिए गये वाहन/मशीन/सामाग्री को दस दिन से अधिक के लिए रखा जाता है तो अनुमोदन प्राधिकारी कब्जे में ली गई सम्पत्ति के निस्तारण के लिए भारतीय पुलिस अधिनियम, 1861 की धारा 25, 26 और 27 के अधीन कार्यवाही करेगा।

व्यथित पक्ष का विहित प्राधिकारी द्वारा जारी आदेश के विरूद्ध अनुमोदन प्राधिकारी को उक्त आदेश की तामील के पन्द्रह दिन के भीतर आपत्ति योजित कर सकेगा और अनुमोदन प्राधिकारी व्यथित पक्षकार को सुनवाई का अवसर देते हुए और उसके पश्चात् तीस दिन के भीतर अनुमोदन अथवा निरस्त करने के आदेश स्वपठित और कारण सहित विहित प्राधिकारी के माध्यम से जारी करेगा।

(1) अनुमोदन अधिकारी द्वारा पारित किसी आदेश के विरूद्ध कोई अपील तब तक स्वीकार नही की जायेगी जब तक कि अनुमोदन प्राधिकारी के आदेश के पारित होने के तीस दिन के भीतर अपील योजित न कर दी गई हो, परन्तु यह कि इस धारा के अधीन विनिर्दिष्ट अवधि के समाप्त होने के पश्चात् कोई अपील स्वीकार की जा सकेगी यदि आवेदक अपीलीय प्राधिकारी का यह समाधान कर दे कि निर्धारित अवधि के भीतर अपील योजित न करने के पर्याप्त कारण थे, परन्तु यह और कि आवेदक जब ऐसे आदेश के विरूद्ध अपील योजित करें, विभाग द्वारा आंकलित सम्भावित मूल्य की पचास प्रतिशत धनराशि जमा करेगा। (2) अपीलीय प्राधिकारी अपील के योजित होने के तीस दिन के भीतर अनुमोदन अधिकारी द्वारा पारित आदेश को अनुमोदित अथवा खारिज कर सकेगा।

(1) धारा 9 के अधीन अपीलीय प्राधिकारी द्वारा अपील में पारित आदेश से व्यथित कोई व्यक्ति ऐसे आदेश के संसूचित होने के तीस दिन के भीतर पुर्नविलोकन के लिए सरकार को आवेदन कर सकेगा। (2) अपीलीय प्राधिकारी के आदेश के विरूद्ध पुर्नविलोकन प्राधिकारी पुर्नविलोकन आवेदन के प्रस्तुत करने के तीस दिन के भीतर या तो अपीलीय प्राधिकारी के आदेश को अनुमोदित करेगा अथवा खारिज करेगा। सरकार इस धारा के अधीन प्रतिकूल प्रभाव डाले बिना ऐसे व्यक्ति को सुनवाई का समुचित अवसर दिये बिना कोई आदेश पारित नही करेगी।

(1) धारा तीन के खण्ड (एक), (तीन) और (आठ) में संदर्भित किसी प्रतिषिद्ध गतिविधि में सम्मिलित कोई व्यक्ति विहित प्राधिकारी सड़क संरचना को उसके मौलिक रूप में लाने के लिए आदेश दे सकेगा और यदि ऐसा व्यक्ति ऐसे आदेश पारित होने के तारीख से सात दिन की अवधि के भीतर कार्य प्रारम्भ करने में असफल रहता है तथा अनुदत्त समय के भीतर पूरा नही करता है तो विहित प्राधिकारी त्रुटिकर्ता के मूल्य पर आदेश को प्रभावी किये जाने हेतु ऐसे उपाय कर सकेगा जैसा वह आवश्यक समझें। (2) यदि कोई व्यक्ति इस अधिनियम की किसी उपबन्धों अथवा उपधारा (1) के अधीन दिये गये आदेश के विरूद्ध कार्य करता है अथवा अनुपालना करने में असमर्थ रहता है तो विहित प्राधिकारी सुनवाई का समुचित अवसर देकर ऐसे व्यक्ति को सड़क संरचना को मौलिक रूप में लाये जाने का शुल्क तथा सड़क संरचना के मौलिक मूल्य को अतिरिक्त रूप से निम्नवत् भुगतान करने के आदेश दे सकेगा- (एक) धारा 3 के खण्ड (दो), (चार), (पांच), (सात), (नौ), (ग्यारह), (सोलह) और (सत्रह) में संदर्भित कोई प्रतिषिद्ध गतिविधि के उल्लंघन के लिए मौलिक मूल्य के पांच गुने के बराबर होगा, (दो) धारा 3 के खण्ड (छ:) में संदर्भित कोई प्रतिषिद्ध गतिविधि के उल्लंघन के लिए खुदान की मिट्टी/मलवा के संदर्भ में एक हजार रुपये प्रतिघन मीटर अथवा उसके भाग और खड़ी/पड़ी सामग्री के संदर्भ में दो हजार रुपये प्रति ट्रक भार अथवा उसके किसी भाग के प्रतिदिन की दर से, (तीन) धारा 3 के खण्ड (बारह) में संदर्भित कोई प्रतिषिद्ध गतिविधि के उल्लंघन के लिए एक हजार रुपये प्रतिघन मीटर प्रति सप्ताह तब के लिए जब तक यह बना रहे, (चार) धारा 3 के खण्ड (चौदह) में संदर्भित कोई प्रतिषिद्ध गतिविधि के उल्लंघन के लिए पांच सौ रुपये प्रति मीटर, प्रतिदिन की दर से तब के लिए जब तक यह बना रहे, (पांच) धारा 3 के खण्ड (तेरह) अथवा (पन्द्रह) में संदर्भित कोई प्रतिषिद्ध गतिविधि के उल्लंघन के लिए हटाने के मूल्य के पांच गुने की दर से। स्पष्टीकरण- (1) इस धारा के उपबन्धो के अधीन सभी मौलिक मूल्य और देय शुल्क दस दिन के भीतर विहित प्राधिकारी को जमा किये जायेंगे।

(1) धारा 3 के अधीन प्रतिषिद्ध कृत्य के लिए अभियुक्त कोई व्यक्ति अथवा इस अधिनियम की धारा (5) के अधीन सौंपे गये दायित्वों में असफल रहने पर दो वर्ष तक का कारावास अथवा अर्थदण्ड अथवा दोनों से दण्डित किया जा सकेगा। (2) किसी व्यक्ति के विरूद्ध उपधारा (1) के अधीन कोई दण्डनीय अपराध का संज्ञान कोई न्यायालय नहीं ले सकेगा, जब तक कि राजपत्र में अधिसूचना द्वारा सरकार अधिकृत किसी लोक सेवक के द्वारा लिखित शिकायत नहीं की जाती है।

इस अधिनियम के तहत किसी अपराध के विचाराण हेतु प्रथम श्रेणी के मजिस्ट्रेट के न्यायालय से अनिमम श्रेणी सुनवाई हेतु सक्षम नही होगा।

प्रत्येक व्यक्ति जो निम्नलिखित सुविधाओं का उपभोग करेगा; अर्थात- (एक) सड़क संरचना से निजी सम्पत्ति को पहुँच मार्ग बनायेगा, (दो) पाईप लाईन, सिवेज लाईन, विद्युत केबिल, टेलीफोन केबिल आदि को बिछायेगा चाहे वह सड़क अथवा पुल के एक ओर हो या दोनो ओर हो, (तीन) विद्यमान सड़क के एक ओर 50 मीटर के भीतर खनन गतिविधि अथवा किसी पुल के 500 मीटर ऊपर धारा या 50 मीटर नीचे धारा खनन की गतिविधियां, (चार) अर्जित और नियंत्रित क्षेत्र के भीतर किसी निजी अथवा वाणिज्यिक गतिविधियों का संचालन, (पांच) अर्जित और नियंत्रित क्षेत्र के भीतर होर्डिंग का प्रदर्शन, (छ) अर्जित और नियंत्रित क्षेत्र के भीतर हैंडपम्पों को लगाना, (सात) 48 घण्टे तक की अनधिक अधिक के लि दुर्घटना घटित वाहन/वस्तुओं को खड़ा रखना, और (आठ) 48 घंटे से अनधिक अवधि के लिए सड़क पर किसी सामग्री/वस्तुओं का स्थायी भण्डारण हेतु खण्ड (एक) से (छ:) के अधीन सड़क संरचना के क्षेत्राधिकार वाले प्रभारी अधिशासी अभियन्ता से तथा इस धारा के खण्ड (सात) और (आठ) के अधीन सुविधा के लिए प्रभारी कनिष्ठ अभियन्ता से लिखित रूप से अनुमति प्राप्ति हेतु आवेदन करेगा एवं इस प्रकार की अनुमति हेतु सभी आवेदन विहित रीति से किये जायेंगे, बशर्ते कि इस धारा के अधीन उल्लिखित अपेक्षा के अनुपालन में असफल होने पर इस अधिनियम की धारा 11 के उपबन्धों के अनुसार मूल्य/शुल्क को भुगतान करने के लिए उत्तरदायी होगा, परन्तु यह कि इस धारा में उल्लिखित सुविधा विभाग द्वारा उपलब्ध कराये जाने की दशा में लाभग्राही को कार्य की पूंजी जमा करनी होगी।

अनुमोदन प्राधिकारी/विहित प्राधिकारी को इस अधिनियम के अधीन किसी कृत्य को सम्पादित करने के प्रयोजन के लिए निम्नलिखित मामलों के सम्बन्ध में वाद के परीक्षण के समय पर सिविल प्रक्रिया सहिता, 1908 के अधीन सिविल न्यायालय में निहित सभी शक्तियां प्राप्त होगी- (क) किसी व्यक्ति को समन भेजना एवं उपस्थिति हेतु बाध्य करना तथा शपथ प्राप्त करना, (ख) अभिलेखों के परीक्षण की अपेक्षा और प्रस्तुतिकरण, और (ग) अन्य कोई मामले जो विहित किये जायें।

इस अधिनियम अथवा तदधीन बनाये गये नियमों के अधीन विहित प्राधिकारी अथवा इस अधिनियम के अधीन प्राधिकृत कोई अधिकारी विभाग के किसी उच्चतर अधिकारी के निर्देश अथवा आदेशों के पालन में किसी कृत्यों के लिए जो उसके द्वारा सद्भावनापूर्वक किया गया हो अथवा किया जाना आशयित हो, के विरूद्ध कोई वाद या अभियोग नही चलाया जायेगा।

इस अधिनियम और तदधीन बनाये गये नियमों के अधीन किसी मामले के असफल होने के सम्बन्ध में किसी प्रश्न के निस्तारण अथवा प्रस्तुत करने का कोई क्षेत्राधिकार किसी सिविल न्यायालय का नही होगा।

सभी सड़क संरचनाएं, जैसे ही यह प्रभाव में आएगा, सरकार की ओर से विभाग की अभिरक्षा में समझे जायेंगे।

सरकार राजपत्र में अधिसूचना द्वारा उत्तराखण्ड राज्य के भीतर स्थित नगर निगम, नगर पालिका, नगर पंचायत और विकास प्राधिकारियों को उनके क्षेत्राधिकार में सड़क संरचना के सम्बन्ध में ऐसी शक्तियों के सम्पादन और ऐसे कृत्यों के निर्वहन के लिए इस अधिनियम के अधीन अधिसूचना में विनिर्दिष्ट किया जाये, सशक्त कर सकेगी।

(1) राज्य सरकार राजपत्र में अधिसूचना द्वारा इस अधिनियम के प्रयोजनों के कार्यान्वयन के लिए नियम बना सकेगी। (2) विशेष रूप से और पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ऐसे नियम निम्नलिखित सभी या किन्हीं विषयों के लिए उपबन्ध कर सकेंगे; अर्थात- (क) इस अधिनियम के अधीन अपेक्षित अथवा अधिकृत किये जाने के लिए किसी नोटिस का प्रारूप और इसे तामील करने की रीति, (ख) इस अधिनियम के अधीन कार्यवाहियों का संचालन, (ग) विहित प्राधिकारी के कार्य का वितरण और आवंटन तथा किसी लम्बित कार्यवाही को किसी विहित प्राधिकारी से अन्य विहित प्राधिकारी को अन्तरित किया जाना, (घ) प्रतिषिद्ध गतिविधियों के कृत्यों के परिणामस्वरुप हुई क्षति के आंकलन की रीति और ऐसे क्षति के आंकलन के लिए अपनाये जाने वाले सिद्धान्त, (ड) सड़क संरचना की पहुँच के सन्दर्भ में नक्शा तैयार करने की रीति, (च) इस अधिनियम के अधीन दी जाने वाली अथवा इन्कार की जाने वाली अनुमति की रीति और अधिरोपित किया जाने वाला शुल्क, तथा (छ) कोई अन्य मामले जो विहित किये जायें। (3) इस धारा के अधीन बनाये गये सभी नियम पूर्व प्रकाशन की शर्त के अध्यधीन होगें। (4) इस धारा के अधीन बनाये गये सभी नियम यथाशीघ्र विधान सभा के समक्ष रखे जायेगें।

In this Act, unless the context otherwise requires:— (क) "Agriculture" includes horticulture, dairy farming, poultry farming and planting of trees in any orchard and its maintenance; (ख) "Appellate Authority" means the Regional Chief Engineer of the Public Works Department of Uttarakhand, appointed by the Government by notification in the Official Gazette to perform any or all the functions conferred by this Act and the rules made thereunder; (ग) "Building" means any structure of a residential, hut or other roof, whether for any purpose or constructed of any material, and any part thereof, and includes any wall or pucca house or pucca trench or drain therein, but does not include any tent or fencing for agricultural purposes; (घ) "Building line" means a line on one side of a road or part of a road as specified by the Government by notification in the Official Gazette in such road or part thereof, in the prescribed manner; (ङ) "Approval Authority" means any authority not below the rank of Executive Engineer of the Public Works Department of Uttarakhand, appointed by the Government by notification in the Official Gazette to perform any or all the functions conferred by this Act and the rules made thereunder; (च) "Controlled Area" means any area declared under section 3 of the Uttar Pradesh Roadside Land Control Act, 1945 (as amended from time to time) for the purposes of this Act; (छ) "Controlled line" means any area of the road or part of the road other than the building line specified in the prescribed manner by the Government by notification in the Official Gazette; (ज) "Department" means such department of the Uttarakhand Government which performs activities related to road infrastructure; (झ) "Government" means the Government of Uttarakhand; (ञ) "Map" means the road infrastructure map of any part notified by the State Government under section 4 of this Act; (ट) "Official Gazette" means the Gazette of Uttarakhand; (ठ) "Place of Worship" includes temple, church, mosque, imam bara, dargah, karbala, takiya, idgah, samadhi, math, sati place or gurudwara; (ड) "Prescribed" means prescribed by rules made under this Act; (ढ) "Prescribed Authority" means any authority not below the rank of Junior Engineer of the Public Works Department of Uttarakhand, appointed by the Government by notification in the Official Gazette to perform any or all the functions conferred by this Act and the rules made thereunder; (ण) "Review Authority" means the Secretary of the Public Works Department of Uttarakhand, appointed by the Government by notification in the Official Gazette to perform any or all the functions conferred by this Act and the rules made thereunder; (त) "Road" means the road under protection of the Uttarakhand Government or any local authority and does not include the National Highway; (थ) "Road Infrastructure" means any road, path and street for traffic or communication, and includes— (one) width of the acquired road land; (two) all types of roads and their structure, such as road kharanja, edges, retaining wall, breast wall, general wall, drains, turns, roadside drains, road junction, medians, speed breakers, road lights, traffic lights etc.; (three) any traffic and communication method road auxiliary structure; (four) bridges including approach road, retaining wall, breast wall, protective work and supporting structures; (five) express ways including interchange, grade separation, dual-carriageway and other necessary infrastructure; (six) road facilities like parapets, railings, mile stones, kilometer stone, bench, signs, view and sign boards, barricading and crash barriers; (seven) road over bridge, flyovers and access roads and their supporting structures; (eight) road side parking site; (nine) road side plantation, nursery, hedge and other landscape elements; (ten) toll booth/plaza; (eleven) tunnels and necessary structures; (twelve) road side amenities/structures like shelter for protection from rain, bus lane, public amenities, park and open space situated on land adjoining the road; (द) "Secretary" means the Secretary of the Government of Uttarakhand for the Public Works Department and includes any person appointed for the time being as Secretary to perform any or all functions conferred by this Act and the rules made thereunder by notification; (ध) "Work Inspector" means any employee of the Public Works Department appointed by the State Government by notification and includes work agent of the department.

No person shall— (one) encroach upon the government land under road infrastructure; (two) construct any permanent, temporary or movable structure on the road or road infrastructure; (three) execute any workshop or any commercial activities including tying of animals on road infrastructure which results in misuse of the road; (four) obstruct/damage the system of roadside and cross-drains; (five) dump garbage from private properties on the road; (six) scatter excavated soil/debris or any other material on the road and shall not store materials/goods permanently in an unauthorized manner; (seven) damage/dig the road infrastructure without the permission of the competent authority; (eight) install any handpump or petrol pump in an unauthorized manner; (nine) damage the approach road, retaining wall, breast wall, parapet, railing, and lighting system, protective works, tunnel, their supporting structures and other structures like road kharanja, edges, retaining wall, breast wall, boundary wall, drainage and roadside drains, road junction, speed breakers, street light, traffic light.

(1) अनुमोदन अधिकारी द्वारा पारित किसी आदेश के विरूद्ध कोई अपील तब तक स्वीकार नही की जायेगी जब तक कि अनुमोदन प्राधिकारी के आदेश के पारित होने के तीस दिन के भीतर अपील योजित न कर दी गई हो, परन्तु यह कि इस धारा के अधीन विनिर्दिष्ट अवधि के समाप्त होने के पश्चात् कोई अपील स्वीकार की जा सकेगी यदि आवेदक अपीलीय प्राधिकारी का यह समाधान कर दे कि निर्धारित अवधि के भीतर अपील योजित न करने के पर्याप्त कारण थे, परन्तु यह और कि आवेदक जब ऐसे आदेश के विरूद्ध अपील योजित करें, विभाग द्वारा आंकलित सम्भावित मूल्य की पचास प्रतिशत धनराशि जमा करेगा। (2) अपीलीय प्राधिकारी अपील के योजित होने के तीस दिन के भीतर अनुमोदन अधिकारी द्वारा पारित आदेश को अनुमोदित अथवा खारिज कर सकेगा।
