The Asian International University, Manipur Act, 2021
1. Short title, extent and commencement
Short title, extent and commencement:
- (1) This Act may be called the Asian International University, Manipur Act, 2021.
- (2) It extends to the whole of the State of Manipur.
- (3) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
2. Definitions
Definitions: In this Act, unless the context otherwise requires,—
- (a) "Academic Council" means the Academic Council of the University;
- (b) "Act" means the Asian International University, Manipur Act, 2021;
- (c) "AICTE" means the All India Council for Technical Education established under section 3 of the All India Council for Technical Education Act, 1987;
- (d) "Authorities" means the authorities of the University as specified in section 21 of this Act;
- (e) "Board of Management" means the Board of Management of the University as specified in section 22 of this Act;
- (f) "Chancellor" means the Chancellor of the University appointed under section 14 of this Act;
- (g) "Dean" means the Dean of the University;
- (h) "Distance Education System" means the system of imparting education through any means of information technology, communication and mechanical devices, correspondence courses, contact programmes, seminars, contact classes or any other methodology and study by any combination of these;
- (i) "Director/Principal" means the Head of the University Institution or the person appointed for the purpose to act as such;
- (j) "Employee" means employee appointed by the University; and includes teachers and other staff of the University or of a constituent college;
- (k) "Fee" means monetary collection made by the University or its colleges, institutions or study centres, as the case may be, from the students by whatever name it may be called, which is not prohibited by any law for the time being in force;
- (l) "Government" means the State Government of Manipur;
- (m) "Higher Education" means study of a curriculum or course for the pursuit of knowledge beyond 10+2 level;
- (n) "Hostel" means a place of residence for the students of the University, or its institutions and includes a place of residence run by the University;
- (o) "Institution" means an academic institution maintained by or admitted to the privileges of the University;
- (p) "Notification" means a notification published in the Official Gazette;
- (q) "Off-campus centre" means a centre of the University established by it outside the main campus (within the State of Manipur) operated and maintained as its constituent unit, having the University’s complement of facilities, faculty and staff;
- (r) "Official Gazette" means the Manipur Gazette; "Prescribed" means prescribed by the Statutes;
- (t) "Pro-Chancellor" means the Pro-Chancellor of the University appointed under section 15 of this Act;
- (u) "Statutes", "Ordinances" and "Regulations" mean respectively, the Statutes, Ordinances and Regulations of the University made under this Act;
- (v) "Student" means a student of the University and includes any person enrolled in the course of study of the University;
- (w) "Study Centre" means a centre established and maintained or recognized by the University for the purpose of advising, counselling or for rendering any other assistance required by the students in the context of distance education;
- (x) "Teacher" means a Professor, Associate Professor, Assistant Professor and such other person as may be appointed for imparting instruction or conducting research in the University or in colleges or institutions maintained by the University;
- (y) "UGC" means the University Grants Commission, established under section 4 of the University Grants Commission Act, 1956;
- (z) "University" means the Asian International University, Manipur established under this Act;
- (za) "Vice-Chancellor" means the Vice-Chancellor of the University appointed under section 16 of this Act; and
- (zb) "Visitor" means the Visitor of the University as referred to in section 13 of this Act.
3. The University
- (1) The Chancellor, the Pro-Chancellor, the Vice-Chancellor, the members of the Board of Governors, the members of the Board of Management, the members of the Academic Council and all other persons who may hereafter become such officers or members, so long as they continue to hold such office or membership, shall constitute a body corporate by the name of "The Asian International University, Manipur".
- (2) The University shall have perpetual succession and a common seal and shall sue and be sued by the said name.
- (3) The University shall be situated at such place as the Government may notify.
4. Powers of the University
The University shall have the following powers, namely:
- (a) to provide for instructions in such branches of learning as the University may, from time to time, determine, and to make provisions for research and for the advancement and dissemination of knowledge;
- (b) to grant, subject to such conditions as the University may determine, diplomas or certificates, and confer degrees or other academic distinctions on the basis of examinations, evaluation or any other method of testing;
- (c) to confer honorary degrees or other distinctions in the manner prescribed by the Statutes;
- (d) to provide for studies through distance education system and to maintain contact with the students for counseling and conduct of programmes;
- (e) to institute and maintain constituent colleges, faculties, centers, halls, institutes of research and other institutions of learning;
- (f) to appoint persons as professors, associate professors, assistant professors and other teachers of the University or to appoint persons of eminence working in any other university or organization to participate in the teaching of the University and to consult other experts in the manner prescribed by the Statutes;
- (g) to create academic, administrative and other posts and to make appointments thereto;
- (h) to institute and award fellowships, scholarships, studentships, medals and prizes;
- (i) to establish and maintain libraries, laboratories, research stations and museums for teaching and research;
- (j) to establish, maintain and manage halls and hostels for the residence of students;
- (k) to supervise and control the residence and regulate the discipline among the students of the University and to make arrangements for promoting their health and general welfare;
- (l) to determine, demand and receive fees, bills, invoices and collect charges as may be prescribed by the Statutes;
- (m) to collaborate with other universities, research institutions, associations, societies or bodies in India or abroad, for the purpose of joint research, teaching and exchange of teachers and scholars;
- (n) to organize and conduct refresher courses, workshops, seminars and other programs for teachers, developers, industry personnel and others;
- (o) to receive funds, provisions, assignments, donations and benefactions from the Government and to accept endowments, bequests, donations and transfers of movable and immovable properties from trusts, donors or other sources;
- (p) to issue guidelines for ensuring the quality of distance education programmes, learning resources and for the conduct of examinations;
- (q) to determine the standard of teaching and learning and to ensure that the standards of the degrees, diplomas and other academic distinctions are not lower than those laid by the University Grants Commission or like statutory bodies;
- (r) to make such provisions as it may consider necessary for the education and training of the women, differently abled and weaker sections of the society; to undertake consultancy services and to promote industrial linkages and facilitate student internships and placements;
- (t) to do all such other acts and things as may be necessary or incidental to the exercise of all or any of the powers of the University.
5. University open to all castes, class and creed
University open to all castes, class and creed.—
- (1) The University shall be open to all persons irrespective of caste, class, creed, race, religion, place of birth or gender.
- (2) Nothing contained in sub-section
- (1) shall be deemed to prevent the University from making special provisions for the employment or admission of women, persons with disabilities or of persons belonging to the weaker sections of the society and, in particular, of the Scheduled Castes, the Scheduled Tribes and the Other Backward Classes within the law of the land:
6. Provided that nothing in this section shall be deemed to prevent the University from prescribing criteria for admission to courses of study or for appointments to posts.
National character of the University National character of the University.— The University shall be a vocational and research-oriented University and shall be deemed to be of national character by virtue of its commitment to excellence in higher education and research, with focus on skill development and innovative academic programmes, and shall strive to maintain the highest standards of academic excellence and integrity.
7. Officers of the University
Officers of the University: The following shall be the officers of the University:
- (a) The Chancellor;
- (b) The Pro-Chancellor;
- (c) The Vice-Chancellor;
- (d) The Pro-Vice-Chancellor;
- (e) The Registrar;
- (f) The Chief Finance and Accounts Officer; and
- (g) Such other officers as may be declared by the Statutes to be the officers of the University.
8. The Chancellor
The Chancellor:
- (1) The Chancellor shall be appointed by the Sponsoring Body for a period of five years.
- (2) The Chancellor shall be the head of the University.
- (3) The Chancellor shall preside over the meetings of the Governing Body and shall, when the Chancellor is not present, preside over the convocations of the University held for conferring degrees, diplomas, charters, designations or certificates.
- (4) The Chancellor shall have the following powers, namely:
- (a) To call for any information or record;
- (b) To appoint the Vice-Chancellor;
- (c) To remove the Vice-Chancellor in accordance with the provisions of this Act;
- (d) To annual such proceedings of the University which are not in conformity with this Act, the Statutes, or the Ordinances;
- (e) To review the academic and other activities of the University and to give such directions as deemed necessary for the betterment of the University.
9. The Pro-Chancellor
The Pro-Chancellor
- (1) The Pro-Chancellor shall be appointed by the Chancellor in consultation with the Sponsor.
- (2) The Pro-Chancellor shall exercise such powers and perform such duties as may be vested in him by the Chancellor.
10. The Vice-Chancellor
The Vice-Chancellor
- (1) The Vice-Chancellor shall be appointed by the Chancellor for a term of three years in the manner as may be prescribed by the Statutes.
- (2) The Vice-Chancellor shall be the principal executive and academic officer of the University and shall exercise general supervision and control over the affairs of the University and give effect to the decisions of all the authorities of the University.
- (3) The Vice-Chancellor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes or the Ordinances.
11. The Pro-Vice-Chancellor
The Pro-Vice-Chancellor:
- (1) The Pro-Vice-Chancellor shall be appointed by the Chancellor on the recommendation of the Vice-Chancellor.
- (2) The Pro-Vice-Chancellor shall be a whole-time officer of the University and shall be a professor of at least ten years standing.
- (3) The Pro-Vice-Chancellor shall hold office for a term of three years and shall be eligible for re-appointment for another term of three years.
- (4) The Pro-Vice-Chancellor shall exercise such powers and perform such duties as may be prescribed by the Statutes or assigned to him by the Vice-Chancellor.
12. Deans of Faculties
Deans of Faculties:
- (1) Every Dean of a Faculty shall be appointed by the Vice-Chancellor from amongst the Professors in the Faculty for a period of three years and shall be eligible for re-appointment.
- (2) When the office of the Dean of a Faculty is vacant or when the Dean is, by reason of illness, absence or any other cause, unable to perform the duties of his office, the duties of the office shall be performed by such person as the Vice-Chancellor may appoint for the purpose.
- (3) The Dean of a Faculty shall be the Head of the Faculty and shall be responsible for the conduct and maintenance of the standards of teaching and research in the Faculty.
- (4) The Dean of a Faculty shall have such other functions as may be prescribed by the Statutes.
13. The Registrar
The Registrar
- (1) The appointment of the Registrar shall be made in such manner as may be prescribed by the Statutes.
- (2) All contracts shall be signed and all documents and records shall be authenticated by the Registrar on behalf of the University.
- (3) The Registrar shall be the ex-officio Secretary of the Governing Body and the Academic Council, but shall not be a member of any of the authorities.
- (4) The Registrar shall exercise such powers and perform such duties as may be specified in the Statutes.
14. The Finance Officer
The Finance Officer
- (1) The appointment of the Finance Officer shall be made in such manner as may be prescribed by the Statutes.
- (2) The Finance Officer shall manage the property and investments of the University and shall be responsible for the preparation of the annual estimates of income and expenditure and for the proper maintenance of the accounts of the University.
- (3) The Finance Officer shall exercise such powers and perform such duties as may be specified in the Statutes.
15. Other Officers
Other Officers:
- (1) The University may appoint such other officers as may be necessary for its functioning.
- (2) The manner of appointment and powers and duties of such other officers shall be such as may be prescribed.
16. Authorities of the University
Authorities of the University: The following shall be the authorities of the University:
- (a) The Governing Body;
- (b) The Board of Management;
- (c) The Academic Council;
- (d) The Finance Committee; and
- (e) Such other authorities as may be declared as such by the Statutes.
17. The Governing Body
The Governing Body
- (1) The Governing Body of the University shall consist of the following persons, namely:-
- (a) the Chancellor;
- (b) the Vice-Chancellor;
- (c) three persons, nominated by the Sponsor;
- (d) one representative of the State Government;
- (e) two persons, representing other Universities or academic bodies, nominated by the Government;
- (f) two persons of eminence, nominated by the Sponsor.
- (2) The Governing Body shall be the supreme authority of the University. All the movable and immovable property of the University shall vest in the Governing Body. It shall have the power to provide general superintendence and directions and to control the functioning of the University by exercising all the powers of the University not otherwise provided for by this Act, the Statutes, the Ordinances, the Regulations and the Rules and shall have the power to review the decisions of other authorities of the University.
- (3) The term of office of the members of the Governing Body shall be three years.
- (4) The Governing Body shall meet at least twice in a calendar year.
- (5) The quorum for meetings of the Governing Body shall be five members.
18. The Board of Management
The Board of Management
- (1) The Board of Management shall consist of the following members, namely:-
- (a) the Vice-Chancellor;
- (b) the Registrar;
- (c) two persons, nominated by the Sponsor;
- (d) two Deans of the Faculties as nominated by the Vice-Chancellor;
- (e) one representative to be nominated by the State Government.
- (2) The Vice-Chancellor shall be the Chairperson of the Board of Management.
- (3) The powers and functions of the Board of Management shall be such as may be specified by the Statutes.
- (4) The Board of Management shall meet at least once in every two months.
- (5) The quorum for meetings of the Board of Management shall be four members.
19. The Academic Council
- (1) The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act and the Statutes, Ordinances and Regulations made there under, coordinate and exercise general supervision over the academic policies of the University.
- (2) The Academic Council shall consist of following members, namely:
- (a) The Vice-Chancellor;
- (b) The Registrar;
- (c) Such other members as may be prescribed by the Statutes.
- (3) The term of office of the members of the Academic Council shall be as may be prescribed by the Statutes.
20. The Finance Committee
- (1) The Finance Committee shall be the principal financial body of the University to take care of financial matters and shall, subject to the provisions of this Act and the Statutes, coordinate and exercise general supervision over the financial matters of the University.
- (2) The Finance Committee shall consist of following members, namely:
- (a) The Vice-Chancellor;
- (b) The Registrar;
- (c) The Chief Finance Officer;
- (d) Such other members as may be prescribed by the Statutes.
- (3) The term of office of the members of the Finance Committee shall be as may be prescribed by the Statutes.
21. The Standing Committee
The Standing Committee
- (1) There shall be a Standing Committee of the University consisting of the following members, namely: -
- (a) The Chancellor, who shall be the Chairperson;
- (b) The Vice-Chancellor;
- (c) The Registrar;
- (d) Two members nominated by the Sponsoring Body; and
- (e) One nominated expert from the field of education or industry.
- (2) The Standing Committee shall advise the University on all matters of policy and administration and such other matters as may be referred to it by the Chancellor.
- (3) The Standing Committee shall meet at least once in every six months.
22. Other Authorities
Other Authorities
- (1) The following shall be the other authorities of the University: -
- (a) The Academic Council;
- (b) The Finance Committee;
- (c) The Board of Studies; and
- (d) Such other authorities as may be declared by the Statutes to be the authorities of the University.
- (2) The constitution, powers and functions of the authorities mentioned in sub-section
- (1) shall be such as may be prescribed by the Statutes.
23. Disqualifications
Disqualifications. -
- (1) A person shall be disqualified for being a member of any of the authorities or bodies of the University, if he -
- (a) is of unsound mind and stands so declared by a competent court;
- (b) is an undischarged insolvent;
- (c) has been convicted by a court of law of any offence involving moral turpitude and sentenced in respect thereof to imprisonment for not less than six months;
- (d) is appearing as a candidate for higher degree in the University;
- (e) has been removed from any other University or Educational Institution for misconduct or misbehaviour.
- (2) If any question arises as to whether a person is disqualified under sub-section (1), the question shall be referred to the Chancellor whose decision shall be final.
24. Vacancies not to invalidate the proceedings of any authority or body of the University
Vacancies not to invalidate the proceedings of any authority or body of the University. -
25. No act or proceedings of any authority or body of the University shall be invalid merely by reason of any vacancy or defect in the constitution thereof.
Filling of casual vacancies Filling of casual vacancies
- (1) Any casual vacancy among the members, other than ex-officio members, of any Authority or body of the University shall be filled in the same manner in which the member whose vacancy it is, was chosen, and the person filling the vacancy shall be a member of such Authority or body for the unexpired portion of the term of the member he replaces.
- (2) In the event of any casual vacancy in the office of the Chancellor or the Vice-Chancellor or the Registrar, the vacancy shall be filled by the Chancellor or the Governing Body or the Vice-Chancellor respectively, for such period as may be decided by the Chancellor.
26. Committees
Committees
- (1) Any Authority of the University shall have the power to appoint a committee, consisting of such members of the Authority and such, if any, other persons as it may deem fit.
- (2) Any committee appointed under sub-section
- (1) may deal with any subject delegated to it, subject to the overall control and supervision of the Authority.
27. The First Statutes
The First Statutes
- (1) Subject to the provisions of this Act and the rules made thereunder, the First Statutes of the University may provide for all or any of the following matters, namely:—
- (a) the constitution, powers and functions of the authorities and other bodies of the University as may be constituted from time to time;
- (b) the appointment and continuance in office of the members of the said authorities and bodies, the filling of vacancies of members, and all other matters relating to those authorities and bodies for which it may be necessary to provide;
- (c) the appointment, powers and duties of the officers of the University and their emoluments;
- (d) the appointment of teachers, academic staff and other employees of the University, their emoluments and conditions of service;
- (e) the appointment of teachers and academic staff working in any other University or Institution for a specified period for undertaking a joint project;
- (f) the conditions of the award of fellowships, scholarships, studentships, medals and prizes;
- (g) the regulation of admission to the courses of study of the University;
- (h) the procedure to be followed at meetings of the authorities and other bodies of the University;
- (i) the fee to be charged for courses of study in the University;
- (j) the procedure and criteria for Degrees and diplomas;
- (k) the provisions regarding disciplinary action against the students;
- (l) the creation, composition and functions of any other body which is considered necessary for improving the academic life of the University;
- (m) the manner of co-operation and collaboration with other Universities and institutions of higher education;
- (n) the remuneration to be paid to the examiners, moderators, invigilators and tabulators;
- (o) such other terms and conditions of service of teachers and other academic staff as are not prescribed by this Act; and
- (p) all other matters which by this Act are to be or may be provided by the Statutes.
- (2) The First Statutes of the University shall be made by the Sponsor and shall be submitted to the State Government for its approval.
- (3) The State Government shall, within two months from the date of receipt of the First Statutes, give its approval with or without modifications.
28. The Statutes
The Statutes
- (1) Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:—
- (a) the constitution, powers and functions of the authorities and other bodies of the University as may be constituted from time to time;
- (b) the appointment and continuance in office of the members of the said authorities and bodies, the filling of vacancies of members, and all other matters relating to those authorities and bodies for which it may be necessary to provide;
- (c) the appointment, powers and duties of the officers of the University and their emoluments;
- (d) the appointment of teachers, academic staff and other employees of the University, their emoluments and conditions of service;
- (e) the appointment of teachers and academic staff working in any other University or Institution for a specified period for undertaking a joint project;
- (f) the conditions of the award of fellowships, scholarships, studentships, medals and prizes;
- (g) the regulation of admission to the courses of study of the University;
- (h) the procedure to be followed at meetings of the authorities and other bodies of the University;
- (i) the fee to be charged for courses of study in the University;
- (j) the procedure and criteria for Degrees and diplomas;
- (k) the provisions regarding disciplinary action against the students;
- (l) the creation, composition and functions of any other body which is considered necessary for improving the academic life of the University;
- (m) the manner of co-operation and collaboration with other Universities and institutions of higher education;
- (n) the remuneration to be paid to the examiners, moderators, invigilators and tabulators;
- (o) such other terms and conditions of service of teachers and other academic staff as are not prescribed by this Act; and
- (p) all other matters which by this Act are to be or may be provided by the Statutes.
- (2) The Statutes of the University shall be made by the Board of Management and shall be submitted to the State Government for its approval.
- (3) The State Government shall, within two months from the date of receipt of the Statutes, give its approval with or without modifications.
29. The First Ordinances
The First Ordinances.-
- (1) The first Ordinances shall be made by the Vice-Chancellor with the previous approval of the Board of Management.
- (2) Every Ordinance made under sub-section
- (1) shall be laid, as soon as may be after it is made, before the Board of Management and the Board of Management shall have power to amend or cancel any such Ordinance.
30. The Ordinances
The Ordinances.-
- (1) Subject to the provisions of this Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely:—
- (a) the admission of students to the University and their enrolment as such;
- (b) the courses of study to be laid down for all degrees, diplomas, certificates and other academic distinctions of the University;
- (c) the award of the degrees, diplomas, certificates and other academic distinctions of the University;
- (d) the creation of new authorities of the University;
- (e) the accounting policy and financial procedure;
- (f) the conditions of the award of fellowships, scholarships, studentships, medals and prizes;
- (g) the conduct of examinations and other tests, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (h) the fees to be charged for the courses of study in the University and for admission to the examinations, degrees, diplomas and certificates of the University;
- (i) the provision of hostels for the students of the University;
- (j) the conditions of residence, conduct and discipline of the students of the University;
- (k) the maintenance of discipline among the employees of the University;
- (l) the discipline of students;
- (m) such other terms and conditions as may be prescribed by the Statutes of the University; and
- (n) any other matter which by this Act or the Statutes is to be, or may be, provided for by the Ordinances.
- (2) The Ordinances shall be made by the Academic Council which after being approved by the Board of Management shall be submitted to the Chancellor for his approval.
- (3) The Chancellor shall have the power to direct the Academic Council, at any time when he is not satisfied with the Ordinances, to amend the Ordinances or to make new Ordinances and the Academic Council shall comply with such direction of the Chancellor:
31. Provided that, nothing in this section shall affect the regulations of the University of Grants Commission or any statutory body.
Regulations Regulations
- (1) The authorities of the University may make Regulations, consistent with this Act and the Statutes, for the conduct of their own business and that of the Committees appointed by them.
- (2) The Academic Council may make Regulations, with the approval of the Board of Management, providing for all or any of the following matters:
- (a) the courses of study and schemes of examinations;
- (b) the admission of students to the University and their enrolment as such;
- (c) the conditions under which students shall be admitted to the courses of study and to the examinations of the University and shall be eligible for the award of degrees, diplomas and other academic distinctions;
- (d) the fees to be charged for the courses of study in the University and for admission to the examinations of the University; and
- (e) any other matter which is required to be or may be prescribed by the Regulations.
32. Admissions
Admissions
- (1) Admission in the University shall be made strictly on the basis of merit.
- (2) Merit for admission in the University shall be determined either on the basis of marks or grade obtained in the qualifying examination and for admissions to post-graduate programmes on the basis of marks or grade obtained in the qualifying examination or on the basis of marks or grade obtained in the entrance test conducted at the State level or National level, either by an association of the universities conducting similar courses or by any agency of the State or Central Government: Provided that the University may conduct an entrance test for admission to any of its programmes.
- (3) The seats for students of the State of Manipur shall be reserved as per the policy of the State Government.
33. Fee Structure
Fee Structure:
- (1) The University shall have power to fix, demand and receive fees and other charges as may be prescribed.
- (2) The fees and other charges to be fixed by the University shall be based on the financial and academic requirements of the University and the guidelines issued by the Regulatory Bodies and the State Government from time to time.
34. Examinations
Examinations:
- (1) All arrangements for the conduct of examinations shall be made by the University in such manner as may be prescribed.
- (2) At the time of issuing any degree, diploma or certificate, the University shall ensure that the same along with the transcripts are issued in such a manner so as to prevent any forgery and the University shall also maintain an electronic database of all the degrees, diplomas and certificates issued by it.
35. Declaration of results
- (1) The results of the examination of the University shall be declared by the Controller of Examinations of the University.
- (2) The results of the examination shall be published in such form as may be determined by the Academic Council.
- (3) The University shall have power to withhold the results of any candidate from publication if it is found that the candidate had adopted unfair means in the examination or was ineligible to appear in the examination.
36. Convocation
- (1) The Convocation of the University shall be held in every academic year in the manner as may be prescribed by the First Statutes for conferring degrees, diplomas, certificates and other academic distinctions.
- (2) The University shall hold its Convocation for conferring degrees, diplomas/degrees or such other awards to the students who have fulfilled the requirements of the programmes of study and have been declared successful by the University.
37. Accreditation of the University
Accreditation of the University The University shall seek accreditation from respective statutory accreditation bodies in India and/or international accreditation bodies, as the case may be, and inform the State Government of the same.
38. The University shall get programs/courses accredited by the concerned statutory bodies.
University Funds University Funds
- (1) The University shall establish a General Fund to which the following amount shall be credited:
- (a) all fees which may be charged by the University;
- (b) all sums received from any other source;
- (c) all contributions made by the Sponsor;
- (d) all contributions/donations made in this behalf by any other person or body which are not prohibited by any law for the time being in force.
- (2) The money credited to the General Fund shall be applied to meet all recurring and non-recurring expenditure of the University.
- (3) The University shall also establish an Endowment Fund provided that the University shall maintain an Endowment Fund of at least Rupees fifty lakhs.
- (4) The funds established under sub-sections
- (1) and
- (3) shall be subject to audit by an independent Chartered Accountant.
39. Annual Report
Annual Report
- (1) The annual report of the University shall be prepared under the direction of the Board of Management and which shall include, among other matters, the steps taken by the University in pursuance of the objects of the University.
- (2) The annual report shall be submitted to the Sponsoring Body.
- (3) The Sponsoring Body shall submit a copy of the annual report to the Government.
40. Annual Accounts and Audit
Annual Accounts and Audit
- (1) The annual accounts including the balance sheet of the University shall be prepared under the directions of the Board of Management and the annual accounts shall be audited at least once in every year by the auditors appointed by the University for this purpose.
- (2) A copy of the annual accounts together with the audit report shall be submitted to the Sponsoring Body.
- (3) The Sponsoring Body shall submit a copy of the annual accounts and the audit report to the Government which shall cause the same to be laid before the State Legislature.
41. Special powers of the State Government in certain circumstances
Special powers of the State Government in certain circumstances
- (1) If it appears to the State Government that the University has contravened any provision of this Act or of any rule, regulation, notification, order or instruction made or issued thereunder or has failed to carry out any of the directions of the State Government or the Regulatory Body or has failed to maintain or has persistently neglected to maintain the academic standard or has abused its powers or persistently neglected the duties imposed upon it by or under this Act, the State Government shall, after consultation with the Regulatory Body, issue a notice to the University to show cause why the order of its dissolution should not be passed.
- (2) If the State Government fails to receive any satisfactory explanation from the University within the time stipulated in the notice issued under sub-section (1), or the explanation is found unsatisfactory, the State Government may recommend to the Sponsor for dissolution of the University.
- (3) The Sponsor shall, after taking into account the recommendation of the State Government under sub-section (2), initiate the process for the dissolution of the University.
- (4) The State Government shall make such arrangements as may be necessary for the management of the affairs of the University until the dissolution process is completed strictly in accordance with the provisions of this Act.
42. Power to issue directions
Power to issue directions
- (1) The State Government may, for the purpose of ensuring that the provisions of this Act and the rules made thereunder are complied with, from time to time, issue such directions to the University as it may consider necessary, and it shall be the duty of the University to comply with such directions.
- (2) The State Government may, if it deems necessary, also issue directions to the University to regulate its admission process, fee structure or any other matter of importance as it may consider appropriate in the public interest.
43. Powers of the State Government to dissolve the University
Powers of the State Government to dissolve the University
- (1) If the Sponsoring Body proposes dissolution of the Asian International University, Manipur in accordance with the law governing its constitution or incorporation, it shall give at least 6
- (six) months notice to the State Government.
- (2) The State Government shall make arrangements for administration of the University from the date of such dissolution and until the last batch of students in regular courses of studies of the University complete their courses of studies in such manner as may be prescribed by the Statutes.
44. Expenditure of the University during the transition period
Expenditure of the University during the transition period
- (1) The expenditure of the University during the transition period or, if the University is dissolved, for its administration until the last batch of students complete their regular courses of studies, shall be met out of the Endowment Fund, the General Fund, the Development Fund or any other funds of the University.
- (2) If the funds referred to under sub-section
- (1) are not sufficient to meet the expenditure of the University during the transition period, such expenditure shall be met by the Sponsoring Body.
45. Admission of students
Admission of students.—
- (1) Admission in the University shall be made strictly on the basis of merit.
- (2) Merit for admission in the University may be determined either on the basis of marks or grade obtained in the qualifying examination and in achievements in co-curricular and extra-curricular activities or on the basis of marks or grade obtained in the entrance test conducted at the State level or National level or on the basis of criteria as may be prescribed by the Statutes.
- (3) The seats for students of the State of Manipur shall be reserved as per the policy of the State Government, and the remaining seats shall be open for all.
46. Manner of making first Statutes, Ordinances, etc
Manner of making first Statutes, Ordinances, etc.—
- (1) The first Statutes, first Ordinances and first Regulations of the University shall be framed by the Sponsor.
- (2) The Sponsor shall place the first Statutes, first Ordinances and first Regulations before the State Government for approval.
- (3) The State Government may approve the first Statutes, first Ordinances and first Regulations with or without modifications.
- (4) The first Statutes, first Ordinances and first Regulations approved by the State Government shall be published in the Official Gazette and shall come into force from the date of such publication.
47. Power to remove difficulties
Power to remove difficulties
- (1) If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by order published in the Official Gazette, make such provisions, not inconsistent with the provisions of this Act, as appear to it to be necessary or expedient for removing the difficulty: Provided that no such order shall be made under this section after the expiry of two years from the commencement of this Act.
- (2) Every order made under this section shall be laid, as soon as may be after it is made, before the State Legislature.

- (1) The State Government may, by notification in the Official Gazette, make rules to carry out the purposes of this Act.
- (2) Every rule made under this Act shall be laid, as soon as may be after it is made, before the State Legislature.
49. Act to override other laws
("Act to override other laws") The provisions of this Act and the Rules and Regulations made thereunder shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force or in any instrument having effect by virtue of any law other than this Act.
50. Dissolution of the University
("Dissolution of the University")
- (1) If the Sponsoring Body proposes to dissolve the University, it shall give at least six months’ notice in writing to the State Government.
- (2) On identification of the mismanagement or failure to perform its duties, the State Government may dissolve the University.
- (3) The dissolution of the University shall have effect only after the last batch of students of the regular courses have completed their courses and they have been awarded degrees, diplomas or certificates, as the case may be.
- (4) On the dissolution of the University all the assets and liabilities of the University shall vest in the Sponsoring Body.

(3) The Registrar shall be the ex-officio Secretary of the Board of Management and the Academic Council, but shall not be a member of any of these authorities. 3. The Finance Officer: (1) The Finance Officer shall be appointed by the Board of Management on the recommendation of the Vice-Chancellor and shall be a whole time salaried officer of the University. (2) The Finance Officer shall manage the property and investments of the University and shall be responsible for the preparation of annual estimates and statements of account for submission to the Board of Management.
