The Uttarakhand Paramedical Council Act
1. Short title, extent and commencement
(1) This Act may be called the Uttarakhand Paramedical Council Act, 2009. (2) It extends to the whole of the State of Uttarakhand. (3) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
2. Definitions
In this Act, unless the context otherwise requires: (a) "Notification" means a notification published in the Official Gazette; (b) "Medical Laboratory" means such a laboratory which is being run by qualified technical persons for clinical, therapeutic and research purposes; (c) "Technician" means any person whose name is entered in the register; (d) "Fund" means the fund of the Council established under sub-section (1) of section 32; (e) "Council" means the Uttarakhand Paramedical Council constituted under section 3; (f) "Paramedical Education" means the programme or field of education, research or training, which the State Government, as the case may be, in consultation with the Paramedical Council, by notification, declares as the discipline of Medical Laboratory, Technology or Radiology Diagnosis or Radiotherapy or Nuclear Medicine or Physiotherapy; (g) "Paramedical Professional" means a person whose name is entered in the register; (h) "Paramedical Subject" means such subjects as may be prescribed by regulations; (i) "Paramedical Qualification" means such qualification as may be prescribed in the regulations; (j) "Physiotherapy" means the clinically directed treatment by means of physical factors, including heat, cold, light, water, massage, electricity or physical exercise, for the purpose of removing or improving the disability of any person, including Occupational Therapy; (k) "Magistrate" means a Judicial Magistrate of the First Class; (l) "Chief Executive Officer" means the Secretary/Registrar appointed in section 16; (m) "Register" means the register kept under sub-section (1) of section 25; (n) "University" means any university situated in the State (excluding Central University) defined under clause (f) of section 2 of the University Grants Commission Act, 1956 and includes any institution situated in the State which has been declared as a Deemed University under section 3 of the said Act; (o) "Radiology Diagnosis" means all clinical procedures including ionizing radiation (X-ray); (p) "Radiotherapy" means any type of therapeutic procedure including sealed ionizing radiation sources; (q) "Regulations" means the regulations made under this Act; (r) "Prescribed" means prescribed by rules made under this Act; (s) "Government" means the Government of Uttarakhand; (t) "Member" means a member of the Council and includes its Chairman and Vice-Chairman; (u) "Institution" means any institution, by whatever name known, established by law or recognized for providing education under this Act; (v) "Committee" means a committee constituted under section 13.
3. Constitution of the Council
(1) The State Government shall, by notification, constitute the Uttarakhand Paramedical Council for the purposes of this Act. (2) The Uttarakhand Paramedical Council shall be a body corporate, having perpetual succession and a common seal, with power to acquire, hold and dispose of property, both movable and immovable, and to contract and shall by the said name sue or be sued. (3) The headquarters of the Council shall be at such place as may be specified by the State Government by notification. (4) The Council shall consist of the following members, namely: (a) The Chairman, who shall be appointed by the State Government from amongst the members of the Council; (b) The Vice-Chairman, who shall be appointed by the State Government from amongst the members of the Council; (c) One officer of the level of Additional Director, Directorate of Health Services, who shall be related to paramedical; (d) One such officer of the Health Department of the State Government, not below the level of Deputy Secretary; (e) One such officer of the Finance Department of the State Government, not below the level of Deputy Secretary; (f) One member of the Medical Education Department of the State Government, not below the level of Deputy Secretary; (g) Three members, appointed by the State Government to represent the following: (1) Uttarakhand School Education Council; (2) Uttarakhand Technical Education Council; and (3) Uttarakhand Medical Council; (h) Four members nominated by the State Government from amongst the teachers of the paramedical institutions recognized by the State Government; (i) One member each nominated by every University granting affiliation to the Paramedical Education institution; (j) Four members nominated by the State Government from amongst the medical practitioners of the Government Medical College and Medical practitioners of the State, who are experts in paramedical subjects; (k) Five members from amongst the registered paramedical professionals, who are from the profession of Medical Laboratory, Technology, Radiotherapy Technology, Physiotherapy, at least one elected member from each: Provided that in the case of the first constitution of the Council after the commencement of this Act, the members of this category shall be nominated by the State Government for a period of three years.
4. Term of office and casual vacancy
(1) Any member of the Council shall hold office for a period of five years from the date of his appointment. (2) The office of a member shall be deemed to be vacant if, in the opinion of the Council, he has been absent from three consecutive general meetings of the Council without sufficient reasons or he ceases to be a member under section 5. (3) Any casual vacancy in the Council shall be filled by new appointment and the person so appointed shall hold office only for the remaining period of the member in whose place he has been appointed. (4) Any member of the Council shall be eligible for re-appointment.
5. Cessation of membership
(1) Any member nominated/appointed by the State Government under clauses (c) to (j) of sub-section (4) of section 3 shall cease to be a member of the Council upon cessation of the service for which he was appointed. (2) Any member elected under clause (k) of sub-section (4) of section 3 shall cease to be a member of the Council upon his name being removed from the register.
6. Resignation by member
Any member appointed by the Government under clauses (a), (b) and (g) to (k) of sub-section (4) of section 3 may at any time resign his membership by writing under his hand addressed to the State Government: Provided that such member, who has submitted his resignation under this section, shall continue to hold office of the Council until his resignation is accepted by the State Government.
7. Removal from membership and vacancy
(1) Without prejudice to the provisions of sub-section (2), the Council may, at any time, by a majority of its total members and a majority of not less than two-thirds of the members present and voting, recommend to the State Government for the removal of any member from his office if it is satisfied that for any reason, the continuance of such member in the Council is not in public interest or the said person is harmful to the interest of the Council and the decision of the State Government in this regard shall be final. (2) The State Government may remove any member of the Council if he: (a) has been convicted for any offence involving moral turpitude; or (b) has been declared an insolvent by a competent court; or (c) becomes of unsound mind and has been declared so by a competent court; or (d) refuses to act or has become incapable of acting as a member; or (e) has been absent from three consecutive meetings of the Council without sufficient reason; or (f) has misused his office as Chairman, Vice-Chairman or member, by which his continuance on the post would be contrary to public interest; or (g) the name of the member chosen under clause (k) of sub-section (4) of section 3 has been struck off from the register: Provided that no person shall be removed under clauses (d), (e) and (f) of sub-section (2) unless the member has been given a reasonable opportunity of being heard.
8. Meeting of the Council
(1) The meeting of the Council shall be held at such time and place and shall comply with such rules of procedure in regard to the transaction of business of its meetings, including quorum for the meetings, as may be determined by regulations: Provided that the Council shall meet at least once in a year. (2) The Chairman of the Council shall preside over the meetings and in his absence the Vice-Chairman shall preside. (3) If for any reason the Chairman or Vice-Chairman is unable to be present in any meeting of the Council, then any other member elected by the members present in the meeting shall preside over such meeting. (4) All such questions, which come before any meeting of the Council, shall be decided by a majority of the members present and voting and in the case of equality of votes, the presiding person shall have a second or casting vote and he shall exercise the same.
9. Vacancy etc. shall not invalidate proceedings of the Council
No act or proceeding of the Council shall be invalid merely by reason of: (a) any vacancy in the Council or any defect in its constitution; or (b) any defect in the appointment of a person acting as a member of the Council; or (c) any irregularity in the procedure of the Council not affecting the merits of the case.
10. Minutes of meeting and validity of proceeding
(1) The minutes of every meeting of the Council shall be confidential and no person shall disclose the proceeding of the meeting or its part without the prior resolution of the Council: Provided that any person may disclose or publish those decisions of the Council, for which a resolution has already been passed by the Council and if the publication has not been resolved to be kept strictly confidential by any resolution of the Council. (2) The work done by any person, as a member of the Council or in the capacity of Chairman, Vice-Chairman or presiding officer of any meeting, shall not cease by reason of any defect or disqualification in their election or nomination nor shall the proceedings of those meetings of the Council, which have been presided over by them, be wanted if the decisions of the meeting were taken on the basis of majority of members. (3) When any post of the Council is vacant, the continuing members of the Council shall act as if such vacancy has not occurred. (4) No work done by the Council shall be questioned merely on the ground that there was a vacancy in it or there was any defect in the constitution of the Council. (5) The minutes of the proceedings of every meeting of the Council shall be recorded in the book to be kept for this purpose, in which the names of the members of the Council present, the minutes shall be entered and signatures of the presiding officer or in the same or exactly next meeting for confirmation shall be signed. (6) Unless contrary is proved, every meeting of the Council, the minutes of which have been signed according to the provisions of this Act, shall be deemed to have been duly called.
11. Allowances to members of the Council
The members of the Council shall receive such travelling and other allowances as may be prescribed by the regulations: Provided that members of the Council, who are government employees, shall not be entitled to receive such other allowances.
12. Power to associate persons with the Council for specific purposes
(1) The Council may, in such manner and for such purposes as may be determined by regulations, associate with itself such person whose assistance or advice it considers necessary for implementing any of the provisions of this Act. (2) Any person associated with the Council under sub-section (1) for any purpose shall have the right to take part in any discussion relevant to that purpose, but shall not have the right to vote in any meeting of the Council and shall not be a member for any other purpose. (3) The associated person shall be entitled to receive such allowances as may be determined by the regulations.
13. Committees of the Council
(1) The Council shall, as soon as possible, constitute such Executive Committee, Disciplinary Committee or any other committee from amongst its members for such general and specific purposes as it considers necessary for the implementation of its functions under this Act, as may be determined by the regulations. (2) The constitution, term of office and functions of any committee shall be as determined by the regulations. (3) Every committee constituted under this section shall choose its Chairman: Provided that: (a) where the Chairman is a member of such committee, he shall be the Chairman of such committee and in his absence the Vice-Chairman, if he is a member of such committee, shall be its Chairman and in the absence of both, any member chosen by the members of that committee shall be its Chairman; (b) where the Chairman is not a member of such committee but the Vice-Chairman is a member, he shall be its Chairman and in his absence any member chosen by the members of that committee shall be its Chairman.
14. Functions of the Council
(1) It shall be the duty of the Council to take such steps as it considers proper for ensuring integrated and unified development of paramedical education and maintenance of standards. (2) Specifically and without prejudice to the generality of the foregoing power, the functions of the Council shall include the following: (a) Entry, removal or re-entry of names in the register; (b) Maintaining a register of persons to practice in the paramedical discipline; (c) Determination of standards of paramedical education, training, research and professional conduct or morals of the paramedical professional, as the case may be; (d) Receiving gifts, grants, donations, endowments from the Central Government or State Government, receiving wills and donations and transfer of movable or immovable property from the testators, donors or transferors, as the case may be; (e) Exercise of disciplinary powers granted by this Act; (f) To do all such things as may be necessary or incidental or auxiliary to achieve all or any of the objects of the Council.
15. Appointment of Secretary/Registrar, officers and other employees of the Council
(1) For the purpose of efficient discharge of its functions under this Act, the Council shall, subject to such regulations as may be made in this behalf, appoint a Secretary/Registrar and such number of officers and other employees as it considers necessary: Provided that the first Secretary/Registrar of the Council shall be appointed by the State Government on such terms and conditions as the State Government thinks fit and such Secretary shall hold office for a period of three years. (2) The Secretary/Registrar, officer or other employee appointed by the Council shall be subject to such terms of service and shall be entitled to such remuneration as may be determined by the regulations. (3) The Registrar or any other officer or servant appointed by the Council under this Act shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code, 1860 (Act No. 45 of 1860).
16. Secretary/Registrar to act as Chief Executive Officer of the Council
The Secretary/Registrar appointed under sub-section (1) of section 15 shall be the Chief Executive Officer of the Council.
17. Duties of Secretary/Registrar
The duties of the Secretary/Registrar shall be as determined in the regulations.
18. Authentication of orders and other instruments of the Council
All orders and decisions of the Council shall be authenticated by the signature of the Chairman or any other member authorized by the said Council in this behalf and all other instruments issued by the said Council shall be authenticated by the signature of the Chief Executive Officer or any other officer of the said Council.
19. Permission of State Government for providing Paramedical Education
Notwithstanding anything contained in any other law for the time being in force, any University or institution shall have to obtain prior permission of the State Government for providing paramedical education within the State. The State Government may give such permission subject to such conditions as it deems necessary.
20. Declaration of qualification of Paramedical Education
(1) The Government, after consultation with the Council, may from time to time, by notification, declare the education granted by any University or institution as a recognized qualification for the purposes of this Act. (2) Such University or institution, whose education has not been notified by the State Government under sub-section (1), may apply to the State Government for review of its decision: Provided that the State Government may reject the application given in sub-section (2) for reasons to be recorded in writing. (3) The State Government, after consultation with the Council, may by notification give relaxation in paramedical education for such persons who are practicing as paramedical professionals, including occupational therapists, on the date of commencement of this Act or before it.
21. Minimum standards for Paramedical Education
The Council may, by regulations, determine the minimum standards of paramedical education required for granting recognized qualifications by universities or institutions.
22. Sending information to the Council by the University or institution regarding Paramedical Education
Any University or institution providing paramedical education shall send to the Council information regarding education standards, duration of syllabus, syllabus scheme of examination and other terms of qualification as required by the Council from time to time.
23. Appointment of Inspectors
(1) The Council may appoint such number of inspectors as it deems fit for the recognition of paramedical education in any University or institution. (2) The inspector may: (a) examine any such University or institution that provides paramedical education; (b) appear in any approved examination; and (c) inspect any such University or institution that has applied for recognition of its paramedical education course or examination under this Act and may appear in any examination of such University or institution. (3) While performing his duties under sub-section (2), no inspector shall interfere in the conduct of the examination but he shall report to the Council regarding the insufficiency of paramedical education standards, including staff, equipment, accommodation, training and other facilities for providing such paramedical education or any insufficiency of any examination in which he appears or any subject in relation to which the Council requires him to report. (4) The Council shall send a copy of such report to the University or institution, as the case may be, and shall send a copy to the State Government with such comments as may have been made by the said University or institution.
24. Withdrawal of recognition
Where the Council has submitted a report to the State Government that any recognized course of paramedical education or any approved examination is not being conducted in accordance with the regulations, the State Government shall notify its intention to consider the question of withdrawal of recognition given to the course of paramedical education or examination, as the case may be, to the concerned University or institution and the said University or institution, as the case may be, shall send such representation in this matter to the State Government within three months of receipt of such notice as it deems appropriate. The State Government shall decide on the said representation and its decision shall be final.
25. Register of Paramedical Professionals
(1) The Council shall keep a register and shall enter the names of paramedical professionals in the manner as determined by the regulations. (2) Subject to the other provisions of this Act, any person, who holds such paramedical education as may be notified by the State Government under section 20, shall be eligible to get his name entered in the register and obtain a practice certificate. (3) No person shall be entitled to practice under this Act unless his name has been entered in the register: Provided that the name of any person, who holds paramedical education as notified by the State Government under section 20, shall be deemed to be entered in the register from the date of such notification until the disposal of his application by the Council, if he has applied to the Council for entering his name in the register within six months of the commencement of such notification. (4) Such register shall be deemed to be a public document under the Indian Evidence Act, 1872 (Act No. 1 of 1872).
26. Entry of name in the register
(1) The Council may, on receipt of an application made by any person in such manner, on payment of such fee, not exceeding two thousand rupees or as may be determined by the regulations, enter his name in the register if the Council is satisfied that such person holds such paramedical education. (2) Any person, whose name has been entered in the register, shall be entitled to be called as Para-Physiotherapist, Medical Practitioner or Medical Laboratory Technician, Radiotherapy Technician, as the case may be, or other disciplines as may be included by the State Government by notification in future. (3) The Council may refuse to enter the name of any person in the register for reasons to be recorded in writing and in the manner determined by the regulations.
27. Professional conduct and removal of name from register
(1) The Council shall determine the standards of professional conduct and discipline and code of ethics for the professions under the regulations under this Act. (2) The regulations made by the Council under sub-section (1) may specify which transgressions constitute professional misconduct and such provisions shall be effective notwithstanding anything contained in any other law for the time being in force. (3) The Council may, after giving a reasonable opportunity of being heard to any person and after such further inquiry, if any, as it deems fit to make, where it is satisfied, by order, remove the name of any person from the register kept under sub-section (1) of section 25: (a) his name was entered in the register by error or by misrepresentation or by concealing material facts; (b) he has been convicted for any offence or has been guilty of professional misconduct or has violated the standards of professional conduct or etiquette or code of ethics determined under sub-section (1), which in the opinion of the Council makes it improper to keep his name in the register. (4) Any order under sub-section (3) may specify that any person, whose name has been ordered to be removed from the register, shall not be eligible for registration under this Act permanently or for such period as may be specified.
28. Procedure for inquiries related to misconduct
(1) Where the Council, on receipt of any information or on any complaint made to it, is prima facie of the opinion that any paramedical professional has been guilty of any professional or other misconduct, the Council shall refer the matter to the Disciplinary Committee constituted under sub-section (1) of section 13 and thereafter the Disciplinary Committee shall conduct such inquiry in such manner as may be determined by regulations and shall report the result of such inquiry to the Council. (2) If upon receipt of such report, the Council concludes that the paramedical professional is not guilty of any professional or other misconduct, it shall record its conclusion accordingly and give directions that the proceedings be filed or the complaint be dismissed, as the case may be. (3) If, upon receipt of such report, the Council finds that, as the case may be, any paramedical professional is guilty of any misconduct in his professional capacity or has violated the standards of professional conduct or etiquette or the code of ethics prescribed under this Act, it shall proceed against such person according to the provisions of sub-sections (3) and (4) of section 27. Explanation: For the purposes of this section, "paramedical professional" also includes a person who was a paramedical professional, as the case may be, on the date of the alleged misconduct, even if he does not continue to be so at the time of inquiry. (4) For the purposes of any inquiry under this section, the Council and its Disciplinary Committee shall have the same powers as are vested in a civil court under the Code of Civil Procedure, 1908: namely— (a) summoning and enforcing the attendance of any person and examining him on oath; (b) discovery and production of any document; and (c) receiving evidence on affidavits.
29. Re-entry in register
The Council may, by order, re-enter the name of any person, whose name has not been permanently removed from the register under sub-section (4) of section 27, in the register on payment of such fee not exceeding two thousand rupees and after fulfilling such conditions and requirements as may be determined by the regulations.
30. Appeal against orders passed by the Council
(1) Where under this Act the Council has: (a) refused to enter the name of any person in the register; or (b) passed an order to remove the name of any person from the register, such person may appeal to the State Government within the said period of 30 days from the date of receipt of the order of the Council in such manner as may be prescribed: Provided that the State Government may, if it is satisfied that such person could not file the appeal for sufficient reasons, admit such appeal even after the expiry of 30 days. (2) The State Government shall dispose of the appeal made under sub-section (1) in accordance with such procedure as may be prescribed. (3) The decision of the State Government under sub-section (2) shall be final.
31. Payment by State Government
The State Government may, after due appropriation made by law in this behalf, pay to the Council in each financial year such sums of money as may be considered necessary for the discharge of the functions of the Council under this Act.
32. Fund of the Council
(1) The Council shall have its own fund and all such sums, which are paid to it by the State Government from time to time and all receipts of the Council (including such sums as any other authority or any person may hand over to the Council) shall be deposited into the fund and all payments by the Council shall be made from the fund. (2) All money related to the fund shall be deposited in such banks and in such manner as may be specified by the Council, subject to the approval of the State Government, and shall be invested therein. (3) The Council may spend such sums of money as it deems fit for the discharge of its functions under this Act and such sums shall be considered as payment expenditure from the funds of the Council.
33. Budget
(1) The Council shall prepare the budget for the next financial year in such form and at such time in each year as may be prescribed, in which estimated receipts and expenditure shall be shown. (2) It shall be forwarded to the State Government within fifteen days of the meeting in which the budget was passed. (3) If the State Government is of the opinion that the provisions of the budget forwarded in this manner are not sufficient to implement the purpose of this Act, it shall return the budget to the Council for measures to make such modifications as may be suggested by the State Government. (4) The Council shall be competent to re-appropriate such sum of money as may be necessary from one head to another head and such head and minor heads. (5) The Council may pass a supplementary budget in such form and by such date as may be prescribed, as and when required, and the provisions of sub-sections (2), (3), (4) shall apply to such supplementary budget.
34. Annual Report
The Council shall, once in every year, prepare an annual report in such form and at such time as may be prescribed, giving a true and full account of its activities during the previous year and copies thereof shall be forwarded to the State Government and the Government shall cause it to be laid before the Legislative Assembly.
35. लेखा और संपरीक्षा
(1) परिषद् अपने वार्षिक लेखा बंद करने के पश्चात्, यथाशीघ्र, ऐसे प्रारूप में लेखाओं का विवरण तैयार करेगी और उसे महालेखाकर को ऐसी तारीख तक अग्रेशित करेगी, जो राज्य सरकार उत्तराखण्ड के महालेखाकर के परामर्श से विहित करे। (2) परिषद् के लेखाओं की महालेखाकर द्वारा ऐसे समय पर और ऐसी रीति से, जिन्हें वह उचित समझे, संपरीक्षा कराई जायेगी। (3) परिषद् द्वारा महालेखाकर या उसके द्वारा इस निमित्त नियुक्त किसी अन्य व्यक्ति द्वारा यथाप्रमाणित लेखे तथा उन पर संपरीक्षा रिपोर्ट राज्य सरकार को वार्षिक रूप में अग्रेशित की जायेगी, जिसे सरकार द्वारा विधान सभा के समक्ष रखा जायेगा।
36. क्लिनिकल स्थापन द्वारा परा-चिकित्सा व्यवसायिक के रूप में नियोजन पर प्रतिषेध
कोई भी क्लिनिकल स्थापन, जैसे अस्पताल, नर्सिग होम या स्वास्थ्य देखरेख से सम्बन्ध में अन्य संस्थाएं, किसी व्यक्ति को परा-चिकित्सा व्यवसायिक के रूप में तभी नियुक्त करेगी, जब उसका नाम परिषद् के रजिस्टर में दर्ज कर दिया गया हो।
37. परा-चिकित्सक व्यवसायिक की रिपोर्ट को संज्ञान में न लिया जाना तथा स्वतंत्र व्यवसाय पर प्रतिबन्ध
परा-चिकित्सा व्यवसायिक की रिपोर्ट तब तक वैध नहीं समझी जायेगी जब तक कि ऐसी रिपोर्ट को विषय विशेषज्ञ चिकित्सक द्वारा प्रतिहस्ताक्षर न कर दिया गया हो। परा-चिकित्सा व्यवसायिक निजी व्यवसाय स्वतंत्र रूप से नहीं कर सकेगा।
38. इस अधिनियम के उपबन्धों के अधिक्रमण के लिए शास्ति
ऐसा कोई विश्वविद्यालय या संस्था का प्राधिकृत प्राधिकारी, जो इस अधिनियम या इसके अधीन बनाये गये किसी नियम अथवा विनियमों के उपबन्धों के उल्लंघन में कार्य करेगा, वह दोनों में से किसी भांति के कारावास से, जिसकी न्यूनतम अवधि छह माह तथा अधिकतम अवधि दो वर्ष तक की हो सकेगी तथा जुर्माने से, जो पांच लाख रुपये तक का हो सकेगा, से दण्डित किया जायेगा।
39. गैर वृत्तिक द्वारा वृत्तिक के रूप में व्यवसाय करने के लिए शास्ति
ऐसा व्यक्ति, जिसका नाम इस अधिनियम के अधीन परिषद् के रजिस्टर में प्रविष्ट नहीं किया गया है या जिसका नाम प्रविष्ट नहीं समझा जाता है और वह, यथास्थिति, परा-चिकित्सा व्यवसायिक के रूप में व्यवसाय कर रहा है, वह दोनों में से, किसी भांति के कारावास से, जिसकी अवधि दो वर्ष तक हो सकेगी तथा जुर्माने से, जो बीस हजार रुपये तक का हो सकेगा, से दण्डित किया जायेगा।
40. प्रमाण-पत्रों आदि का बेईमानी से उपयोग करने के लिए दण्ड
कोई व्यक्ति - (1) जो इस अधिनियम के उपबन्धों के अधीन रजिस्टर में अपनी प्रविष्टि का बेईमानी से उपयोग करता है; या (2) जो लिखित में अथवा अन्यथा, कोई मिथ्या या कपटीपूर्ण घोषणा या अभ्यावेदन करके या प्रस्तुत करके या कराके इस अधिनियम के उपबन्धों के अधीन व्यवसाय करने का बेईमानी से प्रयास करता है; या (3) जो इस अधिनियम के उपबन्धों के अधीन रजिस्टर से सम्बन्धित किसी विषय में स्वेच्छा मिथ्या अभ्यावेदन करता है; या (4) जिसका नाम रजिस्टर से हटा दिया गया है और वह, यथास्थिति, परा-चिकित्सक व्यवसायिक के रूप में स्वेच्छा व्यवसाय करता है, वह दोनों में से, किसी भांति के कारावास से, जिसकी अवधि दो वर्ष तक को सकेगी या जुर्माने से, जो पचास हजार रुपये तक हो सकेगा अथवा दोनों से दण्डित किया जायेगा और किसी पश्चात्वर्ती अपराध के लिए दोनों में से, किसी भांति के कारावास से, जिसकी अवधि तीन वर्ष तक हो सकेगी या जुर्माने से, जो एक लाख रुपये तक का हो सकेगा अथवा दोनों से दण्डित किया जायेगा।
41. अपराधों का संज्ञान
(1) कोई भी न्यायालय इस अधिनियम के अधीन किसी अपराध का संज्ञान परिषद् के सचिव/रजिस्ट्रार द्वारा या परिषद् द्वारा इस निमित्त परिषद् द्वारा साधारण या विशेष आदेश द्वारा प्राधिकृत किया गया हो, लिखित में किये गये परिवाद पर संज्ञान करेगा, अन्यथा नहीं। (2) प्रथम श्रेणी के मजिस्ट्रेट के न्यायालय से निम्न श्रेणी का कोई भी न्यायालय इस अधिनियम के अधीन किसी भी दण्डनीय अपराध का संज्ञान नहीं लेगा।
42. राज्य सरकार द्वारा निर्देश
(1) राज्य सरकार, समय-समय पर परिषद् को ऐसे निर्देश जारी कर सकेगी, जो सरकार की राय में इस अधिनियम के उद्देश्यों की पूर्ति में और उसके कृत्यों के निर्वहन के लिए सहायक है और वह परिषद् किन्हीं, ऐसे निर्देशों को कार्यान्वित करने के लिए आबद्ध होगी। (2) उपधारा (1) के अधीन जारी निर्देशों में, कोई विनियम बनाने या पहले से बनाये गये किन्हीं विनियमों में संशोधन करने या उनको प्रतिसंहृत करने के लिए परिषद् को दिये गये निर्देश भी सम्मिलित हैं। (3) यदि राज्य सरकार की राय में, परिषद् ने इस धारा के अधीन जारी किये गये निर्देशों को प्रभावी करने में लगातार व्यतिक्रम किया है तो राज्य सरकार, परिषद् को अपना पक्ष प्रस्तुत करने के अवसर देने के पश्चात्, आदेश द्वारा परिषद् को विघटित कर सकेगी और उसके पश्चात् एक नई परिषद् का ऐसी तारीख से, जो सरकार द्वारा अधिसूचित की जाये, इस अधिनियम के उपबन्धों के अनुसार गठन कर सकेगी। (4) जहां राज्य सरकार उपधारा (3) के अधीन परिषद् का विघटन करने वाला कोई आदेश पारित करती है, वहां वह इस अधिनियम के उपबन्धों के अनुसार परिषद् के गठन के लंबित रहने तक किसी व्यक्ति या व्यक्तियों के किसी निकाय को परिषद् के कार्यों का प्रबंध ग्रहण करने या ऐसे कृत्यों का निर्वहन करने के लिए प्राधिकृत कर सकेगी, जो राज्य सरकार द्वारा इस निमित्त विनिर्दिष्ट किये जायें।
43. सद्भावपूर्वक की गई कार्यवाही का संरक्षण
इस अधिनियम के अधीन सद्भावपूर्वक की गई कार्यवाही या किये जाने से आशयित किसी बात की बाबत कोई बात, अभियोजन या अन्य विधिक कार्यवाही राज्य सरकार, परिषद्, परिषद् के अध्यक्ष, उपाध्यक्ष, सदस्य, सचिव या परिषद् के किसी अधिकारी या अन्य कर्मचारी के विरुद्ध नहीं होगी।
44. नियम बनाने की शक्ति
(1) राज्य सरकार इस अधिनियम के उपबन्धों को कार्यान्वित करने के लिए नियम, अधिसूचना द्वारा बना सकेगी। (2) विशिष्टतया पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना नियमों में निम्नलिखित सभी या किन्हीं विषयों के लिए उपबन्ध किया जा सकेगा; अर्थात् :- (क) धारा 30 की उपधारा (1) के अधीन अपील फाइल करने की रीति; (ख) धारा 30 की उपधारा (2) के अधीन अपील का निपटारा करने के लिए प्रक्रिया; (ग) धारा 33 के अधीन परिषद् का बजट तैयार करने के लिए प्रारूप और समय; (घ) धारा 34 के अधीन परिषद् की वार्षिक रिपोर्ट तैयार करने के लिए प्रारूप और समय; (ङ) धारा 35 के अधीन लेखा बही रखे जाने का प्रारूप और रीति; और (च) कोई अन्य विषय, जो विहित किये जाने के लिए अपेक्षित हो, या विहित किया जाये।
45. विनियम बनाने की शक्ति
(1) परिषद्, राज्य सरकार के पूर्वानुमोदन से इस अधिनियम के उपबन्धों को क्रियान्वित करने के लिए इस अधिनियम और तदधीन बनाये गये नियमों से संगत विनियम, अधिसूचना द्वारा बना सकेगी। (2) विशिष्टतया और पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना से नियमों में निम्नलिखित सभी या किन्हीं विषयों के लिए उपबन्ध किया जा सकेगा; अर्थात् :- (क) धारा 8 की उपधारा (1) के अधीन परिषद् की बैठक व समय, स्थान उसकी प्रक्रिया और गणपूर्ति; (ख) धारा 12 की उपधारा (1) के अधीन परिषद् के गैर सदस्य सहयोगित करने की रीति और प्रयोजन; (ग) धारा 13 की उपधारा (1) के अधीन किसी समिति की संरचना कालावधि और कृत्य; (घ) धारा 15 की उपधारा (1) के अधीन सचिव/रजिस्ट्रार अन्य कर्मचारी, नियुक्ति, सेवा शर्तें और पारिश्रमिक; (ङ) धारा 17 के अधीन सचिव-रजिस्ट्रार के कर्तव्यों के लिए विनियम; (च) धारा 20 तथा 21 के अधीन मान्यता प्राप्त अर्हताऐं अनुदत्त करने हेतु शिक्षा के न्यूनतम मानक; (छ) धारा 25 की उपधारा (1) के अधीन रजिस्टर का अनुरक्षण; (ज) धारा 26 की उपधारा (1) के अधीन रजिस्टर में नाम की प्रविष्टि के लिए रीति और फीस का संदाय; (झ) धारा 26 की उपधारा (3) के अधीन नाम प्रविष्टि करने के इन्कार करने की रीति; (ञ) धारा 27 की उपधारा (1) के अधीन वृत्तिक आचरण और शिष्टाचार तथा सदाचार संहिता के मानदंड; (ट) धारा 28 की उपधारा (1) के अधीन अनुशासन समिति द्वारा जांच की रीति; (ठ) धारा 29 के अधीन पुनः प्रविष्टि करने की रीति उसकी फीस का संदाय, शर्त और अपेक्षाएं; (ड) परा-चिकित्सा व्यवसायियों में से पांच सदस्यों के निर्वाचन करने की रीति; और (ढ) अध्यक्ष और उपाध्यक्ष की शक्तियां तथा कर्तव्य।
46. नियमों और विनियमों का विधान सभा में रखा जाना
इस अधिनियम के अधीन बनाया गया प्रत्येक नियम तथा विनियम बनाये जाने के पश्चात् यथाशीघ्र विधान सभा के समक्ष रखे जायेंगे।
47. कठिनाइयों को दूर करने की शक्ति
(1) यदि इस अधिनियम के उपबन्धों को कार्यान्वित करने के लिए कोई कठिनाई उत्पन्न होती है तो राज्य सरकार राजपत्र में प्रकाशित आदेश द्वारा, ऐसे उपबन्ध कर सकेगी, जो इस अधिनियम के उपबन्धों से असंगत न हो और जो इस कठिनाई को दूर करने के लिए आवश्यक प्रतीत हो; परन्तु यह कि ऐसा आदेश इस अधिनियम के प्रवृत्त होने की तारीख से दो वर्ष के बाद जारी नहीं किया जा सकेगा। (2) इस धारा के अधीन किया गया प्रत्येक आदेश किये जाने के पश्चात् यथाशीघ्र विधान सभा के समक्ष रखा जायेगा।
