Compensation for non-resumable lands

Statutory text
- (1) While deciding matters under section 27 the Revenue Officer shall further determine the compensation in respect of the non-resumable lands payable in the prescribed manner by the tenant which shall be determined in accordance with the following sub-sections.
- (2) The compensation for the land shall be an amount calculated at the rate of eight hundred rupees per standard acre of the land to be paid in five equal annual instalments with interest at the rate of four and a half percentum per annum on the unpaid balance, the first instalment falling due on such date as the Revenue Officer may in his order specify in that behalf : Provided further that where the tenant pays up the entire compensation amount on or before the date on which the payment of the first instalment falls due he shall be entitled to a rebate of five percentum of the compensation amount.
- (3) The compensation payable for -
- (a) wells, tanks and structures of a permanent nature situate in the land and not constructed by or at the cost of the tenant ; and
- (b) trees standing on the land, shall be the market value thereof to be paid along with the compensation under sub-section (2). Explanation - In determining the market value the Revenue Officer shall, as far as practicable be guided by the provisions contained in sub-section
- (1) of section 23 of the Land Acquisition Act, 1894.
