The South Gujarat University Act, 1965
Chapter I PRELIMINARY
1. Short title, extent and commencement
Short title, extent and commencement.
- (1) This Act may be called the South Gujarat University Act, 1965.
- (2) It extends to the area comprising the districts of Surat, Bulsar, Dangs, Bharuch and such part of the Baroda District as the State Government may, by notification in the Official Gazette, specify in this behalf.
- (3) This section shall come into force at once and the remaining provisions of this Act shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
Chapter I PRELIMINARY
2. Definitions
Definitions. In this Act, unless the context otherwise requires,—
- (1) "Affiliated College" means a college affiliated to the University;
- (2) "Approved Institution" means an institution approved by the University;
- (3) "College" means a degree college or an intermediate college;
- (4) "Degree college" means an affiliated college which is authorised to submit its students to an examination qualifying for any degree of the University;
- (5) "Head Master" means the head of a High School;
- (6) "High School" means a high school which has been recognised as a high school by the State Government or by an officer authorised by it on that behalf;
- (7) "Hostel" means a place of residence for students of the University maintained or recognised by the University, either as a part of or separate from a college;
- (8) "Principal" means the head of a college;
- (9) "Recognised Institution" means an institution for research or specialised studies other than a college and recognised as such by the University;
- (10) "Registered Graduate" means a graduate registered under the provisions of this Act;
- (11) "Secondary Teachers" means such class of teachers imparting instruction in secondary schools as may be declared to be secondary teachers by the State Government;
- (12) "Teachers" means professors, readers, lecturers and such other persons imparting instruction in the University or in any college or institution in accordance with the regulations;
- (13) "University" means the South Gujarat University constituted under this Act;
- (14) "University Area" means the area specified in sub-section
- (2) of section 1.
Chapter II THE UNIVERSITY
3. Incorporation of the University
Incorporation of the University
- (1) The Chancellor, the Vice-Chancellor, the Director of Higher Education, the Deans of Faculties and the members of the Senate, the Syndicate and the Academic Council for the time being holding office as such in the University shall constitute a body corporate by the name of "The South Gujarat University".
- (2) The University shall have perpetual succession and a common seal and may sue and be sued by the said name.
- (3) The University shall be competent to acquire and hold property, both movable and immovable, to lease, sell or otherwise transfer any movable or immovable property which may have become vested in or may have been acquired by it for the purposes of the University and to contract and do all other things necessary for the purposes of this Act: Provided that the power to dispose of any immovable property shall be exercised with the prior sanction of the State Government.
- (4) The headquarters of the University shall be at Surat.
Chapter II THE UNIVERSITY
4. The University, its powers and duties
The University, its powers and duties The University shall have the following powers and duties, namely:—
- (1) to provide for instruction, teaching and training in such branches of learning and courses of study as it may think fit, and to make provision for research and for the advancement and dissemination of knowledge;
- (2) to make such provision as will enable affiliated colleges and recognised institutions to undertake specialisation in studies;
- (3) to organise and make provision for common laboratories, libraries, museums and other equipment for teaching and research;
- (4) to establish and maintain departments, colleges and institutions of research or specialised studies;
- (5) to institute degrees, diplomas and other academic titles and distinctions;
- (6) to confer honorary degrees and other academic distinctions in the manner laid down in the Statutes;
- (7) to hold examinations and to confer degrees, diplomas and other academic distinctions on persons—
- (a) who have pursued approved courses of study in the University or in an affiliated college and have passed the examinations prescribed by the University;
- (b) who have carried on research under conditions prescribed by the University;
- (8) to confer degrees, diplomas and other academic distinctions on persons who have pursued approved courses of study in an affiliated college;
- (9) to provide for such lectures and instructions for students of University colleges and affiliated colleges as the University may determine and also to provide for external candidates to appear at the examinations of the University;
- (10) to inspect colleges and recognised institutions and to take measures to ensure that proper standards of instruction, teaching and training are maintained in them and that adequate library, laboratory and other equipment are provided;
- (11) to control and co-ordinate the activities of, and to give financial aid to, affiliated colleges and recognised institutions;
- (12) to hold and manage trusts and endowments and to institute and award fellowships, travelling fellowships, scholarships, studentships, medals and prizes;
- (13) to establish, maintain and manage hostels;
- (14) to recognise hostels not maintained by the University, to inspect such hostels and to withdraw recognition therefrom;
- (15) to hold and conduct university extension programmes;
- (16) to co-operate with other universities and authorities in such manner and for such purposes as the University may determine;
- (17) to demand and receive such fees and other charges as may be prescribed by the Ordinances;
- (18) to receive grants, bequests, donations and gifts of movable and immovable property and to have the custody and management of any such property and to administer the same;
- (19) to make provision for the instruction and training of students in the National Cadet Corps;
- (20) to make provision for physical training, sports and athletic clubs;
- (21) to exercise control over the students of the University and to provide for their discipline and well-being;
- (22) to supervise and control the conduct and discipline of the teachers and other employees of the University;
- (23) to institute and appoint persons to professorships, readerships, lecturerships and any other posts of teachers required by the University;
- (24) to make provision for research and advisory services and for that purpose to enter into such arrangements with other institutions or bodies as the University may deem necessary;
- (25) to do all such other acts and things, whether incidental to the powers aforesaid or not, as may be requisite in order to further the objects of the University and to cultivate and promote arts, science and other branches of learning and culture.

5. Jurisdiction of the University
Jurisdiction of the University
- (1) No education institution situate within the University Area shall, save with the sanction of the State Government, be associated in any way with, or seek admission to any privileges of, any other University established by law.
- (2) Any such privilege of any other University enjoyed by any education institution situate within the University Area immediately before the appointed day shall be deemed to be withdrawn as from such day.
- (3) On and after the appointed day, no educational institution situate outside the University Area shall, save with the sanction of the State Government, be associated in any way with, or seek admission to any privileges of, the University.

6. Inspection and inquiry
Inspection and inquiry
- (1) The Chancellor shall have the right to cause an inspection to be made by such person or persons as he may direct, of the University, its buildings, laboratories, libraries, museums, workshops and equipment and of any institutions maintained by or affiliated to the University, and also of the examinations, teaching and other work conducted or done by the University, and to cause an inquiry to be made in like manner in respect of any matter connected with the University: Provided that the Chancellor shall in every case give notice to the University of his intention to cause such inspection or inquiry to be made and the University shall be entitled to be represented thereat.
- (2) The Chancellor shall communicate to the Syndicate his views with reference to the result of such inspection or inquiry and shall, after ascertaining the opinion of the Syndicate thereon, advise the University on the action to be taken and fix a time limit for taking such action.
- (3) The Syndicate shall report to the Chancellor the action, if any, which is proposed to be taken or has been taken upon the results of such inspection or inquiry.
- (4) Where the Syndicate does not, within a reasonable time, take action to the satisfaction of the Chancellor, the Chancellor may, after considering any explanation furnished or representation made by the Syndicate, issue such directions as he may think fit and the Syndicate shall comply with such directions.

7. Officers of the University
Officers of the University The following shall be the officers of the University, namely:—
- (i) The Chancellor,
- (ii) The Vice-Chancellor,
- (iii) The Pro-Vice-Chancellor,
- (iv) The Deans of Faculties,
- (v) The Registrar,
- (vi) The University Librarian, and
- (vii) Such other officers in the service of the University as may be declared by the Statutes to be the officers of the University.

8. The Chancellor
The Chancellor
- (1) The Governor of Gujarat shall be the Chancellor of the University.
- (2) The Chancellor shall, by virtue of his office, be the head of the University and shall, when present, preside at any convocation of the University.
- (3) The Chancellor shall have such other powers as may be conferred on him by this Act or the Statutes.

9. The Vice-Chancellor
The Vice-Chancellor
- (1) The Vice-Chancellor shall be appointed by the Chancellor in consultation with the State Government from amongst three persons recommended by a committee appointed for the purpose under sub-section (2).
- (2) The Chancellor shall appoint a committee which shall consist of three members, one of whom shall be appointed by the Chancellor, one shall be nominated by the Executive Council and one by the State Government. The Chancellor shall appoint one of the members of the committee to be its Chairman.
- (3) The Vice-Chancellor shall hold office for a term of three years and shall be eligible for re-appointment for a second term.
- (4) The Vice-Chancellor shall be a whole-time officer of the University and shall receive such salary and allowances as may be prescribed by the statutes.
- (5) In the event of the post of Vice-Chancellor falling vacant due to death, resignation or any other cause, the vacancy shall be filled in the manner provided in sub-section (1). Provided that until the appointment is so made, the Pro-Vice-Chancellor, if any, or if there is no Pro-Vice-Chancellor, the senior most Professor in the University shall carry on the current duties of the Vice-Chancellor.

10. Powers of the Vice-Chancellor
Powers of the Vice-Chancellor
- (1) The Vice-Chancellor shall be the principal executive and academic officer of the University and shall, in the absence of the Chancellor, preside at meetings of the University Authority and at any convocation of the University.
- (2) He shall exercise general control over the affairs of the University and shall be responsible for the due maintenance of discipline in the University.
- (3) He shall ensure that the provisions of this Act, the Statutes, the Ordinances and the Regulations are observed and shall have all powers necessary for this purpose.
- (4) He shall have the power to convene the meetings of the Court, the Executive Council and the Academic Council and shall perform all such acts as may be necessary to carry out the provisions of this Act. (5)
- (a) In case of emergency which in the opinion of the Vice-Chancellor requires immediate action, he shall have the power to take such action as he deems necessary and shall at the earliest opportunity thereafter report the action taken to such authority or body as would have in the ordinary course dealt with the matter.
- (b) Where any action taken by the Vice-Chancellor under clause
- (a) affects any person in the service of the University, such person shall be entitled to prefer an appeal to the Executive Council within thirty days from the date on which such action is communicated to him.
- (6) The Vice-Chancellor shall exercise such other powers as may be prescribed by the Statutes, Ordinances and Regulations.

11. The Pro-Vice-Chancellor
The Pro-Vice-Chancellor
- (1) The Pro-Vice-Chancellor shall be appointed by the Chancellor in consultation with the Vice-Chancellor from amongst persons recommended by the Vice-Chancellor.
- (2) The Pro-Vice-Chancellor shall hold office for a term of three years and shall be eligible for re-appointment for one further term of three years: Provided that the Pro-Vice-Chancellor shall notwithstanding the expiration of his term continue to hold office until his successor is appointed and enters upon his office.
- (3) The Pro-Vice-Chancellor shall be a whole-time salaried officer and his pay and allowances shall be determined by the State Government. (4)
- (a) The Pro-Vice-Chancellor shall assist the Vice-Chancellor in respect of such matters as may be specified by the Vice-Chancellor from time to time.
- (b) He shall exercise such powers and perform such duties of the Vice-Chancellor as the Vice-Chancellor may delegate to him.
- (c) He shall exercise such other powers and perform such other duties as may be prescribed by the Statutes, Ordinances and Regulations.

12. The Registrar
The Registrar
- (1) The Registrar shall be a whole-time salaried officer and shall be appointed by the Syndicate in accordance with the Statutes to be made in this behalf.
- (2) The Registrar shall possess such qualifications as may be prescribed by the Statutes.
- (3) The Registrar shall act as the Secretary of the Senate, the Syndicate and the Academic Council.
- (4) The Registrar shall exercise such powers and perform such duties as may be prescribed by the Statutes, Ordinances and Regulations.

13. Other officers
Other officers
- (1) The following shall also be the officers of the University, namely:—
- (i) The Deans of Faculties,
- (ii) The Registrar,
- (iii) The University Librarian,
- (iv) Such other officers in the service of the University as may be declared by the Statutes to be the officers of the University.
- (2) The modes regarding the appointment and the terms and conditions of service of the officers referred to in sub-section
- (1) shall be such as may be prescribed by the Statutes, Ordinances and Regulations.
Chapter III OFFICERS OF THE UNIVERSITY
14. Authorities of the University
Authorities of the University The following shall be the authorities of the University, namely:—
- (i) The Court,
- (ii) The Executive Council,
- (iii) The Academic Council,
- (iv) The Finance and Accounts Committee,
- (v) The Faculties,
- (vi) The Boards of Studies,
- (vii) The Board of University Teaching and Research,
- (viii) The Board of Extra-Mural Studies, if any,
- (ix) Such other bodies of the University as may be declared by the Statutes to be the authorities of the University.

15. The Court
The Court
- (1) The Court shall be the supreme governing body of the University and shall, except as herein provided, exercise all the powers and perform all the duties conferred or imposed upon the University by this Act.
- (2) The Court shall consist of the following members, namely:— Class I—Ex-officio members
- (i) The Chancellor,
- (ii) The Vice-Chancellor,
- (iii) The Pro-Vice-Chancellor, if any,
- (iv) The Registrar,
- (v) The Deans of Faculties,
- (vi) The Director of Higher Education or his representative not below the rank of a Joint Director,
- (vii) The Director of Technical Education or his representative not below the rank of a Joint Director,
- (viii) The Director of Health and Medical Services,
- (ix) The Chairman of the State Board of Secondary and Higher Secondary Education,
- (x) The Librarian of the University Library,
- (xi) The Director of Physical Education of the University,
- (xii) The Principals of affiliated colleges and heads of recognised institutions,
- (xiii) The Heads of University Departments,
- (xiv) One representative from each of the Councils or Boards, if any, established under the Act,
- (xv) Such other ex-officio members as may be prescribed by the Statutes. Class II—Ordinary members
- (i) Elected representatives of the teachers of the University, the affiliated colleges and recognised institutions in the manner prescribed by the Statutes,
- (ii) Elected representatives of the registered graduates,
- (iii) Elected representatives of the students of the University,
- (iv) Representatives of the donors who have donated such amount as may be prescribed by the Statutes,
- (v) Representatives of the Municipal Corporations and Municipalities within the University area,
- (vi) Representatives of the State Legislature, as prescribed by the Statutes,
- (vii) Such other persons, not exceeding the number prescribed by the Statutes, as may be nominated by the Chancellor.
- (3) The term of office of the members of the Court, other than ex-officio members, shall be five years.
- (4) The Court shall meet at least twice a year. One of the meetings shall be the annual meeting.
- (5) The quorum for a meeting of the Court shall be such number of members as may be prescribed by the Statutes.

16. The Executive Council
The Executive Council
- (1) The Executive Council shall be the executive authority of the University and shall consist of the following members, namely:—
- (i) The Vice-Chancellor, who shall be the Chairman,
- (ii) The Pro-Vice-Chancellor,
- (iii) The Deans of Faculties,
- (iv) Such number of members as may be prescribed by the Statutes, elected by the Court from amongst its members,
- (v) One representative of the State Government,
- (vi) Such other members as may be prescribed by the Statutes.
- (2) The Executive Council shall exercise such powers and perform such duties as may be conferred or imposed upon it by this Act or the Statutes.
- (3) The term of office of the members of the Executive Council, other than ex-officio members, shall be three years.
- (4) The Executive Council shall meet as often as may be necessary.
- (5) The quorum for a meeting of the Executive Council shall be the number of members as prescribed by the Statutes.
Chapter III OFFICERS OF THE UNIVERSITY
17. The Academic Council
- (1) The Academic Council shall be the academic body of the University and shall, subject to the provisions of this Act and the Statutes, have the control and general regulation of, and be responsible for the maintenance of the standards of teaching and examination within the University.
- (2) The Academic Council shall consist of the following members, namely:—
- (i) The Vice-Chancellor, Ex-officio Chairman;
- (ii) The Deans of Faculties;
- (iii) The Professors of the University;
- (iv) The Heads of University Departments;
- (v) One representative of the Board of University Teaching, if any, to be elected by the Board;
- (vi) Ten persons to be elected by the Heads of recognised institutions and teachers of affiliated colleges from amongst their own number;
- (vii) One person nominated by the Syndicate;
- (viii) Two persons elected by the Senate from amongst its members who are not teachers;
- (ix) The Director of Education, Gujarat State, or his nominee;
- (x) The Director of Technical Education, Gujarat State, or his nominee;
- (xi) The Director of Health and Medical Services, Gujarat State, or his nominee.
- (3) The Academic Council shall have the following powers and duties, namely:—
- (i) To make regulations in consultation with the Board of Studies concerned and the Faculties concerned laying down courses of study;
- (ii) To make regulations regarding the special courses of study or subjects or division of subjects for the degrees or other academic distinctions;
- (iii) To make regulations regarding the standards of passing and the granting of classes in the examinations;
- (iv) To advise the Syndicate on all academic matters including matters relating to examinations;
- (v) To make proposals to the Syndicate for the institution of Professorships, Readershiips, Lecturerships and any other posts of teachers required by the University and for prescribing the duties of such posts;
- (vi) To make proposals to the Syndicate for the institution and award of Fellowships, Travelling Fellowships, Scholarships, Studentships, Medals and Prizes and to make regulations for their award;
- (vii) To make regulations for the encouragement of co-operation and reciprocity among colleges and recognised institutions;
- (viii) To recommend to the Syndicate the establishment of Board of Studies;
- (ix) To formulate, modify or revise schemes for the organisation of the Faculties and to assign to such Faculties their respective subjects and also to report to the Syndicate as to the expediency of the abolition or sub-division of any Faculty;
- (x) To make regulations for the recognition of examinations of other Universities and institutions as equivalent to the examinations of the University;
- (xi) To make regulations relating to courses of study leading to degrees, diplomas and certificates;
- (xii) To exercise such other powers and perform such other duties as may be conferred or imposed on it by or under this Act or the Statutes.
Chapter III OFFICERS OF THE UNIVERSITY
18. Other authorities
The following shall be the other authorities of the University:—
- (i) The Faculties;
- (ii) The Board of University Teaching;
- (iii) The Boards of Studies;
- (iv) The Board of Extra-Mural Studies;
- (v) Such other bodies as may be declared by the Statutes to be the authorities of the University.

19. Supplementary provisions
Supplementary provisions.
- (1) The Senate, the Syndicate and the Academic Council may make rules and regulations for all matters relating to the University and the students thereof, not inconsistent with the provisions of this Act, the Statutes, the Ordinances and the Regulations.
- (2) All such rules and regulations shall be consistent with the provisions of this Act and shall, when made, be published in such manner as the Senate may direct.
Chapter IV AUTHORITIES OF THE UNIVERSITY
20. Statutes
Statutes. Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:—
- (a) the conferment of honorary degrees;
- (b) the holding of convocations to confer degrees;
- (c) the powers and duties of the officers of the University;
- (d) the constitution, powers and duties of the authorities of the University;
- (e) the institution and maintenance of Departments, hostels, colleges and institutions of research;
- (f) the conditions of recognition of colleges and institutions of research;
- (g) the recognition of hostels;
- (h) the mode of appointment and the duties of professors, readers, lecturers and other teachers and the academic staff of the University;
- (i) the registration of graduates and the maintenance of a register of registered graduates;
- (j) the procedure at meetings of the authorities of the University and for the transaction of their business;
- (k) the award of fellowships, scholarships, exhibitions, medals and prizes;
- (l) any other matter which is to be, or may be, prescribed by Statutes.
Chapter IV AUTHORITIES OF THE UNIVERSITY
21. Statutes, their making, amendment, repeal and operation
Statutes, their making, amendment, repeal and operation.
- (1) Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:—
- (a) the conferment of honorary degrees;
- (b) the holding of convocations to confer degrees;
- (c) the powers and duties of the officers of the University;
- (d) the constitution and powers of the authorities of the University;
- (e) the institution and maintenance of pension, provident fund and the system of insurance for the benefit of the officers, teachers and other servants of the University;
- (f) all matters which by this Act are to be or may be provided for by the Statutes.
- (2) The first Statutes shall be those made by the State Government.
- (3) The Senate may, from time to time, make new or additional Statutes and may amend or repeal the Statutes in the manner hereinafter in this section provided.
- (4) Every Statute made, amended or repealed shall require the assent of the Chancellor who may assent thereto or remit it to the Senate for further consideration.
- (5) No Statute passed by the Senate shall be valid or shall come into force until assented to by the Chancellor.
- (6) Notwithstanding anything contained in the foregoing sub-sections, the Chancellor, either suo motu or on the advice of the State Government, may, after consultation with the Vice-Chancellor, by notification in the Official Gazette, make, amend or repeal any Statute:

22. Provided that before any such Statute is made, amended or repealed, the Chancellor shall give to the Senate an opportunity of expressing its views on such Statute.
Ordinances Ordinances.
- (1) Subject to the provisions of this Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely:—
- (a) the admission of students to the University and their enrolment as such;
- (b) the courses of study to be laid down for all degrees and diplomas of the University;
- (c) the awards of degrees, diplomas, certificates and other academic distinctions, the qualifications for the same and the means to be taken relating to the granting and obtaining of the same;
- (d) the fees to be charged for courses of study in the University and for admission to the examinations, degrees and diplomas of the University;
- (e) the conditions of the award of fellowships, scholarships, studentships, exhibitions, medals and prizes;
- (f) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (g) the conditions of residence, health and discipline of the students of the University;
- (h) the maintenance of a register of registered graduates;
- (i) all other matters which by this Act or the Statutes are to be or may be provided for by the Ordinances.
- (2) The first Ordinances shall be made by the Vice-Chancellor with the previous approval of the State Government.
- (3) The Syndicate may, from time to time, make new or additional Ordinances and may amend or repeal the Ordinances in the manner hereinafter in this section provided.
- (4) The Syndicate shall not have power to amend any draft of any Ordinance proposing any changes in the arrangements for the admission of students or prescribing courses of study or the conditions of residence except after consultation with the Academic Council.
- (5) Every Ordinance made by the Syndicate shall be submitted to the Chancellor for his information.
- (6) The Chancellor may, within two months of the receipt of the Ordinance, direct that the operation of any Ordinance shall be suspended and he shall thereafter inform the Syndicate of his reasons for such direction.
- (7) No Ordinance shall be effective until it has been submitted to the Chancellor as aforesaid.
Chapter IV AUTHORITIES OF THE UNIVERSITY
23. Ordinances, their making
Ordinances, their making
- (1) Subject to the provisions of this Act, the Ordinances may provide for all or any of the following matters, namely:—
- (a) the conditions under which students shall be admitted to the courses of study for degrees, diplomas, certificates and other academic distinctions;
- (b) the fees to be charged for enrolment of students for obtaining degrees, diplomas and certificates of the University and for other purposes;
- (c) the conditions of the award of fellowships, scholarships, studentships, medals and prizes and the like;
- (d) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (e) the maintenance of discipline among the students of the University;
- (f) the conditions of residence of students at the University;
- (g) the recognition and inspection of hostels;
- (h) the branches of study to be included in each faculty;
- (i) the special qualifications for the recognition of Principals and Professors or other teachers receiving emoluments;
- (j) the mode of appointment of examiners and their remuneration;
- (k) the fees to be charged for courses of study, research, experiment and practical training and for registration of graduates;
- (l) any other matter which is or may be prescribed under the provisions of this Act or which is not specifically provided for in this Act and is necessary to give effect to the provisions of this Act.
- (2) No Ordinance shall be made by the Syndicate unless a draft thereof has been proposed by the Vice-Chancellor.
- (3) The Syndicate shall not have power to amend any draft proposed by the Vice-Chancellor under sub-section
- (2) but may reject it or return it to the Vice-Chancellor for reconsideration, in which case the Vice-Chancellor may submit an amended draft and the Syndicate may approve such amended draft.
- (4) All Ordinances made by the Syndicate shall, except as provided by this Act, have effect from such date as it may direct, but every Ordinance so made shall be submitted as soon as may be to the Chancellor and the Senate.
- (5) The Chancellor may within six months of the receipt of an Ordinance, signify to the Syndicate his disallowance of such Ordinance and from the date of receipt of intimation of such disallowance, the Ordinance shall become void.
- (6) The Senate may, by a resolution passed by a majority of not less than two-thirds of the members present and voting, cancel any Ordinance made by the Syndicate and such Ordinance shall from the date of such resolution cease to have effect.
Chapter IV AUTHORITIES OF THE UNIVERSITY
24. Regulations

- (1) The Senate may make Regulations consistent with this Act and the Ordinances—
- (a) laying down the procedure to be observed at the meetings of the Senate, the Syndicate, the Academic Council and other authorities of the University and the committees thereof;
- (b) providing for all matters which by this Act or by the Ordinances are to be provided for by Regulations;
- (c) providing for any other matter solely concerning such authorities or committees and not provided for by this Act or the Ordinances.
- (2) The Regulations made by the Senate shall be submitted to the Chancellor who may approve them or refer them back to the Senate for further consideration.

25. Residence of students
Residence of students The University shall provide for the residence of students of the University; and every student of the University shall reside in a hostel or under such conditions as may be prescribed.

- (1) No student shall be admitted to the University as a candidate for any University examination—
- (a) unless he has passed such qualifying examination as may be prescribed; and
- (b) unless he has complied with such other conditions as may be prescribed.
- (2) Every student admitted to the University shall be enrolled as a student of the University in such manner as may be prescribed.

27. Examinations
Examinations.
- (1) Subject to the provisions of this Act and the Statutes, the University shall hold examinations in such courses of study as may be prescribed by Ordinances.
- (2) The time and manner of holding examinations shall be determined by the Ordinances.
- (3) The University shall appoint examiners and moderators for the examinations in consultation with the Boards of Studies.

28. Degrees, diplomas and other academic distinctions
Degrees, diplomas and other academic distinctions.
- (1) The University shall have power to confer such degrees, diplomas and other academic distinctions as may be prescribed by the Statutes.
- (2) The University may confer honorary degrees or other academic distinctions in the manner and under the conditions prescribed by the Statutes:

The University Fund The University Fund
- (1) The University shall establish a fund to be called the University fund.
- (2) The following shall form part of, or be paid into, the University fund:
- (a) any contribution or grant by the State Government;
- (b) the income of the University from all sources including income from fees and charges;
- (c) any bequests, donations, endowments or other grants made to the University;
- (d) such other sums as may be received by the University.
- (3) The University fund shall be kept in the State Bank of India or in such other bank as may be approved by the State Government.

30. Annual accounts and financial estimates
Annual accounts and financial estimates
- (1) The annual accounts of the University shall be prepared under the direction of the Executive Council and shall be submitted to the State Government for such audit as the State Government may direct.
- (2) The accounts when audited shall be published by the Executive Council in the Official Gazette and copies thereof shall be submitted to the Senate and to the State Government.
- (3) The Executive Council shall also prepare, before such date as may be prescribed by the Statutes, the financial estimates for the ensuing year.
- (4) Every such estimate shall be considered by the Senate at its annual meeting and the Senate may approve the same with such modifications as it may think fit.
Chapter IV AUTHORITIES OF THE UNIVERSITY
31. Annual report
Annual report.
- (1) The annual report of the University shall be prepared under the direction of the Syndicate and shall be submitted to the Senate on or before such date as may be prescribed by the Statutes and shall be considered by the Senate at its annual meeting.
- (2) The Senate may pass resolutions thereon and communicate the same to the Syndicate which may take action in accordance therewith and the Syndicate shall report the action taken or proposed to be taken by it to the Senate.
- (3) Copies of the annual report along with the resolutions of the Senate thereon shall be communicated to the State Government.
Chapter IV AUTHORITIES OF THE UNIVERSITY
32. Pension or Provident Fund
Pension or Provident Fund.
- (1) The University shall constitute for the benefit of its officers, teachers and other servants such pension, insurance and provident fund as it may deem fit.
- (2) Where such provident fund has been so constituted, the State Government may declare that the provisions of the Provident Funds Act, 1925, shall apply to such fund as if it were a Government Provident Fund.
Chapter IV AUTHORITIES OF THE UNIVERSITY
33. Officers and servants to be public servants
Officers and servants to be public servants. All salaried officers and the members of the teaching, administrative and other staff of the University shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code.
Chapter V STATUTES, ORDINANCES AND REGULATIONS
34. Contracts
Contracts.
- (1) All contracts relating to the management and administration of the University shall be in writing and shall be made by the University.
- (2) Every such contract shall be signed by the Vice-Chancellor or such other officer of the University as may be authorised by the Syndicate in this behalf.
- (3) No contract involving an expenditure of such amount as may be prescribed by the Statutes shall be made by any officer or authority of the University otherwise than in such manner as may be prescribed.
- (4) No contract or instrument not executed in the manner provided in this section shall be binding on the University.
Chapter V STATUTES, ORDINANCES AND REGULATIONS
35. Procedure for conducting business of authorities

- (1) The meeting of any authority of the University shall be held in accordance with the Statutes.
- (2) Every authority of the University shall act in such manner as may be prescribed by the Statutes.

36. Delegation of powers
Delegation of powers.—
- (1) The University may by Statutes provide for the delegation of any of its powers or duties conferred or imposed by or under this Act to any authority, officer or person.
- (2) Subject to the provisions of this Act, the Statutes may provide for the sub-delegation of such powers or duties by any authority or officer to whom they are delegated.

37. Acts and proceedings not to be invalidated by vacancies
Acts and proceedings not to be invalidated by vacancies No act or proceeding of any University authority or other body shall be invalidated merely by reason of any vacancy in its membership or by reason of any defect in the election, nomination or appointment of any person as a member thereof or by reason of any such person having taken part in the proceedings of the authority or body while not being entitled to do so.

38. Disputes as to constitution of University authorities
Disputes as to constitution of University authorities If any question arises whether any person has been duly elected, appointed, nominated or co-opted as, or is entitled to be, a member of any authority or other body of the University, the matter shall be referred to the State Government whose decision thereon shall be final.
Chapter VI FINANCE
39. Protection of acts and orders
- (1) No suit, prosecution or other legal proceeding shall lie against the University or any authority or officer of the University for anything which is in good faith done or intended to be done in pursuance of this Act or of any Statutes, Ordinances or Regulations.
- (2) Save as otherwise provided in this Act, no officer or employee of the University shall be liable for any damage or loss caused or likely to be caused by any action taken in good faith in pursuance of any of the provisions of this Act or of any Statutes, Ordinances or Regulations.
Chapter VI FINANCE
40. Initial statutes
- (1) Notwithstanding anything contained in this Act, the Statutes set out in the Schedule shall be the Statutes of the University and shall be deemed to have been made by the University under section 33.
- (2) The State Government may, by notification in the Official Gazette, amend the Schedule and thereupon the Schedule shall be deemed to have been amended accordingly.
Chapter VII AFFILIATION OF COLLEGES AND RECOGNITION OF INSTITUTIONS
41. Transitory provisions
Transitory provisions.
- (1) Notwithstanding anything contained in this Act, the Statutes, Ordinances and Regulations, any student who immediately prior to the commencement of this Act was studying in the Gujarat University for a degree, diploma or other academic distinction of the Gujarat University shall be permitted to complete his course in preparation therefor, and the University shall provide for such instruction, teaching and training for such student in accordance with the course of study of the Gujarat University.
- (2) The results of such student in any examination of the Gujarat University held or to be held after the commencement of this Act shall be determined in accordance with the Gujarat University Act, 1949 and the Statutes, Ordinances and Regulations of the Gujarat University in force immediately before such commencement.
Chapter VII AFFILIATION OF COLLEGES AND RECOGNITION OF INSTITUTIONS
42. Duty of certain authorities to provide for staff
Duty of certain authorities to provide for staff.
- (1) It shall be the duty of any authority or body of the Gujarat University or any college or recognised institution of that University, to provide for the staff of any college or institution in the University Area which is to be affiliated to or recognised by the University under this Act, such facilities, records and other information as may be necessary for the University to discharge its functions under this Act.
- (2) Any person who holds office as a teacher or member of the staff of any college or recognised institution within the University Area immediately before the commencement of this Act, shall, if the State Government so directs, be deemed to be a teacher or member of the staff of the University, as the case may be, and shall continue to hold office on the same terms and conditions as were applicable to him before such commencement until the University otherwise provides.
Chapter VII AFFILIATION OF COLLEGES AND RECOGNITION OF INSTITUTIONS
43. Power to remove difficulties
Power to remove difficulties.
- (1) If any difficulty arises as to the first constitution or reconstitution of any authority of the University after the commencement of this Act, or otherwise in giving effect to the provisions of this Act, the State Government, as occasion may require, may by order do anything which appears to it necessary for the purpose of removing the difficulty.
- (2) No such order shall be made after the expiry of three years from the date of the commencement of this Act.
I. The Statutes
(University Area) The University area shall comprise the Surat, Bulsar, Dangs and Broach districts.
II. [Constitution of the First Senate]
(Constitution of the First Senate) (1) The First Senate shall consist of the following members, namely:— (a) The Vice-Chancellor; (b) The Director of Education, Gujarat State; (c) The Director of Health and Medical Services, Gujarat State; (d) The Director of Agriculture, Gujarat State; (e) The Director of Technical Education, Gujarat State; (f) Principals of affiliated colleges in the University area; (g) Five persons elected by the members of the Gujarat Legislative Assembly from among themselves; (h) Two persons to be nominated by the State Government, who are teachers of recognized institutions; (i) Two persons to be nominated by the State Government from among the registered graduates of any University established by law in India; (j) Fifteen persons to be nominated by the State Government, who are eminent educationists, social workers or representatives of industry or commerce. (2) The tenure of the First Senate shall be for a period of three years from the date of its constitution.
III. Provisions regarding the constitution and functioning of the internal auditor
Schedule III "Provisions regarding the constitution and functioning of the internal auditor" (1) There shall be an internal auditor of the University who shall be appointed by the Executive Council in such manner and on such terms and conditions as may be prescribed by the Statutes. (2) The internal auditor shall— (a) conduct a continuous audit of the accounts of the University and of the institutions and colleges managed by the University; (b) report to the Vice-Chancellor every half year on the progress of the audit; (c) submit to the Executive Council an annual report on the accounts of the University. Provided that the internal auditor shall not have any role in the executive functions of the University and shall only perform the duties assigned to him under this Act or the Statutes.
IV. Repeal and Savings
Schedule IV "Repeal and Savings" (1) The Gujarat University Act, 1949 (Bom. L of 1949), in its application to the University Area specified in the Schedule to this Act, shall, in so far as it relates to the areas comprised in the South Gujarat region, stand repealed. (2) Notwithstanding such repeal— (a) any person holding office immediately before the commencement of this Act as an officer of the University of Gujarat shall be deemed to have been appointed as an officer of the South Gujarat University under the corresponding provisions of this Act; (b) all colleges or institutions affiliated to or recognised by the University of Gujarat immediately before the commencement of this Act and located in the University Area shall be deemed to be affiliated to or recognised by the South Gujarat University under this Act; (c) all property, assets, rights and liabilities of the University of Gujarat in respect of the South Gujarat region shall stand transferred to and vest in the South Gujarat University. Provided that any disciplinary action initiated by the University of Gujarat against any employee before the commencement of this Act shall stand transferred to the South Gujarat University and shall be continued as if the proceedings had been initiated by the South Gujarat University.

(2) Any contract for service between the University and any of its salaried officers or teachers shall be lodged with the Registrar of the University. (3) The University shall maintain a record of the service of every such officer and teacher and such record shall be signed by the officer or teacher concerned. (4) Any dispute arising out of a contract between the University and any of its salaried officers or teachers shall, at the request of the officer or teacher concerned, be referred to a Tribunal of Arbitration consisting of one member nominated by the Executive Council, one member nominated by the officer or teacher concerned and an umpire appointed by the Chancellor. (5) The decision of the Tribunal shall be final and shall not be questioned in any court.

(2) Any contract for service between an affiliated college and any of its salaried officers or teachers shall be lodged with the Registrar of the University. (3) The college shall maintain a record of the service of every such officer and teacher and such record shall be signed by the officer or teacher concerned. (4) Any dispute arising out of a contract between the college and any of its salaried officers or teachers shall, at the request of the officer or teacher concerned, be referred to a Tribunal of Arbitration consisting of one member nominated by the Governing Body of the college, one member nominated by the officer or teacher concerned and an umpire appointed by the Vice-Chancellor. (5) The decision of the Tribunal shall be final and shall not be questioned in any court.
VII. Transitory Provisions
(Transitory Provisions) (1) Notwithstanding anything contained in this Act, the Vice-Chancellor may, with the previous approval of the State Government, discharge all or any of the functions of the University for the purpose of carrying out the provisions of this Act and for that purpose may exercise any powers or perform any duties which by this Act are to be exercised or performed by any officer or authority of the University which is not yet constituted. (2) The first Vice-Chancellor may, for a period of six months from the date of his appointment or such further period not exceeding one year as the State Government may specify, exercise all or any of the powers exercisable by the University under this Act.
VIII. Transitory Provisions
(Transitory Provisions) (1) Any student who immediately prior to the commencement of this Act was studying in a college affiliated to the Gujarat University and situated in the University Area shall be permitted to complete his course in preparation for such degree, diploma or other academic distinction of the Gujarat University and the University shall provide for the instruction, teaching, training and examination of such student in accordance with the courses of studies, schemes of examination and standards of the Gujarat University. (2) The University shall make such arrangements as it may deem fit for the conduct of the examinations for such students for such period as may be prescribed.

THE STATUTES
1. Definitions
- (i) "The Act" means the South Gujarat University Act, 1965;
- (ii) "Section" means a section of the Act;
- (iii) "Statute" means a Statute of the University;
- (iv) "Ordinance" means an Ordinance of the University;
- (v) "Regulation" means a Regulation of the University;
- (vi) "Rule" means a Rule of the University. 2. Officers of the University The following shall be the officers of the University, namely:
- (i) The Chancellor,
- (ii) The Vice-Chancellor,
- (iii) The Pro-Vice-Chancellor, if any,
- (iv) The Deans of Faculties,
- (v) The Registrar,
- (vi) The University Librarian,
- (vii) Such other officers in the service of the University as may be declared by the Statutes to be officers of the University. 3. Chancellor
- (i) The Governor of Gujarat for the time being shall be the Chancellor of the University.
- (ii) He shall by virtue of his office be the Head of the University and the President of the Court and shall, when present, preside at meetings of the Court and at any convocation of the University.
- (iii) He shall have such other powers as may be conferred on him by this Act or the Statutes. 4. Vice-Chancellor
- (i) The Vice-Chancellor shall be appointed by the Chancellor from amongst three persons recommended by a committee appointed for the purpose under sub-section (2).
- (ii) The committee shall consist of the following members, namely:
- (a) Two members appointed by the Executive Council, none of whom shall be a member of the Executive Council or an employee of the University or an affiliated college or a recognised institution,
- (b) One member appointed by the Chancellor,
- (c) The Chairman of the University Grants Commission or his nominee.
- (iii) The Chancellor shall appoint one of the members of the committee to be its chairman.
- (iv) The committee shall recommend a panel of three persons to the Chancellor.
- (v) The Vice-Chancellor shall hold office for a period of three years and shall be eligible for re-appointment for a further period of three years.
- (vi) The Vice-Chancellor shall be a whole-time officer and shall receive such salary and allowances as may be determined by the State Government.
- (vii) In the case of the office of the Vice-Chancellor becoming vacant, the Chancellor may appoint a person to act as the Vice-Chancellor for a period not exceeding six months. 5. Powers and duties of Vice-Chancellor
- (i) The Vice-Chancellor shall be the principal executive and academic officer of the University and shall exercise general control over the affairs of the University.
- (ii) He shall ensure that the provisions of the Act, Statutes, Ordinances and Regulations are duly observed and he shall have all powers necessary for that purpose.
- (iii) He shall preside at the meetings of the Executive Council, Academic Council and Finance Committee.
- (iv) He shall have the power to convene meetings of the Court, the Executive Council and the Academic Council.
- (v) He shall have the power to take disciplinary action against any officer, teacher or other employee of the University.
- (vi) He shall exercise such other powers and perform such other duties as may be conferred or imposed upon him by this Act, Statutes, Ordinances or Regulations. 6. Pro-Vice-Chancellor
- (i) The Pro-Vice-Chancellor shall be appointed by the Chancellor in consultation with the Vice-Chancellor.
- (ii) He shall hold office for a term of three years and shall be eligible for re-appointment.
- (iii) He shall exercise such powers and perform such duties as may be assigned to him by the Vice-Chancellor. 7. Deans of Faculties
- (i) There shall be a Dean for each Faculty.
- (ii) Each Dean shall be appointed by the Vice-Chancellor from amongst the heads of the University Departments or senior professors in the Faculty.
- (iii) The Dean shall hold office for a period of three years.
- (iv) The Dean shall be the Chairman of the Faculty and shall be responsible for the due observance of the Statutes, Ordinances and Regulations relating to the Faculty. 8. Registrar
- (i) The Registrar shall be a whole-time officer of the University and shall be appointed by the Executive Council.
- (ii) He shall act as the Secretary of the Court, the Syndicate, the Academic Council and the Finance Committee.
- (iii) He shall be responsible for the custody of the records and the common seal of the University.
- (iv) He shall perform such other duties as may be assigned to him by the Vice-Chancellor. 9. University Librarian
- (i) The University Librarian shall be appointed by the Executive Council.
- (ii) He shall be in charge of the University Library and shall perform such duties as may be assigned to him by the Vice-Chancellor. 10. Authorities of the University The following shall be the authorities of the University:
- (i) The Court,
- (ii) The Syndicate,
- (iii) The Academic Council,
- (iv) The Faculties,
- (v) The Board of University Teaching,
- (vi) The Board of Studies,
- (vii) The Finance Committee,
- (viii) Such other bodies as may be declared by the Statutes to be the authorities of the University. 11. The Court
- (i) The Court shall be the supreme authority of the University.
- (ii) The Court shall consist of the Chancellor, the Vice-Chancellor, the Pro-Vice-Chancellor, and such other members as may be prescribed by the Statutes.
- (iii) The Court shall have the power to review the acts of the Syndicate and the Academic Council.
- (iv) The Court shall meet once a year at an annual meeting to consider the annual report and the annual accounts of the University. 12. Syndicate
- (i) The Syndicate shall be the executive authority of the University.
- (ii) The Syndicate shall consist of the Vice-Chancellor, the Pro-Vice-Chancellor, the Deans of Faculties and such other members as may be prescribed by the Statutes.
- (iii) Subject to the provisions of this Act and the Statutes, the Syndicate shall have the power to manage the affairs of the University. 13. Academic Council
- (i) The Academic Council shall be the academic body of the University.
- (ii) The Academic Council shall consist of the Vice-Chancellor, the Pro-Vice-Chancellor, the Deans of Faculties and such other members as may be prescribed by the Statutes.
- (iii) The Academic Council shall have the control and general regulation of, and be responsible for the maintenance of the standards of teaching and examinations within the University. 14. Faculties
- (i) The University shall include such Faculties as may be prescribed by the Statutes.
- (ii) Each Faculty shall consist of such members as may be prescribed by the Statutes.
- (iii) Each Faculty shall have the power to consider and report to the Academic Council on any matter relating to any course of study, scheme of examinations or other academic matters. 15. Board of University Teaching
- (i) The Board of University Teaching shall consist of the Vice-Chancellor, the Deans of Faculties and such other members as may be prescribed by the Statutes.
- (ii) The Board shall advise the University on all matters relating to post-graduate teaching and research. 16. Board of Studies
- (i) There shall be a Board of Studies for each subject or group of subjects.
- (ii) The members of the Board of Studies shall be appointed by the Academic Council in such manner as may be prescribed by the Statutes.
- (iii) The Board of Studies shall recommend text-books and syllabi for various courses of study. 17. Finance Committee
- (i) The Finance Committee shall consist of the Vice-Chancellor, the Registrar and such other members as may be prescribed by the Statutes.
- (ii) The Finance Committee shall examine the annual accounts and financial estimates of the University and recommend them to the Syndicate. 18. Statutes, Ordinances and Regulations
- (i) The Statutes shall be made by the Syndicate and require the assent of the Chancellor.
- (ii) The Ordinances shall be made by the Syndicate.
- (iii) The Regulations shall be made by the Academic Council. 19. Miscellaneous
- (i) The University shall maintain a common pool of teachers.
- (ii) No person shall be appointed as a teacher in the University or any college affiliated to it unless he possesses such qualifications as may be prescribed by the Statutes.

- (1) Every salaried officer and teacher of an affiliated college shall be appointed in writing.
- (2) Any contract for service between an affiliated college and any of its salaried officers or teachers shall be lodged with the Registrar of the University.
- (3) The college shall maintain a record of the service of every such officer and teacher and such record shall be signed by the officer or teacher concerned.
- (4) Any dispute arising out of a contract between the college and any of its salaried officers or teachers shall, at the request of the officer or teacher concerned, be referred to a Tribunal of Arbitration consisting of one member nominated by the Governing Body of the college, one member nominated by the officer or teacher concerned and an umpire appointed by the Vice-Chancellor.
- (5) The decision of the Tribunal shall be final and shall not be questioned in any court.

- (1) Notwithstanding anything contained in this Act, the Vice-Chancellor may, with the previous approval of the State Government, discharge all or any of the functions of the University for the purpose of carrying out the provisions of this Act and for that purpose may exercise any powers or perform any duties which by this Act are to be exercised or performed by any officer or authority of the University which is not yet constituted.
- (2) The first Vice-Chancellor may, for a period of six months from the date of his appointment or such further period not exceeding one year as the State Government may specify, exercise all or any of the powers exercisable by the University under this Act.

- (1) Any student who immediately prior to the commencement of this Act was studying in a college affiliated to the Gujarat University and situated in the University Area shall be permitted to complete his course in preparation for such degree, diploma or other academic distinction of the Gujarat University and the University shall provide for the instruction, teaching, training and examination of such student in accordance with the courses of studies, schemes of examination and standards of the Gujarat University.
- (2) The University shall make such arrangements as it may deem fit for the conduct of the examinations for such students for such period as may be prescribed.
