3. Incorporation of the University

Incorporation of the University
- (1) The Chancellor, the Vice-Chancellor, the Director of Higher Education, the Deans of Faculties and the members of the Senate, the Syndicate and the Academic Council for the time being holding office as such in the University shall constitute a body corporate by the name of "The South Gujarat University".
- (2) The University shall have perpetual succession and a common seal and may sue and be sued by the said name.
- (3) The University shall be competent to acquire and hold property, both movable and immovable, to lease, sell or otherwise transfer any movable or immovable property which may have become vested in or may have been acquired by it for the purposes of the University and to contract and do all other things necessary for the purposes of this Act: Provided that the power to dispose of any immovable property shall be exercised with the prior sanction of the State Government.
- (4) The headquarters of the University shall be at Surat.

4. The University, its powers and duties

The University, its powers and duties The University shall have the following powers and duties, namely:—
- (1) to provide for instruction, teaching and training in such branches of learning and courses of study as it may think fit, and to make provision for research and for the advancement and dissemination of knowledge;
- (2) to make such provision as will enable affiliated colleges and recognised institutions to undertake specialisation in studies;
- (3) to organise and make provision for common laboratories, libraries, museums and other equipment for teaching and research;
- (4) to establish and maintain departments, colleges and institutions of research or specialised studies;
- (5) to institute degrees, diplomas and other academic titles and distinctions;
- (6) to confer honorary degrees and other academic distinctions in the manner laid down in the Statutes;
- (7) to hold examinations and to confer degrees, diplomas and other academic distinctions on persons—
- (a) who have pursued approved courses of study in the University or in an affiliated college and have passed the examinations prescribed by the University;
- (b) who have carried on research under conditions prescribed by the University;
- (8) to confer degrees, diplomas and other academic distinctions on persons who have pursued approved courses of study in an affiliated college;
- (9) to provide for such lectures and instructions for students of University colleges and affiliated colleges as the University may determine and also to provide for external candidates to appear at the examinations of the University;
- (10) to inspect colleges and recognised institutions and to take measures to ensure that proper standards of instruction, teaching and training are maintained in them and that adequate library, laboratory and other equipment are provided;
- (11) to control and co-ordinate the activities of, and to give financial aid to, affiliated colleges and recognised institutions;
- (12) to hold and manage trusts and endowments and to institute and award fellowships, travelling fellowships, scholarships, studentships, medals and prizes;
- (13) to establish, maintain and manage hostels;
- (14) to recognise hostels not maintained by the University, to inspect such hostels and to withdraw recognition therefrom;
- (15) to hold and conduct university extension programmes;
- (16) to co-operate with other universities and authorities in such manner and for such purposes as the University may determine;
- (17) to demand and receive such fees and other charges as may be prescribed by the Ordinances;
- (18) to receive grants, bequests, donations and gifts of movable and immovable property and to have the custody and management of any such property and to administer the same;
- (19) to make provision for the instruction and training of students in the National Cadet Corps;
- (20) to make provision for physical training, sports and athletic clubs;
- (21) to exercise control over the students of the University and to provide for their discipline and well-being;
- (22) to supervise and control the conduct and discipline of the teachers and other employees of the University;
- (23) to institute and appoint persons to professorships, readerships, lecturerships and any other posts of teachers required by the University;
- (24) to make provision for research and advisory services and for that purpose to enter into such arrangements with other institutions or bodies as the University may deem necessary;
- (25) to do all such other acts and things, whether incidental to the powers aforesaid or not, as may be requisite in order to further the objects of the University and to cultivate and promote arts, science and other branches of learning and culture.

5. Jurisdiction of the University

Jurisdiction of the University
- (1) No education institution situate within the University Area shall, save with the sanction of the State Government, be associated in any way with, or seek admission to any privileges of, any other University established by law.
- (2) Any such privilege of any other University enjoyed by any education institution situate within the University Area immediately before the appointed day shall be deemed to be withdrawn as from such day.
- (3) On and after the appointed day, no educational institution situate outside the University Area shall, save with the sanction of the State Government, be associated in any way with, or seek admission to any privileges of, the University.

6. Inspection and inquiry

Inspection and inquiry
- (1) The Chancellor shall have the right to cause an inspection to be made by such person or persons as he may direct, of the University, its buildings, laboratories, libraries, museums, workshops and equipment and of any institutions maintained by or affiliated to the University, and also of the examinations, teaching and other work conducted or done by the University, and to cause an inquiry to be made in like manner in respect of any matter connected with the University: Provided that the Chancellor shall in every case give notice to the University of his intention to cause such inspection or inquiry to be made and the University shall be entitled to be represented thereat.
- (2) The Chancellor shall communicate to the Syndicate his views with reference to the result of such inspection or inquiry and shall, after ascertaining the opinion of the Syndicate thereon, advise the University on the action to be taken and fix a time limit for taking such action.
- (3) The Syndicate shall report to the Chancellor the action, if any, which is proposed to be taken or has been taken upon the results of such inspection or inquiry.
- (4) Where the Syndicate does not, within a reasonable time, take action to the satisfaction of the Chancellor, the Chancellor may, after considering any explanation furnished or representation made by the Syndicate, issue such directions as he may think fit and the Syndicate shall comply with such directions.

7. Officers of the University

Officers of the University The following shall be the officers of the University, namely:—
- (i) The Chancellor,
- (ii) The Vice-Chancellor,
- (iii) The Pro-Vice-Chancellor,
- (iv) The Deans of Faculties,
- (v) The Registrar,
- (vi) The University Librarian, and
- (vii) Such other officers in the service of the University as may be declared by the Statutes to be the officers of the University.

8. The Chancellor

The Chancellor
- (1) The Governor of Gujarat shall be the Chancellor of the University.
- (2) The Chancellor shall, by virtue of his office, be the head of the University and shall, when present, preside at any convocation of the University.
- (3) The Chancellor shall have such other powers as may be conferred on him by this Act or the Statutes.

9. The Vice-Chancellor

The Vice-Chancellor
- (1) The Vice-Chancellor shall be appointed by the Chancellor in consultation with the State Government from amongst three persons recommended by a committee appointed for the purpose under sub-section (2).
- (2) The Chancellor shall appoint a committee which shall consist of three members, one of whom shall be appointed by the Chancellor, one shall be nominated by the Executive Council and one by the State Government. The Chancellor shall appoint one of the members of the committee to be its Chairman.
- (3) The Vice-Chancellor shall hold office for a term of three years and shall be eligible for re-appointment for a second term.
- (4) The Vice-Chancellor shall be a whole-time officer of the University and shall receive such salary and allowances as may be prescribed by the statutes.
- (5) In the event of the post of Vice-Chancellor falling vacant due to death, resignation or any other cause, the vacancy shall be filled in the manner provided in sub-section (1). Provided that until the appointment is so made, the Pro-Vice-Chancellor, if any, or if there is no Pro-Vice-Chancellor, the senior most Professor in the University shall carry on the current duties of the Vice-Chancellor.

10. Powers of the Vice-Chancellor

Powers of the Vice-Chancellor
- (1) The Vice-Chancellor shall be the principal executive and academic officer of the University and shall, in the absence of the Chancellor, preside at meetings of the University Authority and at any convocation of the University.
- (2) He shall exercise general control over the affairs of the University and shall be responsible for the due maintenance of discipline in the University.
- (3) He shall ensure that the provisions of this Act, the Statutes, the Ordinances and the Regulations are observed and shall have all powers necessary for this purpose.
- (4) He shall have the power to convene the meetings of the Court, the Executive Council and the Academic Council and shall perform all such acts as may be necessary to carry out the provisions of this Act. (5)
- (a) In case of emergency which in the opinion of the Vice-Chancellor requires immediate action, he shall have the power to take such action as he deems necessary and shall at the earliest opportunity thereafter report the action taken to such authority or body as would have in the ordinary course dealt with the matter.
- (b) Where any action taken by the Vice-Chancellor under clause
- (a) affects any person in the service of the University, such person shall be entitled to prefer an appeal to the Executive Council within thirty days from the date on which such action is communicated to him.
- (6) The Vice-Chancellor shall exercise such other powers as may be prescribed by the Statutes, Ordinances and Regulations.

11. The Pro-Vice-Chancellor

The Pro-Vice-Chancellor
- (1) The Pro-Vice-Chancellor shall be appointed by the Chancellor in consultation with the Vice-Chancellor from amongst persons recommended by the Vice-Chancellor.
- (2) The Pro-Vice-Chancellor shall hold office for a term of three years and shall be eligible for re-appointment for one further term of three years: Provided that the Pro-Vice-Chancellor shall notwithstanding the expiration of his term continue to hold office until his successor is appointed and enters upon his office.
- (3) The Pro-Vice-Chancellor shall be a whole-time salaried officer and his pay and allowances shall be determined by the State Government. (4)
- (a) The Pro-Vice-Chancellor shall assist the Vice-Chancellor in respect of such matters as may be specified by the Vice-Chancellor from time to time.
- (b) He shall exercise such powers and perform such duties of the Vice-Chancellor as the Vice-Chancellor may delegate to him.
- (c) He shall exercise such other powers and perform such other duties as may be prescribed by the Statutes, Ordinances and Regulations.

12. The Registrar

The Registrar
- (1) The Registrar shall be a whole-time salaried officer and shall be appointed by the Syndicate in accordance with the Statutes to be made in this behalf.
- (2) The Registrar shall possess such qualifications as may be prescribed by the Statutes.
- (3) The Registrar shall act as the Secretary of the Senate, the Syndicate and the Academic Council.
- (4) The Registrar shall exercise such powers and perform such duties as may be prescribed by the Statutes, Ordinances and Regulations.
