Chapter IV AUTHORITIES OF THE UNIVERSITY
20. Statutes
Statutes. Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:—
- (a) the conferment of honorary degrees;
- (b) the holding of convocations to confer degrees;
- (c) the powers and duties of the officers of the University;
- (d) the constitution, powers and duties of the authorities of the University;
- (e) the institution and maintenance of Departments, hostels, colleges and institutions of research;
- (f) the conditions of recognition of colleges and institutions of research;
- (g) the recognition of hostels;
- (h) the mode of appointment and the duties of professors, readers, lecturers and other teachers and the academic staff of the University;
- (i) the registration of graduates and the maintenance of a register of registered graduates;
- (j) the procedure at meetings of the authorities of the University and for the transaction of their business;
- (k) the award of fellowships, scholarships, exhibitions, medals and prizes;
- (l) any other matter which is to be, or may be, prescribed by Statutes.

21. Statutes, their making, amendment, repeal and operation
Statutes, their making, amendment, repeal and operation.
- (1) Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:—
- (a) the conferment of honorary degrees;
- (b) the holding of convocations to confer degrees;
- (c) the powers and duties of the officers of the University;
- (d) the constitution and powers of the authorities of the University;
- (e) the institution and maintenance of pension, provident fund and the system of insurance for the benefit of the officers, teachers and other servants of the University;
- (f) all matters which by this Act are to be or may be provided for by the Statutes.
- (2) The first Statutes shall be those made by the State Government.
- (3) The Senate may, from time to time, make new or additional Statutes and may amend or repeal the Statutes in the manner hereinafter in this section provided.
- (4) Every Statute made, amended or repealed shall require the assent of the Chancellor who may assent thereto or remit it to the Senate for further consideration.
- (5) No Statute passed by the Senate shall be valid or shall come into force until assented to by the Chancellor.
- (6) Notwithstanding anything contained in the foregoing sub-sections, the Chancellor, either suo motu or on the advice of the State Government, may, after consultation with the Vice-Chancellor, by notification in the Official Gazette, make, amend or repeal any Statute:

22. Provided that before any such Statute is made, amended or repealed, the Chancellor shall give to the Senate an opportunity of expressing its views on such Statute.
Ordinances Ordinances.
- (1) Subject to the provisions of this Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely:—
- (a) the admission of students to the University and their enrolment as such;
- (b) the courses of study to be laid down for all degrees and diplomas of the University;
- (c) the awards of degrees, diplomas, certificates and other academic distinctions, the qualifications for the same and the means to be taken relating to the granting and obtaining of the same;
- (d) the fees to be charged for courses of study in the University and for admission to the examinations, degrees and diplomas of the University;
- (e) the conditions of the award of fellowships, scholarships, studentships, exhibitions, medals and prizes;
- (f) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (g) the conditions of residence, health and discipline of the students of the University;
- (h) the maintenance of a register of registered graduates;
- (i) all other matters which by this Act or the Statutes are to be or may be provided for by the Ordinances.
- (2) The first Ordinances shall be made by the Vice-Chancellor with the previous approval of the State Government.
- (3) The Syndicate may, from time to time, make new or additional Ordinances and may amend or repeal the Ordinances in the manner hereinafter in this section provided.
- (4) The Syndicate shall not have power to amend any draft of any Ordinance proposing any changes in the arrangements for the admission of students or prescribing courses of study or the conditions of residence except after consultation with the Academic Council.
- (5) Every Ordinance made by the Syndicate shall be submitted to the Chancellor for his information.
- (6) The Chancellor may, within two months of the receipt of the Ordinance, direct that the operation of any Ordinance shall be suspended and he shall thereafter inform the Syndicate of his reasons for such direction.
- (7) No Ordinance shall be effective until it has been submitted to the Chancellor as aforesaid.

23. Ordinances, their making
Ordinances, their making
- (1) Subject to the provisions of this Act, the Ordinances may provide for all or any of the following matters, namely:—
- (a) the conditions under which students shall be admitted to the courses of study for degrees, diplomas, certificates and other academic distinctions;
- (b) the fees to be charged for enrolment of students for obtaining degrees, diplomas and certificates of the University and for other purposes;
- (c) the conditions of the award of fellowships, scholarships, studentships, medals and prizes and the like;
- (d) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (e) the maintenance of discipline among the students of the University;
- (f) the conditions of residence of students at the University;
- (g) the recognition and inspection of hostels;
- (h) the branches of study to be included in each faculty;
- (i) the special qualifications for the recognition of Principals and Professors or other teachers receiving emoluments;
- (j) the mode of appointment of examiners and their remuneration;
- (k) the fees to be charged for courses of study, research, experiment and practical training and for registration of graduates;
- (l) any other matter which is or may be prescribed under the provisions of this Act or which is not specifically provided for in this Act and is necessary to give effect to the provisions of this Act.
- (2) No Ordinance shall be made by the Syndicate unless a draft thereof has been proposed by the Vice-Chancellor.
- (3) The Syndicate shall not have power to amend any draft proposed by the Vice-Chancellor under sub-section
- (2) but may reject it or return it to the Vice-Chancellor for reconsideration, in which case the Vice-Chancellor may submit an amended draft and the Syndicate may approve such amended draft.
- (4) All Ordinances made by the Syndicate shall, except as provided by this Act, have effect from such date as it may direct, but every Ordinance so made shall be submitted as soon as may be to the Chancellor and the Senate.
- (5) The Chancellor may within six months of the receipt of an Ordinance, signify to the Syndicate his disallowance of such Ordinance and from the date of receipt of intimation of such disallowance, the Ordinance shall become void.
- (6) The Senate may, by a resolution passed by a majority of not less than two-thirds of the members present and voting, cancel any Ordinance made by the Syndicate and such Ordinance shall from the date of such resolution cease to have effect.

24. Regulations
Regulations
- (1) The Senate may make Regulations consistent with this Act and the Ordinances—
- (a) laying down the procedure to be observed at the meetings of the Senate, the Syndicate, the Academic Council and other authorities of the University and the committees thereof;
- (b) providing for all matters which by this Act or by the Ordinances are to be provided for by Regulations;
- (c) providing for any other matter solely concerning such authorities or committees and not provided for by this Act or the Ordinances.
- (2) The Regulations made by the Senate shall be submitted to the Chancellor who may approve them or refer them back to the Senate for further consideration.

25. Residence of students
Residence of students The University shall provide for the residence of students of the University; and every student of the University shall reside in a hostel or under such conditions as may be prescribed.

26. Admission to University courses
Admission to University courses
- (1) No student shall be admitted to the University as a candidate for any University examination—
- (a) unless he has passed such qualifying examination as may be prescribed; and
- (b) unless he has complied with such other conditions as may be prescribed.
- (2) Every student admitted to the University shall be enrolled as a student of the University in such manner as may be prescribed.

27. Examinations
Examinations.
- (1) Subject to the provisions of this Act and the Statutes, the University shall hold examinations in such courses of study as may be prescribed by Ordinances.
- (2) The time and manner of holding examinations shall be determined by the Ordinances.
- (3) The University shall appoint examiners and moderators for the examinations in consultation with the Boards of Studies.

28. Degrees, diplomas and other academic distinctions
Degrees, diplomas and other academic distinctions.
- (1) The University shall have power to confer such degrees, diplomas and other academic distinctions as may be prescribed by the Statutes.
- (2) The University may confer honorary degrees or other academic distinctions in the manner and under the conditions prescribed by the Statutes:

29. Provided that such degrees or distinctions shall not be conferred without the previous approval of the Chancellor.
The University Fund The University Fund
- (1) The University shall establish a fund to be called the University fund.
- (2) The following shall form part of, or be paid into, the University fund:
- (a) any contribution or grant by the State Government;
- (b) the income of the University from all sources including income from fees and charges;
- (c) any bequests, donations, endowments or other grants made to the University;
- (d) such other sums as may be received by the University.
- (3) The University fund shall be kept in the State Bank of India or in such other bank as may be approved by the State Government.

30. Annual accounts and financial estimates
Annual accounts and financial estimates
- (1) The annual accounts of the University shall be prepared under the direction of the Executive Council and shall be submitted to the State Government for such audit as the State Government may direct.
- (2) The accounts when audited shall be published by the Executive Council in the Official Gazette and copies thereof shall be submitted to the Senate and to the State Government.
- (3) The Executive Council shall also prepare, before such date as may be prescribed by the Statutes, the financial estimates for the ensuing year.
- (4) Every such estimate shall be considered by the Senate at its annual meeting and the Senate may approve the same with such modifications as it may think fit.

31. Annual report
Annual report.
- (1) The annual report of the University shall be prepared under the direction of the Syndicate and shall be submitted to the Senate on or before such date as may be prescribed by the Statutes and shall be considered by the Senate at its annual meeting.
- (2) The Senate may pass resolutions thereon and communicate the same to the Syndicate which may take action in accordance therewith and the Syndicate shall report the action taken or proposed to be taken by it to the Senate.
- (3) Copies of the annual report along with the resolutions of the Senate thereon shall be communicated to the State Government.

32. Pension or Provident Fund
Pension or Provident Fund.
- (1) The University shall constitute for the benefit of its officers, teachers and other servants such pension, insurance and provident fund as it may deem fit.
- (2) Where such provident fund has been so constituted, the State Government may declare that the provisions of the Provident Funds Act, 1925, shall apply to such fund as if it were a Government Provident Fund.

33. Officers and servants to be public servants
Officers and servants to be public servants. All salaried officers and the members of the teaching, administrative and other staff of the University shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code.
