Notification and Effect of Town Development Scheme

Statutory text
- (1) The Capital Region development authority shall declare its intention for preparation of a Town Development Scheme on an area as it deems to be fit, and notify its intention for the information to the general public.
- (2) Within one year of declaration of its intention, the Capital Area Development Authority shall publish the Draft Town Development Scheme in the notified area for inviting objections and suggestions. Within one year of publication of Draft Town Development Scheme, after considering the objections and suggestions received on the Draft Town Development Scheme the authority shall notify the Final Town Development Scheme.
- (3) Any such Town Development Scheme shall be notified for information to general public and others, by the Capital Region Development Authority or other body authorized to undertake the Town Development Scheme after the layout is approved by the Capital Region Chief Executive Officer giving details of the plots available for disposal, reconstituted plots and sites available for social infrastructure, and the cost of providing infrastructure facilities and the tentative final cost, period for completion of the developments, regulations, development charges, levy, etc.
- (4) After notification of the said approved Town Development Scheme, the same shall be incorporated in the Capital Region Development and Investment Plan or where there is no Statutory Plan, such a Scheme be integrated with the surrounding area. Such a Town Development Scheme shall be deemed to be an area development plan.
- (5) The notified Town Development Scheme shall be deemed to be a development permission by the Capital Region Development Authority and all building permissions shall be scrutinized by the Local authority based on the approved Town Development Scheme.
- (6) All plots for disposal, open spaces, roads and other land as required by the authority for development of the Town Development Scheme shall be deemed to be handed over to the Capital Region Development Authority free from all encumbrances upon the notification of the Final Town Development Scheme.
- (7) As soon as the Final Scheme is notified, the revenue records shall be updated by the concerned revenue officers as per the Final Town Development Scheme. The original land shall be reconstituted into Final Plots and all other land required by the authority for development of Town Development Scheme such as land under roads, open spaces, amenities, plots for disposal, etc. shall be transferred to the authority's ownership on freehold basis.
